ALAMEDA, TUESDAY EVENING, MARCH 30TH, 1915.
The meeting convened with Mayor Frank Otis presiding.
The roll was called and Councilmen Bartlett, Bullock, Hammond
MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9) were
noted present. Quroum present. Absent:None.
Mr. Morgenstern introduced the following Resolution and moved
its adoption:
RESOLUTION TRANSFERRING 4600.00 FROM THE
GENERAL FUND (CONTINGENT ) TO THE GENERAL
FUND (FIRE) .
RESOLVED, by the Council of the City of
Alameda, that there be transferred from
the General Fund (Contingent) to the
General Fund (Fire), the sum of Six Hun-
dred (600.00) Dollars to be added to the
$5,000.00 for the purchase of the two
automobile chassis for the Fire Department.
The Auditot is hereby authorized to make
said transfer upon his books.
Mr. Bullock seconded the motion to adopt the Resolution and it
was passed and adopted by the following vote:- Ayes:Councilmen
Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Probst,
Roth and Stewart Noes:None. Absent:ITone.
Claims against the General Fund amounting to 0264.44; against
the Police Fund amounting to 18.35; and against the Recreation Com-
mission amounting to 02006.05 having been approved and audited by the
proper officials were read by the Clerk as follows:-

The following were received:
1. The Affidavit of Publication of the Proclamation calling the
General Municipal Election. Ordered filed.
2. A profit sharing coupon of the Ford Motor Company coverinF the "T"
roadster purchased by the _Police Department. Ordered filed.
The application of P. Leon to peddle tamales and enchiladas.
Endorsed and recommended by John Conrad, Chief of Police. Mr. Bartlett
moved that the free license be granted, seconded by Mr. Haamond and carried
by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, 1:acRae
Morgenstern, Morris, Probst, Roth and Stewart, (9). Noes:None. Absent:None.
The following communications were received:
• From the Oklahoma Panama Exposition Tent City requesting permission
to erect a tent city on Blocks B and H of the Oak Park Tract. The same bore
the endorsement of E. C. Maillot, Sanitary Building Inspector, After some
discussion on the application, Mr. Stewart moved that permission be granted
seconded by Mr. Roth. Mr. Hammond offered a substitute motion that the
matter be referred to the Committee of the 'Mole and parties interested be
invited to attend, the understand being that the Tent City Company would
seel,c another location, seconded by Mr. Probst and carried by the following
vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, 1,7.acRae, Morgenstern,
Probst and Roth, (7). Noes:Councilmen itorris and Stewart, (2). Absent:
None.
5. From the Police and Fire Commission recommending the purchase of two
pa
. automobile chassis from the Cuyler Lee Company. Mr. Morris moved
that the recommendation be adopted, seconded by Mr. Hammond and carried hy
the following vote:- Aye ouncilmen Bartlett, Bullock, Hammond, IiiacRae,
Morgenstern, Morris, Probst, Roth and Stewart, (9). Noe :None. Absent:
None.

Library Trustees to take effect on Larch 26th, 1915. Mr. Probst
moved that the resignation be accepted, seconded by Mr. Morris
and carried by the following vote:- Ayes:Councilmen Bartlett,
Bullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and.
Stewart, (9). Mayor Otis took occassion to state that Mr. Hawks
while a member of the Board gave freely of his time and effort to
the work required of him; that Mr. Hawks had shown excellent
judgment in matters pertaining to the welfare of the Library; that
he had inconvenienced himself on numerous occasions in order that
the work of the Library would not be hampered by his non-attendance;
that in resigning from the Board, that Body has lost a most efficient
and helpful worker, Councilman Hammond moved that Mayor Otis'
remarks be spre ad. upon the minutes, seconded by Mr. Bartlett and
carried. Mr. Probst thereupon moved that Dr. H. A. Miller be
appointed to fill the unexpired term of Hr. Hawks seconded by
Mr. Dorris and carried by the following vote:- Ayes:Ctuncilmen
Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris Probst,
Roth and. Stewart, (9). Noes:None. Absent:None.
.// From the California Ripe Olive Day Association of San
Francisco, inviting the Council to participate in the ceremonies
at the Exposition on March 31st, 1915. Mr. Morgenstern moved
that the invitation be accepted, seconded by Mr. Probst and
carried.
From the City Planning Commission giving a supplementary
report on the lands to be taken for the opening of Atlantic
Boulevard. Referred to the next Committee of the Whole meeting.
9. A Bill for Ordinance entitled.
A BILL
FOR ORDINANCE NO. NEW SERIES.
Prescribing the manner in which any person,
firm, Company or Corporation owning and operat-
ing any Steam, Electric or Street Railway within
the City of Alameda shall pave those portions
of Streets which they are required by law to
pave and keep in repair, and providing a penalty
for violation of provisions thereof,
came uo for passage, Mr. Poorman suggested that the word "how" as
the title origihally read be stricken out and the words "the manner
in which" be substituted therefor. Mr. Morgenstern moved that
the title be so amended, seconded by Mr. Bullock and carried. Mr.
W. R. Alberger of the San Francisco, Oakland. Terminal Railways
addressed the Council on the subject matter of the Ordinance and
requested a delay so that he might have time to carefully study
it. He stated further that at the present time his Company was
unable to meet the expense required if the Ordinance passed. On
motion of Mr. Hammond, seconded by Mr. Bartlett and carried the
matter was laid over until April 20th, 1915.

