1914-01-20 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF .LAMBDA TUESDAY EVENING, JANUARY 20TH, 1914. The Council convened with Mayor Frank Otis presiding. The roll was called and Councilmen MacRae, Morgenstern, Morris, Roth and Stewart, (5) were noted present. Councilmen Bartlett, Bullock, Hammond and Probst, (4) were noted absent. The Minutes of the regular meeting held January Gth, 1914 were approved as read. During the reading of the Minutes Councilmen Bartlett, Bullock aMmond and. Probst arrived and were noted present. Councilmen Bull eh b o ght up the matter of the report of the License Committee takinj option to certain remarks made in the report and moved that the Clerk be given an opportunity to answer the accusations made, second- ed h. Hammond and carried. Thereupon the City Clerk presented a communi- cation in his on behalf and Councilman Morgenstern moved to defer considera- tion until after County Surveyor Haviland had macle his address on the propos- ed subway under the estuarj, seconded by Mr. Stewart. Whereupon Councilman Bullock moved to amend the motion by ordering the Clerk's communication filed, seconded by Mr. Hammond and lost by the following vote:- Ayes:Conncilner Bartlett, Bullock, Hammond and Prollet, (4) . roes:Corrcilmen MacRae, Morgen- stern, Morris, Roth and Stewart, (5). The chair declared the motion lost and called for a roll call on the original motion ch was carried by the following vote:- Ayes:Councilmen MacRae, Morgenstern, Morris Roth and Stewart, (5). Noes:Councilmen Bartlett, Bullock, Hammond and Probst 4. Absent:None. Noes;None. Absent:None. / The Auditor's Balance sheet for the month ending December 31st was received and filed. The semi-annual report of the Fire Department submitted by the Police and Fire Commission was received and ordered. filed. The semi-annual report of the Police Department for the period ending December 31st, 1913, submitted by the Police and Fire Commission was received and ordered filed. , A communication was received from the Police and Fire Commission stating that the Commission had math thorough tests and inspected the auto fire engine, as contracted for with the Waterous &igine Company of St. Paul, Minnesota and found that it met with all the requirements as set forth in the specifica- tions and contract and recommended that the City Council purchase the same. Mr. Morris moved that the City purchase the auto fire engine, seconded by Mr. Bartlett and carried the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, lVIaoRae, Morgenstern Morris, t3robst, Roth and Stewart Noes:None. Absent:None. A communication was received from the Industrial Accident Board of the January 20th, 1914. 1 Several communications were received regarding the Fire insurance on:the City Hall-and contents from various agents of Insurance Companies. Mr. Bartlett moved that they be referred to the Finance Committee, Second- ed by Mr. Probst and carried. V A Deed, properly recorded, from Edwin B. Robinson to the City of Alameda conveying a strip of land forty by two hundred and fifty feet, and known as Palm Street adjoining Aishington Park on the west, was received. Mr. Bartlett moved that the Deed be referred to the City Attorney for 7-11_ approval seconded Mr. Enrond arA earried. A communication was received from the Street Superintendent stating that at various times he had notified Mr. John Robertson, owner of the property on the southwest corner of Lafayette Street an Encinal Avenue to repair his sidewalk. V A communication was received from the Southern Pacific Company referring to the proposed stations at Third Street and Pacific Avenue and at Pacific Avenue. Ordered filed. A communication was received from J. M. Cohen of 1453 Sixth Street suggesting that the Southern Pacific Company enclose the south side of the Alameda mole by .erecting a fence to keep off the strong winds and rains from persons boarding the trains. Also complaining of the inconvenience of having to walk through mud puddles at the pier. Mr. Hammond moved that the matter be referred to the Public Utilities Committee, seconded b! Mr. Bullock and carried. v7 Two communication were received,one from the Universal Engineering Company and the other from the Morse Engineering Company regarding garbage incinerators. Mr. Probst moved that they be referred to the Health Committee seconded by Mr. Bartlett and carried. A comnunication was received from the League of California Municipali- ties requesting the attendance of the Mayor, Cit • Council and officials of the City of Alameda at a meeting to be held in the chambers of the Board. of Supervisors of San Francisco on February 12th, 1914 at 10:30 a. m. for the purpose of organizing a Bay cities branch of said League. Order- ed filed. v/ A supplemental report on the improvement of Briggs Avenue was received from the City Attorney and ordered filed. / A Bill for Ordinance No. New Sores, to Amend Section 498 of Article 2, Chapter VIII of Ordinance No. 1, New Series, known asthe Muni- cipal Code of the City of Alameda, Approved January 14, 1913, by re-enact- ing said section as amended, having to do with the display of License Tags, introduced by Mr. Stewart at the meeting of January 6th, 1914 came up for final passage. Mr. Probst