1931-01-13 Regular CC Minutes4.‘f 8. 10/ ADJOURNED REGULAR MEETING OF TIE COUNCIL OF THE CITY OF- ALPMEDA, TUESDAY EVENING, JANUARY 13TH, 1931. . The meeting convened at 8 o'clock P. M. with Council-president Schaefer presiding. The roll was called and Councilmen Brodersen, Calcutt, Henning, Latham and President Schaefer, (5). Absent: None. The minutes of the regular meeting of December 16, 193o and of the scheduled meeting of January 6th, 1931 were approved as read. NEW BUSINESS: Mr, H. A. Weichart addressed the council relative to a temporary permit for the use of the old firehouse lot on Webster Street as an automobile sales lot. Mr. Latham moved that it be the sense of the Council that the permit be granted upon receipt of recommendation of the City Planning Commission. The motion was seconded by Mr. Brodersen and carried unanimously. Mr. Calcutt moved that the sum of $250.00 be appropriated out of the advertising fund covering expenses for the Annual May Day Festival to be held by the Recreation Department. The motion was seconded by Mr. Latham and on roll call carried unanimously. Mr. Henning moved that the City Manager and City Attorney be instructed to have gutters and curbing installed on the property at the northwest miner of Park and Encinal Avenues. The motion was seconded by Mr. Brodersen and carried unanimously. The Purchasing Agent reported to the council the results of bids received covering the painting in the various parks and recommended that on account of insufficiency of specifications, all bids be rejected. Mr. Henning moved that the bids be rejected and certified checks returned. The motion was seconded by Mr. Brodersen and carried unanimously. Mr. Harry Moore, representing Alameda Post No. 9, American Legion, speaking for the Civic Betterment Committee of that organization, addressed the council requesting its endorseMent in the making of San Leandro Bay a game reserve. Mr. Latham moved that the suggestion submitted by Mr. Moore be endorsed by the Council. The motion was seconded by Mr. Brodersen and same carried unanimously. Mr. Latham called attention of the Council to various complaints received, relative to gas fumes in the buses operated by the East Bay Motor Coach Lines, and moved that the City Manager and City Attorney confer with the Company and the Railroad Commission in an endeavor to have the odor eliminated. The motion was seconded by Mr. Brodersen and carried unanimously. Mr. Brodersen called attention of the council to the deposit of tree branches on the beaches and moved that the matter be referred to the City Manager. The motion was seconded by Mr. Henning and carried unanimously. A petition was received signed by 55 property owners requesting the instal- lation of lights on the east side of Third Street, from Pacific Avenue to Central Avenue. Mr. Henning moved that the matter be referred to the City Manager and Board of Public Utilities to report back and that plans and specifications be prepared covering this installation, and that the City Attorney and City Engineer prepare a Resolution of Intention covering the request. The motion was seconded by Mr. Brodersen and on roll call carried unanimously. Mr. Henning moved that an appronriation'in amount of $500.00 each be made to the owners of the Mazzini and Powell properties in consideration of the one- year option received from them for the purchase of their properties, this amount to be deducted from the purchase price. Duchesnay addressed the council relative to the matter of ous property and submitted a map showing the property referred to. n, Mr. Latham moved that the City of Alameda grant 827 plus-minus property belonging to said city to A. E. J. Duchesnay, who, in deed to the city all his right, title and interest in and to sq. ft. and 23e plus-minus sq. ft. of real property as shown on the in addition thereto said A. E. J. Duchesnay shall pay to the 85.00 and shall assume and pay all expenses in connection with of papers, documents, recording fees, etc. in said transaction. seconded by Mr. Calcutt and on roll call carried unanimously. In the matter of the further hearing of protests under Resolution of In- tention No. 96, New Series, relative to Third Street tmprovaments, Mr. Henning stated that the council as a Committee of the Whole had viewed the contemplated improvements on Sunday, January lith, and introduced and moved the adoption of "Resolution No. 1566. "Resolution Overruling Protest. (Resolution of Intention No. 96, New Series.)" Mr. Brodersen seconded the motion to adopt the Resolution. The Clerk then read a petition signed by 273 property onwers filed