1913-06-17 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, JUNE 17TH, 1913. The meeting convened with Mayor Frank Otis presiding. The Roll was called and Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Probst and Stewart, f8) were noted present and Council- man Roth, (1) absent. Councilman Roth arrived later and was noted present. The Minutes of the regular meeting held June 3rd, 1913 were approved as read. The Minutes of the Special meeting of the Council held Pr±day evening, June 13th, 1913 were approved as read. (POLICE) Municipal Electric Light Plant Advertising 28.40 Mr. Hammond moved that the Claims as read be paid, seconded by Mr. Bullock and carried by the following vote:- Ayes:Councilmen Bartlett Buliock, Hammond, MacRae, Morgenstern Morris, Probst, Roth and Stewart, (9). A communication was read from Gavin Aitchison under date of June 12th, 1913 addressed to Mayor Frank Otis in which he tendered his resignation as a member of the Board of Education. Mr. Hammond moved that the resignation be accepted, second- ed by Mr, Roth and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Prob t Roth and Stewart, (9). Noes: None. Absent:None. 4 A copy of a communication from Mayor rank Otis, under date of June 1g) h, 1914 to Gavin Aitchison was read, in which the Mayor accepted the resignation of the School Director and thanked him on behalf of the city for services rendered. Ordered filed. A communication from Mayor Frank Otis was read, under date of June 16th, 1913, in which he appointed Mrs. H. Theresa Speddy as School Director to succeed J. B. Lanktree, term expired. Mr. Morgenstern moved that the appointment be confirmed, seconded by Mr. Hammond. Mayor Otis called President Morgenstern to the Chair and addressed the Council setting forth his reasons for appointing Mrs. Speddy. The roll call on the motion to confirm Mrs. Speddy's appointment resulted as follows:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9). Noes:None. Absent:None. ` A communication from Mayor Frank Otis under date of June 16th, 1913, was read in which he appointed J. B. Lanktree School Director to fill the vacancy caused by the resignation of Gavin Aitchison. Mr. Probst moved that the appoint- ment be confirmed, seconded by Mr. Bullock. Mr. B. C. Brown and Mayor Otis spoke in connection with the appointment of Mr. Lanktree. The roll call on the motion to confirm Mr. Lanktree's appointment resulted as follows:- Ayes:Council- men Bartlett, Buliock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and June 17th, 1913. A recess of five minutes was declared, after which the Clerk administered the Oath-of Office to Mrs. Speddy and Mr. Lanktree. Upon invitation Mrs. Speddy and Mr. Lanktree addressed the Council. A communication from Mayor Frank Otis, under date of June 17th, 1913, having to do with a sane celebration for the Fourth of July was read and ordered filed. AA communication was read from Mayor Frank Otis, under date of June 9th, 1913 in which he urged that prompt action be taken in refunding surplus moneys collected on electrolier assessments. Mr. Hammond moved that the matter be re- ferred to the Finance Committee, seconded by Mr. Probst and carried. A copy of a telegram dated June 14th, 1913 sent by Mayor Frank Otis to Congressman J. R. Knowland concerning the attitude of the City of Alameda and the. Council in regard to projected east bay harbor improvements was read and ordered filed. A communication from Mayor Frank Otis under date of May 21 t 1913, in which he announced his appointment of Geo. W. Christensen as Oity Hall Deputy, which communication was read at the meeting of June 3rd, 1913, was called up by the Clerk for action. Mr. Hammond moved that the appointment be confirmed, seconded by Mr. Probst and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stawart (9). Noes:None. Absent:Nona. • A communication from Auditor and Assessor F. J. Croll Under date of May 28th, 1913, in which he appointed E. Mayrisch as Deputy Auditor and G. W. Christensen, Deputy Assessor, which communication was read at the Council meeting of June 3rd, 1913, was called up by the Clerk for action. Mr. Probst moved that the appointment of Mr. Mayrisch as Deputy Auditor be confirmed, seconded by Mr. Hammond and carried by the following vote:- Ayes: Councilmen, Bartlett, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (8). Mr. Pr,..lpst moved that the appointment of Mr. Christensen as Deputy Assessor be confirmed seconded by Mr. Hammond and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9). A communication was read from the Pacific Coast Borax Company, under date of June 5th, 1913, in which the Company agreed to comply with certain conditions imposed by the Council regarding a Permit that had been granted the Company to bore a well in the street adjoining its Plant at the west end. Ordered filed. A communication was read from the Board of Electricity under date of June 13th, 1913, in which notice was given that it had the words "Fire Alarm" placed on electrolier globes nearest all the fire alarm boxes in the city. Ordered filed. communication was read from the Board of Electricity undrr date of June 13th, 1913, submittingspecial rates for electric sign lighting and recommending that the same be adopted. Mr. Bullock moved that the matter be referred to the Utilitipq Committp.A. seconded by Mr. Morris and (-tarried. 