1914-01-06 Regular CC Minutes82 REGULAR MiETIflG OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, JANUARY 6TH, 1914. The Council convened with Mayor Frank Otis presiding. The roll was called and Councilmen Bartlett, Hammond, MacRae, Morgen- stern, Probst, Roth and Stewart, (7)4 were noted present. Councilmen Bullock and Morris (2) were noted absent. The Minutes of the regular meeting held December 16th, approved as read. Mr. Bartlett introduded the following Resolution and moved its adoption:- RESOLVED, by the Council of the City of Alameda, that there be transferred, as requested by the 3oard of Electricity, from the Electric Light Fund to the Lighting Fund (the latter a subdivision of the General Fund) the sum of 05370.53 (Five Thousand Three Hundred and Seventy and 53/100 Dollars) said sum being an amount equal to the amount of the city lighting bill for the quarter ending September 30, 1913; and the Auditor and Treasurer are hereby authorized to make said transfer upon their books. Mr. Morgenstern seconded the motion to adopt the Resolution and it was passed and adopted by the following vote:- Ayes:Councilmen Bartlett Hammond, Morgenstern, MacRae, Probst, Roth and Stewart, (7). Noes:None. Absent:Councilmen Bullock and Morris,(2). laims against the General Fund amounting to .90; against the Police Fund amounting to 023.90; against the Electric Light Fund amounting to 04936,..27; against the Street Fund amounting to 08- .71; against the Library Fund amounting to ;;1310.82 and against the Recreation Fund amount- ing to 042.77 having been approved and audited by the proper officials were read by the Clerk as follows:- GENERAL FUND. Noes:None. Absent:Councilmen Bullock and Morris (2). A statement was received fron the Auditor showing apportionment of taxes for 1913-1914, made December 19th 1913. Ordered filed. The following report was submitted by the Mayor, the Auditor and the City Clerk:- "Alameda, Jan.6th, 1914. To the Honorable, the Council of the City of Alameda. Gentlemen:- In compliance with Section 8, Article 12 of the Charter of the City of Alameda, the Mayor, the Auditor and the City Clerk together counted the money and, the securities in the City Treasury on Monday,morning, January 5th, 1914, and found the amount of the same then in the possession and under the control of the City Treasurer to be e163,681.01 said amount corresponding correctly with the amount that should be in the City Treasury at the time, as shown by the City Auditor's books. Part of the same amount to wit: 4115,750, was on deposit with banks in Alameda and San Francisco, bearing interest at the rate of two per cent per annum. The renayment of said $115,750 by said banks to the City of Alameda is secured by bonds of the face value of $127,_650, which bonds were on January 5th, 1914, in the custody of the City Treasurer. Respectfully yours, Frank Otis, Mayor. F. J. Croll, Auditor. T. C. Ooughlin, City Clerk." January 6th, 1914. The Poundmaster report for the month of December 1913 was received and filed. The Oath of Office of Walter C. Leigh as City Ohernist was received and filed. An application for a gratuitous license to sell a patented ironing board of his own manufacture was received from C. M. Larkin of 1301 High Street. Mr. Hammond moved that the application be granted, seconded by Mr. Bartlett and carried by the following vote:- Ayes:Councilmen Bartlett Hammond MacRae, Morgenstern, Probst Roth and Stewart (7). Noes:None. Absent:Councilmen Bullock and Morris (2). An application for a gratuitous license tcv,peddle toilet article, etc., was received from J. J. Halpin of 1437 Cottage Street. Mr. Roth moved that the application be granted, seconded by Mt. Stewart and carried by the folleviL ing vote:- Ayes:Councilmen Bartlett Harnond, MacRae, Morgenstern, Probst Roth and Stewart, (7). Noes:None. Absent:Councilmen Bullock and Morris, (2). A communication was received from City Auditor and Assessor F. J. Croll giving notice that during the years 1908 and 1909 a piece of property assessed to the Beadle Company had been doubly assessed. He further stated that the property in question had been sold by the Tax Collector to the City of Alameda under Delinquent Sale No. 48 in 1909 and under Delinquent Sale No. 46 in 1910. In order to cure the error the Auditor and Assessor recommended that the Council direct the Tax Collector to cancel the sales referred to. Mr. Hammond moved that the City Council direct the City Tax Collector to cancel Delinquent Tax Sale No. 48 in 1909 and Delinquent Tax Sale' No. 46 in 1910, seconded by Mr. Bartlett and carried by the follow- ing vote:- Ayes:Councilmen Bartlett, Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7). Noes:None. Absent:Councilmen Bullock and Morris, (2). I A protest signed by about sixty persons against any plan to locate the City Pound