with the council under date of January 6th, 1931, and also a petition signed by 38 signers, filed on January 13th, 1931, in favor of the improvement. A communication was also/ad from Edward V. Orr, favoring the improvement. Mr. Sam C. Wright, representing the protestants addressed the council against the contemplated improvement. The motion to adopt the Reeolution was then sugmitted to the council and the resolut.on overruling protests was upon roll call adopted by the following vote:- Ayes: Councilmen Brodersen, Calcutt, Henning, Latham and President Schaefer, (5). Noes: None. Absent: None. Upon the adoption of the Resolu- tion Overruling Protest, Mr. Wright, representing the protestants, requested that the following exceptions be noted in the minutes of this meeting:- "The contestantsexcept to the ruling of the Council on the Third Street paving, curbing, etc., upon the ground that no Public necessity therefore has been shown; that the proposed improvement is a private improvement; that the assessment if carried out as proposed is in violation of the law of the State of California, and in violation of Sec. 1 of Article 14 of the Constitution of the United. States." RESOLUTIONS 12./ Mr. Latham introduced and moved the adoption of "Resolution No. 1567. Transferring $4,274.50 from the Electric Light Fund to the General Fund." Mr. Calcutt seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 13.V/ Mr. Calcutt introduced and moved the adoption of "Resolution No. 1568. Transferring $2500.00 from the Electric Light Fund to the Compensation Insurance Fund." Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. FILING: The Clerk stated that since the last ineeting the following papers had been filed:- Continuation Certificate on bond of Lloyd Battersby, M. E. L. P. Continuation Certificate on bond of Edith Anderson, M. E. L. P. Oath of office, Clifford G. Mehrtens as emember of City Planning Commission. Affidavit of Publication of Notice to Painting Contractors. Opinion and Order, Railroad Commission re San Jose Ave. Bus lines. City Manager's Report, 1929-30. COMMUNICATIONS: The following communications were received:- 20/ From H. M. Bradley, Captain, 159th Infantry, requesting the Council's permission to use and remove an obsolete steel tank in the City Jail to the Armory for use in storing guns, ammunition, etc.; they to assume all expense and labor necessary for the removal of the tank. Mr. Latham moved that the City Manager be instructed to sell the tank to Company d, 159th Infantry for $1.00 and the cost of necessary expenses and labor in connection with the removal thereof. The motion was seconded by Mr. Henning and on roll call carried unanimously. 21. From J. P. Holland, Inc., requesting an extension of time under their contract for the grading of the Industrial Highway west of Webster Street. Mr. Henning moved that the a)ntract be extended as per their request to May 1st, 1931 and that the contractors be paid an amount equal to 90% of their con- tract with the city and that the 75% bond contained in their contract be kept alive until final payment is made upon the a)ntract. The motion was seconded by Mr. Brodersen and on roll call carried unanimously. 22, From Hutchinson Company, requesting permission to grade between gutter lines and macadamize the roadway on Clay Street, between Versailles Avenue and Pearl Street, Mr. Latham moved that the request be granted, seconded hy Mr. Brodersen and on roll call carried unanimously. 23. From F. J. Malley, requesting information as to the dismantling of the Municipal Electric Light Plant. Mr. Calcutt moved that the communication be referred to the Board of Public Utilities, seconded by Mr. Latham and carried. 24.V From Mrs. Lindquist, relative to action of Social Service Board. Ordered filed. 25.1 From City Manager Hickok, relative to a resurvey of Oakland Harbor in the vicinity of Brooklyn Basin. The communication was ordered filed. Mr. Calcutt moved that Congressman Carter be asked to have a resurvey made in San Leandro Bay with its connection to San Francisco Bay. The motion was seconded by Mr. Latham and same carried unanimously. 26. From Mr. O. P. Wagner, requesting permission to continue the use of the southeast corner of Webb Avenue and Park Street, as an express wagon stand. Mr. Latham moved that the request be granted, seconded by Mr. Brodersen and carried unanimously. 27.1 From Mayor Victor L. Schaefer, advising the appointment of Clifford G. Mehrtens as a member of the City Planning Commission. Ordered filed. 