1936-09-15 Adjourned CC Minutes- a ADJOURNED REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, SEPTEMBER 15th 1936 The meeting convened at 8 o'clock P.M. with President Eschen presiding. The roll was called, and Councilman Godfrey, Morris, Weichhart and President Eschen, (4), were noted present. Absent: None. MINUTES: 1. The minutes of the Adjourned Regular meeting of September 1st, 1936 and the minutes of the Regular meeting of September 15th, 1936, were approved as read. 2. Councilman Morris moved that the regular order of business be suspended to proceed, under "New Business", seconded by Councilman Godfrey, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None. NEW BUSINESS: '3. A communication was presented from Mayor James N. Eschen, appointing Dr. Alice B. Burke as a member of the Board of Education for a term expiring in April 1940, and re- questing confirmation from the Council. On motion of Councilman Morris, seconded by Councilman Godfrey, the Council concurred in the recommendation, and carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None, Absent: None. /4. Councilman Morris moved, seconded by Councilman Godfrey that A. C. Carrington be appointed as a member of the Council of the City of Alameda, to succeed Hans W. Roebke, resigned. The motion carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart.and President Eschen, (4). Noes: None. Absent Nano. 5. On motion of Councilman Morris, seconded by Councilman Godfrey, the Council reverted back to the regular order of business, and the motion carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None. COMMUN CATIONS: A communication from the Board of Police and Fire Commissioners, requesting the Council to rescind Resolution No. 1983, fixing the salaries and establishing the number of members of the Police and Fire Departments. There being no objections, the communi- cation was ordered filed. 7. From the Board of Police and Yire Commissioners, requesting that a new resolution be passed of the same character as Resolution No. 2010, p:ssed on November 19th,1935. The communication was referred to "Resolutions. V 84, From the Alameda City Tennis Championships Committee, requesting an appropriation of 00.00 to help defray the expenses of Junior Championships Tennis tournament. On motion of Councilman Morris, seconded by Councilman Godfrey, the communication was referred to the City Attorney. The motion carried unanimously. /9. From Z. J. Silver, informing the Council that a deed to the property known as 1519 Broadway in the City of Alameda, had been placed in escrow with Alameda County Title Ins. Company. On motion of Councilman Weichhart, seconded by Councilman Morris, and unan- imously carried, the communication was referred to the City Attorney. V10. From the City Manager, in reference to application of P. Royal Haulman to move a house and garage from its present location at 706 Pacific Avenue to a new location and informing the Council that the owner had decided to wreck the buildings referred to, therefore a permit would not be necessary. There being no objections, the commu- nication was ordered filed. 411. From the Board of Police and Fire Commissioners, requesting an amendment to Title XXVII, Traffic Regulations of the Alameda Municipal Code, to provide for boulevard. STOP signs on Lincoln Avenue at easterly and westerly lines of Gibbons Drive. On motion of Councilman Morris, seconded by Councilman Godfrey, and unanimomsly aarried, the communication was referred to the City Manager and the Chief of Police. 12. From the City Treasurer, requesting the Council's consent to the depositing of $120,000.00 of public funds in the banks as inactive deposits and $126,000.00 as active deposits. Action was deferred, to come up under "Resolutions". 113. From the District Attorney, with reference to dismissal of grand jury accusations against . 3• Locke, former City Attorney, and Sherman G. Blood, former City Clerk. The communication was ordered filed. 14. From the City Planning Commission, with reference to transportation in the City of Alameda following the opening of the San Francisco-Oakland Bay Bridge. There being no objections, the communication was referred to the Committee of the Whole. v 15. From the City Planning Commission, recommending the reclassification of property known as 2024 San Antonio Avenue, from Residential District, Class 1, to Residence District, Glass li for the purpose of constructing a duplex bungalow. On motion of Councilman Godfrey, seconded by Councilman Morris and unanimously carried, the recommend- ation was adopted. 