1939-12-19 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, DECEMBER 19 , - - - - - - - 1939 The meeting convened at 8 :02 o'clock P. M. with President Weichhart presiding. ROLL CALL: The roll was called and Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting of the Council held December 5, 1939 were approved as transcribed. WRITTEN COMMUNICATIONS: An invitation was presented from Harry G. Williams, Auditor and Assessor of the City of Oakland, to attend an annual Christmas Party to be held in his office on December 21. There being no objections, the communication was ordered filed. 3. From C. A. Beck of Oakland, stating he wished to purchase for the sum of $5.00, a certain bench in the store room of the City Hall. There being no objections, this request was referred to the City Manager.. 4. A Resolution was presented from the Board of Supervisors of the County of Alameda declaring that all of High Street, from the northeasterly line of Fernside Boulevard, northeasterly to the southwesterly line of the property of the United States commonly known as the United States Tidal Canal between San Leandro Bay and the head of the San Antonio Estuary, is no longer a part of the county system of Highways. There being no objections, the Resolution was ordered filed. 1 5. From G. E. Wade, Clerk of the Board of Supervisors of the County of Alameda, dated December 19, 1939, enclosing copy of letter, dated September 28, 1939, addressed to the War department, United States Engineer's Office, San Francisco, referring to the opera- tion of the Fruitvale Avenue Bridge by the County of Alameda pursuant to the decision of the Supreme Court of the State of California - County of Alameda vs. Ross. The communication of the Board of Supervisors to the War Department states that the de- cision referred to - County of Alameda vs. Ross - holds that the license agreement under which the County operates the Fruitvale Avenue Bridge is void. The Board of Supervisors of Alameda County feels that the United States Government should be given a reasonable length of time within which to meet the situation created by this decision and the County, not being able to operate the Fruitvale Avenue Bridge indefinitely, gives notice that at midnight, December 31, 1939, the County will cease to operate said bridge. ORAL COMMUNICATIONS: -J 6. Mayor Weichhart addressed the assemblage regarding the threatened closing of the Fruitvale Avenue Bridge and read a telegram from the Honorable Albert E. Carter, member of Congress, addressed to the City Manager. The Mayor stated that the Council will de- mand as much time from the Board of Supervisors in which to give this matter full con- sideration, as the Board of Supervisors gave to the Southern Pacific Company and the War Department regarding its contemplated step to close the Fruitvale Avenue Bridge. Mayor Weichhart promised that everything humanly possible will be done to keep the Fruitvale Avenue Bridge open and requested the City Attorney to frame the necessary Resolution requesting additional time from the Board of Supervisors within which to examine the situation. Councilman Godfrey commended the plan of drawing a resolution to be sent to the County and also suggested that like communications be forwarded to the War Department and the Southern Pacific Company. Mr. Godfrey also suggested that when this Council meeting adjourn, it do so to meet prior to the next regular meeting of January 2, 1940 so that any resolutions may be formally adopted. Councilman Maurer suggested contact with the War Department be made by telegraph. The City Attorney then pointed out that any approach by the City of Alameda to the Board of Supervisors, Southern Pacific Company or War Department, need not necessarily be by resolution, but could as well be accomplished by motion. Councilman Morris then moved that any and all steps be taken which the City Attorney and the City Manager deem advisable in contacting all interested parties with regard to the matter in question; that the Mayor and the City Manager forward letters of protest re- garding the contemplated closing of the Fruitvale Avenue Bridge to the Board of Super- visors and the Southern Pacific Company. Also that protest by telegraph be made to the War Department. The motion was seconded by Councilman Carrington. Councilman Morris stated at this point he felt most decidedly that the Board of Super- visors should be given to understand the Council of the City of Alameda considers this a most amazing procedure, that it should take action on a matter which so drastically effects the City of Alameda without giving any intimation of such action, and felt the Board of Supervisors should be informed of the Council's reaction to this omission. Mayor Weichhart assured Councilman Morris that the Council's attitude would be definitely stated in its communication to the Board of Supervisors. Councilman Maurer also expressed himself regarding the Board of Supervisors withholding information from the Council in this matter. Councilman Morris, motion was then put and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Councilman Godfrey then moved that it be the solution of this problem until it is exclusion of all other business wherever man Morris and unanimously carried. 7. Frank Gottstein addressed the Council with regard to drainage on Webster Street and transportation in general. the sense of the Council to devote its time to brought to a successful conclusion, to the possible. From Clarence J. Nobmann, Member of the Alameda Board of Education, tendering his resignation as a member of the Board, effective as of January 1, 1940. Mr. Nobmann's business having been transferred to another city necessitated this action. Councilman Morris moved that Mr. Nobmann's resignation be accepted with regret, to take effect January 1, 1940 and for the reason as stated in his letter, seconded by Councilman Carrington and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Councilman Godfrey suggested Mayor Weichhart send a letter to Mr. Nobmann thanking him for his past services to the City of Alameda, and it was so ordered. 