1910-12-06 Regular CC MinutesREGULAR MEETING OF TEE COUNCIL OF TEE CITY OF ALAMEDA,TUESDAY,DECEMBER 6th 1910/ In the absence of the Mayor the meeting convened with Council President Bullock,presiding. The Roll was called and Councilmen Christensen,Walker,Krumb,Crosby,Ells and Bullock,(6),were noted present and Councilmen Hannond,Fisher and Probst, (3),asent. The minutes of the meeting of November lbth 1910 were read and ordered approved. Councilman Hammond arrived and was noted present. A communication was received from Auditor & Assessor Oroll requesting permis- sion to purchase an Adding Machine at a cost of 'i500.00 as rovided for in his bud- get. Mr.Christensen moved that the request be granted,seconded by Mr.Hammond and carried by the following vote. Ayes:Councilmen Christensen,Walker,Krumb,Hannond, Croshy,Ells and Bullock, (7). Noes :None. Mr.Christensen offered the following resolution and moved its adoption: Resolved:That the salaries of City Officials and etnployees,for the month of December,1910,shall be due. and payable on the 23rd day of December,1910,and the City Auditor is hereby authorized and directed to issue and deliver warrants for all such salaries on said last mentioned day;and the City Treasurer is hereby auth- orized and directed to pay said warrants so issued and delivered. Mr.Hammond seconded the resolution and. it was passed and adopted by the fol- lowing vote. Ayes:Councilmen Ohristensen,Walker,Krunb,Hammond,Grosby,Ells and Bullock,(7). Noes:None. Absent:Councilmen Fisher and Probst,(2). A reTort was received from the Auditor as to the amounts on, hand in the var- ious funds,on November 30th 1910. Ordered filed. A report was received from the Auditor as to the apportionment of taxes on November 25th 1910. Ordered filed. A report was received from the Municipal Electric Light Plant for the month of October,1910. Ordered filed. A renewal certificate was received from the United States Fidelity & Guar- anty Company of Baltimore on the burglar insurance maintained on the Treasurer's vault. Mr.Walker moved that it be referred to the Finance Connittee,seconded by Er.Krumb and carried. ilcommunication was received from the hayor in which he stated that he had believed that the Municipal Electric Light Plant was in danger by reason of a strike and had appointed S.S.Winchell a special police officer to serve under the direction of the Board of Electricity. Mr.Watker moved that the appointment be De ember 6th 1910. seconded by Mr.Hammondand carried. An application was received from lIrs.Susan Drew for a gratuitous license to sell notions &c. Mr.Walker moved that it be referred to the License Committee with power,seconded by Mr.Christensen and carried. An application and bond was received from Fred J.Borrnann & Co.,to conduct a saloon Business at 1525 Park Street,accompanying the sane was a communication con- senting to the transfer of the license to said Fred J.Bormann & Co,frorn Minnie Bormann,Executrix of the estate of Marie Louis,deceased in whose name the license was at present held. The City Attorney had indorsed the said bond and application as being in correct forrn. Mr.Krumb moved that the application be granted,second- ed by Mr.Walker and carried by the following vote. Ayes:Councilmen Christensen, Walker,Krumb,Hamnond,Crosby,EllS and Bullock,(7). Noes:None. Absent:Council- men Fisher and Probst,(2).. An application and bond was received from Geo H. & Sue Seebeck to conduct a saloon business at the N.E.Corner of Webster Street and Santa Clara Avenue,accom- panying the samewas a petition from the sa±d Geo H. & Sue Seebeck for permission to transfer their liquor license from their present location at 1513 Webster Street to said N.E.corner of Webster Street and Santa Clara Avenue. The City Attorney had indorsed the said bond and application as being in correct form. Er.Nrumb moved that the request be granted the sane to take effect and be in force from and after January 1st 1911,seconded by Mr.Christensen and carried by the following vote. Ayes:Councilmen Christensen,Walker,Krumb,Hammond,Crosby,Ells and Bullock, (7) . Noes:None. Absent:Councilmen'Fisher and Probst, (2). A complaint was received from Lewis F.. Shaw against the unloading of _e fuel oil cars at Encinal Avenue and Park Avenue and recommending that the Council take steps to remove the spur track at said location. Mr.Krumb moved that the mat- ter be referred to the Public Utilities Committee and that it also take up the nat- ter of having the Railroad make dedication of the street at said iocation,seconded by Mr.Walker and carried. A conmunication was received from CJ1.Wooster Co.,giving figures as to the cost of building a garbage incinerator plant. Mr.Krumb moved that it be refer- red to the Public Utilities Committee,seconded by Mr.Christensen and carried. A report was received