1931-07-07 Regular CC MinutesREGULAR MEETING OF TEE COUNCIL OF THE CITY OF ALAI A, TUESDAY EVENING, JULY 7th, 1931 The meeting convened at 8 o'olook with Council-president Henning presiding. The roil was called and Counoilmen Brodersen, Leydecker'and President Henning (3) were noted present. Absent: Councilmen Murray and Schaefer, (2) The minutes of the regular meeting of June 16th, 1931 were approved as read. The minutes of the special meeting of June 29th, 1931 were approved as read. WRITTMCOMMUNICATIONS, 'The following communications were received: 1 From Mayor's and Councilmen's Association of Northern California, relative to the formation of a local body. Mr. Brodersen moved that the communication be refer- red to the Committee of the Whole, seconded by Mr. Leydecker,and carried unanimously - From Alameda Airport, Inc., requesting an appropriation of $200.00 to assist in defraying expenses of motor boat races around Alameda. Mt. ,Leydecker moved that this matter be referred to the Publicity and Convention Committee, seconded by Mr. Brod- ersen and carried unanimously. From Retail Meat Dealers Association of Alameda County, relative to the adoption of uniform ordinances regulating retail meat markets. Mr. Brodersen moved that this matter be referred to the City Manager to report back at the next meeting of the Council, seconded by Mr. Leydecker and carried unanimously. 4,%i Froathe League of California Municipalities concerning specimen ordinances on file in the League headquarters for use of cities in preparing new ordinances. Ordered filed. 5.1/ From City unager Pierson relative to the claim of 0. R. Smith, city Historian, for $69.00, recommending that Mr. Smith be allowed the sum of $69.00 for services rendered the City of Alameda as City Historian for the period ending April'30th, 1931. Mt, Brodersen moved that the recommendation of the City nager be adopted, seconded by Mr. Leydecker and on roll call carried unanimously. 6.N7 From Barrett Camp No. 29„ ,United Spanish War Veterans relative to office of City Historian in the City Hall. There being no objection this communication was referred to the Committee of the Whole to be considered with other communications regarding this matter. From the Pension Board, requesting the Pension Fund be reimbursed in the amount of $505.97 for moneys'paid to Officers Thrane and Johnson of the Police Department, injured while on duty, oontending that the moneys had been improperly drawn from the Pension Fund. Mr. Leydecker moved that the request be granted and such transfer be - made, seconded by Mr. Brodersen and carried unanimously. 8 From the San Francisco Bay Airfrome, Ltd., thanking the Council for the removal of the pole lines along Webster Street, between the Posey Tube and the Segregation Line. Ordered filed. From the East Alameda Improvement Club, endorsing the communication of the North Side Protective Club, relative to the establishment of an entire city service of municipal busses. There being no objection this communication was referred to the Transportation Committee and the Clerk requested to notify the Club of the action taken. 10(o/ From the Bast Alameda Improvement Club, endorsing purchase of property for extension of Fernside Boulevard, south of Encinal Avenue. Mr. Brodersen moved that the communication be referred to the Committee of the Whole, seconded by Mr. Leydecker and,carried unanimously. From Alameda Veterans Council inviting the City council to participate in their Fourth of July celebration. Ordered filed. 12.1 From State of Californialreterans'Welfate Board petitioning,the,,COUncil to �an- oel TeartaintaXes:on property owned by the Board. Mr. Leydecker moved that this petition be referred to the City Manager for investigation and report,and to be , taken up with the City Assessor; also, that the Clerk notify the Veterans' Welfare Board of the action taken, seconded by Mr. Brodersen and carried unanimously. 13.V( From Citizens Voluntary Committee on Social Service, addressed to Mayor Henning, oontaining copy of Resolutions adopted commending work of Social Service Board and staff. Ordered filed. 14,v From the City Council of San Leandro containing resolution opposing employment of aliens by the East Bay Municipal Utility District. Mr. Leydecker moved that it - be the sense of the Council of the City of Alameda that they go on record as opposed to the employment of aliens by the Utility District and the Clerk notify the East Bay Municipal Utility District and the San Leandro City Council of the action taken, seconded by Mr. Brodersen and carried. 15.7 From the City Planning Commission, recommending reclassification on the Council's own initiative of 3245 Encinal Avenue, permitting the use of said property for makingiand selling doughnuts. Mr. Brodersen moved that the reo- ommendation of the,City Planning Commission be adopted,' seconded by Mr. Leydeck er and carried unanimously. 16.V From the City Planning Commission, recommending the reclassification of the property situated on the southeast corner of San Jose Avenue and Chestnut Street, from a Residence Distridt, Class I, to a Residence District, Class II. Mr. 'Brodersen moved that the recommendation of the City Planning Commission be adopted, seconded by Mr. Leydecker and carried unanimously. 