10. From the City Manager, recommending the acceptance of contract with the Gamewell Company for installing a complete Central Fire Alarm System at Minturn and Grand Streets, as this installation has met with the approval of the General Manager of the Department of Public Utilities and the City Engineer. Councilman Godfrey moved that the recommen- dation of the City Manager be adopted and the contract accepted, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 11. From the City Manager, recommending the acceptance of contract with the Taper Tube Pole Co. covering delivery of 134 street lighting installations on Santa Clara Avenue. This work having the approval of the City Engineer, Councilman Maurer moved that the recommendation of the City Manager be adopted and the contract be accepted, seconded by Councilman Carrington and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 12. From the City Planning Board, recommending that the City adopt a plan of major streets and through thoroughfares for the future development of that portion of the City lying south of the present shore line of Alameda between points approximately at the "southern end of Main Street to the southern extension of Park Street. There being no objections, this matter was referred to the Committee of the Whole. 1 :. From the City Planning Board, stating that it has approved the amended Tentative Map of proposed subdivision in Tract 565, Alameda which was filed by Messrs. David & Iccleston, San Francisco on December 13, 1939, with the express condition, however, that the street shown on the tentative map as "6th Street" be of uniform width of sixty feet for its entire length from the southern line of Central Avenue. Councilman Maurer moved that this amended tentative map be approved, also under the con- dition as set forth by the City Planning Board, that "6th Street" be of a sixty foot width along its entire length, seconded by Councilman Morris and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and Presi- dent Weichhart, (5). Noes: None. Absent: None. NEW BUSINESS: 14. Councilman Godfrey commended the installation of the new lighting standards on Santa Clara Avenue and offered the suggestion that it might be feasible to retain the existing lighting standards which carry the green globes for the purpose of designating intersections and asked that his suggestion be referred to the City Manager for inves- tigation and report. It was so ordered. Councilman Morris also discussed the possible advantage of retaining the old standards with the green globes at intersections. RESOLUTIONS: 15. Councilman Maurer introduced and moved the adoption of "Resolution No. 2433 Authorizing the Making of a Survey for Developing a Plan for Sewage Disposal: Approving the Form of Agreement for Conducting such Survey Jointly with Other Cities and Authorizing the Execution Thereof; And Appropriating Funds to Defray the Cost Thereof." Councilman Morris seconded the motion and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 16. Councilman Morris introduced and moved the adoption of -'Resolution No. 2434 Adopting Budget and Approving Second Supplemental Memorandum of Agreement for Expenditure of 1/4 Cent Gas Tax Allocated for Streets of Major Importance." Councilman Godfrey seconded the motion and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 17. Councilman Godfrey introduced and moved the adoption of "Resolution No. 2435 Adopting Specifications for Furnishing Loam to the City of Alameda, Calling for Bids and Directing the City Clerk to Advertise the Same." Councilman Maurer seconded the motion' and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 18. Councilman Godfrey introduced and moved the adoption of "Resolution No. 2436 Adopting Specifications for Furnishing Grass Seed to the City of Alameda, Calling for Bids and Direct - ing the City Clerk to Advertise the Same." Councilman Carrington seconded the motion and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 19. Councilman Maurer introduced and moved the adoption of "Resolution No. 2437 Resolution Authorizing and Directing the City Auditor to Make and File with the Commissioner of Internal Revenue all Reports of Salaries or Other Compensation Paid to Officers and Employees of the City of Alameda as may be Required under the Internal Revenue Laws of the United States." Councilman Godfrey seconded the motion and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. ORDINANCES PASSED: 20. "Ordinance No. 700 New Series An Ordinance Amending the Alameda Municipal Code by Adding to Title XI Thereof a New Chapter and Article to be Known as Chapter 3, Article 1, Prescribing Rules and Regulations Governing Platting and Subdividing of Land and the Filing and Approval of Subdivision Maps." Councilman Morris moved that the reading of this Ordinance be dispensed with as copies had previously been sent to all members of the Council for study, seconded by Councilman Carrington and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. Councilman Morris then moved that the ordinance as designated be adopted, seconded by Councilman Carrington and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. 21. "Ordinance No. 701 New Series RECLASSIFYING PROPERTY (Property known as 1226 Sherman Street)" Councilman Godfrey moved that the ordinance as read be adopted, seconded by Councilman Carrington and on roll call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent: None. FILING: 22. Affidavit of Publication - Notice to Bidders - Furnishing 1 steel cab, 1/2 Ton Pick Up Truck for Park Department. 23. Specifications - For furnishing Loam to City of Alameda. 24. Specifications - For furnishing Grass Seed to City of Alameda. 25. Notice of Hearing - Railroad Commission of State of California re change in operating schedules. BILLS 26. An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows, was resented to the City Council: General Departments; $5,815.91; Police Department, 318.58; Civil Service Department, $1.41; Pound Department, $24.89; Fire Department, $ 46.02; Street Department, $16,974.72• Health Department, $221.78; Recreation Department, 4`99.56; Park Department, 229.67; Golf Course Department, $916.14; Store Department, $405.10; Social Service Department 20.30; Initiative Relief Fund, $137.25; Street Improvement Fund, $365.96; A motion was made by Councilman Carrington, seconded by Councilman Maurer, that the claims and bills against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on December 19, 1939, and presented to the Council at this meeting,be allowed and paid. There being no further business to transact at this meeting, Councilman Godfrey moved that the Council adjourn to meet in adjourned regular session Friday afternoon, December 22, 1939 at 5 :00 o'clock P.
