1933-07-05 Regular CC Minutes117C-AJLAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD WEDNESDAY EVENING, JULY 5th,1933 The meeting convened at 8 o'clock with Vice-president Eschen presidia. The roll was called and Councilmen Leydecker, Morris, Shanly aid Vice-president Eschen, (4), were noted present. Absent:President Murray, (1). The minutes of the regular meeting of June 20th, 1933, were approved as read. ORAL COISIUNICATIONS: v/i. Mr. B. F. Lamborn addressed the Council in protest of the transfers from the Electric Light Fund to various other funds, and was informed by Vice-president Eschen that he might place his protest in writing;in accordance with which a com- munication was later presented to the Council by Mr. Lamborn and ordered read at the next regular meeting of the Council. WRITTEN COMMUNICATIONS: 1/2. From the North Side Protective Club protesting against the dismissal of mem- bers of the Fire Department. The communication was, without objection, ordered filed. From the North Side Protective Club in reference to tree pruning, tree plant- ing and tree up-rooting, and suggesting that Ordinance No. 162 N.S. be nended to provide that any tree planting Program be submitted to the City Planning Commission for action before being adopted. The communication was, without objection, ordered filed. i/4. / From the City Manager, recommending the acquisition of property at Central Av. and Fourth St. and also at the intersection of Buena Vista Avenue and Everett St., for the purpose of eliminating existing hazardous conditions at these points. On motion of Councilman Shanly, seconded by Councilman Leydecker and unanimously car- ried, the communication was referred to the City Attorney and the City Manager. 5./ From the City Manager, accompanied by communication from Marshall P. Craig, and recommended that the Gity participate to the extent of 37.00 in the expense of an East Bay Consolidated Band, in connection with the ground breaking ceremon- ies for the Transbay Bridge at Yerba Buena Island, Sunday, July 9,1933. On motion of Councilman Shanly, seconded by Councilman Leydecker and on roll call unanimous- ly carried, the matter was referred to the City Manager with power to act, and authorization was granted for the payment in the amount mentioned. v/.6„/ From the City Engineer, informing the Council that in accordance with Sec.274, Article 2, Chapter 5 of the Municipal Code, he is about to turn over to the Treas- urer of the City of Alameda two tons of miscellaneous metal scrap to be disposed of at public auction. On motion of Councilman Leydecker, seconded by Councilman Shanly, action of the City Engineer was approved. / From Jordan & Ticoulet, submitting monthly report of receipts and expenditures of the City of Alameda for the fiscal year 1932-33 as of May 31,1933. Ordered filed. v/8,,i From the City Planning Commission recommending to the Council the reclassifi- cation of the northeast corner of Park and Central Avenues from Business District, Class III, to Business District, Class V, for the purpose of erecting a gasoline service station. On motion of Councilman Shanly, seconded by Councilman Leydecker and unanimously carried, the recommendation was adopted. NEW BUSINESS: 9. // On motion of Councilman Leydekcer, seconded by Councilman Morris, the follow- ing application for license to sell alcoholic beverages was approved: Ben Carminati 1600 Webster Street The motion carried unanimously. Y l0.1 Councilman Leydecker informed the Council that it was his intention to intro- duce an ordinance affecting the personnel of the Fire Department, but would with- hold its introduction until the return of the Mayor. s , " 11.1 On motion of Councilman Leydecker, seconded by Councilman Shanly and unanimous- ly carried, authorization was granted for the refund of auctioneer's license fee of 015.00 to J. A. Lunroe which was paid under misapprehension. RESOLUTIONS: v 12. Councilman Shanly introduced and moved the adoption of "Resolution No. 1768 Creating and Establishing an Unemployment Fund". July, 5, 1933. The motion was seconded by Councilman Morris, and on roll call carried by the follow- ing vote: Ayes: Councilman Morris, Shanly and Vice-president Eschen,(3). Noes: Council- man Leydecker,(1). Absent: President Murray, (1). V/ 13. Councilman Morris introduced and moved the adoption of "Resolution No, 1769 Transferring $5000.00 from the Ebctric Light Fund to the General Fund for Use of Unemployment Bureau". The motion was seconded by Councilman Shanly, and on roll call carried by the follow- ing vote: Ayes: Councilmen Morrs, Shanly and. Vice-president Eschen, (3). Noes: Councilman Leydecker, (1). Absent: President Murray, (1). ve 14. Councilman Shanly introduced and moved the adoption of "Resolution No. 1770 Transfering $4000,00 from Electric Light Fund to the General Fund". The motion was seconded by Councilman Morris and on roll call carried unanimously. 15. Councilman Morris introdiced and moved the adoption of "Resolution No. 1771 Transferring $400.00 from the General Fund to the Unemployment Fund." The motion was seconded by Councilman Shanly and on roll call carried unanimously. 16. Councilman Morris introduced and moved the adoption of "Resolution No, 1772 Transferring p500.00 from the General. Fund to the Municipal Bus Fund." The motion was seconded by Councilman Shanly and on roll call carried unanimously. ORDINANCES PASSED: 6 k" 17. - "Ordinance No. New eries Amending Section 21 of Ordinance No. 500 New Series Regulating and Licensing the Sale of Beer, Ale, Porter, Wine, Similar Fermented Melt or Vinous Liquor and Fruit Juice Contain- ' ing One Half al of One (1) Per Centum or More of Alcohol By Volume and Not More than Three and Two-tenths (3.2) Per Centum of Alcohol by Wdght in the City of Alameda, County of Alameda, and Providing Penalties for Violations of Any of the Provisions Thereof." Councilman Shanly moved that the ordinance as read be adopted, seconded by Councilman Morris and on roll call carried unanimously. 18. "Ordinance No. , New Series, Amending Ordinance No. 378 Relating to Delinquent Taxes and the Penalties for Redemption, and Ordinance No. 463 N.S. Relating to Publication of Notice When Taxes Shall Become Delinquent". Councilman Norris moved that the ordinance as read be adopted, seconded by Councilman Shanly and on roll call carried unanimously. ORDINANCE INTRODUCED: 19. The following ordinance was introduced and laid over under provision of the Charter: "Ordinance No. , New Series Reclassifying Property (Northeast corner of Park and Central Avenues)" 20. Councilman Shanly infromed the Council that it had been his intention to intro- duce an ordinance regulating beaching of old vessels, but believed that this situation is already covered by statute and made ermoIion,which was seconded by Councilman Ley- decker, and unanimously carried, that the gity Eilanager and the City Attorney investi- gate and if necessary prepare an ordinance prevent such beaching of old vessels.'
