TUESDAY EVENING, APRIL 213T, 1914.
The meeting convened with Mayor Frank Otis presiding.
The roll was called and Councilmen Bartlett, MacRae, Morgenstern
Morris, Probst, Roth and Stewart, (7) were noted present. Quorum
present. Councilman Bullock arrived later and was noted present.
Absent :Councilman Hammond.
The Minutes of the previous meeting were read and approved.
Claims against the General Fund amounting to 0318.38; against
the Police Fund amounting to c360.49: against the Fire Fund amount-
ing to 01338.12 and against the Street Fund amounting to 01500.72
having been approved and audited by the proper officials were read
by the Clerk as follows:-

v' From Mayor Frank Otis announcing the appointment of Herman
Krusi as member of the 3oard of Electricity. Mr. Probst moved that
the appointment be confirmed, seconded by Mr. Morgenstern and carried
by the following vote:- Ayes; Councilmen Bartlett, Bullock, MacRae,
Morgenstern, Morris, Probst, Roth and 3tewart, (8). Noes:None.

of the Board of ;Iducation to succeed J. 3. Lanktree. Mr. Bullock
moved that the communication be filed and action suspended for two
weeks, seconded by Mr. Roth and carried by the following vote:

Trustees stating that all Insurance Companies holding policies
coverfng the Library had eaid their rebate. Ordered filed.
V From the Alameda Civic League, in which they condemn the
action taken by the Council and request the suspension of City
Attorney Poorman. Ordered filed.
v" From the Alameda Chamber of Commerce in the matter of
cleaning streets, sidewalks, etc. Referred to the Street
Committee.
From the City engineer regarding the bids of the Dorward Pump
Company and the Simonds Machinery Company.
Ordered filed.
V From the City Engineer and Street Superintendent on the matter
of providing fire protection in the factory district. Upon motion
of Mr. Probst seconded. by Mr. Bullock and duly carried the report
was adopted. Appended thereto were the amended Specifications and
Plans providing for the fire protection pipe line in said district.
Mr. Prohst moved that the specifications be adopted and that the
Clerk advertise for bids, seconded Mr. Morris and carried by the
following vote:- Ayes:Councilmen Bartlett, Bullock, MacRae, Morg
stern, Morris, Probst Roth and Stewart (V). Noes:None. Absent:

From the Street Committee statins that the bid. of the Powell Bros.
Constriction Company was the lowest for the construction of the sea wall
along 3ay Island Avenue. Mr. Stewart moved that the report be adopted and
the Powell Bros. Construction Company To awarded the contract, seconded by
Mr. Bullock and carried by the following vote: OS: Councilmen Bartlett,
Bullock, MacRae

