1939-09-05 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, SEPTEMBER 5 , - - - - - - - 1939 The meeting convened at 8 o'clock P. M. with President Weichhart presiding. ROLL CALL: The roll was called and Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting held August 15, 1939, of the adjourned regular meeting held August 24, 1939, and of the adjourned regular meeting of August 29, 1939, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. From the Pacific Coast Building Officials Conference, giving notice of its 17th annual meeting, to be held in Oakland from October 3 to 6 inclusive, and requesting the City to authorize E. H. Rogers, Building Inspector of the City of Alameda, to attend the conference. There being no objection, this communication was referred to the City Manager for his recommendation. 3. From Bruce Sutherland, 1528 Adeline Street, Oakland, requesting the return of a portion of junk dealer's license fee paid to the License Collector of the City of Alameda. There being no objection, this request was referred to the City Attorney for his recommendation. ORAL COI+IICJIUNICATIONS: 4. The City Manager stated that he would here recommend that E. H. Rogers, Build- ing Inspector of the City of Alameda be authorized to attend the Pacific Coast Building Officials Conference to be held in Oakland, California, October 3 to 6 in- clusive. Councilman Maurer moved that the recommendation of the City Manager be approved and that Mr. Rogers, Building Inspector, be authorized to attend this con- ference. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. OPENING OF BIDS: ✓' 5. A bid to furnish the City of Alameda with seven Street Lighting Standards in accordance with specifications MS 8 -3913, was presented as follows: From the Taper Tube Pole Company Accompanied by certified check in amount of $602.32 100.00 There being no objection, this bid was referred to the City Manager for his considera- tion and recommendation. REPORTS OF COMMITTEES: 6. From the City Manager, recommending that contract be awarded to the Union Paving Company for the widening and construction of Lincoln Avenue between Park and Everett Streets for the sum of $5,289.00 and stating that the State Department of Public Works, Division of Highways, concurs in his recommendation. Councilman Morris moved that the City Manager's recommendation be adopted and that contract be awarded to the Union Paving Co. for this work, for the sum of $5,289.00 and that the checks be returned to the unsuccessful bidders, seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 7. From the City Manager, recommending that representatives of all departments of the City be authorized to attend the League of California Municipalities' Convention to be held in Oakland, September 18 to 21, inclusive. Councilman Carrington moved that the recommendation of the City Manager be adopted, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 8. From the City Planning Board, notifying the Council that it had approved the pro- posed paving at the east end of Central Avenue, approximately 100 feet east of Fernside Boulevard. This matter was presented to the Planning Board by Mr. E. H. Richardson, Realtor, with the thought in mind of deeding the street to the City after the paving is completed. Councilman Godfrey moved that the action of the City Planning Board in ap- proving the paving of the east end of Central Avenue approximately 100 feet east of Fernside Boulevard be also approved by the Council, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer and Morris and President Weichhart, (5). Noes: None. Absent: None. 9. From the City Planning Board, stating that a communication had been received from Angelo J. Rossi, Mayor of the City of San Francisco, requesting that effort be made to have San Francisco selected as its Convention City by the American Society of Planning Officials in 1940. The City Planning Board, at its meeting held August 30, 1939, had approved the desire of Mayor Rossi in this regard and unanimously requested the City Council to forward a communication urging that San Francisco be selected as the Con- vention City for the American Society of Planning Officials in 1940, the communication to be directed to Mr. Walter H. Blucher, Executive Director, American Society of Planning Officials, Chicago, Illinois. Councilman Morris moved that the recommendation of the City Planning Board be approved and that Mayor Weichhart be authorized to write the letter as suggested by the City Planning Board, seconded by Councilman Maurer and on roll carried by the following vote: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 10. From the City Planning Board, notifying the Council that it had, at its meeting of August 30, unanimously approved a plan submitted by the City Manager for the future de- velopment of the area bound by Mound and Market Streets, Washington Street and Otis Drive. The City Planning Board at this meeting also approved the tentative map of the proposed subdivision of Blocks 12, 13, 20 and 21, Map of the Town of Alameda, as sub- mitted by the Santa Cruz Oil Company. This area is bound by Fountain and Post Streets, Calhoun and Otis Drive and will be incorporated in the completed plan for future develop- ment of this section of the City as suggested by the City Manager. Councilman Maurer moved that the recommendation of the City Manager be adopted and the general plan for the improvement of the area bound by Mound and Market Streets, Washing- ton Street and Otis Drive be approved, seconded by Councilman Carrington and on roll call carried by the following vote: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Councilman Maurer then moved that the tentative map