17.V From City Attorney Silver relative to Final Decree of Partition in the case of George L. Sessions, et al,vs. City of Alameda, et alooncerning claim to a portion of Government Island and requesting the approval of the decree and quitclaim deed, and that the Mayor be authorized to execute any and all documents to complete said compromise agreement. Mr. Brodersen moved that the recommendation of the City Attorney be adopted, ,seconded by Mr. Leydecker and carried unanimously., 18./ From Holdal and Richardson, Public Accountants, giving report of audit of City's books. Mr. Leydecker moved that the report be accepted-, seconded by Mr. Brodersen and carried unanimously. Mr. Brodersen moved that the report be refer- red. to the Committee of the-Whole for study of recommendations contained therein during budget consideration, seconded by Mr. Leydecker and carried unanimously. 19.1 -From R. C. Strehlow, Jr., relative to lease of conoessions at Washington Park, requesting modification of the lease. Mr. Brodersen moved that the opm; munipation be referred to the City Attorney for investigation and report to the Committee of the Whole as to whether the request can be granted, seconded by Mr. Leydecker and carried unanimously. 20.v' From Gaetano Ventimighti requesting permit to peddle fish in the City of *Alameda. Mr. Brodersen moved that the request be denied, seconded by Mr. Ley- decker and carried unanimously. 21.1 From City Manager Pierson relative to oomplaint of newsboys shouting at the corner of Park Street and Santa Clara Avenue., Also the request of Mr. M. R. Blankenship for forty minute parking on Central Avenue, just east of Webster Street. A report from the Chief of Police accompanied the letter stating that the officers on Park Street had been instructed to remedy the complaint. Relative to the request of Mr. Blankenship the Qity Manager requested further time to make his recommendations. Ordered filed. 22.1 From City Manager Pierson, relative to the application for a permit to conduct Gospel meetings in a tent on Webb Avenue and recommending that the-request'be denied. Mr. Brodersen moved that the recommendation of the Oity Manager be adopted, second ed by Mr. Leydecker and carried unanimously. 2 From City Manager Pierson, re fire protection in the district east of Post Street, between Encinal Avenue and Fillmore Street. Mr. Leydecker moved that the communication be referred to the Committee of the Whole for budget consideration and that the East Bay Municipal Utility District be requested to give-an estimate of the cost of installation of necessary mains to serve this district, seconded by Mr. Brodersen and carried. 2444 From City Manager Piersons, relative to purchase of land at High Street and. San Jose Avenue to relieve traffic congestion at said point. There being no objection this was referred to the Committee of the Whole for budget consideration. 25.V From Alameda Lodge #49, Knights of Pythias, containing Resolution relative to purchase of additional lands for park purpeses. Ordered filed. 26.1 From Bay Farm Island residents petitioning the council to recondition roadway to farms on Bay Farm Island. Mr. Leydecker moved that this matter be referred to the City Manager, City Attorney and City IhIgineer for report back to the Council, seconded by Mr. Brodersen and carried unanimously. 27,/ From Alameda Dahlia Show Committee requesting an appropriation of $300.00 to defray expenses of Dahlia Show to be held next month. Mr. Leydecker moved that the request be referred to the Publicity and Convention Committee, seconded by Mr. Brodersen and carried unanimously. 2841 From O. A. Wilson, relative to discharged employees of the Electric Light Department. Ordered filed. 29.V From E. J. Probst, former Superintendent of Reoreation, requesting a vacation. Ordered filed, no action taken. UNFINISHED BUSINESS 30.4 A communication was received from the Fernside Home Owners Association protest- ing against the granting of any frahohise to run freight cars over Fernside Boulevard between Broadway and. High Street and for spur tracks at intervals, one into the proposed Glass factory site and other further on, when necessary. The Olerk was instructed to communicate with the Fernside Home Owners Association informing them that'no application had been received in conformity with the letter of said associa tion, and that a copy of the application as approVed by the Council be submitted to the Association for their information. The letter was ordered filed. 1. 31. An application was presented from the Southern Pacific Company for a permit to construct, reconstruct, maintain and operate railroad tracks upon, along and/or across Fernside Boulevard, Versailles Avenue land Pearl Street in the Oity of Alameda. Mr. Murphy of 1614 Versailles Avenue, representing the Fernside Home Owners Associa= tion, addressed the Council protesting the granting of any franchise for .a spur track on Fernside Boulevard at any time, also requesting the Council to take no action at this time as there is no necessity for such spur track until -such time as the factory is actually built. Discussion.followed as to certain provisions to be embodied in the permit. Mayor Henning aubmitted the following to be incorporated in the resolution granting the permit: "That no rolling stook of any. description whatever be allowed to use the track on Fernside Boulevard and Versailles Avenue, as shown on the plan.under the designation of.track "A" for any other purpose - than to feed the Owens Illinois Glass Company, or 'allowed to stand on any track . outside of the building, or buildings to be built; that no freight car or cars, locomotive or locomotives of any description whatsoever be allowed to be shunted on Fernside Boulevard east of the switch, designated on plane as switch No. 1, or to stand during the shunting of cars in or out of the factory of the Owens Illinois Glass Company's glass works." Mr. Murphy stated that this statement of Mayor Henning, if incorporated in the permit when granted would be acceptable to the people he represented. Mr. Brodersen moved that the City Attorney be instructed_ to draw up the necessary papers granting the permit embodying in same the provis- ions submitted by Mayor Henning, seconded by Mr. Leydecker and carried. 