16. From the City Planning Commission, recommending the reclassification of property known as 911 Santa Clara Avenue, from Residential District, Class 1, to Residential District, Class for the purpose of constructing a bungalow court. On motion of Councilman Morris, seconded by Councilman Weiohhart and unanimously carried, the recommendation was concurred in. 17. From A. C. Keane, requesting the repeal of Ordinance No. 563, New Series, reclas- sifying real property at the northeast corner of Union Street and Central Avenuel'from Residential Distridt, Class II, to Business District, Class, V. On motion of Councilman Godfrey, seconded by Councilman Morris, and unanimously carried, the communication was referred to the City Attorney. 18. From Alameda Voters' League, Inc., submitting a resolution requesting that the Charter of the City of Alameda be amended to change ttetime for general municipal elections to the second Tuesday in March in each odd numbered year. After the Council had been addressed by former City Clerk R. E. Bosshard and 'Mr. John V. Ferretti on the subject of the resolution, the communication was referred to the Committee of the 'sole. 19. From the City Manager requesting the for bids for a new street sweeper for the Morris, seconded by Councilman Weichhart, adopted: Ayes: Councilmen Godfrey, Morri None. Absent: None, Council to instruct the City Clerk to advertise Street Department. On motion of Councilman the recommendation was,on the following vote, s, Weiohhart and President Eschen, (4). Burke as member of the Board of Education. t22, Notice of Claim of Jaok Seltenrich, in amount of 48100.00. RESOLUTIONS: and ORDINANCES INTRODUCED: 23. Councilman Morris introduced and moved the adoption of "Resolution No. 20 Authorizing and Directing the City Manager to Make Application to the Works Progress Administration of the State of California for Emergency Projects Under the Control of the City of Alameda", Councilman Godfrey seconded the motion, and on roll call oarried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None. 24. Councilman Weichhart introduced and moved the adoition of "Resolution No. 200 Transferring $3,000.00 to the Library Fund from the General Fund", Councilman Morris seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None. 25. Councilman Morris introduced and moved the adoption of "Resolution No. 2094 Authorizing Purchase of Real Property for Park and Playground Purposes, and Settlement and Compromise of Claim of Bianca Conti Royce," Councilman Weichhart seconded the motion, and on roll call carried by the following vote: Ayes.: Councilmen Godfrey, Morris, Weichhart and President Escheat (4). Noes: None. Absent: None. 26, Councilman Morris introduced and moved the adoption of "Resolution No. 2095 Resolution of,Acceptance and Consent to Recordation", Councilman Godfrey seconded the motion, and on roll call carried by the following voteayen Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None.. 27. Councilman Morris introduced and moved the adoption of "Resolution No. 209& Approving and Adopting a Budget for the Fiscal Year 1936-1937; appropriating Certain Moneys for the EXpenditures Provided in Said Budget for Said Fiscal Year, and Ratifying Certain Expenditures Heretofore Made", Councilman Weichhart seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, rris, Weichhart and President Eschen, (4). Noes: None. Absent: None. 28, Councilman Weichhart introduced and moved the adoption of "Resolution No. 2097 Fixing the Rate and Levying a Tax on all Real and Personal Property in the City of Alameda for the Fiscal Year 1936-1937, and Apportioning the Same Among the Several Funds of thA nitve_ Councilman Morris seconded the motion, and on roll call c arried by the following vote:. Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None. 29. Councilman Morris introduced and moved the adoption pf "Resolution No. 20; Authorizing and Providing for Extra Monthly Remuneration for Police Officers Attaining a Certain Proficiency in Marksmanship", Councilman Weichhart seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None. 30, President Eschen requested Vice-President Morris to assume the Chair, and after eulogizing former Councilman Alfred Latham, moved the adoption of "Resolution No. 2099 Expressing ,Sympathy for the Death of Alfred Latham., "WHEREAS, the Infinite Power which rules the universe has seen fit, in His great wisdom, to call our friend and esteemed citizen, Alfred Latham, from our midst, and "WHEREAS Alfred Latham served for many years as a member of the Council of the City of Alameda, and give freely and unstittihay of his time and ability for the tnproyement of our city, the betterment of our