1931-04-24 Regular CC MinutesADJOURNED REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, FRIDAY EVENING, - - - APRIL 24th, 1931 The meeting convened at 8 o'clock with Council President Henning presiding. The roll was called and Councilman Brodersen, Leydecker, Murray, Schaefer and President Henning, (5) were noted present. Absent: None. The minutes of the regular meeting of April 21st, 1931, were approved as read. NE'q BUSINESS: 1./ - Various applications for City Manager were presented and filed. 24/' Mr. Leydecker moved that Mr. Niel B. Pierson be appointed as City Manager, seconded by Mr. Brodersen. A statement was made by Mayor Henning as to the qualifi- cations of Mr. Pierson for the position of City Manager, and that the Council had considered other applications on file. The roll then being called, Mr. Pierson was appointed City Manager by the following vote: Ayes: Councilmen Brodersen, Leydecker, Murray and President Henning, (4). Noes: None. Not Voting: Councilman Schaefer, (1). Absent: None. Mr. Murray moved that the compensation of the City Manager be fixed at 05,000.00 per annum for the first three months and at the -end of this period may be increased to $6,000.00 per year, said appointment to take effect May lst,1931, seconded by Mr. Brodersen and on roll call carried by the following vote : - Ayes: Councilmen Brodersen, Leydecker, Murray and President Henning, (4). Noes: None. Not Voting: Councilman Schaefer, (13. Absent: None. Mr. Brodersen moved that the Mayor appoint a member of the Council to look into the matter of general insurance for the city, seconded by Mr. Leydecker and carried unanimously. Thereupon the Mayor appointed Wm. F. Murray, with the request that he report as soon as possible and not later than the second meeting in May. .y Mr. Brodersen nominated W. B. O'Brien as one of the members of the Police and Fire Board of Appeals, seconded by Mr. Leydecker. Mr. Murray nominated Mr. Elwin P. Haglund as the other member of said Board, seconded by Mr. Brodersen. Mr. Brodersen moved that the nomination be closed and the council appoint Messrs. O'Brien and Hag- lund as the citizen members of the Police and Fire Board of Appeals, in complience with the newly adopted charter provision. Seconded by Mr. Leydecker and on roll call carried by the following vote:- Ayes: Councilmen Brodersen, Leydecker, Murray and President Henning, (4). Noes: Councilman Schaefer, (1). Absent: None 5, The matter of the resurfacing of the south tennis courts in Lincoln Park was discussed. After discussion, Mr. Murray moved that the City Engineer be requested to prepare plans and specifications for the resurfacing of the courts mentioned in two ways; one of the plans to cover drainage as recommended by the City Engineer and the • other to cover drainage as suggested by Mr. Collier of the Alameda Tennis Club. Sec- onded by Mr. Brodersen and carried unanimously. A recess of ten minutes was declared. Upon reconvening all members of the Council were noted present. Mr. Leydecker moved that the employment of Walter H. Cramer as Accountant for the Oity of Alameda be terminated as of April 30th, 1931. Seconded by Mr. Brodersen and on roll call carried by the following vote : = Ayes: Councilmen Brodersen, Ley- decker, Murray and President Henning, (4). Noes: Councilman Schaefer, (1). Absent: None. RESOLUTIONS: 8. Resolution No. Resolution Adopting Resolution of Intention Providing for Closing Park Avenue, South of Otis Drive. Mr. Schaefer moved that the Resolution as read be adopted, seconded by Mr. Leydecker. After discussion, Mr. Schaefer, with the consent of his second, withdrew his motion and the matter laid on the table. The Clerk was instructed to notify Mr. Duchesnay, the owner of the property in question, that the Resolution would be be passed until such time as a definite statement in writing was filed with the council that he would be responsible for all costs connected with the closing of Park Avenue. Resolution No. esolution Adopting Resolution of Intention re Sidewalks in Portion of West End (Vowinokel Property). Mr. Brodersen moved that the matter lay over to the next meeting, seconded by Zeydecicer and carried. Mr. Henning requested that the Oity Clerk communicate with the owner of the property and ask him to submit to the Council a deed or any other record that he had previously deeded to the city any portion of this particular piece of property to the City for sidewalk purposes. Street. COMMUNICATIONS:, he following communications were received: 16.V 20.V From AlaMeda County Mosquito Abatement District, re resignation of 0. E. Hickok as member of Board of Trustees. Ordered flied. Mr. Broderden moved that the new City Manager, Mr. Pierson, be appointed to succeed Mr., C. E. Hickok, seconded by Mr. Murray and carried unanimously. From the North Side Protective Club, re dumping garbage on Eagle Avenue between Mulberry and Park Streets. Mr. Brodersen moved that the matter be referred to the City Manager for report back to the Council, seconded by Mr. Murray and carried unanimously. From the North Side Improvement Club, re operating municipal busses. Mr. Brodersen moved that the communication be referred to the City Manager for investi- gation and report back to the council, seconded by Mr. Schaefer and carried unan- imously. From the North Side Protective Club, re opposing taxation of municipally owned industries. Mr. Leydecker reported that the propoeed bill had failed to receive the required majority in the lower house and would not, therefore, be passed. The Clerk was instructed to so notify the North Side Protective Club aocordingly. From the California Real Estate Magazige, re advertising. There being no objection this was referred to the Publicity 'Convention Committee. 