from the Board of Health regarding the complaint of the unsanitary condition of the arks and shacks located on the shore of an Lean- dro Bay at the easterly end of the Cityrin which it found that the conditions Complained of were caused by the discharge from the City's sewers instead of the arks and shacks and that the sanitary condition of the said arks and shacks was comparatively good. Ordered filed. A report was received from the Board of Health regarding the complaint of the storing of manure at the south end of Regent Street and Versailles Avenue and stating that the owners thereof had been duly notified to remove the sane by the 1st of January 1911. Ordered filed. A communication was received,signed by nine dairy firms stating that they did not object to the passage of an ordinance providing for the delivery of milk in glass bottles or other single containers. Ordered filed. A communication was received from John T.Flynn with reference to the matter proposed by him looking toward the leasing of tide lands adjacent to the City of Alameda. 'A copy of an advertisement for the lease of two lots of U.S.Government land fronting on the Tidal Canal west of the Park Street Bridge was received and on not- ion of Mr.Krumb,seconded by Mr.Christensen and carried referred to the City Attor- ney. A communication was received from the Southern Pacific Company stating it could not comply with the request of the City to allow Policemen to ride free on the trains as the such riding by public officials is contrary to the provisions of the Wright Act (Stata.1909,page 499) and that the Attorney General of the State of California came with in the meaning of a public official. Lr.Krumb moved that the matter be referred to the City Attorney to take up with Assemblyman elect Oroshy in the endeavor to have the said Act amended so as to allow Policemen to free rides, seconded by Mr.Christensen and carried. A communication was received from the Pacific Coast Borax Company complaining of the condition of the roadway leading to its plant in the West End of Alameda. Mr.Krumb moved that the matter be referred to the Street Committee,seconded by Hr. Walker and carried. Affidavits of Posting and of Publication of Notice of Street Work inviting proposals for the work of constructing a sewer in Grand Street between Clinton and Dayton Avenues and ordered filed. The Clerk reported that in reply to the said Notice,one bid had been received. Mr.Krumb moved that the bid be received and op- ened,seconded by Kr.Hammond and carried and thereupon the Clerk opened and read a bid from Hutchinson Company,which was accompan*ed by a bond in the sun of ;;i;50.00, follows: For Six-inch Pipe- - - - - - - - - -58 cents per Linear Foot. For Six-inch Y Branches,4" openings- - - -60 cents each Extra. The Street Superintendent reported that it was a reasonable bid and thereupon Mr. Krumb offered the following Resolution and moved its adoption: Resolved that the Council of the City of Alameda,having in open session on the 6th day of Dec.1910,opened,examined and publicly declared all sealed proposals and bids for the following street work in said city,to wit: That a salt-glazed,vit- rified,iron-stone sewer,6 inches in inside diameter,with 4-inch Y-branches,and with- out house connections,be constructed in Grand Street in a right line from the exist- ing manhole at the crossing of Grand Street and Clinton Avenue along the center line of Grand Street to the existing manhole at the crossing of Grand Street and Dayton Avenue hereby rejects all of said bids except that next herein mentioned and hereby awards the contract for said work to Hutchinson Company,it being the lowest responsible bidder therefor,at the prices specified in its bid therefor on file to wit: For Six-inch Pipe- - - - - - - - - - - - - 58 cents per Linear Foot For Six-inch Y Branches,4 inch openings- 60 cents Each Extra The City Clerk is hereby directed to post Notice of this Award conspicuously for five days near the Chamber door of this Council,and to publish said notice for two days in the Alameda Daily Argus,newspaper. Mr.Krumb offered the following Resolution and moved its adoption: Resolved,That the public interest and convenience require and that it is the intention of the Council of the City of Alameda to order the following street work December 6th 1910. That High Street,from a right line eleven hundred (1100) feet right angle meas- urement northerly from and parallel with the northern line of Lincoln Avenue to the southern end of the United States Tidal Canal bridge,which is distant seven hundred and twenty-two and three-tenths (722.3) feet northerly along the center line of High Street frorn the right line above mentioned,and axcepting the crossing of Hi gh Street with Fernside Bonlevard,be improved as follows: That the entire width of said