136 June 17th, 1913. communication was read from R. Postel under date of June 6th, 1913, asking that his liquor license at 1413 Park Street be transferred to Henry Naber and Charles Naber. Mr. Morgenstern moved that the matter be referred to the LicenSe Committee, seconded by Mr. Hammond and carried. The Clerk announced that he was in possession of a number of applications for liquor licenses that had been filed with him. Mr. Stewart moved that the applications be referred to the License Committee, seconded b:.; Mr. Morris and carried. A:communication was read from R. B. Tappan, City Justice, under date of June 17th, 1913, which the writer suggested that the Council enact an Ordinance authorizing the Chief of Police to destroy all liquors taken from persons arrested for selling liquor without a license. Mr. Bartlett moved that the matter be referred to the License Committee, seconded by Mr. Hammond and carried. Communications protesting against proposed consolidation of the office of Building Inspector and Department of Building Inspection with that of the Santary Inspector, as designed in an Ordinance introduced by Mr. Stewart- June 3rd, 1913, were read from the following:- Henry H. Meyers, Architect; Communication signed by sixteen Alameda builders and firms; Alameda Improvement Club; W. Dufour, Architect; and Chas. V. Neal, a property owner . Ordered filed, communication was read from the Bay Shore Club, Arthur T. Murdock Secretary, under date of J11310 llth, 101'.1, in which permission was asked by the Club to shoot blue rocks on Sunlay mornings, between .9 a. m. and 12 m. from the rear platform of the Club House at the south end of Ninth Street. Mr. Morgenstern moved that the matter be referred to the Police, Fire and Water Committee of the Council, seconded by Yr. Hammond and carried. A communication was read from Geo. A. Lank, of 1305 Pacific Avenue, asking for permission to connect two house sewers with one street connection at 1719 and 1723 Bay Street. Mr. Hammond mood that the matter he referred to the Board of Health, seconded by Yr. Probst and carried. An aeplication for position as gardener of the parks andplaygrounds was read from Simon V:inkler of 1098 Versailles Avenue. A like application was received from A. Delucki of Palace Court. Mr. Bullock moved that both be referred to the Park and Playground Committee, seconded by Mr. Hammond and carried. = A communication was read from the East End Improvement Club under date ne 10th, 1913, which request was made that the City Attorney obtain from the Oakland Traction Company. the time and place where the school chil- dren of this city could purchase two and one-half cent fare tickets. Follow- ing the reading of the communication by the Clerk. the City Attorney explained that he already had the matter inhand and was in conference with the Oakland Traction Company. The communication was ordered filed. 4 A communication under date of June 17th, 1913 from the Board of Police and Fire Commissioners was read, in which the attention of the Council was called to the damage done the auto fire engine of the city in collision with June 17th, 1913. asked several automobile concerns to submit bids for the repair of the engine. Mr. Probst .1fter stating that the matter was one of emergency moved that the Board of Police and Fire Commissioner be authorized to proceed and have the engine re- paired, seconded b;“ Mr. Hammond and carried by the following vote:- Ayes:Council- men Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9). Noes:None. Absent:None. The Clerk announced the reception of three sealed bids. Mr. MacRae moved that the bids be opened, seconded by Mr. Bullock and carried. Noes:None. Absent:None. A communication was read from Councilman F. H. Bartlett, addressed to Mayor -Frank Otis, under date of June 17th, 1913, in which Mr. Bartlett tendered his resignation as a member and Chairman of the Park and Playground. Committee of the Council and giving his reason for resigning the fact that he had been elected Ohairman of the Finance Committee of the Council and that it would be impossible for him to devote the necessary time to the work of the Park and Playground Committee. Mr. Morgenstern moved that the resignation be accepted, seconded by Mr. Roth and carried. ( A communication was read from Brainard. C. Brown, under