government and the promotion of welfare of our people, and "WHEREAS by his loyal and generous character, his public spirit and his faithful and upright conduct as a public servant and as a citizen, have en- deared him to his friends, and to the people of this community, "NOW THEREFORE, BE IT RESOLVED that we$ the members of the Council of the City of Alameda, in regular session assembled, express and here record, on behalf of ourselves and of the citizens of Alameda, sorrow and deep regret for the loss which the community has sustained by reason of the untimely death of Alfred Latham. !RESOLVED FURTHER that a copy of this resolution be spread on the minutes of this meeting, and that we here express to the members of his bereaved family our deepest and heartfelt sympathy for their loss, and that the recollection of his many virtues, and the record of his long and useful career, will be treasured in their hearts and memories, and will serve to soothe and strengthen them in this, their hour of bereavement. "RESOLVED FURTHER that when this council adjourns this meeting such adjournment shall be out of respect to the memory of our fellow citizen and friend, Alfred Latham", In seconding the motion, Councilman Weichhart also referred to the high appreciation in which the deceased was held, and it carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Councilman Godfrey introduced and moved the adoption of "Resolution No. 2200 Consenting to the Deposit of Public Money in Banks", Councilman Morris seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None. 32. The following ordinances were introduced and laid over, under provision of the Charter: "Ordinance No. New Series Reolassifying Property (Known as 911 Santa Clara Avenue "Ordinance No. New Series Reclassifying Property (Known as 2024 San Antonio Avenue)" "Ordinance No. New Series An Ordinance Amending Section 2-115 of the Alameda Municipal Code". W BUSINESS: 33. On motion of Councilman Morris, seconded by Councilman Godfrey, and unanimously carried, the Council approved bonds of Charles R. Schwanenberg as City Manager, H. Albert George as City Attorney, Loreme R. Beatie as Acting City Clerk and 3. P. Clark as Office Deputy of Auditor and Assessor's Department. ORDINAN FO P GE: 34. "Ordinance No. Ne Series, An Ordinance Amending Section 2-111 of the Alameda Municipal Code, so as to Provide that the Regular Meetings of the Council Shall be Held at Eight O'clock in the Evening on the First and Third Tuesday of Each Month", Councilman Morris moved that this ordinance as read be adopted, seconded by Councilman Godfrey and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None, Absent: None. 35. "Ordinance No. , New Series, An Ordinance Amending Sections g-115 and 2-116 of the Alameda Municipal Code", Councilman Morris moved that this ordinance as read be adopted, seconded by Councilman Weichhart and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None. 36. "Ordinance No. - New Series, Reclassifying Property (Property Known as 913 Central Avenue)" Councilman Morris moved that this ordinance as read be adopted, seconded by Councilman Godfrey and on roll call carried by the -following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent: None, BILLS: 37. An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presanted to the City Council: General Departments, $5009.34; Police Department, $114.49; Pound Department, $.97; Fire De- artment,$194.97; Street Department, $252,62; Health Department, $70.96; Park Department, $465.71; Golf Course Department, $601.14; Store Department, $306.50; Social Service Department, $22,13; Initiative Relief Fund, $4.00 and East Bay Municipal Utility District Payments Fund, $2493.85. Councilman Godfr:y moved, seconded by Councilman Weichhart, that the claims and bills against the City in the amounts as listed and itemized in the List of Calims filed with the City Clerk on September 15th, 1936, and presented to the Council at this meeting be allowed and paid. On roll call this motion carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4). Noes: None. Absent None. /38, A warrant in amount of $6000.00 was authorized allowed and paid in favor of Oakland Title Insurance & Guaranty Co, for the purchase of Bianca Conti Royce property at Franklin Park. The motion was made by Councilman Morris, seconded by Councilman Weichhart and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Morris, Weichhart and President Eschen, (4).Noes: None. Absent: None. 39. There being no further business to transact, the Council adjourned to meet in adjourned regular session on Tuesday evening, September 22nd, at 8 o'clock.
