1910-05-03 Regular CC MinutesTUESDAY,MAY 3RD 1910 The meeting convened with Mayor V.H.Noy,presiding. The Roll was called and Councilmen Christensen,Walker,'Krumb,Ells and Bullock were noted present and Councilmen Hammond, rosby,Fisher and Probst,absent. The minutes of the meeting of April 19th 1910,were read and ordered approved. Mr. rosby arrived and was noted present. Mr.Bullock offered the following resolution and moyed its adoption: RESOIVED,That the Park and Playground Commission be empowered to employ Rhoda C. Mackenzie as Matron of Lincoln Park at a salary of 30.00 per month sane to be in force from and after April 1st 1910. Mr.Christensen seconded the resolution and it was adopted and passed IT the fol- lowing vote. Ayes :Councilmen Christensen,alker,Yrumb,Crosby,E17s and Pullock,(6). Noes :None. Absent :Councilmen Hammond,Fisher and Probst, (3). A communication was received from the Alameda Steam Laundry Association,protest- ing against the license tax which it had paid to conduct a towel service business in conjunction with its regular laundry business and requesting the refunding of the li- cense tax of UO.00. Mr.Bullock moved that the matter be referred to the License Thmmittee in conjunction with the License Collector,seconded by Er.Krumb and carried. Mr. Bullock moved that the claims as read be paid, seconded by Mr. Christensen and tarried h the following vote. Ayes:Counoilmen Christensen, Walker, Krumb, Hammond, Crosby, Ells and Bullock, (7). Noes :None. Absent :Councilmen Fisher and Probst, (2). A report was received from the Municipal Electric Light Plant for the month of March, 1910. Ordered filed. A report was received from the Auditor showing the balances in the various funds for the month ending April 30th, 1910. Ordered filed. A petition w,s received from residents on Haight Avenue, between Fourth and Fifth Streets requesting that an arc light be installed in said street. Mr. Walker moved that the matter be referred to the Department of Electricity, seconded by Mr. Krumb and carried. A report was received from the Board of Health regarding the matter of the protest against the dairy at the corner of Eagle Avenue and Bay Street, stating that the said dairy was in a good sanitary condition, but recommending that the Council pass ordinance prohibiting the maintenance of, within 500 feet of any residence, any barn or dairy yard in which more than two cows are kept. Mr. Hammond moved that the matter be referred to the Public Health Committee, seconded by Mr. Crosby and carried. The Clerk presented a comrunication from the White Steamer Company stating that they had never received the certified check and photographs which accompanied their bid for the police patrol and ambulance. Accompanying the same was a report from the Postmaster stateing that they had been unable to trace the said package in the mails. Mr. Hammond moved that the matter be referred to the Mayor and the City Attorney with power, seconded by Mr. Ells and carried. A connunication was received from E. W. Maslin, stating that the term of office of Library Trustee W. M. Bowers had expired and recommended that he be reappointed. Order- ed filed, and thereupon Mr. Crosby moved that W. M. Bowers be appointed as a member of the Board of Library Trustees for the ensuing term of five years, begin-ing April 22nd, 1910, seconded by Mr. Christensen and carried by the following vote. Ayes :Councilmen Christensen, Walker, Krumb, Hammond, Crosby, Ells anct ilullock, (7). Noes:None. Absent:Councilmen Fisher and Probst, (2). An application for a free license was received from Mrs. H. C. Ballheimer to conduct a small notion store at the northeast corner of Sixth Street and Central Avenue. Mr. Walker moved that it be granted, seconded by Mr. Hammond and carried. An application for a gratuitous license was received from Eugene Pucci to peddle fruit and vegetables. Mr. Walker moved that the request be denied, seconded by Er. Bullock and carried. An application Was received from Alfred Jarratt for a gratuitous license to con- duct an express business using a two horse team for the purpose. Mr. Hammond moved that the matter he referred to the License Committee, seconded by Mr. Krumb and carried. A communication was received from the Police and Fire Commission regarding a window broken by a man under arrest. Mr. Bullock moved that the matter be referred to the Public Buildings and Grounds Committee, seconded by Hr. Krumb and carried. A communication was received from the Police and Fire Commission requesting