TUESDAY EVENING, OCTOBER 20TH, 1914,
The meeting convened with Mayor Frank Otis presiding.
The Roll was called and Councilmen Bullock, MacRae, Morgenstern,
Morris and Probst, (5) were noted present. Councilmen Bartlett,
Hammond, Roth and Stewart, (4) were noted absent.
The Minutes of the regular meeting of October 6th were approved
as read.
The Minutes of the adjourned regular meeting of October 14th were
approved as read.
v Mr. Jordan, on behalf of the Cohens, addressed the Council
and asked for a further extension of time on the improvement of High
Street. He stated that Mr. Cohen had not yet returned to Alameda
and he was therefore unable to present the contract for the improvement
of that street as agreed upon. The matter was laid over for another two
weeks.
2 / A communication was received from the City Attorney, in which he
stated that the case of Emilie G. Cohen, vs. the City of Alameda
had been finally decided by the Supreme Court of the State of California
in favor of the municipality and that the remittitur therein has been
duly filed. Ordered filed.
Mr. Morgenstern introduced the following Resolution and moved its
adoption:-
RESOLVED, by the council of the City
of Alameda, that the sum of Three
thousand, six hundred and eighteen
and 00/100 (3618.00) Dollars be, and
the same is hereby transferred from
the General Fund to the Electric Light
Fund, being portion of premium on Bonds
of 1910, less cost, due the Electric Light
Fund, as agreed upon by the Finance Com-
mittee; and the Auditor and the Treasurer
are hereby authorized to make the said
transfer upon their respective books.
Mr. Bullock seconded by the motion to adopt the Resolution and it
was passed and adopted by the following vote:- Ayes:Councilmen Bullock,
MacRae, Morgenstern, Morris and Probst, (5). Noe :None. Absent:Council
men Bartlett, Hammond, Roth and Stewart, (4).
Claims against the General Fund amounting to 02378.12; against the
Police Fund amounting to 0'91.41 and against the Fire Fund amounting to
)660.57 having been approved and audited by the proper officials were
read by the Clerk as follows:-

A copy of the corrected budget for 1914-1915. Ordered filed.
The following communications were received:-
From A. Latham, President of the Police and Fire Commission
requesting the Council to erect a suitable garage at the rear of the
City Hall to house the Fire Chief's automobile. Referred to the
t?ublic Buildings and Grounds Committee to prepare plans and specifi-
cations and to report back at the next meeting of the Council.
From A. Latham, President of the Police and Fire Commission
requesting the Council to advertise for bids for a combination chemi-
cal and hose wagon. Referred to the Police and Fire Commission and
to the Police, Fire and Water Committee to provide the necessary
specifications and to report back at the next meeting of the Council.
The Affidavit of Publication of Notice Inviting Sealed Proposals
for the improvement and severing of Liadison Street and the affidavit
of posting of the Notices Inviting Sealed Froposais for the improvement
of ;,Tadison Street were presented and ordered filed. The Clerk report-
ed that in response thereto he was in receipt of one bid. ;Jr. Morgen-
stern moved that
the Clerk open and read the bid, seconded by Mr.
Probst and carried. The Clerk theca opened and read the bid as
follows:-

check in the sum of :150.00, offereing to do the work at the following
rates:-
For 40 cents per cubic yard.
For macadamizing,............ 7 cents per square foot.

