ROLL CALL - PRESENT: ABSENT: Commissioners Arnerich, DeWitt, Lucas, and Chair Appezzato - 4. None. Adjourned to Closed Session to consider: (96 -23) CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Initiation of litigation pursuant to subdivision (b) of Section 54956.9. Number of Cases: One. (96 -24) CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Subdivision (a) of Section 54956.9) Name of Case: Community Improvement Commission v. Lohr Following the Closed Session, the Special Meeting was reconvened and Chair Appezzato announced that regarding Anticipated Litigation, the Commission declined to initiate litigation. Chair Appezzato announced that regarding Existing Litigation, the Commission voted unanimously to authorize dismissal of an eminent domain action which was filed on the property located at 1629 Park Street; it is called the silver building and not in productive use; the owner of the building has decided to take action on her own to sell the building; and the Commission has agreed to dismiss its eminent domain action. ADJOURNMENT There being no further business before the Commission, Chair Appezzato adjourned the meeting at 7:35 p.m. ectfully sub D ' E B.