at the northerly end of Grand Street was received and filed. A card was received from A. Larsson, 931 Pacific Avenue, asking the Council to take steps to establish a municipal natatorium at the foot of Park Street. Ordered filed. A communication was received from the San anciseo, Oakland Terminal Railways giving notice that the corporation had issued instructions to its street car conductors to discontinue the practice of throwing the stubs of transfer books into Santa Clara Avenue at the High Street terminal. The communication was in reply to a letter sent the San Francisco, Oakland Terminal Railways by the City Clerk, December 18th, 1913, by direction of the City Council. Ordered filed. A communication was received from K. Owyang, Consul-General for China at San Francisco, requesting that the Council disregard verbal pro- test made by Harry Grieg relative to the occupancy by Wing Lee, a Chinese, of certain premises bordering Fernside Boulevard. Ordered filed. '1 A communication was received from the Alaska Packers Association in January 6th, 1914, sewer at present emptying into the basin on the Estuary at the Association's ship yard. Ordered filed. A communication was received from the Commonwealth Club of California asking to be advised of the names of the delegates the city was entitled to send to the Internal Waterways C. gross to be held in San Francisco, January 15th to 17th, 1914. Mr. Hammon0_ moved that the communication be referred to the Mayor, seconded by Mr. Probst and carried. V A communication under date of December 17th, 1913, was received from John de P. Teller of 743 Haight Avenue complaining of local train service of the Southern Pacific Com 'any. Mr. Hammond moved that the communication be referred to the Public Utilities Committee, seconded by Mr. Probst and carried. Communications were received from Ina M. Baird, 1303 Park Street; /Herbert D. Clark, Citizens Bank Building and E. M. Shaw, 1504 Park Street reletive to renewal of in91rance polioles nr City Hall operty. Referred to the Finance Committee. A communication entitled "Water Wells and. Water Distribution" was received from J. E. Breitwiser of 1130 Regent Street. Mr. Stewart moved that the matter be referred to the Public Utilities Committee, seconded by Mr. Hammond and carried. V A communication was received from Charles L. Pryal of 945 Park Street, Alameda asking that the city reduce its rate for electric current. Ordered filed. V A communication was received from Geo. W. Emmons requesting the Council to appropriate the sum of 450.00 toward the expense of the proposed improvement at the south end of Grand. Street. Mr. Bartlett moved that the City appropriate 0450.00 as its share of the expense of the proposed improvement, the appropriation to be taken from the Contingent Fund, second- ed by Mr. Hammond and carried by the following vote:- Ayes:Councilmen Bartlett, Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7). Noes:None. Absent:Councilmen Bullock and Morris, (2). Plans and Specifications for the proposed improvement of Post Office Court were submitted by the City Engineer. Mr. MacRae moved the adoption of the Plans and. Specifications as submitted, seconded by Mr. Probst and carried by the following vote:- Ayes:Councilmen Bartlett, Hanmond MacRae, Morgenstern, Probst, Roth and Stewart, (7). Noes:None. Absent: Councilmen Bullock and Morris, (2). In connection with the proposed improvement of Post Office Court Yr. MacRae brought up the matter of the City improving at its expense a strip of the Court in the rear of the Federal Post Office Building which improvement it was announce the Federal Government would refuse to make. Mr. MacRae moved that the Street Committee and the Street Superintendent obtain from Ransome, Crummey Conipany, who had obtained a contract to improve the remainder of the Court, estimates as to wha would cost the City for improving the strip in question and report their findings back to the Council, seconded by Mr. Probst and carried. 4 January 6th, 1914. A communication was received from Ransome Crummey Company in which it petitioned for permission to regrade construct concrete curbs and pave with an asphalt pavement by private contract, Post Office Court between Park Street and Park Avenue, excepting that portfon fronting on Post Office property. Mr. Hammond moved that the matter be referred to the Street Committee, seconded by Mr. Bartlett and carried. A lunicalion, under date of December 2Oth, 1913, s receed from W. C. Sharpstein relative to the granting of a liquor license at Bay Station. Mr. Hammond noved that the communication be received and filed, seconded b Mr. Bartlett. Mr. Stewart moved to amend by having the com- munication referred to the License Committee, seconded by IIr. MacRae. The vote on the amendment resulted as follows:- Ayes:Councilmen