1935-08-20 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF TIE CITY OF ALAMEDA HELD TUESDAY MORNING, AUGUST 20th . . . . . 1935 The meeting convened at 11 o'clock A.M. with President Roebke presiding. The roll was called and Councilmen Broyles, Munro and President Roebke, (3), .were noted present. Absent: Councilmen Eschen and Morris, (2). The minutes of the Regular Meeting of August' 6th, 1935, and of the Special Meet- ing of August 17th, 1935, were read and approved. COMMUNICATIONS:, /1. / A communication was presented from Edward J. Silver, Attorney at Law, regarding a fence which was erected by Worden & Forsythe for the tennis court at Franklin Park, and for which payment was never made on the ground that the contract therefor exceeded $1000.00, and demanding the return of said fence or payment by the City of Alameda of the sum of $992.00 to cover cost of said fence. Councilman Broyles moved that this matter be referred to the City Manager, seconded by Councilman Munro and on roll call carried by the following vote: Ayes: Councilmen Broyle Munro and President Roebke4(3). Noes: None. Absent: Councilmen Eschen and Morris, (2 /2. From the Mayor, City Manager and Auditor reporting to the Council on the Count of Money held August 15th, 1935; that there is under the control of the City Treasurer the amount of $391,290.76 which is the amount that should have at that time been in the City Treasury. The communication was ordered filed. V From the Auditor, Fred 3. Croll, submitted list of properties sold for taxes to the City of Alameda,on June 26, 1935. The communication was ordered filed. Y4./ From the City Attorney, Wm. J. Locke, submitting his opinion that the City of Alameda has the right to grant easements to the United States of America for the construction of a bulkhead, dock and retaining wall along the southern boundary of the fifteen acre tract of land granted to the United States Government in 1930 on Government Island. The matter was deferred until "Resolutions". From the City Attorney, W.M. 3. Locke, regarding rates charged by the Alameda Times-Star for legal advertising, and advising that an investigation be made to find out the Time-Starts charges for the publication of other legal notices. Councilman Broyles moved that the matter be referred to the City Manager for investigation, seconded by Councilman Munro and on roll call carried by the following vote: Ayes: Councilmen Broyles, Munro and President Roebke, (3). Noes: None. Absent: Council men Eschen and Morris, (2). (,'./From the City Attorney, WM.J.Locke, regarding balance of 289,34 left in fund under the name of "Water Commission of the Eastbay Cities", which fund was contri- buted to by the'cities of Oakland, Berkeley, Richmond and Alameda, and requesting the examination of City records for the total amount contributed by the City of Alameda, so that a distribution of the balance can be made. Without objection, the matter was referred to the City Manager for report. V( V From the Department of Public Utilities, attaching copy of their Resolution protesting appointment by City Council of engineer subject to Bureau of Transporta- tion. . There being no objection, the communication was ordered filed. , 145. v From the Department of Public Utilities, with attached copy of their Resolution concerning the proposed. Municipal Yacht Harbor and requesting the City 'Council to cooperate in preparing plan to finance this project. There being no objection, the communication was ordered filed. / From T.C.West, tendering his resignation as a member of the Board of Education of the Alameda School District, to take effect immediately. Councilman Broyles moved, seconded by Councilman Munro, that the resignation of Mr. VJbst be iaccepted with regrets. On roll call the motion carried by the following vote: Ayes: Council- man Broyles, Munro and President Roebke,(3). Noes: None. Absent: Councilmen Eschen and Morris, (2). 10. From Public Works & Unemployed Union, Local No. 5, calling the Council's atten- tion to conditions existing in the Alameda Employment Bureau with regard to S.E.R.A. and requesting the closing of the Alameda Employment Bureau. Councilman Munro moved, seconded by Councilman Broyles, that the matter be referred to the Committee of the Whole. The motion carried by the following vote: Ayes: Councilmen Broyles, Munro and President Roebke, (3). Noes: None. Absent: Councilmen Eschen and Morris, (2) RESOLUTIONS: 11 Councilman Munro introduced and moved the adoption of "Resolution No. 1979 Abolishing the Requirement for Aircraft Mechanics", Councilman Broyles seconded the motion and on roll call carried by the following vote: Ayes: Councilmen Broyles, Munro and President ,Roebke (3) Noes: None. Absent: Councilmen Eschen and Morris, (2) 12. Councilman Munro introduced and moved the adoption of "Resolution No. 1980 Granting Bulkhead Easements to the United States of America", Councilman Broyles seconded the motion and on roll call carried by the following vote: Ayes: Councilmen Broyles, Munro and President Roebke, (3). Noes: None. Absent: Councilmen Eschen and Morris, (2). 13. Councilman Munro introduced and moved the adoption of "Resolution No. 1981 Authorizing the Employment of T.C.West to Assist the City Attorney, Providing for a Retainer Fee, and Rescinding Resolution No. 1978 Relating to Said Appointments", Councilman. Broyles seconded the motion and on roll call carried by the following vote: Ayes: Councilmen Broyles, Munro and President Roebke, (3). Noes: None. Absent: Councilmen Eschen and Morris, (2). 14. - °Ordinance No. New Series Reclassifying Property (Property known as Nos. 1562 and 1566 Lincoln Avenue)" Councilman Broyles moved that the ordinance as read be adopted, seconded by Council- man Munro and on roll call carried by the following vote: Ayes: Councilmen Broyles, Munro and President Roebke, (3) Noes: None. Absent: Councilmen l'schen and Morris, (2) BILLS: 15. An itemized list of claims against the City of Alameda and the several depart ments thereof, in the total amounts as follows, was presented to the City Council: General Departments; $3217,29; Police Department, $19.89; Pound Department, $2.85; Fire Department, 0109.36; Street Department, $1559.89; Health Department, $207.12; Park Department, $1296.35; Golf Course Department, $830.98; Store Department, $1489.59; Social Service Department, $76.21; Initiative Relief Fund, j8.00; Street Improvement Fund, $158.51. Councilman Munro moved, seconded by Councilman Broyles, that the claims and bills against the City in the amounts -as listed and itemized in the List of Claims against the City of Alameda filed with the City Clerk on-August 2Oth,1935, and presented to the Council at this meeting, be allowed and paid. On roll call this motion carried by the following vote: Ayes: Councilmen Broyles, Munro and President Roebke,(3). Noes: None. Absent: Councilmen Eschen and Morris, (2). 16.