32.v An application from the Alameda Belt Line for permit to construct, operate and maintain a spur track across the industrial higway in Alameda, at the westerly termination of said highway, previously. referred to the Committee.of the Whole was, on motion of Mr. Brodersen, seconded by Mr. Ieydecker and carried, taken out of the Committee of the Whole and presented. After discussion, Mr. Brodersen moved that the application be approved and-the City Attorney instructed to draw up the neces- sary papers granting the permit, seconded by Mr. Leydecker and carried unanimously. NEW BUSINESS 33.V Deeds were received from the Board of Trustees of the Leland Stanford Junior University and. George H. and Elizabeth C. Noble to the Oity of Alameda for lands for highway purposes for extension of Clay Street, between Versailles Avenue and. Pearl Street. Mr. Leydecker moved that the City Attorney be instructed'to draw up the necessary Resolution accepting the property for highway purpoees, seconded by Mr. Brodersen and carried unanimously. 34.V An application for permit to deposit dredged material on property of Planatel Company, formerly known as the Liberty Yard, was received from the American Dredg- ing Company. Mr. Leydecker moved that the permit be granted and the work done under the supervision of the City Manager and City Engineer, providing the necep sary bond is filed, seconded by Mr. Brodersen and carried unanimously. 35.V An application was received from Hutchinson Company for permission to grade, . durb, gutter and macadamize Mound Street; between the northerly line of Gby Street and the southerly line of Calhoun Street, under private contract. Mr. Brodersen moved that permission be granted Hutchinson Company to improve the said street in accordance with their request, seconded by Mr. Leydecker and carried unanimously. Mr. Brodersen submitted the names of Emil M. Brodersen, Neil B. Pierson, B. M. Kenney, Walter Hauck, Floyd Thompson, Edmund G. Hathaway, Rev. H. H. Shires, Henry Martine and Charles Moody, and moved that they be appointed members of the Golf Commission of the City of Alameda, .. seconded by Mr. Leydecker and carried unanimously. The Clerk was requested to thank the-members of the Miner Golf Commission for their services to the City while serving as members- of said Com= mission. 37.'/ yor Henning stated that it was impossible to secure clear title to the property of all lands to be purchased for the proposed E. K. Taylor Park prior to August 14th, 1931, at which time amendments to the-Acquisition and. Improvement Act of 1925 would go into effect, therefore it was impossible to proceed with the purchase of said property under said Act to acquire any of the parks. He stated possiblyllome other arrangement could be made to purchase said land either through the tax levy or a bond issue. He suggested that a portion of the property of the proposed B. K. Taylor Park might be purchased,' particularly beach property. The title to a portion of the ].ands can be procured by the sale of the city's undivided one-fourteenth interest in certain lands. -Mt. Brodersen moved that the City Attorney,be instructed to prepare the necessary papers for the sale of the city's undivided'one=fourteenth interest in the property,referred to at a minimum price of $300.00, seoonded by MX.-Leydecker and on roll call carried unanimously. Mayor Henning moved that he be instructed to negotiate with the owners of the beach • land in the proposed. B. K. Taylor Park to procure a certain portion of said property, seconded by Mr. Brodersen and on roll call carried unanimously. 38./ , Mr. Leydecker moved that the Mayor and City Manager investigate the purchase of properties for Franklin Park and the Park to Willow Tidelands, under some other method than the Acquisition and. Improvement Act of 1925, and to report back to the Council their recommendations, seconded by Mr. Brodersen and carried unanimously. 39. City Attorney Silver'requested permission to leave the State for two weeks, beginning July 14th, 1931, Mr. Leydecker moved that the request be granted, seconded. by Mr. Brodersen and carried unanimously. RESOLUTIONS: 40, Mr. Brodersen introduced and moved the adoption of "Resolution No.1611 Transferring $2062.50 eFarthe 41ectric Light Fund to the Interest and Redemption Fund". Mr. Leydecker seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. . 4].,I Mr. Brodersen introduced and moved the adoption of "Resolution No. 1612 Transferring $8,745.43 f7.671 the Electric Light Fund to the General Fund," Mr. Leydecker seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. , 421 Mr. Leydecker introduced and moved the adoption of "Resolution No. 1613 Transferring $505.97 froM7Tha GenBral Fund to the Pension Fund." , Mr. Brodersen seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 43.1 Mr. Brodersen introduced and moved the adoption of "Resolution No. 1614 Approving ComprOMise Agreement and Authoriz- ing Mayor to Execute Any and A11 Documents to Complete Same". Mr. Leydecker seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously.
