1914-10-06 Regular CC MinutesREGULAR MEEETING OF THE COUNCIL OF TID CI Y OF ALAMEDA TUESDAY EVENING, OCTOBER 6TH, 1914. The meeting convened with Mayor Prank Otis presiding. The roll was called and Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, and Morris, (6) were noted present. Councilman Probst arrived later and was noted present. Absent :Councilmen Roth and Stewart, (2). The Minutes of the regular meeting of September 15th, 1914 were approv- ed as read. The Minutes of the special meeting of September 23rd,1914 were approved as read. 1 Mr. Morgenstern introduced the following Resolution and moved its adoption: - WHEREAS, there remains to be collected as taxes on personal property, the sum of One thousand and twenty -one and 57/100 (1021.57) Dollars, which represents the excess in tax rate for the year 1914 -1915 over the year 1913 -1914; and, whereas, the cost and uncertainty will not warrant the collection of said taxes. RESOLVED, that the Tax Collector be, and he is hereby authorized to omit said collection, and the Auditor is hereby directed to disre- gard said taxes in his settlement with said Tax Collector. Mr. Bullock seconded the motion to adopt the Resolution and it was passed and adopted by the following vote: - Ayes :Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris and Probst, (7). Noes:None. Absent :Councilmen Roth and Stewart, (2). 2 Mr. Morgenstern introduced the following Resolution and moved its adoption: RESOLVED, by the Council of the City of Alameda, that there be transferred from the account of F. J. Croll, Assessor, Four Thousand, two hundred and eight and 83/100 Dollars, (04208.83) Dollars, being for Personal Property Taxes collected by the Assessor for the year 1914, the same are hereby transferred and apportioned to the several funds as follows, to wit: General Fund. ................. Absent: Councilmen Roth and Stewart, (2). 3 Mr. Morgenstern introduced the following Resolution and moved its adoption : - RESOLVED, by the Council of the City of Alameda that there be transferred from the General Fund to the Police Pension Fund the sun of Nine Hundred and 00/100 October 6th, 1914. Ur. Morris seconded the motion to adopt the Resolution and it was passed and adopted by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris and Probst, (7). Noes:None. Absent:Councilmen Roth and Stewart, (2). ,..- Mr. Morgenstern introduced the following Resolution and moved its adoption:- RESOLVED, by the council of the City of Alameda, that there be transferred from the Electric Light Fund to the Interest and Redemption Fund, the sum of Nine hundred and fifty-six and 25/100 (956.25) Dollars to pay the Interest due October 1st, 1914 on Electric Light Bonds authorized in 1908. The Auditor and the Treasurer are hereby authorized to make the said transfer upon their respective books. Mr. Bullock seconded the motion to adopt the Resolution and it was passed and adopted by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris and Probst, (7). The following communications were received; From Mayor Frank Otis, containing a number of suggestions made to him, received during "Suggestion Week". Referred to the next Committee of the Whole Meeting. From Mayor Prank Otis recommending the construction of a driveway on the west side of the City Hall from Santa Clara Avenue to the rear of the lot. Referred to the Public Buildings and Grounds Committee. From Mayor Frank Otis and Councilmen Bartlett, Chairman of the Public Utilities Committee reporting on an interview had with the Telephone Company on the telephone franchise. Mr. Bartlett moved that the report be adopted, seconded by Mr. Hammond and duly carried. From the Mayor,Auditor,and City Clerk, stating that the regular count of money in the TReasury had been made on September 21st, 1914. Ordered filed. From the North Side Improvement Club asking whether the expenditure of the proposed issue of $200,000 upon land which the city already owns would be in compliance with the conditions of the grant. Referred to the City Attorney for an opinion. I ) October 6th 1914. 7 From the Police and Fire Commission stating that in thier opinion the janitor service of the police office should be handled and cared for by the regular janitor of the City Hall. M. Frodden, Street Superintendent, recommending that the Council order the sidewalk in front of the property of Mrs. Cohen on the south side of Taylor Avenue at the southwest corner of Eighth Street be laid under public contract. Mr. MacRae moved that the re- commendation be adopted, seconded by Mr. Morgenstern and duly carried. Mr. Probst moved, that the City Attorney draw up the necessary Resolution for the same, seconded by Mr. MacRae and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hawond, MacRae, Morgenstern, Morris and Probst, (7). Noes:None. Ab ent:Councilmen Roth and Stewart, (2). 13 From V. H. Frodden, Street Superintendent, recommending that two water carts owned by the Street Department be sold. Mr. Morgenstern moved that the Clerk advertise an auction sale for the same, seconded by Mr. MacRae and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Horiss and Probst, (7). Frodden, Street Superintendent, reporting that the work of constructing a sewer on the west side of Webster Street, from the Borth Side Sewer northerly, three thousand, one hundred and twenty nine feet, done by the Ransome-Crummey Company, had been completed to his satisfaction. Ordered filed. 15 From V. M. Frodden, Street Superintendent, reporting that the work of constructing a bulkhead across the end of Garfield Avenue, done by Hume, Clark and Frederick, had been completed to his satis- faction. Ordered filed. 