28.1 From the Mayor, Auditor and. City Manager re count of money as of January 3rd, 1931. Ordered filed. A petition signed by various property owners on Marian Avenue requesting that the council change the name of Marian Avenue to Delmar Avenue, was read. Mr. Calcutt moved that the name be changed in accordance with the request. The motion was seconded by Mr. Brodersen and carried unanimously. From the United. States Engineer's office advising public hearing relative to Park Street Bridge. There being no objection the communication was referred to the City Manager and Councilman Calcutt. From Mayor Victor L. Schaefer, advising of the appointment of W. R. Calcutt to represent Alameda on the Advisory Committee for Oakland-San Francisco Bay Brtlge. Ordered filed. 32.V From Mr. and Mrs. Wm. H. Brommage containing holiday greetings and pre- senting to the City of Alameda en eighteen foot American Flag. Mr. Latham moved that the Council extend to Mr. and Mrs. Brommage a sincere vote of thanks. The motion was seconded by Nr. Brodersen and same carried unanimously. 33.1/ From E. J. Silver, City Attorney, advising that A. E. J. Duchesnay desires that proceedings to close a portion of Park Avenue,be dropped. Mr. Henning so moved and the motion was seconded by Mr. Latham and carried unaniMously. From City Attorney E. J. Silver, relative to suit of George F. and Elizabeth Kincaid. From Alden Stanton, Business Manager "The Acorn", requesting the council to appropriate 00.00 for a page advertisement in the next issue. Mr. Brodersen moved that $50.00 be appropriated out of the advertising fund to cover this request. The motion was seconded by Mr. Latham and on roll call carried unanimously. From City Attorney, E. J. Silver, relative to confining prisoners in the City Jail. The communication was ordered filed and the Clerk requested to mail a copy to Mrs. Alice Caton. From the City Manager, relative to the proposed removal of the building known as the Borax Works. Mr. J. N. Solon addressed the council in the 'utter. After discussion, Mr. Henning moved that the City Attorney be instructed to start proceedings under the dilapidated building ordinance and that expert advice be obtained if necessary. The motion was seconded by Mr. Brodersen and on roll call carried unanimously. From members of the Alameda Police and Fire Departments re amending Section 4 of the Police and Fire Pension Ordinance. There being no objection this was re- ferred to a meeting of the Committee of the Whole for consideration. From City Attorney E. J. Silver, advising that the charter amendments had passed the Assembly. Ordered filed. From the City Manager showing result of traffic count made for sixty days of automobiles and passengers carried during off-peak hours by Southern Pacific ferries operating between Alameda and. San Francisco. There being no objection the communication was filed, with the request that the City Clerk furnish each council- man with a copy of the traffic count. From the City Manager, relative to installation of fire mains on Versailles Avenue, Mound and. Clay Streets. Mr. Latham moved, that the matter be referred to the City Manager to report back as to the actual detail covering this instalhation. The motion was seconded by MT. Henning and carried unanimously. From the City Manager, relative to building a private office in the Police Court for the Police Judge. Mr. Calcutt moved that the bid of Vernor E. Thorp be accepted. The motion was seconded by Mr. Brodersen and on roll call carried unanimously. INGS: An application for a permit to sell soft drinks was received from Laura E. Albert. Mr. Latham introduced and moved the adoption of Granting a Mr. Henning seconded the motion adopted and passed unanimously. ORDINANCE FOR PASSAGE: "Resolution No. 1569. Permit for a License to Sell Soft Drinks." to adopt the Resolution and on roll call it Was The following Ordinancescame up for passage and vier read by the Clerk:- "Ordinance No. New Series. Making Gibbons Drive, from Central Avenue to High Street, a Boulevard, and Prohibiting Heavy Vehicles Thereon." Mr. Latham moved that the Ordinance as read be adopted, seconded by Mr. Henning and on roll call it was adopted and passed unanimously. 45. flOreinance No. New Series. RECLASSIFYING PROPERTY. (N. E. Corner Santa Clara Ave. & Everott St.)" Mr. Latham moved that further consideration of the passage of the Ordinance be postponed until the next regular meeting of the Council. The motion was seconded by Mr. Henning and carried unanimously. 46.1 Mr. Latham moved that the City Clerk be granted permission to leave the state for twelve days, commencing February llth, 1931.The. motion was seconded by Mr. Brodersen and carried unanimously.