date of June 17th, 1913 in which comment was made on proceedings of the Council relative to the refusal of the CoUncil to pay a bill for an automobile delivered to the City by the Osen and Hunter Auto Company. Ordered filed. A communication was read from the Alameda Chamber of Commerce under date of June 14th, 1913, in which protest was made against the work being done by the San Francisca Bridge Company in throwing up dykes and filling in marsh land ad- jacent to the iebster Street roadway, it being alleged in the communication that the work would create unsanitary and unsightly conditions and would depreciate the value of property in that vicinity. Mr. Hammond moved that the matter be re- ferred to the Public Utilities Committee, seconded by Mr. Probst and carried. -A A communication was read from the Alameda Chamber of Commerce under date of June 17th, 1913, in which the Council was requested to take immediate steps toward providing money to repair and rebuild some of the principal thoroughfares of the city. Mr. Morgenstern moved that the matter be referred to the Committee of the whole, seconded by Mr. Stewart and carried. A communication from H. M. Parry ,,Company of n Francisco,, in which an offer was made to lay floor in tennis court at Lincoln Park was referred to the Park and Playground Committee. A protest, under date of June llth, 1913, presented by F. M. Driesbach of the Zenith Mil]. and Lumber Company of Oakland against the enforcement of Sub-divi- 1 8 June 17th, 1913. communication from David Ungar, 16 Clement Street, San Francisco, under date of June 15th, 1913, in which compliant was made against alleged unsanitary and unsafe conditions at the premises known as 2008 Encinal Avenue, this city, was on motion of Mr. Hammond, seconded bz, Mr. Roth referred to the Police, Fire and. Water Committee. A communication from Chas. L. Pryal. in which he outlined a plan for the city to obtain water from local wells was on motion of Mr. Probst second- ed by Mr. Bullock referred to the Police, Fire and water Committee. A communication was read from d. A. S. Nicholson of 2003 Pacific Avenue under date of June 16th, 1913, in which complaint was made of the failure of the Southern Pacific Company to inaugurate service on its cross town line by June 1st 1913, and urging that immediate action be taken to obtain the service desired. Mr. Bartlett moved that the City Clerk be directed to make complaint to the State Railroad Commission of the failure of the Southern Pacific Company to institute service on the Eighth street cross town line, seconded by Mr. Roth and carried. On motion of Mr. Morgenstern, seconded by Mr. Stewart, the Clerk was di- rected to notify Mr. Nicholson of the action taken by the Council with re- gard to his complaint. \ A communication under date of June 17th, 1913, was read from Will C. Wood, Superintendent of Schools, in which he asked for permission to leave the State for a period beginning June 2lst, 1913 and ending August 3rd, 1913. Mr. Bullock moved that the desired permission be granted, seconded by Mr. Morgenstern and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9). Noes:None. Absent:None. A communication from the Park and Playground Committee under date of June 10th, 1913 was read, in which announcement was made of the appointment by the Committee of Samuel Orr as a gardener at a salary of Sr 0.00 per month, dating from June 10th, 1913. Mr. Probst moved that the appointment be con- firmed, seconded by Mr. Bullock and carried by the following vote:- Ayes: Councilmen Bartlett, Bullock Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart,.(9) . Noes:None. Absent:None. The Park and. Playground Committee submitted its estimate for the fiscal year 1913-1914. Mr. Probst moved that the matter be referred to the Finance Committee, seconded by Mr. Roth and carried. An invitation, under date of June 13th, 1913,from the Young People's Educational and Social Society of Alameda to the Mayor and the Council to attend a meeting under the auspices of the Society, June 17th, 1913, was received and the Clerk was directed, on behalf of the Mayor and Council to thank the Society for the same. The Public Utilities Committee submitted a report on the investigation it had made relative to an alleged ,)plan of the Citizen's Rate Payers Pro- testive Association to call an election for the purpose of reducing rates on all public utilities. The Committee disapproved of the plan. The report 3 n June 17 h, 1913. The Public Utilities Committee submitted a report relative to the pro- posed creation of the position of Commissioner of Finance and Revenue of the City. Mr. Hammond moved that the report be approved and filed seconded by Mr. Morgenstern and carried. Mr. Hammond brought up the matter of the resignation of Mr. Bullock as Chairman and member of the Finance Committee