e' Er. Roth thereupon bronght un the matter of completing the wall
easterly to Park Street. Mr. J. A. Powell was celled upon and asked if
the work could be completed at the time that the work :for the first portion
of the sea wall was beine done. He answered that it could be. City
Attorney Poorman stated, however, that bids for the same would have to be
advertised for, and suggested that the City ingineer draw the Plans and.
Specifications therefor. Later in the evening these were submitted by
Mr. Sutton. Mr. MacRae moved that they be adopted and the Clerk advertise
for bids, seconded by Hr. Probst and carried by the following vote:
Ayes:Councilmen Bartlett, Bullock, MacRae, Morgenstern, Morris, Probst,
Roih and Stewart, (8). Noes:None. Absent:Councilmar Hammond, (1).
J From the Jardine Machinery Company, in which they offered to sell
the City a bitumen plant. Referred to the Street Committee,
From the Recreation Commission renornmenriirta that the bid of the
Powell Bros. Construction Company for the building of a sea wall on the
southerly side of lashington Park be accepted. Mr. ?robst moved that the
report be adopted and the the Contract be awarded to the Powell Bros.
Construction Company, seconded by Mr. Morgenstern and carried by the follow-
ing vote:Ayes:Councilmen Bartlett, Bullock, MacRae, Morgenstern, Morris,
Probst, Roth and Stewart, (8). Noes:None. Absent:Councilman Hbmmond (1).
v, From the Recreation Commission recommending that the bid of
Pronosition "C" of the forward Pump Company for instellin,e. a water supply
system in Jackson Park be accepted. Mr. Pro-bet moved that the report be
adopted, and the contract for the same he awarded to the forward Pump
Company, seconded by Mr. Morgenstern and carried by the following vote:
Ayes: Cou ilmer Bartlett, Bullock, MacRae, Morgenstern, Morris, Probst
Roth and Stewart, . Noes:None. Absent:Councilman Hammond (1).
/From the Recreation Commission recommending that the bid of Proposition
of the forward Pump Company for installing a water supply system in
Vlashington Park be accepted. Hr. Probst moved that the report he adopted
and that the contract be awarded to the forward Pump Company, seconded
by Mr. Morgenstern and carried by the following vote: es:Couneilmen
Bartlett, Bullock, MacRae, Morgenstern, Morris, Probst, Roth and Stewart,
(8) . Noes:None. Absent : Councilman Hammond, (1).
V From Mrs. C. A. Knudsen and other residing in the vieinity of
Fifth Street and. Santa Clara Avenue, petitioning the Council to declare
April 21, 1914.
Avenue and Fifth Street a nuisance. Ordered filed.
"From the Street Committee submitting a report on the above,
in which they recommended that the trees he declared a nuisance
and that the Street Superintendent order the owner to remove them
within thirty days. Mr. Probst moved that the report be adopted,
seconded by Mr. Roth and duly carried. Mr. Probst thereupon moved
that the trees be declared a nuisance, seconded by Mr. Roth and
carried.
v/ From C. L. Colvin requesting come action against the nuisance
caused by the stable on ncinalAvenue, between Park and Oak Streets.
Referred to the Board of Health to abate the nuisance.
V From Mayer Frank Otis calling attention of the Council to
a letter received by him from J. C. McPherson of the Southern Pacific
Company of the matter of the improvement of High Street, between
Fernside Boulevard and the High Street Bridge. Mr. Probst moved
that the City Clerk be directed to write to the 3oard of Supervisors
and again request them to contrt k a bulkhead on the south side of
the High Street bridge,and also that City Attorney Poorman look
into the law covering the imporement of High Street, between Fern-
side Boulevard and the bridge, seconded bz,- Mr. Stewart and duly
carried. Ap-7ended to the above communication was a statement of
the Street Superintendent covering the matter.
I/ From Howard K. James requesting that some action be taken
to correct the numbering of the houses in Alameda. Referred to
the Building Inspector.
From the City Engineer and Street Superintendent on the
matter of the mud on the south shore of Alarrec,a. Referred to the
Public Utilities Committee.
/From F. J. Croll requesting an assistant in his office for
abont two months at a salary of .50.00 per month. Mr. Probst'
moved that the request be granted, seconded by Mr. Bartlett and
carried bz: the following vote:- Ayes:Councilmen Bartlett, Bullock,-
MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (8). Noes:
None. Absent:Councilman Hammond, (1).
V From the Harbor Advisory Board reporting on the conclusions
arrived at by them. Mr. Probst moved that the report lay over
until the next meeting, seconded by Mr. Morgenstern and duly carried.
V From C. J. Du Four, Secretary of the Board of .1;ducation, on
the matter of the leasing of a lot adjoining the Porter School.
Ordered filed.
Mr. Bartlett introduced the following Resolution and moved its
adoption:
WHERI1S, it appears that the term of that certin lease entered
into by C. G. Powell and Laura _Powell, his wife, with the City of
Alameda under date of the 5th day of February, A. D. 1912, and
April 21 , 1914.
WHIMS , it further a:'ears that the space trilab for 1a: at
Jhe roller School of said City of Alame('a is inadequate and that
the owner of said lot of land adjoining said Porter School and de-
scribed as follows, to wit:-
All that certain piece or parcel of land lying and being in
the City of Alameda, County of Alameda, State of California, bound-
ed and described as follows, to wit:-
Commencing at a point on the northerly line of Encinal Avenue
(as said Avenue now exists since the widening thereof to eighty
(80) feet, distant thereon three hundred and fifty (350) feet
westerly from the westerly line of Oak Street; running thence
westerly along said line of elncinal Avenue one hundred (100) feet;
thence at r ht angles northerly one hundred and forty (140) feet;
thence at right angles easterlyone hundred (100) feet, and thence
at right angles southerly one hundred and forty (140) feet to said

numbered one (1) and two (° ), (less ten (10 feet taken for the

Alameda County.
Has offered to lease the same to the sqld City of Alameda; now
therefore be it
R'ESOLVED City of-Alameda enter into a lease with
Leah F. Mott
owner of the said lot if land, for the term of
two years from and after the first day of April, A. D. 1914, to the
first day of April A. D. 1916, at the sum or rental of three hundred
and sixty (360) dollars per annum, said rental to be payable in
equal monthly installments at the end of each calendar month of
said term; and he it further
RESOLVED, that said lease be entered into only upon condition
that the said owner of said real property enter into an agreement
with the City of Alameda that said City of •Llameda may, at any
time during the term of said lease, purchase the said lot of land
therein described for the sum of Forty-five hundred (4500) Dollars
in Gold Coin of the United States, and that said agreement cohtain
a covenant upon the part of the said owner of the said lot of land
to convey the same to said City of Alameda, free and clear of all
liens and encumbrances of whatsoever nature, upon the exercise of
such option to purchase by the City of Alameda and the tender to
the said owner of said sum of Forty-five hundred (4500) dollars;
and be it further
RESOLVED, that the Mayor of the City of Alameda be, and he