16 From V. E. Frodden, Street Superintendent, reporting that the work of constructing the bulkhead across the easterly end of Liberty Avenue done by Hume, Clark and Frederick, had been completed to his satisfaction. Ordered filed. 17 From Edward Angelle Allen, protesting against abolishing the city electrical store. Ordered filed. 18 From Paul Leon for a gratuitous license to peddle tamales and enchiladas, and from C. E. Masoh for a gratuitous license to peddle silverware. Both having been endorsed by John Conrad, Chief of Police, they were granted upon motion of Mr. Morris, seconded by Mr. Bartlett and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris and Probst, (7). Noes: None. Absent:Councilmen Roth and Stewart, (2). 19 From A. Feldhamer and others requesting the withholding of the Freeholders' Election until the close of the Exposition. Ordered filed. 20 2rom Councilmen Hammond, Bartlett, ?robst and Bullock, recommending a reduction in the commercial lighting and power rates. Mr. Hammond moved that the recommendation be adopted, seconded by Mr. Bullock and carried by the following vote:- Ayes:Councilmen October 6th, 1914. Mr. Hammond moved that a copy be sent to the Electric Light Commission with a statement of the Council's action thereont,secnded by Mr. Bart- lett and carried. 21 V From G. F. Utley, and other residents of north Broadway, re- questing that a sidewalk be placed on the east side of Broadway, be- tween Clement Avenue and Eagle Avenue and on the west side of Broad- way near Clement Avenue. Referred to the Street Committee and the Street Superintendent to report back at the next regular meeting of the Council. 22 V From O. D. Stoesser, President of the California Apple Show enclosing season passes for the Mayor and members of the City Council. Mr. Bartlett moved that the same be accepted and that the Clerk, on behalf of the Council, thank the sender for them, seconded by Mr. Hammond and duly carried. 23 From the Library Board, accompanied by a communication from the California Library Association, in which request is made, that the local Library place an exhibit at the Panama-Pacific Exposition. A written opinion from City Attorney Poorman accompanied the above, in which he states that the Charter does not permit of expenditures for such purposes. The communications were ordered filed and the Clerk instructed to inform the Library Trustees of the City Attorney's opinion. 24 From the Street Committee recommending that the Street Super- intendent be authorized to have Pacific Avenue, between Bryant Street and the Borax Works put in fair condition, provided, that the Borax Company pay one-half of the cost. Mr. Hammond moved that the report be adopted, seconded by Mr. Probst and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris and Probst, (7). Noes:None. Absent:Councilmen Roth and Stewart, (2). 25 Copies of Quitclaim Deeds to Agnes L. Fischer, J. H. Bruns, Fischer-Straub Company, (2), G. B. Devincenzi and Helen H. Goodwin were presented and ordered filed. Mayor Otis stated that these had been executed in accordance with a Resolution authorizing the Mayor and City Clerk to do so, which Resolution was passed by the Couhcilo August 18th, 1914. Mr. Hammond moved that the Council ratify the action, seconded by Mr. Bartlett and carried. 26 7Tr. Morgenstern called the at'ention to the need of a bulkhead on the south side of the Schumacher property and desired some quick action taken. City Attorney Poorman explained that the District Attornw had taken the matter up and was pressing it as quickly as could be done under the circumstances. 27 I Hammond also spoke of the need of filling in back of the bulkhead on the south shore of Bay Island Avenue. The matter was referred to the Street Committee to report back at the next regular October 6th, 1914. 28 Mr. Bullock called attention to the fact that oil had appeared on the surface of the water in the vicinity of the south end of Pam Street. The Clerk was instructed to notify the Board of Health and the Fish and Game Commission. 29 flr. Bullock also spoke of the condition of an abandoned sewer at the south end of Paru Street. The matter was referred to the Street Superintendent to remove the old pipes and piles. The Street Superintendent was also in- structed to investigate the condition of the beaches with a view of cleaning them of all objectionable matter and to report back to the Council. 30 The Clerk inquired as to how many Councilmen desired copies of the budget. Mr. Bullock moved, seconded by Mr. Bartlett and carried that copies be made for each of the Councilmen and the heads of the departments. 31 Mayor Otis called attention to the fact that no contract was forthcom- ing from the Cohens for the improvement of High Street as agreed by them, but that Mr. Jordan, their Attorney, had stated that within a short time the same would be presented. Mr. Probst moved that the Clerk communicate with Mr. Jordan, informing him that if the work was not started by the next regular meeting of the Council, that body will take the necessary steps according to law to compel the Cohens to pave High Street according to the original plans and specification, required an asphaltic concrete pavement, seconded by Mr. Hammond, and carried. 