MacRae, .orgen- stern Roth and Stewart, (4). Noes:Councilmen Bartlett, Hammond and Probst, (Z). Absent:Councilmen Bullock and. J The Clerk announced that he had completed the Printing Schedule of blanks, forms books, etc., that may be required by the various departments of the City for the year beginning February 16th, 1914. Mr. Bartlett moved that the same be adopted as the "City's Printing Schedule" for the year beginning February 16th, 1914, seconded by Mr. Hammond and carried by the following vote:- Ayes:Councilmen Bartlett, Hammond, MacRae, Morgenstern Probst, -Roth and Stewart (7). Noes:Uone. Absent:Councilmen Bullock and Morris, (2) . Mr. Bartlett moved that the City Clerk be directed to advertise for bids for doing the city printing, as per City Printing Schedule, for the year beginning February 16th, 1914, seconded by Mr. Hammond and carried by the following vote:- Ayes:Councilmen 3artlett, Hammond MacRae, Morgenstern, Probst, Roth and Stewart, (7). Noes:None. Absent:Councilmen Bullock and Morris, (2). Ir. Bartlett moved that the City Clerk be directed to advertise for bids for doing City advertising for the year beginning February 16th, 1914, seconded by Mr. Hammond and carried by the following vote:- Ayes: Councilmen Bartlett, Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7). A communication, under date of January 6th, 1914, was received from the Board of Electricity relative to the furnishing of free 1. ht by the City to the Armory of Company G, Fifth Infantry, N. G. C. Mr. Probst moved that the communication he referred to the City Attorney with instructions to report back to the Council seconded by Mr. Hammond and carried. A communication was received. from the Board of Alectricity relative to a communication sent by Mayor Hugh Craig of Piedmont to Mayor Frank Otis, in wIlich Mayor Craig asked if it was possible for the City of Alameda to supply electric current for use in Piedmont. The Alectricity Commission stated in its communication that it had carefully considered Mayor Craig letter and decided that it would be impr acticable for the City of Alameda to supply electric current to the City of Piedmont. Order -P41,r1 January h, 1914. A communication wa veceived from the Board_ of Electricity authorizing the Council to transfer the sum of 05370.53 from the Electric Light Puna to the General Fund, the amount being a sum equivalent to the city lighting bill for the quarter endin g September 0th, 1913. The communication was ordered filed, the transfer having /been ordered by Resolution adopted earlier in the meeting. ' A communication was received from the Board. of Alectricity recommending that the electrolier system of street lighting. be ex- tended along the debster Street roadway from Atlantic Avenue to the debster Street bridge, the cost of proposed system to be about 02500. Mr. Stewart moved that the matter be referred to the Public Utilities Committee, seconded by Mr. Morgenstern and carried. - A communication was received from the Board of Electricity relative to the insuring of the employees of the Electric Light Department under the Workmen's Compensation and Safety Act. Mr. Morgenstern moved that the matter be referred to the Finance Committee, seconded bz,- Mr. MacRae and carried. V A communication under date of January 6th, 1914 was received from the Board of Health relative to the dumping of garbage in Peach Street. In conneetion with the same matter the City Attorney sub- mitted copies of two letters that hc? had sent to the Board of Health, one under date of December 6th, 1913 and one under date of January 6th, 1914. Mr. Morgenstern moved that all communications in con- nection with the matter be filed, seconded by Mr. Bartlett and carried. . An Affidavit was presented showing due publication of Notice to Automobile Dealers inviting sealed bids for an automobile tractor to he attached to Hook and Ladder Truck No. 1 of the Fire Department. The Clerk_announced that in response to said Notice he was in receipt . of three bids. Mr. Bartlett moved that the bids be received and opened, seconded by Mr. Hammond and.carried. Thereupon the bids were opened and read by the Clerk as follows:- Park Garage, C2500 and 02800. Not accompanied by a certified check or bond. ance Auto Company, 02900. Accompanied by a certified check in the sum of 0290.00. hite Company, 05385.00 and 03950.00 accompanied by a certified check in the sum of 538.50. Mr. Hammond moved that the bids be referred to the Board of Police and Fire Commissioners to report back to the Council, seconded by Mr. Bartlett and carried. A communication from the City Attorney to Councilman C. W. MacRae Chairman of the Street Commitee, relative to the desired improvement of other streets in connection with the assessment proceedings for the proposed widening of Encinal Avenue was read January 