Mr. Probst seconded the motion to adopt the Resolution and
it was passed and adopted by the following vote:- Ayes:Council-

/From the Street Committee recommending that the sand blast
sis made by Fred Bank of Alameda he used and that three hun-
dred of them be purchases at a cost of ;1.40 each. Mr. Roth mov-
ed that the report headopted, seconded by Mr. Bullock and carried

The Specifications for the construction of a cement sid-
walk on Walrnt Street and Clement Avenue were ordered filed.
/ Mr. Moreno tern moved that Maslin he re-annointed a
member of the Board of Library Trustees to succeed himself,- second-
ed by. Mr, .:lerris and carried b the followinr- vote:- Ayes:

Mr. Roth moved that Dr. J. L. Riley be re-ppointed a member
of the Board of Health to succeed himself, seconded by Mr. Bullock
and carried by the followinp, vote:- yes: Councilmen Bartlett,
Bullock, MacRae, Morgenstern, Morris, Drobst, Roth. and Stewart,
(8). Noes:None. Absent:Councilman Hammond, (1).
v/ A Bill for an Ordinance entitled "A 3111 for Ordinance No.
New Series, Declaring Insanitary Buildings, Structures or parts
thereof, nuisances and providing for the abatement thereof" came up
for passage. The Clerk read the same in its amended form- Upon
motion of Mr. Bullock, seconded by Mr. Morgenstern it was adapted
as amended by the followinr-vote:- Ayes: Councilmen Bartlett,
Bullock, MacRae, Morgenstern Morris, Probst, Roth and Stewart,
(8). Noes:None. Absent:Councilman Hammond (1).
City Attorney Doorman called attention to the fact that the
words "inmediately"
used in Section 5 of said Ordinance should
be changed to "promptly". Mr. Bullock moved that the Ordinance
with these chanr-'es be adopted, seconded by Mr. Stewart and carried

Affidavit was presented showing clue publication of
Notice to D lers in Refreshments. ; .deredfiled. The Clerk re-
ported that in response to said Notice he was in receipt of two
bids. Mr. Probst moved that the bids be opened and read, seconded
by Mr. Bartlett and duly carried. The Clerk thereupon opened and
read the bids as follows:_

Upon motion of Mr. Probst seconded by Mr. Morgenstern and duly carried
the bids were referred to the Recreation Commission.
" The matter of dicussion of the Telephone Franchise came before
the Council. Mr. Bartlett moved that the matter be taken up in the next
Committee meetinp: of the hole, instead of on Friday eveninc:, April 24th
as previously arraned, seconded by Mr. Probst 'and carried.
A Bill for an Ordinance entitled "A Bill for Ordinance No.
New Series, to 4mena Section 203 of Article VII, Oha,)ter IV of Ordinance.
No. 1, New Series, known as the Municipal Code of the City of Alameda,
approved January 14th, 1913,
having to do with the drivin near stand-
ing street cars came up for passage. Mr. Probst moved that the Ordi-
nance be adopted, seconded by Mr. Bartlett and carried by the following
vote:- Ayes:Councilmen Bartlett, Bullock, MacRae, MOrgensternan.

Mr. Bullock moved that the CLerk notify the Alameda Improvement
Club of the present status the pi1in of manure on lots and the haul
ing of the same through the streets of the City, seconded by Mr. .
Stewart and duly carried.
Mr. Bullock also moved that the Clerk advertise for bids for the
unsned safe in the Treasurer's office, seconded by Mr. Morgenstern
and carried by the following vote: Ayes:Councilmen Bartlett, Bullock,
MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (8) . Nees.:
None. Absent:Councilman Hammond, (1).
Mr. Roth brought up the matter of alterations in the Clerks office
and upon motion of Mr. Stewart seconded by Mr. Morris and duly earried
it was referred to the Public Buildiivs and Grounds Committee.
Mr. Probst brought up. the matter of installing the standard
electroliers on Webster Street where the old style are at present
used. Upon motion of Mr. Probst, seconded by Mr. Bartlett and duly
carried, it was referred to the Electric Light Commission to investigate
and see if the desired change can be made.
Mr. Probst brought up the matter of electric lights in the
waiting om at Webster Street. and Lincoln Avenue, Alto the lack
of a waiting room at Fifth Street nd Lincoln Avenue and he moved
that the Clerk communicate with the Southern Pacific Company to
request them to make the desired improvements, seconded by Mr.
Bullock and duly carried.
There being no further business to transact the Council
adjourned until it next meeting time Tuesday evening, May
5th, 1914, at 7:30 o'clock.