that they be authorized to purchase a filing cabinet at a cost not to exceed $35.00. Mr. Krumb moved that the matter be referred to the Finance Committee, seconded by Mr. Christensen and carried by the following vote. Ayes:Councilmen Christensen, Walker, Krumb, Hammond, Crosby, Ells and Bullock, (7). Noes:None. Absent:Councilmen Fisher and Probst, (2). A communication was received from the Police and Fire Commission stating that the rolice patrol and ambulance would arrive in Alameda about May 20th, and requesting that immediate action be taken to provide for the housing of the same in a temporary or permanent garage to be located on the ground north of the City Hall. Mr. Bullock moved that the matter be referred to the Building and Grounds Committee with power to act, seconded by Mr. Krumb and carried by the following vote. Ayes :Councilmen Christensen, Walker, Krumb, Hammond,Crosby, Ells and Bullock, (7). Noes :None. AbFent:Connoilmen Fisher and Probst, (2). A contract was received from the Powell Bros. Construction Company for the con- struction of an artificial stone sidewalk on the west side of Eighth Street, fronting Washington Park. Ordered filed. A Plan and Specifications for Corrugated Iron Fart Circle Culverts was presented by the City Engineer. Mr. Krumb moved that they be adopted, seconded by Mr. Ells and carried. Mr. Krumb offered the following Resolution and moved its adoption:- RESOLVED, That the public interest and convenience require and that it is the inetention of the Council of the City of Alameda to order the following street work to be done in said city namely:: That Pacific Avenue from the eastern line of First Street to the eastern line of Fourth Street and including the crossings of Second Street and Third Street with Pacific Avenue, and including the termination and opposite termi- nation of Fourth Street in Pacific Avenue be improved as follows: That the entire width of said avenue, from property line to property line , between said limits, and including said crossings and terminations, be graded to the official grade; that con- crete curbing, eight inches by fourteen inches in cross section dimension, be construct- ed on the curb lines of said avenue and on the curved corners of said crossings and of said opposite termination between said limits; that cement grouted rock gutters, three feet in width and of the "flat" pattern, be constructed in the roadway of said avenue between said limits, contiguous to said curbing and to said curved corners; and that a corrugated iron, part circle culvert, set in concrete, with "T4sn and manholes with cast-iron covers and rims, be constructed across Pacific Avenue on the eastern side of the crosping of said avenue with Second Street, also across Pacific Avenue on the western side of the crossing of said avenue with Third Street, also across Pacific Avenue on the eastern side of the crossing of said avenue with Third Street, and also across Fourth Street in the opposite termination thereof with Pacific Avenue, and also across Pacific Avenue on the western side of the crossing of said avenue with Second Street, except that said culvert last mentioned shall be constructed without "T's" or manholes; that the culverts, "T's" and manholes herein provided for shall be constructed, except as herein otherwise provided, in accordance with "Plan for Corrugated Iron Part Circle Culvert" together with Specifications therefor adopted by the Council of the City of Alameda on the 3rd day of May, 1910, and on file in the office of the City Clerk in said City of Alameda, which said Plan and Specifications are hereby referred to and made a part hereof; that the roadway of said avenue, between said limits and including said, crossings and said termination and opposite termination, but excepting that portion of said roadway occupied by gutters and man- holes be macadamized with a layer of broken trap rock eight inches in thickness. That portion of said avenue required by law to be kept in order by the rail- road company having its tracks thereon is hereby excepted from the operation of this resolution. The Alameda Daily Argus is hereby designated as the daily newspaper published and circulated in this City in which this resolution, and the Street Superiiitendent's Notice of the passage thereof, shall be published. The Clerk is hereby directed to publish this Resolution by two successive insertions in said newspaper, and post the same for two days conspicuously near the Chamber door of this Council. Mr. Walker sr-conded