32 Lir, Morgenstern called attention to the fact that rebates can now be made in Districts Nos. 6, 7 and 8 and moved that the Auditor make the necessary arrangements for the rebates and that he be allowed a sum not to exceed 50.00 for each District, for the necessary clerical help, seconded by Mr. Hammond and carried by the following vote:- Ayes: Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris d Probst, (7). Noes:None. Absent:Councilmen Roth and Stewart, (2). :Ir. Morgenstern also stated that owing to the Charter prohibition against the giving of money for certain uses, it was impossible for the City to make the '25.00 donation to the Baby Hospital Association as reouested by them. The Clerk was instructed to notify the Body of that fact. Mr. MacRae introduced the following Resolution and moved its adoption:- RESOLVED, that whereas the Council of the City of Alameda did on the 18th day of August, 1914, pass its Resolution of Intention No. 17, New Series, to order the hereinafter described work to be done and improvement to be made in said Citv, which Resolution of Intention was duly and le- gally published as required by law, as appears from the affidavit of Frank Brown now on file in the office of the city clerk of said city; and whereas, notices of the passage of said Resolution of Intention No. 17, New Series headed "Notice of Im- provement" were duly and legally poS,ed along the line of said contemplated work and im- provement and in front of all the property liable to be assessed therefor, in form and Tanner as required by law, immediately October 6th, 1914. of said notices, forthwith filed said affidavit in the office of the city clerk, making oath that he completed the filing of said notices on the 22nd day of August 1914; and whereas, more than fifteen days has expired since the day of the second publication of said Resolution of Intention No. 17, New Series, and the completion of the posting of said "Notices of Improvement" therefore be it RESOLVED, that the public interest and convenience require the work herein de- scribed, and the Council of the City of Alameda hereby orders the following work to be done in said city, to wit: That a six inch, vitrified, iron stone sewer, with 4 inch Y branches and 4 inch house connections, be constructed along the center line of Madison Street in a right line from the existing man- hole in the crossing of Mound street with Madison street to a manhole to be constructed at a point two hundred and thirty-four (234) feet westerly there- from. That said manhole to be constructed hereunder shall be of brick masonry, with cast iron tops and covers and and eight inch wall and bottom, in accordance with "Plan for Brick Man- hole" adopted by the Board of Trustees of the City of Alameda, January llth, 1897, and on file in the office of the City Clerk of said city, which plan is hereby referred to and made a part here- of. That the entire width of said Madison street, from the westerly line of Mond street to a line parallel therewith and distant two hundred and nine and eight- hundredths (209.08) feet westerly there- from, be graded to the official grade; that concrete curbing, eight inches by fourteen inches in cross section dimen- sion, be constructed along the curb lines of said street between said limits; that concrete gutters, of the "flat" pattern, three (3) feet in width and six (6) inches in thickness , be constructed along the road :y side of and contiguous to said curbing; that the remaining portion of the roadway, between said limits, be macadamized with a layer of broken trap rock, eight inches in thickness. All of said work shall be done in accord- ance with the plans and specifications heretofore adopted for doing said work and now on file in the office of the City Clerk. The City Clerk is hereby directed to post a notice of said work, together with the plans and specifications therefor, conspicuously for five days on or near the council chamber door, inviting sealed proposals or bids for doing the work ordered. He is also di- rected to publish a notice inviting such proposals, and referred to the specifications posted or on file, in the Evening Times Star and Alameda Daily Argus, a daly news- paper published and circulated in said city, and hereby designated for that purp6se. Mr. Hammond seconded the motion to adopt the Resolution and it was passed and adopted by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris and 2robst Noes:None. Absent:Councilmen Roth and Stewart, (2). Mr. Morgenstern spoke of the needed improvement of Park Street at the south end. The matter was referred to the Street Committee to report 34 October 6th, 1914. Mr. Probst stated that the School Department was willing that the school houses be used as polling places for the purpose of the Freeholders' election . 35 iir. Hammond moved that a recess be taken to take up the matter of the Ordinance providing for the Freeholders' Election, seconded by Mr. Bartlett and carried. Upon reconvening Councilmen Bartle t Bullock, Hammond, MacRae, Morgenstern, Morris and Probst, (7) were noted present. Councilmen Roth and Stewart, (2) were noted absent. 36 /, Mr. Hammond introduced a Bill entitled,,"A Bill for Ordinance No. , New Series, calling and providing for a special election in and for the City of Alameda, County of Alameda, State of California, to be held in said City on Saturday, the 21st day of Novembe A. D. 1914, for the purpose of electing a Board of Fifteen Freeholders, w c5-duties it shall be to prepare and propose a new charter for said City of Alameda, pursuant to the provisions of, and in the manner provided by the Constitution of the State of California; establishing the election precincts and designating the polling places therein for such election, and the names of election officers for each such precinct, and appointing such election officers, and proclaiming uch election and providing for giving notice thereof, " which was laid over under a provision of the Charter. 37 Ur. Morgenstern called attention to the bad condition of Encinal Avenue, between Park Avenue and Broadway and asked that a proper report as to the rights of the city in the same be made to the Council. The matter was referred to the Street perintendent and City Attorney and to the City Engineer.