21.1 From U. S. Engineer's Office re public hearing Hunter Boat Co., to construct marine ways. Ordered filed. 22 From J. Y. Lambert, re development of south shore tidelands. Mr. Murray moved that the communication be filed, seconded by Mr. Brodersen and carried unanimously. 23./ From O. E. Hickok, re rental and tax dispute, Alameda Airport, Inc.. Mr. Brod- ersen moved that this matter be referred to the City Attorney.for investigation and report his recommendations to the council at its next meeting, seconded by Mr. Murray and carried unanimously. 24.1 From Building Inspector Rogers, re building.at the southeastdorner of High and Adams Streets. The communication was filed and the Clerk instructed to advise the East Alameda Improvement Club of the report of the Building Inspector. 25.4 From City Attorney Silver, re deed from E. K. Taylor Estate for property at south end of Fernaide Boulevard. Mr. Brodersen moved that the communication be filed, seconded by Mr. Murray and carried unanimously. The matter of constructing a fence to prevent automobiles from using the Southern Pacific Right of Way was discussed, and the matter referred to the City Manager for report back to the Council. 26. - From Building Inspector and Fire Chief Steinmetz, relative to the building at 1556 Pacific Avenue. The communication was ordered filed and the Clerk instructed to send a copy of the report to the Alameda Improvement Club, the complainant, in the matter. 27./ From Grayson4twen Company with petition relative to parking on Santa Clara Avenue,' between Oak and Park Streets. Mr. Brodersen moved that the matter be referred to the City Manager and the request complied . with, seconded by Mr. Leydecker and carried unanimously. 28. From Superintendent of Parks, E. J. Probst, relative to additional fence at Lincoln Park. Ordered filed. 29. From City Attorney E. J. Silver, re judgment suit of Alameda vs. Benjamin Walters. Filed. Mr. Brodersen moved that the Board of Public Utilities be requested to submit information to the Council relative to the nonpayment of a claim for electrical energy furnished Benj. Walters at the Alameda Airport, in accordance with the motion passed by the council at its meeting of April 7th, 1931, said information to be presented to the council at its regular meeting of May 5th, 1931, seconded by Mr. Leydecker and carried unanimously. 30. 31 32.x" From East Oakland Auto Sales re City automobiles. Ordered filed. From C.-E. Hickok, former City Manager, re financial condition of city as of April 1st, 1931. Ordered filed. From Fred B. Gee, re fire protection for City Hall. Referred to the Committee of the Whole. From Fire Chief Steinmetz re installation of fire alarm boxes in City Hall. Referred to the Committee of the Whole. 34.E From League of California Municipalities, relative to Assembly Bill #1188 and Senate Bill #283, re taxation of motor vehicles, asking the Council to re- quest Alameda County representatives in the State Legislature to oppose the passage of Assembly Bill #1188 and to urge passage of Senate Bill #283. Mr. Schaefer moved that the Mayor be requested to notify our representatives in the legislature, seconded by Mr. Murray and carried unanimously. 35, From officials of Sacramento re Clerks, Auditors and Assessors meeting at Sao- ramento on Saturday, April 25, 1931. The city Clerk was granted permission to attend this meeting. Ordered filed. 36.V From L. L. Page, requesting permission to improve Mound Street, from Bay Island Avenue to Clay Street, under private contract. Mr. Brodersen moved that the request be granted, seconded by Mr. Schaefer and carried unanimously. From Alameda Improvement Club re Government Island, submitting a resolution relative thereto and requesting the Council to adopt the same. After disoussion, Mr. Murray introduced and moved the adoption of "Resolution No. Re Development of GovernmeIsland ", and further moved that the City Clerk be instructed to send a copy of same to the proper Government officials, Capt. Asserson, Area Coordinator, Congressman Albert E. Carter, City Council of Oakland, George Hatfield, U. S. District Attorney, Oakland Port Commission and Mr. Walter G. Tibbitts, seconded by Mr. Schaefer and carried unanimously. 38.1 From Alameda Improvement Club, re opposing taxation of municipally -owned utilities. It was reported that this bill failed to receive the required majority and therefore would not be passed. The communication was ordered filed. 39,v/ From City Engineer Hamilton re roadway surrounding Alameda Portal of Posey Tube, Mr. Murray moved that the City Clerk be instructed to communicate with the County Board of Supervisors of Alameda County relative to this matter, agreeing to the suggestions contained in the communication. 40." From the Alameda Housewives League extending congratulations to the new council. Mr. Brodersen moved that the Clerk thank the Club for their expression of interest, seconded by Mr. Murray and carried unanimously. ORDINANCES FOR INTRODUCTION: The following ordinances were introduced which were laid over under a provision of the charter:— 41. 42/ "Ordinance No. New Series Regulating the Use or Occupancy of Any Room, House or Other Building to or from Which the Public has or may have Ingress or Egress" "Ordinance No. New Series Regulating the Periods of Absence from Duty in Case of Sickness -of Injury, and Repealing Ordinances Nos. 256, N.