To amend Section 541, Chapter VIII of Ordinance
No. 1, New Series, known as the Municipal Code
of the City of Alameda, Approved. January 14,
1913, by re-enacting said section as amended,
came up for passage and was read by the Clerk. Mr. Probst moved that
Subdivision A, eliminating the license tax on automobiles carrying
passengers for hire., commonly known as the jitney bus, be adopted,
seconded by Ur. Bullock and carried. Mr. Probst thereupon moved
that the Ordinance as amended be adopted, seconded by Mr. Bullock
and carried by the following vote:- Ayes:Councilmen Bartlett,
Bullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and
Stewart, (9). Noes:None, Absent:None.

Establishing and Providing for the Regula-
tion of the business of using, operating
and driving automobiles for hire upon the
public streets of the City of Alameda; for
the licensing of the same; repealing all
ordinances, or parts of ordinances, in
conflict herewith, and providing a penalty
for the violation hereof,
was presented and laid over under a provision of the Charter0

Determining Water Rates and fixing the Com-
pensation for water furnished for private and
public purposes in the City of Alameda during
the year comiencing July 1, 1915, and ending
June 30, 19169
came up for passage and was read by the Clerk, Mr. Morgenstern
moved that the Ordinance be adopted, seconded by Mr. Bullock and
carried by the following vote:- Ayes:Councilmen Bartlett, Bullock,
Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9).
Noes:None. Absent :None,
11. Mr. Morgenstern called attention to the need of concrete curb-
ing along San Jose Avenue, between the two portions of Park Avenue
and moved that Q100.00 be allowed for the same, and that the Street
Superintendent have power to act in the manner, seconded by Mr. Bart let
and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock,
Hammond, MacRae,- Morgenstern, Morris, Probst, Roth and Stewart, (9).
Noes:None. Absent:None.
12. / Mr. Bartlett moved that 05.00 be allowed the Street Department
to purchase garbage cans to be placed at the polling piaces at election
times, seconded by Mr. Hammond and carried by the following vote:-
Ayes:Councilmen Bartlett, Bullock, Hammond, MacRe, Morgenstern,
Horris, Probst, Roth and Stewart, (9). Noes:None. Absent :None.
13. Mr. Probst stated that the Western Union Telegraph Company
was charging an extra toll for the delivery of messages west of

14. Mr. Morgenstern stated that the Recreation Commission de-
sired to be allowed to spend :490.00 for the construction of a
new back-stop and bleachers at Lincoln Park and moved that the
Commission be allowed to ezpend that amount, seconded by Mr.
Probst and carried by the following vote:- Ayes:Council'nen
Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Probst,
Roth and Stewart, (9). Noes:ITone. Absent:rone.
15.
Mr. Roth stated that Mrs. Jhon Fraser, owner of the lot
at the corner of Willow Street and Lincoln venue ,would not
relinquish the ten foot strip needed for the sidewalk unless
she were paid for the same. He moved, seconded by Mr. Hammond
and carrion, that the Clerk ascertain from her what price she
would ask for the lend in question.
16. Mr. Hammond asked what action the City Attorney had taken
on the matter of amending the Tent Ordinance. City Attorney
Foorman replied that in his judgment he doubted whether a suit-
able amendment excluding individual tents could be drawn. He
woudl, however, give it further attention.
17. Mr. Bullock asked of the 7ublic Buildings ounds
Committee what action they had taken towards the repair of the
City Hall. YR. Roth stated that he would have a report ready for
the next meeting of the Council.
18. City Attorney Poorman stated that it appeared that his
demurrer in the case of Robinson vs. Otis, et al, will be over-
ruled and asked if the Council desired to have the same appealed.
Jr, Bartlett, moved, seconded by Mr. Morgensternand carried that
the City Attorney be instructed to appeal the case in the event
that the demurrer is over-ruled.
19.
Mr. Hammond moved that the proposed change of schedule of
street cars along San Jose Avenue about to be made effective,
be placed in thehands of the Public Utilities Committee, second-
ed by Mr. Bartlett and carried.
Mr. MacRae reported on the reauest of the Peoples Water
Company for Permission to move their house across Fernside Boule-
vard and moved that the request be granted, seconded by Mr. Roth.
Mr. Morgenstern moved to mend that the matter lay over until
the next meeting of the Council, seconded by Mr. Bullock and carried.
21. Mr. Morgenstern moved that the matter of insuring the city's
employees be laid over to the next Committee of the Whole meeting.
There being no further business to transact the Council ad-
journed to meet in regular session, Tuesday evening, April 6th,
1915, at 7:30 o'clock.