portion of said street from roperty line to property line be graded to the official grade;that concrete curbing,eight inches by fourteen inches in cross section dimension,be constructed on the curb lines of said portion of said street;that cement grouted rock gutters,three feet in width and of the flat pattern,be constructed along the roadway of said portion of said street contig- uous to said curbing;that the remaining portion of the roadway of said portion of said street he macadamized with a layer of broken trap rock eight inches in thickness. And,be it further resolved,that the proceedings for the doing of said street work shall be and are hereby taken under and by virtue of the provisions of the "Local Improvement Act of 1901",and that the proposed work above described be and the same is hereby referred to the City Engineer of the City of Alameda,and said City Engineer be and he is hereby instructed to make to the Council of the City of Alameda a report in writing containing his recommendations as to the best method of doing said work and of making said improvement. City,nanely: That Cedar Street from a right line 520 feet right angular measurement south- erly from and parallel with the southern line of Clinton Avenue to the concrete bulkhead,which is distant 121 feet southerly alo. ng the 00'7w center line of Cedar Street from the right line above mentioned,be improved as follows: That the entire width of said street between said limits from property line to property line,be graded to the official grade;that concrete curbing,eight inches by fourteen inches in cross section dirnension,compined with concrete gutters,three feet wide by six inches thick,be constructed along both edges of the roadway of said street between said limits;and that the remaining portion of the roadway of said street between said limits,be macadamized with a layer of broken trap rock six in- ches in thickness,as per Resolution of Intention No.754,Adopted by this Council,Oct- ober 4th 1910. The City Engineer presented Plans and Specifications in accordance with the foregoing Resolution and thereupon Mr.Krumb offered the following Resolution and moved its adoption: Resolved,That the Plans and Specifications furnished by the Ci ty Engineer of the City of Alameda,to this Council,for the following Street work to he done in said City,namely: uecemoer btn Ivio. erly from and parallel with the southern line of Clinton Avenue to the concrete bulkhead,which is distant 121 feet southerlu along the center line of Cedar Street from the right line above nentioned,be improved as follows: That the entire width of said street between said limits from property line to property line,be graded to the official grade;that concrete curbing,eight in- ches by fourteen inches in cross section dimension,combined with concrete gutters three feet wide by six inches thick,be constructed along both edges of the roadway of said street between said limits:and that the remaining portion of the roadway of said street between said limits,be macadamized with a layer of broken trap rock six inches in thickness,under Resolution of Intention No.754,adopted by the Council of said City October 4th 1910,be and the same are hereby adopted and ap- proved. And the Clerk is directed' to file the same. Mr.Walker seconded the resolution and it was adopted and passed by the follow- ing vote. Mr.Krumb offered the following resolution and moved its adoption: Whereas,It appears to the satisfaction of this Council,that Resolution of Intention No.754 for the work of grading,curbing,macadamizing and otherwise improv- ing the southerly end of Cedar Street in the City of Alameda,adopted by this Coun- cil,October 4th 1910,has been posted and published according to law,and that ob- jection to the doing of said work was filed with the City Clerk of said city,Nov- ember 1st 1910,and dated October 14th 1910,that due and legal notice of hearing of objections was given and after said hearing on November 15th 1910,a Resolution Ov- erruling Objections was adopted by the Council of the City of Alaneda,on November 15th 1910. Resolved,that-the public interest and convenience require and the Council of the City of Alameda hereby orders the following described street work to be done in said city,according to the plans and specifications adopted therefor,namely: That Cedar Street from a rlght line 520 feet right angular measurement south- erly from and parallel with the southern line of Clinton Avenue to the concrete bulkhead,which is distant 121 feet southerly along the center line of Cedar Street from the right line above mentioned,be improved as follows: That the entire width of said street between said limits from property line to property line,be graded to the official grade;that concrete curbing,eight in- ches by fourteen inches in cross section