Mayor/Chair Appezzato convened the Joint Meeting at 7:35 p.m. ROLL CALL - MINUTES Present: Councilmembers/Commissioners Daysog, DeWitt, Johnson, and Mayor/Chair Appezzato - 4. Absent: Councilmember/Commissioner Kerr - 1. (CC 01-157) (CIC 01-09) Minutes of the Special Joint City Council, Community Improvement Commission, Alameda Reuse and Redevelopment Authority and Housing Authority Board of Commissioners Meeting, and the Special Joint City Council and Community Improvement Commission Meeting of March 20, 2001. Approved. Vice Mayor/Commissioner DeWitt moved approval of the Minutes. Councilmember/Commissioner Johnson seconded the motion, which carried by unanimous voice vote - 4. AGENDA ITEMS (CC 01-158) (CIC 01-10) Joint Public Hearing of the City Council and the Community Improvement Commission to consider an Initial Study, IS 00-02, proposing a Negative Declaration pursuant to the California Environmental Quality Act, a request to amend the General Plan, GPA 00-03, to reclassify three parcels from Community Commercial to Medium Density Residential, a Rezoning, R 00-03, to amend the Zoning Designation from C-C (Community Commercial) Zoning District to R-4/PD (Neighborhood Residential/Planned Development Combining) Zoning District, and a Business and Waterfront Improvement Project Area Plan Amendment to reclassify the parcels from commercial designation to commercial/residential designation. The approximately 26,000 square foot site is located at 616, 620 and 626 Buena Vista Avenue and is located within the Alameda Business and Waterfront Improvement Project. Applicant: Alameda Development Corporation. Mayor/Chair Appezzato stated the purpose of this meeting is to conduct a Joint Public Hearing to consider and act upon the Negative Declaration and the proposed Amendment to the Community Improvement Plan for the Business and Waterfront Improvement Project (BWIP). Also being considered and acted upon will be a request to amend the General Plan and Zoning Designation. The Special Joint Meeting Alameda City Council and Community Improvement Commission April 3, 2001 State law under which we are acting is the Community Redevelopment Law of the State of California. That law requires that we follow certain procedures in the conduct of the portion of tonight's Public Hearing which pertains to the amendment of the Community Improvement Plan for the BWIP. A transcript will be made of the Hearing. Now, several items will be entered into the record by Kathleen Kelley, Development Specialist II, for the City of Alameda. Development Specialist Kelley stated at this time, we would like to ascertain from the [City) Clerk that she has in her possession and will enter into the record of the Hearing the following documents: Exhibit 1 an Affidavit of Publication of notice of Joint Public Hearing on the proposed Amendment, published twice [once) a week for three successive weeks as required by Sections 33452 and 33458 of the California Health and Safety Code; Exhibit 2 a Certificate of Mailing notice of Joint Public Hearing on the proposed Amendment to each assessee of land in the existing Project Area, as shown on the last equalized assessment roll; Exhibit 3 a Certificate of Mailing notice of Joint Public Hearing on the proposed Amendment to the governing body of each taxing entity which receives taxes from property in the Project Area; Exhibit 4 a Certificate of Mailing notice of Joint Public Hearing on the proposed Amendment to each residential and business occupant of the Project Area; Exhibit 5 Certification of Certain Official Actions that have been taken by Council, the Planning Board and the Community Improvement Commission (CIC) in connection with the proposed Amendment to the Community Improvement Plan for the BWIP; Exhibit 6 Report of the CIC to the City Council on the proposed Amendment to the Community Improvement Plan for the BWIP; Exhibit 7 the Negative Declaration; Exhibit 8 the proposed Amendment to the Community Improvement Plan for the BWIP; and Exhibit 9 Recommendation of the Economic Development Commission recommending approval of the proposed Amendment. The City Clerk noted that she received all exhibits. Mayor/Chair Appezzato announced the documents will be made part of the record; any written comments received on the Amendment would be placed into the record at this time; inquired whether staff had any comments. Development Specialist Kelley introduced staff and consultants available to answer questions: Mark Sullivan, Seifel