the resolution and it was adopted by the following Vote. Ayes :Councilmen Christensen, Walker, Krumb, Hammond, Crosby, Ells and Bullock, (7). Noes:None. Absent :Councilmen Fisher and Probst, (2). Mr. Krumb offered the following Resolution and moved its adoption: RESOLVED, That the City Engineer be and hereby is directed to make Plans and Specifications for the following Street work to be done in said City, namely: That Cedar Street from a right line 520 feet right angular measurement souther- ly from and parallel with the southern line of Clinton Avenue to the concrete bulk- head in the southern extremity of said street be improved as follows: That the entire width of said street between said limits, from property line to property line, be graded to the official grade; that concrete curbing, eight inches by twelve inches in cross section dimension, combined with concrete gutters, three feet wide by six inches thick, be constructed along both edges of the roadway of said street between said limits; and that the remaining portion of the roadway of said street, between said limits, be macadamized with a layer of broken trap rock six inches in thickness, as per Resolution of Intention No. 747, adopted by this Council March let, 1910. And that the Clerk be instructed to notify the City Engineer of the adoption of this Resolution. Mr. Walker seconded the Resolution and it was adopted by the following vote. Ayes:Councilmen Christenson, Walker, Krutb, Hammond, Crosby, Ells and Bullock, (7). Noes:None. Absent.: Councilmen Fisher and Probst, (2). The City Engineer presented Plans and Specifications for the work of improving the south end of Cedar Street and thereupon Mr. Krumb offered the following Resolu- tion and moved its adoption: RESOLVED, That the Plans and. Specifications furnished by the City Engineer of the City of Alameda, to this Council, for the following Street work to be done in said City, namely: That Cedar Street from a right line 520 feet right angular measurement southerly from and parallel with the southerly line of Clinton Avenue to the concrete bulkhead in the southern extremity of said street be improved as follows: That the entire width of said street between said limits, from property line to property line, be graded to the official grade; that concrete curbing, eighth inches by twelve inches in cross section dimension, combined with concrete gutters, three feet wide by six inches thick, be constructed along both edges of the roadway of said street between said limits; and that the remaining portion of the roadway of said street, between said limits, be macadamized with a layer of broken trap rock six inches in thickness, under Resolution of Intention No. 747, adopted by the Council of said City, March 1st, 1910, be and the same are hereby adopted and approved. And the Clerk is directed to file the sane. Mr. Christensen seconded the Resolution and it was adopted by the following vote. Ayes:Councilmen Christensen, Walker, Krumb, Hammond, Crosby, Ells and Bullock, (7). Noes:None. Absent:Councilmen Fisher and Probst, (2). Mr. Krumb offered the following resolution and moved its adoption: WHEREAS, It appears to the satisfaction of this Council that Resolution of Intention No. 747 for thework of grading, curbing, macadamizing and otherwise improving the southerly end of Cedar Street in the City of Alameda, adopted by this Council, March 1st 1910, has been posted and published according to law, and that objection to the doing of said work filed with the City Clerk of said city, March 19th, 1910, and dated March 12th 1910, that due and legal notice of hearing of objections and after said hearing on April 19th 1910, a Resolution Overruling Objections was adopted by the Council of the City of Alameda, on April 19th, 1910. RESOLVED, That the public interest and convenience require and the Council of the City of Alameda hereby orders the following described street work to be done in said City, according to the plans and specifications adopted therefor, namely: That Cedar Street from a right line 520 feet right angular measurement souther- ly from and parallel with the southern line of Clinton Avenue to the concrete bulk- head in the southern extremity of said street be improved as follows: That the entire width of said street between said limits, from property line to property line, be graded to the official grade; that concrete curbing, eight inches by twelve inches in cross section dimension, combined with concrete gutters, three feet wide by six inches thick, be