2000-07-18 Special CIC Minutes1 5 8 MINUTES OF THE SPECIAL COMMUNITY IMPROVEMENT COMMISSION MEETING TUESDAY - - JULY 18, 2000 - - 7:25 P.M. Chair Appezzato convened the Special Meeting at 8:10 p.m. Commissioner Daysog led the Pledge of Allegiance. Reverend. David Borglum, Home of Truth Spiritual Center, gave the Invocation. ROLL CALL - Present: Commissioners Daysog, DeWitt, Johnson, Kerr and Chair Appezzato - 1. Absent: None. MINUTES (00-34) Minutes of the Annual Community Improvement Commission Meeting held on June 20, 2000, and the Special Community Improvement Commission Meeting and the Special Joint City Council, Community Improvement Commission, Alameda Reuse and Redevelopment Authority, and Housing Authority Board of Commissioners Meeting held on July 5, 2000. Approved. Commissioner Johnson moved approval of the Minutes. Commissioner Kerr seconded the motion, which carried by unanimous voice vote - 5. AGENDA ITEM (00-35) Resolution No. 00-91, "Approving the Expenditure of Funds from the Business and Waterfront Improvement Project (BWIP) Low and Moderate Income Housing Fund in the Alameda Point Improvement Project (APIP) to Provide Affordable Housing Opportunities." Adopted. Councilmember Johnson moved adoption of the Resolution. Councilmember DeWitt seconded the motion. Under discussion, Commissioner Kerr stated that on October 6, 1999, there was a Joint Meeting to approve a Memorandum of Understanding Special Meeting Community Improvement Commission July 18, 2000 with the Homeless Collaborative to move 58 units from East Housing to West Housing and build a new 39 unit apartment house adjacent to the East Housing area; if all in -lieu housing fees were put together to build the 39 unit apartment house and moderate income units, the City would end up with more units than required under California Redevelopment law; Alameda has been very good at meeting Redevelopment Law obligations, e.g., Independence Plaza used set aside funds from Marina Village; the agenda item is vague and there is no cap on the amount of money [which could be transferred]; a cap should be put on the amount of money, rather than authorization to transfer an unlimited amount of money from BWIP to APIP; requested an amendment to the motion. Chair Appezzato stated that with the Homeless Collaborative, the City met federal mandates; it was a legal and moral responsibility; Redevelopment Law requires that 15% of any homes built in redevelopment areas and 20% of every tax increment go to the development of affordable housing; the City is trying to provide affordable housing opportunities. Commissioner Johnson inquired whether the action tonight allows the transfer of money from one project to another and whether specific transfers would have to be approved in the future. Acting Legal Counsel Highsmith responded in the affirmative; stated the Resolution makes the necessary findings; money would be spent on a project -by- project basis. Commissioner Johnson inquired whether use of money would have to be approved by the Council [CIC] every time, unless the amount is within purview of the City Manager, to which Acting Legal Counsel responded in the affirmative; stated any expenditure over $75,000 would require prior approval. In response to Commissioner Johnson's further inquiry whether the action only provides the ability to transfer funds if the governing body chooses to do so, Acting Legal Counsel Highsmith responded in the affirmative; stated otherwise a similar resolution, with similar project specific findings, would have to be adopted on a project -by- project basis. Special Meeting Community Improvement Commission July 18, 2000 Commissioner Kerr stated the money will be used to identify appropriate sites for housing development and perform pre- development and development activities, including funding architectural site studies and financial feasibility analyses; BWIP is throughout the Island and provides an opportunity to scatter affordable housing throughout Alameda; low income housing should not be concentrated in the West End; inquired whether her amendment [to the motion] was accepted. Commissioner Johnson stated that she was satisfied with the [original] motion [adoption of the Resolution]. Chair Appezzato inquired how the action tonight would benefit the community. The Economic and Community Development Assistant City Manager stated the CIC budget adopted several weeks ago indicated an intent to conduct feasibility analyses for creating affordable housing on Alameda Point and throughout the community; there was a specific objective for the CIC related to Alameda Point; the proposed Resolution allows project-by-project investment to further the budget objective. Commissioner Daysog stated there should be housing for people with all types of income; a cap might not allow enough money to be spent; there should be flexibility to spend the correct amount. On the call for the question, the motions carried by the following voice vote: Ayes: Commissioners Daysog, DeWitt, Johnson and Chair Appezzato - 4. Noes: Commissioner Kerr - 1.