moved that the Ordinance lay over until the meeting of March 17th, for final passage, seconded by Mr. Stewart and carried. VA Bill for Ordinance No. New Series, to Amend Sections 405, 406, 407, 413, 415, 416 amd 427 of Article 7, Chapter VI of Ordinance No. 1, New Series, known as the Municipal Code of the City ofAlameda approved. Januar:: 14, 1913, (all of said sections relating to the Public Pound of said. City and to the duties of the Poundmaster), by re-enacting said sections as amended, introduced by Mr. MacRae, January 6th, 1914, came up for final passage. Mr. Probst moved that the Ordinance be laid on the table, seconded by Mr. Bullock and carried. At this stage of the meeting a recess was taken to hear the remarks of County Surveyor Haviland. and. Mt. Tibbitts on the proposed subway under the estuary. Mayor Otis called upon Messrs. Kelly, Haviland and Tibbitts for remarks regarding the matter. At the conclusion of their remarks Council- man Morgenstern moved that a vote of thanks be extended to Messrs. Haviland and Tibbitts for their interesting talk, seconded by Mr. Morris and carried. Mayor Otis at this time called upon A. A. Denison, Secretary of the Oakland Chamber of Commerce for a few remarks.. The Council reconvened with all members present. I The Clerk brought up the report on the proposed natatorium submitted by a Special Committee appointed by the Mayor. Mr. Hammond moved that the report be filed with the understanding that an advisory vote be obtained from the people at the next election, provising an estimate of the cost could be obtained, seconded by Mr. Bartlett. Mr. Bullock moved to amend by adopting the report, seconded b:T Mr. Hammond. The vote on the amendment resulted as follows:- Ayes:Councilmen Bartlett, Bullock Hammond, Probst and Roth, (5). Noes:Councilmen MacRae, Morgenstern, Morris and Stewart, (4), Absent:None. Mr. Bullock brought up the matter of the danger due to the Southern Pacific Company's unguarded high tension wires in the city and moved that the City Attorney be directed to take the matter up with the Southern Pacific Companyrequesting the Company to provide proper safe guards seconded by Mr. Morris and carried. Mr. Bartlett, Chairman of the Public Utilities Committee reported 61; January 20th, 1914. pay to the City two per cent of its gross receipts yearly. Mr. Bartlett moved that the City Attorney be directed to draw up the necessary papers under the Broughton Act advertising for bids for the sale of the franchise and that the Clerk be directed to advertise for bids, seconded by Mr. Bullock and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond MacRae Morgenstern, Morris, Probst, Roth and Stewart, (9). Noes:None. Absent:None. Mr. Bartlett brought up the matter of the hydrant service and the refusal of the Peoples Water Company to remedy the conditions in this City and moved that the City Attorney be directed to prepare a formal complaint and file same with the Railroad. Commission of the State of California, seconded by Mr. Hammond and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9). Ndes:None. Absent:None. v/ Mr. Bullbck brought up the matter of the proposed fire protection for the factory district at the north end of debster Street. Mr. Probst moved that the Clerk be directed to communicate with the Police and Fire Commissioners requesting them to take immediate action in the matter as the money had been provided in the Fire budget for the necessary improvement, seconded by Mr. Hammond and carried. / Mr. Bartlett spoke of the poor ventilation in the Committee room and moved that the Public Buildings and Grounds Committee be empowered to put in ventilators, seconded 1) Mr. Probst and carried by the following Ayes:Councilmen Bartlett Bullock, Hammond, MacRae, Morgenstern Morris Probst, Roth and Stewart, (9). Noes:None. Absent:None. Mr. MacRae brought up the matter of the improvement of Post Office Court, the strip in question being in the rear of the federal post office building and stated tba+ +be Ransome-Crummey Company would do the work for the sum of 400.00. Mr. Probst moved that the work be done by the City, the money to be taken from the Contingent und, seconded by Mr. Hammond and carried by the following vote:- Ayes: Councilmen Bartlett, Bullock Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, 9). Noes:None. Absent:None. /7 Mr. Probst again brought up the matter of the proposed new station at Third Street and. Pacific Avenue on the Southern Pacific Company electric line and moved that the City Clerk communicate with the Southern Pacific Company stating that it was the sense of the City Council and to the satisfaction of the residents in the immediate vicinity that the station be established at Third Street and Pacific Avenue and make Pacific Avenue a flag station only, seconde(' by Mr. Bullock and carried. C. Coughlin he, and he hereby is, removed from the office of City Oierk of the City of .1eda, and that the said office of City Clerk be, and the same hereby is, declared vacant. Mr. MacRae seconded that motion to adopt the Resolution. After a general debate in which the Mayor and Council participated, the Resolution was adopted by the following vote:- Ayes:Councilmen MacRae, Morgenstern, Morris, Roth and Stewart, (5).