and spoke of the valuable services rendered by Mr. Bullock during his six years connection with that Committee. Mr. Hammond moved that a Committee be appointed to prepare a set of ResolutionSof appreciation to be presented to Mr. Bullock, seconded by Mr. Bartlett and carried unanimously. Mayor Otis thereupon appointed Messrs. Hammond, Probst and MacRae as members of the Committee to prepare Resolutions. The Street Committee submitted the following report:- "Alameda, Cal. June 13, 1913. To the Mayor and Council of the City of Alameda. Gentlemen:- In response to the petition of the Bast End Club, your Committee on the opening, paving and bulkheading of the ends of Briggs, Central Liberty, and GarfieldAvenues, respectfully reports as follows: 1st- That the easterly ends of said named Avenues have never been deeded to the City. 2nd- That if said avenues were so deeded it would not be wise for the City to bulkhead the ends until the property owners had constructed bulkheads along their bay frontages on either side of the avenues. Your Committee respectfully suggests that this matter be referred back to the East End Club, asking the Club to secure deeds from the property owners in conformity with the descriptions prepared and delivered to them on June llth, 1913, by the City Engineer. Chas. V. MacRae, Conrad Roth G. d. Stewart." Street Committee. Mr. Bartlett moved that the report be adopted, seconded by Mr. Roth and carried. The License Committee submitted the following report:- 'Alameda, June 13, 1913. To the Honorable the Council of the City of Alameda. Gentlemen: - Kith regard to the communication from the Alameda Dairymen's Association, under date of May 6, 1913, in which request was made that Section 541, Subdivision F of the License Ordinance be amended so as not to apply to substitute wagons which are used at night or when the regular wagons are in the repair shop, your License Committee to which the matter was referred, recommends that the City Attorney be requested to prepare an amAramRrt tn the 1-,inprIp 717-;11 nicani- nes,,A-;+-1^,,e, 140 June 17th, 1913. Mr. Probst moved that the report be adopted, and that the City Attorney be direct- ed to draw up the desired amending Ordinance, seconded by Mr. Hammond and carried. The Police, Pire and Water Committee submitted the following report:- "Alameda, California. June 3rd 1913. To the Honorable the City Council of Alamer'.a, Alameda, California. Gentlemen:- Your Committee appointea to investigate into, and report upon, the matter of -9rovidinz a water-syston :or fire-protection covering the built up quarter of the City in the vicinity of ';iebster Street and the 2,stuary. has to recommend to :Tour honorabae body that the City ngrieer be directed to prepare. and furnish to your committee, plans and estimates for tile installing of an eight-inch water-main with all necessary hydrants and connections, - such main to be laja from the United :]ngineoring WorkScto Webster Street and in 7ebster Street and along the railroad right of way for such distance in and along each as may be requisite to provide fire hydrants within suitable distances from all buildings in that vicinity. These plans and estimates should contemplate a permanent installation which, for the sake of economy and also of immediate protection, may be temporarily connected with the private salt- water fire system of the United Engineering Works,under its previous offer to the City; but which, without the loss of any substantial portion of the material or labor used in making such installation, can be connected with a municipal pumping plant to be located at a convenient point on the Estuary, if the cost of erecting and maintaining such a plant be found not to be prohibitive. Committee." \In connection with the matter the City Engineer submitted an estimate of the cost of pipe line for fire protection, also plan. Mr. Hammond moved that the entire matter be referred to the Committee of the Whole, seconded by Mr. Probst and carried. The Oath of Office of Prank Goldstone. as Deputy Poundmaster was received and ordered filed. The report of Police and Fire Commissioner W. H. L. Hynes on an investigation that he had made of the Fire Department equipment, which report was read at the meeting of June 3rd 1913, was received and ordered filed. ',Mr. Morris offered certain Resolutions directing that inspections and tests be made of the tanks and boilers of engines in the Fire Department and moved their adoption. Mr. Bartlett seconded the motion. Police and Fire Commissioner Al Iath:u explained that the testing had been ordered and was being done. Mr. Morr Juno 17th, 1913. thereupon withdrew his Resolutions. Ordered filed. The Clerk reported that in response to said Notice he was in receipt of two bids. Mr. Hammond moved that the bids be opened, seconded by Mr. Probst and carriec'. Following