as submitted by the Santa Cruz Oil Company of the proposed subdivision bound by Fountain and Post Streets, Calhoun Street and Otis Drive be approved in conformity with action of the City Planning Board, seconded by Councilman Carrington and on roll call carried by the following vote: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. V 11. At this point, the City Manager stated it was his recommendation that contract be awarded to Taper Tube Pole Co. for the furnishing of Street Lighting Standards to the City of Alameda in accordance with Specifications MS 8-3913 for the sum of $602.32. On motion of Councilman Godfrey, seconded by Councilman Maurer, contract was awarded as recommended by the City Manager and on roll call, carried by the following vote: Coun- cilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. UNFINISHED BUSINESS: 14. Various communications and petitions were presented containing approximately 1,175 names commending the Dime Taxi Company and petitioning the Council to amend the ordinance which has been introduced regulating vehicles for hire to carry public liability and property damage insurance in the sum of $5,000.00 for injury to one person and $10,000.00 for injury to more than one person in any one accident. The present ordinance contained these amounts as $10,000.00 and $20,000.00 respectively. There being no objection, this matter was referred to "Ordinances for Passagefl. RESOLUTIONS: 13. Councilman Morris introduced and moved the adoption of "Resolution No. 2412 Approving and Adopting a Budget for the Fiscal Year 1939-1940; Appropriating Certain Moneys for the Expenditures Provided in Said Budget for Said Fiscal Year, and Ratifying certain Expenditures Heretofore made." Councilman Godfrey seconded the motion and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Councilman Maurer introduced and moved the adoption of 14. "Resolution No. 2413 Fixing the Rate and Levying a Tax on all Real and Personal Property in the City of Alameda for the Fiscal Year 1939-1940, and Apportioning the Same Among the Several Funds of the City." Councilman Carrington seconded the motion and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Councilman Carrington introduced and moved the adoption of 15. "Resolution No. 2414 Establishing Certain Positions of Employment in the City of Alameda and Fixing the Salaries and Rates of Compensation for such Positions and for all Charter Officers and Positions under the Jurisdiction of said City." Councilman Maurer seconded the motion and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 16. Councilman Godfrey introduced and moved the adoption of "Resolution No. 2415 Transferring $4,000.00 from the General Fund to the Library Fund." Councilman Morris seconded the motion and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). 17. Councilman Maurer introduced and moved the adoption of "Resolution No. 2416 Authorizing Certain Work and Improvements Without Contract on Chestnut Street Sewer." Councilman Godfrey seconded the motion and on roll call carried by the following vote: Ayes: Councilman Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 18. Councilman Carrington introduced and moved the adoption of "Resolution No. 2417 Authorizing the Expenditure of $250.00 for City Advertising." Councilman Maurer seconded the motion and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. ORDINANCES PASSED: 19. "Ordinance No. New Series An Ordinance Repealing Sections 7 -111 to 7 -118 Inclusive, and Amending the Alameda Municipal Code by Adding to Title ViI Thereof a New Chapter and Article to be Known as "Chapter 1, Article 1 ", Regulating Vehicles for Hire." Councilman Maurer stated he wished permission to withdraw this ordinance, which he had introduced at the regular meeting of the Council held July 18, 1939. Thereupon Council- man Morris moved that permission be granted to Councilman Maurer to withdraw the above titled ordinance, and that the ordinance be considered withdrawn, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Morris and President Weichhart, (4). Noes: None. Not Voting: Councilman Maurer, (1). Absent: None. 20. Councilman Morris moved that the order of business revert back to "Ordinances Introduced", seconded by Councilman Godfrey and on roll call carried by the following vote: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5) . Noes: None. Absent: None. ORDINANCES INTRODUCED: 21. Councilman Maurer introduced the following ordinance, after which it was laid over as provided by law and the Charter. "Ordinance No. New Series An Ordinance Repealing Sections 7 -111 to 7 -118 Inclusive, and Amending the Alameda Municipal Code by Adding to Title VII Thereof a New Chapter and Article to be Known as "Chapter 1, Article 1 ", Regulating Vehicles for Hire." Councilman Maurer explained that the above ordinance sets the amounts for public lia- bility and property damage insurance at $5,000.00 and $10,000.00, instead of $10,000.00 and $20,000.00 as contained in the same titled ordinance as introduced by him July 18, 1939, and withdrawn at this meeting. He stated $5,000.00 and $10,000.00 seems to be the accepted amounts for insurance of this type. 22. Councilman Godfrey then moved that the regular order of business be resumed, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. FILING: 23. Budget of the City of Alameda for the fiscal year 1939 -1940, as filed on September 5, 1939. 24. Financial Report of the Bureau of Electricity for the month of July, 1939. 25. Affidavit of Publication - Notice to Bidders - Street Lighting Standards to be erected on Lincoln Avenue between Versailles Avenue and Park Street. 26. Auditor's Balance Sheet as of August 31, 1939. BILLS: 27.