Consulting; Jerry Ramiza, McDonough, Holland and Allen; and Jerry Cormack, City's Development Review Manager. Development Specialist Kelley announced there are no written objections from the property owners and/or taxing entities regarding the proposed Amendment to the BWIP. Special Joint Meeting Alameda City Council and Community Improvement Commission April 3, 2001 Mayor/Chair Appezzato stated public comment on the proposed Amendment and any statements or testimony from those present in favor of the Amendment or the Negative Declaration would now be heard. Gregg Fujita, Alameda Development Corporation (ADC), stated ADC Board of Directors solicits support of rezoning the parcel; that he could respond to any questions of ADC. Mayor/Chair Appezzato stated it has been a long process; thanked Mr. Fujita and ADC for making redevelopment of the area possible; stated it [project] will be a tremendous improvement in the West End. Mr. Fujita stated ADC's Board of Directors are volunteers; acknowledged Treasurer Robert Kemp who was present tonight. Mayor/Chair Appezzato announced any statements or testimony from those present in opposition to the proposed Amendment or the Negative Declaration; announced there were no speakers in opposition would now be heard. Mayor/Chair Appezzato inquired whether anyone else in the audience desired to make a statement or present testimony concerning the Negative Declaration or the Amendment. There being no speakers, Mayor/Chair Appezzato inquired whether there were any final questions by members of the Council/Commission. Mayor/Chair Appezzato closed the Joint Public Hearing of the City Council and the [Community Improvement] Commission. (CC 01-1584) Resolution No. 13327, "Approving a Negative Declaration for the Amendment to the Community Improvement Plan for the Business and Waterfront Improvement Project." Adopted. Councilmember Johnson moved adoption of the Resolution. Councilmember Daysog seconded the motion. Under discussion, Vice Mayor DeWitt stated that he agrees with the recommendation as indicated on [Staff Report] attachment 12 which provides for eight units to be developed at the site. Councilmember Johnson inquired whether eight or nine units were proposed. Vice Mayor DeWitt stated Attachment 12, the Staff Report prepared by the Development Services Director indicates: "this project will Special Joint Meeting Alameda City Council and Community Improvement Commission April 3, 2001 create eight workforce ownership housing units, affordable to households with incomes in the approximately $30,000 - $70,000 range;" that he agrees with said statement. On the call for the question, the motion carried by unanimous voice vote - 4. [Absent: Councilmember Kerr - 1.] (CIC 01-10A) Resolution No. 01-96, "Approving a Negative Declaration for the Amendment to the Community Improvement Plan for the Business and Waterfront Improvement Project." Adopted. Commissioner Johnson moved adoption of the Resolution. Commissioner Daysog seconded the motion, which carried by unanimous voice vote - 4. [Absent: Commissioner Kerr - 1.] (CC 01-158B) Resolution No. 13328, "Approving General Plan Amendment, GPA 00-03, to Redesignate 616 to 626 Buena Vista Avenue from Community Commercial to Medium Density Residential on the General Plan Diagram." Adopted. Vice Mayor DeWitt moved adoption of the Resolution. Councilmember Johnson seconded the motion, which carried by unanimous voice vote - 4. [Absent: Councilmember Kerr - 1.] (CC 01-158C) Introduction of Ordinance Reclassifying and Rezoning Certain Properties Within the City of Alameda by Amending Zoning Ordinance No. 1277, N.S., for that Property Located at 616, 620 and 626 Buena Vista Avenue. Introduced. Vice Mayor DeWitt moved introduction of the Ordinance. Councilmember Johnson seconded the motion, which carried by unanimous voice vote - 4. [Absent: Councilmember Kerr - 1.] (CC 01-158D) Introduction of Ordinance Amending Ordinance No. 2559, as Amended by Ordinance Nos. 2681, 2835, and 2844 and Approving and Adopting the Amendment to the Community Improvement Plan for the Business and Waterfront Improvement Project. Introduced. Councilmember Johnson moved introduction of the Ordinance. Vice Mayor DeWitt seconded the motion, which carried by unanimous voice vote - 4. [Absent: Councilmember Kerr - 1.] (CIC 01-11) Recommendation to authorize the Executive Director to enter into an Owner Participation Agreement with Mariner Square and Associates (2415 Mariner Square Drive).