an examination of the bids by the Street Superintendent and City Attorney, the Streett Superintendent recommended that the bid of J. F. O'Brien be accepted, he being the lowest bidder. Thereupon Mr. Hammond intro- duced the following Resolution and moved its adoption:- WHEREAS, the Council of the City of Alameda did, in open session, on the 17th day of June 1913 publicly open, examine, and declare all sealed proposals or bids for doing the following work in said city, to wit: That a salt-glazed, vitrified, iron stone sewer, six (6) inches in inside diameter, with four-inch "Y"-branches and without house connections, be constructed in Buena Vista Avenue, from-the present manhole at the crossing of Webster Street and Buena Vista Avenue westerly along the center line of Buena.Vista Avenue Three Hundred and seventy-five (375) feet dis- tant thereon. That one (1) new manhole be constructed at the western termination of said line of sewer. That said manhole to be constructed hereunder shall be of brick masonry, with cast iron tops and covers and wight-inch walls and bottoms, in accord- and with "Plan for Brick Manhole" adopted by the Board of Trustees of the City of Alameda, January llth, 1897, and on file in the office of City Clerk of said city, which plan is hereby referred to and made a part here- of. Mr. Probst seconded the motion to adopt the Resolution and it was adopt- ed and passed by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9). In accordance with-the foregoing Resolution the City Engineer presented plans and specifications and thereupon Mr. Probst introduced the following Resolution and moved its adoption:- RESOLVED, that the plans and specifications for the following work to be done and improvement to be made in said City, to wit: The construction of a salt-glazed, vitrified, iron-stone sewer, six (6) inches in inside diameter, with four-inch "Y" branches, and without house connections, in San Jose Avenue, from the present manhole at the crossing of Post Street with said avenue, in a right line to the present manhole at the crossing of Peach Street with said avenue, as prepared by the City Engineer of said City and submitted. this 17th day of June, 1913 be, and the same are hereby adopted as and for the plans and specifications for doing said work. Mr. Probst introduced the following Resolution and moved its adoption:- RESOLVED, that it is the intention of the Council of the Oity of Alameda, to order the following work to be done and improvement to be made in said. City, to wit: That a salt-glazed, vitrified iron-stone sewer, six (6) inches in inside diameter, with four-inch "Y" branches, and without house connections, be con- structed in San Jose Avenue from the present manhole at the crossing of Post 'Street with said avenue, in a right line to the present manhole at the crossing June 17th, 1913. tons heretofore adopted for doing said work and now on file in the office of the City Clerk. The Clerk shall cause this Resolution of Intention to be published twice in the Evening Times Star and. Alameda Daily Argus a daily newspaper published and circulated in said City and hereby designated for that pur- pose by the said Council. The Street Superintendent shall, immediately, cause to be conspicuous- ly posted along the line of said contemplated work and improvement and in front of all the property liable to be assessed, notices of the passage of this Resolution of Intention, in the manner and form required by law. All of the herein proposed work shall be done in pursuance of an act of the Legislature of the State of California designated the Improvement Act of 1911" approved. April 7, 1911. Mr. Morris introduced a Bill entitled "A Bill for Ordinance No. New Series, to Amend Sections 320 and 323 of Chapter V of Ordinance No. 1, New Series, known as the Municipal Code of the City of Alameda approved January 14th, 1913 by Re-enacting said. Sections as mended", which was laid over under the provisions of the Charter. A Bill for an Ordinance designed to create a Recreation Commission to have control an management of the playgrounds and recreation facilities of the city, introduced by Mr. Bartlett May 6th, 1913, was called up by the Clerk. After, discussion of the same by Messrs. Bartlett Bullock, Hammond, Probst and Morgenstern, Mr. Morgenstern moved that the Bill be laid over for further conSideration, seconded by Mr. Hammond and carried. Mr. Morgenstern brought up the matter of a request from the Alameda Dairymen's Association to the Board of Health der date of June 2nd, 1913, that a change be made in the Section of the Milk Ordinance relating to the non-sale of skin milk from regular delivery wagons. Mr. Morgenstern moved that the matter be referred to the Board of Health wth instructions to prepare d submit a draft of the desired amending Ordinance , seconded by Er.