The bid was referred to City Engineer Sutton to determine if the
same was a reasonable one. After investirtion he reported that it
was and thereupon Mr. Morgenstern introduced the following Resolution
and moved its adoption:-
WHEREAS, the Council of the City
of Alameda did, in open session, on
the 20th day of October, 1914, public
ly open, examine, and declare all
sealed proposals or bids for doing
the following work in said city, to
wit:
That a six inch, vitrified, iron stone
sewer, with 4 inch Y branches and 4
inch house connections, be constructed
along the center line of Madison Street
in a right line from the existing man-
hole in the crossing of Mound Street
with Uadison street to a manhole to be
constructed at a point two hundred and
thirty-four (234) feet westerly there-
from.
That said manhole to be constructed
hereunder shall be of brick masonry,
with cast iron tops and covers and
eight inch wall and bottom, in accord-
ance with "Plan for Brick Manhole"
adopted by the Board of Trustees of
the City of Alameda January llth,
October 20th, 1914.
That the entire width of said Madison
street, from the westerly line of
Mound Street to a line parallel there-
with and distant two hundred and nine
and eight-hundredths (209.08) feet
westerly therefrom, be graded to the
official grade; that concrete curbing,
eight inches by fourteen inches in
cross section dimension, be constructed
along the curb lines of said street be-
tween said limits; that concrete gutters,
of the "flat" pattern, three (3) feet
in width and six (6) inches in thickness,
be constructed along the roadway side
of and contiguous to said curbing; that
the remaining portion of the roadway,
between said limits be macadamized with a
layer of broken trap rock, eight inches
in thickness.
RESOLVED, that the said Council hereby
rejects all of said proposals or bids
except that next herein mentioned, and
hereby awards the construct for doing
said work and improvement to the lowest
responsible bidder, to wit: Powell
Bros. Construction Company at the prices
named in their bid. The city clerk is
hereby directed to post notice of this
award conspicuously for five days, on or
near the chamber door of the said Council
and also publish said notice by two in-
sertions in the Evening Times Star and
Alameda Daily Argus, a daily newspaper
published and circulated in said city,
and hereby designated for that purpose
by said Council.
Mr. MacRae seconded the motion to adopt the Resolution and
it was passed and adopted by the following vote:- Ayes:Councilmen
Bullock, MacRae, Morgenstern, Morris, and Probst, (5). Noes:None.
Absent:Councilmen Bartlett, Hammond, Roth and Stewart, (4).
V From C. J. DuFour, Secretary of the Board of Education,
requesting the Council to place signs in the vicinity of various
school houses containing the words "School, Drive Slow". Mr.
Morgenstern moved that the matter be referred to the Street Com-
mittee with power to act, seconded by Mr. Probst and carried by the
following vote:- Ayes :Councilmen Bullock, MacRae, Morgenstern,
Morris and Probst, (5). Noes:None. Absent: Councilmen Bartlett
Hammond, Roth and Stewart, (4).
From the Alameda Chamber of Commerce presenting two Reso-
lutions, one providing for the calling of a bond election for short
term bonds to the amount of 100,000 for the improvement of streets,
and the other urging the Council to abate the sewer nuisance at the
Alaska Packers Association Plant. Referred to the next Committee
of the Whole meeting.
10 From Vi. P. Robinson, asking permission to remove a one-
story frame building now located at 631 Santa Clara Avenue to a
lot on the north side of Santa Clara Avenue, three hundred and
five feet and eight inches west of Fifth Street. The same was
accompanied by petitions signed by persons living in the vicinity
giving their consent to the change. Mr. Probst moved that the matter
be referred to the Street Committee with power to act, seconded by

11 From the Public Service Bureau. of Berkeley, stating that
they were in the field for drafting vc.rious documents needed by
municipalities. Ordered filed.
12 , Deeds from R. C. Hillen and Myra Hillen conveying to the
City of Alameda strips of land at the foot of Liberty Avenue and
Garfield Avenue were presented and ordered filed.
13 - Mr. Morgenstern introduced the following Resolution and
moved its adoption:-
RESOLVED, by the council of the City
of Alameda, that there be rebated to
the property wners in Electrolier
Districts Nos. 6, 7 and 8 for the
frontage as paid by them upon the
original assessment books on file in
the office of the City Treasurer, the
expended balances
From Local Improvement No. 783, the
sum of 0,632.54; From Local Improvement
Fund No. 784, the sum of 35,224.68;
From Local Improvement No.786, the sum
of 36,358.45 and the rate of rebate
is hereby fixed and determined as
follows:-

per front foot as assessed therein, and
the Auditor is hereby authorized to pre-
pare and issue to the persons entitled
thereto his warrant qnd the Treasurer to