constructed along both edges of the roadway of said street between said limits; and that the remaining portion of the roadway of said street be- tween said limits, be macadamized with a layer of broken trap rock six inches in thick- ness. The Clerk of this City is hereby directed to publish this Resolution for two days in the Alameda Daily Argus, a daily newspaper published and circulated in this City, and which is hereby designated for that purpose. He is also directed to post conspicuously for five days near the Chamber Door of the said Council, notice of said work with specifications inviting sealed proposals or bids for doing the work ordered, and to publish notice of said work inviting sealed proposals or bids for doing the work and referring to the specifications posted or on file, also for two days in the said. Alameda Daily Argus, the newspaper hereby designated for that purpose. Both of the said notices shall require a certified check or a bond, either as prescribed by law and for an amount not less than ten per cent of the aggregate of the proposal, and shall name Tuesday , the 17th day of May, 1910, as the day hereby designated on which up to the hour of 8 o'clock p. m., the said proposals or bids shall be received. Mr. Christensen seconded the resolution and it was adopted by the following vote. Ayes:Councilmen Christensen, Walker, Krumb, Hammond, Crosby, Ells and Bullock, (7). Noes:None. Absent:Councilmen Fisher and Probst, (2). A Bill entitled "A Bill for Ordinance No. Authorizing and Consenting to the Sale and Disposition of the Haight School Building by the Board of Education" introduc- ed April 19th, 1910, by Mr. Christensen came up for passage and was read by the Clerk. Mr. Christensen moved its adoption seconded by Mr. Krumb, and adopted and passed by the following vote. Ayes:Councilmen Christensen, Walker, Krumb, Hammond, Crosby, Ells and Bullock, (7). Noes:None. Absent:Councilmen Fisher and Probst, (2). A'Bill entitled "A Bill for Ordinance No. to Prohibit the Use of Electrol- liers for Hitching Purposes" Introduced April 19th, 1910, by Mr. Hammond came ur for passage and was read by the Clerk. Mr. Hammond moved its adoption, seconded by Mr. Bullock and carried by the following vote. Ayes:Councilmen Christensen, Walker Krumb, Hammond, Crosby, Ells and Bullock,(7). Noes:None. Absent:Councilmen Fisher and Probst, (2). A BIll entitled " A Bill for Ordinance No. Prohibiting the Hanging of Banners Over or Across Streets or Avenues" introduced April 19th, 1910, by Mr. Hammond, cane ur for passage and was read by the Clerk. Mr. Hammond moved it sadoption, second- ed by Mr. Crosby and carried by the following vote. Ayes:Councilmen Christensen, Walker, 'crumb, Hammond, Crosby, Ells and Bullock, (7). Noes:Uone. Abeent:Councilmen Fisher and Probst, (2). City Attorney M. W. Simpson reported that in his opinion the Ordinance against the maintenance of laundries within certain districts of the City of Alameda was not valid and could not be enforced. Mr. Walker requested that the City Attorney render such an opinion citing authorities, in writing. Mr. Walker brought up the matter of police officials riding on the railroad trains at all times, whether in uniform or not, and moved that the matter be referred to the Public Utilities Committee to endeavor to have such arrangement made With the railroad officials, seconded by Mr. Krumb and carried. Mr. Walker moved that the City Engineer and Street Superintendent proceed at their earliest convenience to set hack the curb on Central Avenue fronting Washington Park to the curb line of Central Avenue, east of Eighth Street, seconded by Mr. Christensen and carried. Mr. Hammond moved that the matter of the renewal of the insurance on the corpora- tion yard and its contents be referred to the Street Committee with power, seconded by Mr. Crosby and carried. Mr. Krumb moved that a free license be granted for the keeping of a dog at each of the five fire houses, seconded by Mr. Hammond and carried. President Latham of the Police and Fire Commitsion addressed the Council request- ing authority to purchase a team of horses for the Fire Department at a cost of 3OO.00. Mr. Hammond moved that the authority be granted, and that the payment for same be re- ferred to the Finance Committee, seconded by Mr. KruMb and carried by the following vote. Ayes :Councilmen Walker, Krumb, Hammond, Crosby and Ells, (5). Noes:Councilman Bullock, (1). Absent:Councilmen Fisher and Probst, (2). Excused from voting: Council- man Christensen, (1).