dimension,combined with concrete gutters three feet wide by six inches thick,be constructed along both edges of the roadway of said street between said limits:and that the remaining portion of the roadway of said street,between said limits,be macadamized with a layer of broken trap rock six inches in thickness. The Clerk of this City is hereby directed to publish this Resolution for two days in the Alameda Daily Argus,a daily newspaper published and circulated in this City,and which is hereby designated for that purpose. He is also directed to post conspicuously for five days near the Chamber Door of the said Council,notice of said work with specifications inviting sealed proposals or bids for doing the work or- dered,and to publish notice of said work inviting sealed proposals or bids for do- ing the work and referring to the specifications posted or on file,also for two days in the said Alameda Daily Argus,the newspaper hereby designated for that purpose. Decernber 6th 1910. scribed by law and for an amount not less than ten per cent of the agregate of the proposal,and shall name Tuesday,the 20th day of December,1910,as the day hereby des- ignated on which up to the hour of 8 o'clock,P.M.,the said proposals or bids shall be received. Mr.Christensen seconded the resolution and it was adopted and passed by the following vote. Ayes :Councilmen Christensen,Walker,Krumb,Hannond,Crosby,Ells, Probst and Bullock, (S). Noes:None. Absent:Councilman Fisher,(1). A communication was received from B.M.Kearney,stating that as the condition provided for in the deed given for right of way privilege for a portion of the street known as Fernside Boulevard had not been complied with as regards the grad- ing,macadamizing Ike of said portion of said street,that he now rescinded the said deed and had taken possession of the said property. Mr.Rammond moved that the matter be referred to the Street Committee with power,sec0ndE by Mr.Christensen and carried. The Street Conrnittee presented a report stating that it found upon investiga- tion that there is a strip of land 80 feet wide commencing at the northern line of Encinal Avenue and running thence northerly 110 feet to Fernside Boulevard,claimed by Mrs.Hattie Kearney,that had not been deeded to the City. Mr.Hammond moved that the report be filed,seconded by :1r.Crosby and carried. A communication was received fron the Street Committee recommending that an Intercepting Sewer 1-e constructed in the extreme east end of the City,as soon as possible. Mr.Krumb moved that it be filed,seconded by Iqr.liammond and carried. L.V:.McGlauflin presented an application for permission to make certain repairs to a frame building located in Fire Limits ,No.1 at 2410 Webb Avenue. Mr.Walker moved that the request be denied,seconded by Mr.Christensen and carried. A Bill entitled "A Bill for Ordinance No. Relating to the Plumbing and Repealing Certain Sections of Ordinance No.522," introduced by Mr.Fisher,November 15th 1910,cane up for passage and was read by the Clerk. Mr.Walker moved its adoption,seconded by Mr.Hammond and carried by the following vote. Ayes:Council- men Christensen,Walker,Krumb,Hammond,Crosby,Ells,Probst and Bullock,(8). Noes: None. Absent :Councilman Fisher,(1). Mr.Christensen introduced A Bill entitled Amend Ordinance No.516 of the City of Alameda P "A Bill for Ordinance No. To escribing Building Regulations", which was laid over under the provisions of the Charter. Mr.Krumb introduced A Bill entitled "A Bill for Ordinance No. Establish- ing the curb Grade of Pearl Street between Blanding Avenue extended and Harrison Avenue",which was laid over under the provisions of the Charter. Mr.Walker introduced A Bill entitled "A Bill for Ordinance No. Relating to Salaries in the Police Department and Fixing Same on a Basis of Longevity of Service", which was laid over under the provisions of the Charter. Mr.Krumb introduced A BIll entitled "A Bill for Ordinance o. To Require the use of Lights on Motor Vehicles at Night ,which was laid over under the provisi- ons of the Charter. Mr.Krumb moved that the Clerk be directed to advertise for bids for the re- moval of manure and garbage from the fire fire stations in the City,Mr.Walker second- the motion and it was passed by the following vote. Ayes:Vouncilmen Christensen, Walker,Krumb,Hammond,Orosby robst and Bullock, (8). Noes :None. Absent: Councilman Fisher,(1). December 6th 1910. Mr.Xrumb stated that complaints had been made regarding the dumping of garbage on the marsh land west of the V;ebster Street Eoadway and moved that the Clerk he di- rected to notify the Police Department to take action toward suppressing such ac- tions,seconded by Mr.Walker and carried. There being no further business to transact the Council adjourned until the next regular meeting,Tue day,December 20th 1910,at 7.30 P.M.
