REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA
HELD TUESDAY EVENING, SEPTEMBER 5th,1933
The meeting convened at 8 o'clock with Council President Murray presiding.
The roll was called and Councilmen Eschen, Leydecker, Morris and President Murray,
(4), were noted present, Absent: Councilman Shanly, (1).
The minutes of the regular meeting of August 15th were read and approved.
The minutes of the special meeting of August 18th were read and approved.
V 1. The Mayor declared a Special Order of Business for the opening of bids for the
improvement of Park Street from Buena Vista Avenue to Santa Clara Avenue, as per Ad-
vertisement for Bids ordered by the Council at its regular meeting of August 15th11933.
The bids were received, as follows:
Heafev-Moore Co., Excavation $ 0.90 per cubic yard
Crusher Run Base 1.80 per ton.
Asphaltic Concrete Base 3.90 per ton
Asphaltic Concrete Surface4.40 per ton
Non-skid Surface 4.30 per ton. This bid
was accompanied by a certified check in the sum of $600.00

Eschen, seconded by Councilmen Morris and unanimously carried
to the City Engineer, to examine and report to the Council.

2.v Councilman Leydecker requested, and was granted, permission to read a communication
signed by him in reference to the report and audit by Messrs. Jordan and Ticoulet, Spec-
ial Accountants,of the City Manager's Revolving Fund, from May 1st, 1931, to July 30th,
1933. The Mayor ordered the communication referred to the Council as a Committee of the
Whole.
' 3,/ From Messrs. Jordan and. Ticoulet, submitting a report of examination of the books
and records of the City of Alameda for the fiscal year from July 1, 1932 to June 30,
1933. The report was ordered filed, after Councilmen Leydecker had requested that a
copy be furnished him.
4./ From the North Side Protective Club, in reference to disposition of the communica-
tions addressed to the Council which are sent in by that organization. The City Clerk
was instructed to communicate with the writer, informing it of the Council's practice
concerning such communications. The communication was ordered filed.
v/ 5. / From the Mayor, City Manager and Auditor, informing the Council that the money and
securities in the City Treasury on August 24th,1933, were counted on that date, and
there was chargeable to and under control of the Treasurer the sum of $542,346.86, which
sum was the amount which, according to the Auditor's books, should at that time have
been in the City Treasury. Jordan and. Ticoulet, Special Accountants and auditors for
the City of Alameda, were represented at this count of money. The communication was
ordered filed.
6./ From Mr. John Yoshino, in reference to traffic conditions on Pacific and Buena
Vista Avenues, in the vicinity of Oak and. Park Streets. The communication was, with-
out objection, referred to the City Manager.
V 7. From the Board of Supervisors, enclosing copy of resolution adopted on August
24th, 1933, declaring the number of miles of track, the assessed value per mile and
total assessed value of main track of various railways lying within the City of Alameda.
Ordered filed.
v 8.7 From Mr. F. J. Croll, Auditor and Assessor, in reference to the salary of Mr. B.
E. Jost, Deputy Assessor. Communication was ordered filed.
9.i From the City Manager, Ralph M. Bryant, in reference to the salary of Mr. B.
Jost, Deputy Assessor. Communication was ordered filed.
v 10./ From the Secretary of War, acknowledging receipt of copy of Resolution No. 1781,
in reference to construction work at Benton Field, Alameda, and requesting preference
in employment of labor to citizens of Alameda. The communication was ordered filed.
/ 11./ From the City Manager, submitting the budget for the fiscal year 1933-1934. The
communication was ordered filed.
12/ From the City Manager, recommending that Fire Chief Thomas M. Lane be authorized
to attend the 1933 Convention of the Pacific Coast Association of Fire Chiefs to be
held in Portland, September 26, 27 and 28,1935. Upon motion of Councilman Morris,
seconded by Councilman Eschen and unanimously carried, the recommendation was not
granted.

/13, From Mayor Murray, enclosing a communication from Councilman James M. Shanly, ten-
dering his resignation as a member of the Council. Councilman Leydecker moved that
the resignation be accepted; there being no second, the motion was lost and Councilman
Eschen moved, seconded by Councilman Morris, that the letter of resignation be tabled,
and that Councilman Shanly be anted an indefinite, revokable leave of absence, which
motion was carried by the following vote: Ayes: Councilmen Eschen, Morris and Presi
dent Murray, (3). Noes: Councilman Leydecker, (1). Absent; Councilman Shanly,(1).
v14.1 From the City Attorney, Edward J. Silver, informing the Council that the confi-
dential records of the Polibe Department are not open for investigation, unless per-
mission is given by the proper authorities, which would be the city Manager or the
Chief of Police. Communication ordered filed.
V15,%/From Messrs. Jordan and. Ticoulet, enclosing a report of an audit of the City
Manager's Revolving Fund from May 1st, 1931 to June 30th, 1933. The communication
was referred to the Council as a Committee of the Whole.
1/16./ From Trask & Squier Co., offering to purchase. from the City 70 single tier
lockers which are not in use, and are at present stored in the Municipal Electric Light
Plant,for a total of $119.00. The communication was referred to the City Manager.
f17../ From Mr. Edward J. Silver, City Attorney, tendering his resignation as City At-
torney, to became effective October 1st, 1933, Upon motion of Councilman Morris,
seconded by Councilman Eschen, the resignation was accepted with regret, by the follow-
ing vote: Ayes: Councilman Eschen, Morris, and. President Murray (3). Noes: Councilman
Leydecker, (1). Absent: Councilman Shanly (1).
NEW BUSINESS:
On motion of Councilman Eschen, seconded by Councilman Morris, and unanimously car-
ried, the following applications for On and. Off Licenses to sell alcoholic beverages
were granted:

RESOLUTIONS:,
19. Councilman Morris introduced and moved the adoption of
"Resolution No. 1788
Fixing Salary of Deputy Assessor".
Councilman Eschen seconded the motion.,and on roll call it carried unanimously.

Councilman Eschen seconded the motion and on roll call it carried by the following vote:

I, 21, Councilman Morris introduced and moved the adoption of
"Resolution No. 1790
Establishing the Policy of the Council of
the City of Alameda in Providing for the
Legal Defense of Officers and Employees
in Actions Arising Out of or in the Per-
formance of Duty."
Councilman Eschen secamded the motion and on roll call it carried by the following vote:
Ayes: Councilmen Eschen, Morris and President Murray, (3). Noes: Councilman Leydecker,
(1); Absent: Councilman Shanly, (1).

Councilman Eschen seconded the motion and on roll call it carried by the following vote:

23 Councilman Eschen introduced and moved the adoption of
"Resolution No. 1792
Providing for Compensation Insurance."
Councilmsr Morris seconded the motion and on roll call it carried by the following vote:
Ayes: Councilmen Eschen, Morris and President Murray, (3). Noes: Councilman Leydeeker,
(1). Absent: Councilman Shanly, (1).

V24. v The, City Engineer reported to the Council that he had investigated the bids for
the improvement of Park Street from Buena Vista' to Santa Clara Avenues, and that Heafey-
Moore Col, appeared to be the low bidder for the work., Councilman Eschen moved that the
contract be awarded to Heafey-Moore Co., at the price's quoted in their bid and that
the certified check be returned to the unsuccessful bidder. The motion was unanimously
carried.