Mr. Probst seconded the motion to adopt the Resolution and
it was passed and adopted by the following vote:- Ayes:Councilmen
Bullock, MacRae, Morgenstern, Morris and Probst, (5). Noes:None.
Absent:Councilmen Bartlett, Hammond, Roth and Stewart, (4).
Mr. MacRae introduced the following Resolution and moved
its adoption:-
RESOLUTION REFERRING WORK TO CITY ENGINEER.
Whereas, in the opinion of the City Council,
the public interest and convenience require
that the southerly side of Taylor Avenue, in
the City of Alameda, from the westerly line
of 8th Street, in said city, to a point Three
Hundred and twenty (320) feet westerly there-
from be improved as follows:
That a cement sidewalk five (5) feet in width
and three (3) inches in depth be constructed,
the center line of said walk to be six and
one-half (6i) feet southerly from the northerly
face of the curb in place on the southerly curb
line of said Taylor Avenue; and that proceed-
ings for said work and improvement be conducted
in accordance with the terms of an act of the
Legislature of the State of California known
as the "Local Improvement Act of 1901";
Now, therefore, be it resolved, that said
proposed work is hereby referred to the City
Engineer of the City of Alameda, who is here-
by instructed to make to the City Council a
report in writing, containing his recommenda-
tions as to the best method of doing said work
and of making said improvement, to which said
report he is instructed to attaching the follow-
ing exhibits:
1. A description of the work to be done.
2. A dembription of the exterior boundaries
of the district which will be benefited by the
proposed improvement and should be specially
assessed to pay the cost thereof;

4. An estimate of the expense of said
improvement, deducting therefrom the
estimated cost of so much, if any, of said
improvement as may be by law required to
be done by railroads having tracks upon the
streets affected;
5. A map showing the district above re-
ferred to, and also the subdivisions of the
property within said district, as ascertain-
ed by said Engineer, each of which subdivisions
shall be given upon said map a separate number
in red ink;
6. A list referring to the said subdivisions
upon said map by the respective red ink numbers
thereof, and showing the names of the owners
if known, otherwise designating them as unknown,
and the valuations of said respective subdi-
visions, as the same appear upon the last
assessment roll of said municipality, if they
so appear, otherwise as estimated by said. Engi-
neer, also the dimensions, areas, and his
estimates of the benefits which the respective
parcels will receive from said improvement;
7. An estimate of all incidental expenses
likely to be incurred in connection with the
work, such as clerical, engineering, inspection,
printing and advertising.
Mr. Morris seconded the motion to adopt the Resolution and it
was passed and adopted by the following vote:-

The City Engineer thereupon presented the plans and specifications
for the improvanent, whereupon Mr. EacRae introduced the following
Resolution and moved its adoption:-
RESOLUTION ADOPTING REPORT OF CITY MIGINEER.
Whereas, the City Engineer of the City
of Alameda did on the 20th day of October,
A. D. 1914, pursuant to Resolution No.
18, New Series, of this Council, file with
the City Clerk his report in writing con-
taining his recommendations as to the
best method of doing the work and making
the improvement referred to in said reso-
lution, and described in said report as
follows, to wit:
That the southerly side of Taylor Avenue
in the City of Alameda, from the westerly
line of 8th Street, in said city, to a
point Three Hundred and twenty (320) feet
westerly therefrom be improved as follows:
That a cement sidewalk five (5) feet in
width and three (3) inches in depth be
constructed, the center line of said walk to
be six and one-half (6-1.) feet southerly
from the northerly face of the curb in place
on the southerly curb line of said Taylor
Avenue; and
That said work be done in all respects in
accordance with the plans, profiles, cross-
sections and specifications therefor pre-
pared by the City Engineer of the City of
Alameda, marked Exhibit 3, and annexed to his
report to the City Council as to the best
method of doing said work and making said
improvement; and also in pursuance of an
act of the Legislature of the State of Cali
fornia known as the "Local Improvement Act
of 1901"; and
Whereas, the City Council has considered
said report;
Now, therefore, be it resolved, that said
report as filed by said City Engineer be,
and the same is hereby- adopted! and an
October 20th, 1914.
of the district benefited by said improve-
ment contained in Exhibt 5 attached to said
report, each of which subdivisions is given
upon said map a separate number in red ink,
in and to the amount of the benefits which
each of said lots will receive from said
improvement, which amounts are estimated and
set forth in Exhibit 6 attached to said re-
port, which estimated are hereby adopted as
and determined to be the amounts of benefits
such lots will receive respectively from said
improvement,and which district is hereinafter
described, but said assessment shall not con-
stitute a lien upon the property until all
persons interested have had an opportunity
to be heard, as hereinafter provided.
And this Council hereby determines:
1. That the rate of interest to be charged
upon deferred payments shall be seven per cent
per annum.
2. That the time to be allowed upon deferred
payments shall be nine years, said payments to
be made in ten yearly installments, the first
of which shall be paid at the time an agree-
ment for such Payments is filed, and the others
annually thereafter.
3. That the rate of interest to be allowed
upon bonds issued to cover deferred payments
shall be seven per cent per annum.
4. That the time for which bonds issued to
cover deferred payments are to run shall be
nine years from the date of issuance.
5. That the 1st day of December, L. D. 1914,
at the hour of 7:30 o'clock P. M., at the
Council Chamber of the City Hall of the City
of Alameda, at the northwest corner of Santa
Clara Avenue and Oak Street in said City of
Alameda, be, and the same are hereby fixed
as the time and place when and where any and all
persons may appear before this Council to show
cause, if any they have, why said improvement
provided for in said report and in this reso-
lution should not be carried out in accordance
herewith:
6. That the following is a description of
the exterior boundaries of the district hereby
declared by the City Council to be benefited
by the proposed improvement and to be assessed
to pay the costs and expenses thereof:
All that certain parcel of land situate in the
City of Alameda, County of Alameda, State of
California, described as follows:
Beginning at the intersection of the westerly
line of 8th street with the southerly line of
Taylor Avenue; thence westerly along the south-
erly line of Taylor Avenue Three Hundred and
twenty (320) feet; thence southerly and parallel
with the westerly line of 8th Street One Hundred
and thirty-eight and 35/100 (138.35) feet; thence
easterly and parallel with the southerly line of
Taylor Avenue Three Hundred and twenty (320) feet
to the westerly line of bth Street; thence northerly
along said westerly line of 8th Street One hundred
and thirty-eight and 35/100 (138.35) feet to point
of beginning.
7. The City Clerk is hereby directed to post
conspicuously in three of the most public places
within the City of Alameda, and also along the
street frontages of all the real property within
the district herein described, at not more than
One Hundred feet in distance apart, notices of
the hearing herein provided for. Said notices
shall be headed "Notice of Local Improvement"
in letters of not less than one inch in length,
and shall in legible characters state the fact of
the passage of this resolution, and briefly de-
scribe the work of improvement proposed, and
refer to this resolution for further particulars;
said notice shall also state the date, hour and
place for which the hearing provided for has been
set, and shall notify all parties interested in
any real estate within the limits of said dis-