6th, 1914. ( The Health Committee submitted a report in which it recommended that the bid of Louis J. Borie, representing the Metz Motor Cars, to supply the Health Department with one motor driven light roadster for 1525.00 be accepted. Mr. Hammond moved that the report be adopted, that the contract be awarded Louis J. Borie and that the City tttorney be directed to draw up the necessary contract and the Mayor and City Clerk be authorized to sign same on behalf of the City, seconded b: Mr. Bartlett and carried by the following vote:- Ayes:Councilmen Bartlett, Hammond, MacRae, Morgen- stern, Tro)at, Roth and Stewart, (7). Absent:Councilmen Bullock and Morris, (2). \/ A Bill entitled "A Bill for Ordinance No. New Series Astablish- ing the Curb Grade of Fernside Boulevard from Garfield to Briggs Avenue" introduced by Councilman MacRae, December 16th, 1913, came up for nassage and was read by the Clerk. Mr. MacRae moved the adoption of the Ordinance as read seconded by Mr. Stewart and carried by the following vote:- Ayes:- Councilmen Bartle t Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7). Noes:None. Absent:Councilmen Bullock and Morris ( Mr. Stewart introduceda 3111 entitled, "A Bill for Ordinance No. New Series to amend Section 498 of Article 2, Chapter VIII of Ordinance No. 1, New Series, known as the Municipal Code of the City of Alameda, approved January 14, 1913, by re-enacting said section as amended", the same having to do with display of license tag; which was laid over under a provision of the Charter. Mr. MacRae introduced a 3111 entitled "A Bill for Ordinance No. New Series, to Amend Sections 405, 406, 407, 413, 415, 416 and 427 of Article 7, Chapter VI of Ordinance No. 1, New Series, known as the Munici. pal Code of the Oity of Alameda, approved January 14, 1913, (all of said sections relating to the "ublic Pound of said City and to the duties of the Poundmaster" by re-enacting said sections as amended," which was laid over under a provision of the Oharter. Mr. MacRae reported on the matter of the proposed widening of 3ncinal Avenue and moved that the Public Utilities Committee confer with the Southern Pacific Company to ascertain from that corporation What it would be willing lo do in a financial way towards the proposed widening of iJIncinal Avenue, east of Park Avenue, seconded by Mr. Hammond and carried. Mr. Probst brought up the matter of the Southern Pacific stations at Third Street and Pacific Avenue and at Pacific Avenue. . He moved that the Council direct the C1er k to request the Southern Pacific Company to establish a regular station at Third and Pacffic Avenue and to make the station at Pacific Avenue and carried. Mr. Hammond brought up the matter of the delay in the proposed im- provement of the easterly end of Briggs Avenue, for which contract was ded by the City to Hutchinson Company, November 18th, 1913. Mr. Roth moved that the matter be referred to the Street Committee, with instructions a flag station, seconded by Mr. Hammond January 6th, 1914. Mr. Kearney if some arrangement might not be had under which the proposed improvement could be carried out and report back to the Council at its next meeting, seconded by Hr. Stewart and carried. Mr. Morgenstern brought to the attention of the Council the condition of High Street at Fernside 3oulevard and from that point northerly to the Tidal Canal. Mr. HammonCI moved that the matter be referred to the Street Committee to investigate and report back to the Council, seconded by Mr. Probst and carried, / Mr. Stewart and Mr. MacRae of the License Committee submitted a report signedtv their relating to the liquor license granted on December 16th, 1913 toll. A. Borchert for No. 1205 Lincoln Avenue. Mr. Stewart asked that the Clerk read the report which the Clerk did. Following the reading of the report Mr. Stewart moved its adoption, seconded by Mr. MacRae. Mr. Bartlett and Mr. Hammond took exceptions to portions of the report which they de- clared were unjust to the City Clerk. The report was adopted without roll call. Mayor Otis gave notice that he had invited County Surveyor Perry A. Haviland to deliver an address in the Council Chamber on the evening of January 20t., 1914 on the proposed estuary subway between this City and Oakland. Mayor Otis also announced that he had invited Secretary A. A. Denison of the Oakland Chamber of Commerce to be present on that occasion. The Clerk was directed to issue invitations on behalf of the Council to the members of the various Improvement Clubs and civic organizations to be present on the evoning 0± January 20th, in the Council Chamber, and hear the address given by Mr. Haviland. There being no further business to transact the Council adjourned until its next regular meeting time, Tuesday evening, January 20th, 1914 at 7:30 o'clock. -5 /11--- City Clerk.