a description of the district covered by
this resolution by the exterior boundaries
thereof, said description to be in bold-faced
type; said notice shall be posted at least
twenty days before the time set for the
hearing; and the said City Clerk is further
directed to publish said notice twice in
"The Evening Times-Star and Alameda Daily
Argus", a daily nev;spaper printed, published
and circulated in the.City of Alameda and
hereby designated for the purpose, at least
ten days before the date of hearing.
Mr. Morgenstern seconded the motion to adopt the Resolution
and it was passed and adopted by the following vote:- Ayes:Council
men Bullock, MacRae, Morgenstern, Morris and Probst, (5). Noes:
None. Absent:Councilmen Bartlett Hammond, Roth and Stewart, (4).
14 Mayor Otis called attention to the Attorney General's opinion
on fines received through violation of the speed ordinances and
asked City Attorney Poorman if he had received any information on
the same. Kr. Poorman replied that he had not, but that he would
look in to the matter.
15 Mayor Otis reported that he had a communication from City
Attorney Poorman in which the latter gives an outline of the
Berkeley and Oakland franchises and a few points of the proposed
Alameda franchise. The matter was referred to the next Committee
of the Whole meeting, for discussion.
Reports from the Street Committee were received as follows:-
16 That the Street Superintendent be instructed to notify the
owners at the north end of Broadway to lay sidewalks in front of
their property. On motion of Mr. MacRae, seconded by Mr. Probst and
carried the report was adopted.

That the Street Superintendent is putting in a filling of
rock surfacing across Crist Street at the corner of Regent Street.
Upon motion of Mr. MacRae, seconded by Mr. Morris and carried the
report was adopted.
18 That the improvement of Pacific Avenue as requested by the
!'acific Borax Compamy is being done with the co-operation of that
organization, they agreeing to pay half the expenses. ar. MacRae
moved that the report be adopted, seconded by Mr. Probst and carried.
That the portion back of the Bay Island liven-1.1e bulkhead
is being filled in by the depositing thereon street sweepings and that
not money is available at the present time to do the filling in any
other way. The report was ordered filed.
20 That the widening of Blqnding Avenue from Park Street to
Pearl Street was in the hands of the City Planning Commission, who
will submit a report later on. The report vms acdered filed.
There being no further business ;otransact the Council adjourned
to meet Wednesday evening, November 4th, 1914 at 7:30 o'clock, as
Tuesday, November 3rd, 1914 is q legal holiday.
