1917-01-02 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA,
TUESDAY EVENING, JANUARY 2ND, 1917.
The meeting convened at 8:07 P. M. with Mayor F. H. Bartlett presiding.
The roll •vas called and Councilmen Morris, Probst, Roth, Smith and
Walke (5) were noted present. Councilmen Hammond and Stewart arrived
Inter and were noted present. Absent:Councilman Fowler.
The Minutes of the previous meetings were read and approved.
A communication from Mayor Bartlett appointing Thomas J. Allan a
member of the Council for the Second Ward was read. Mr. Morris moved that
the appointment be confirmed, seconded by Mr. Stewart and carried. Mr.
Allan thereupon took the Oath of Office and was seated as a member of the
Council. His Oath of office was ordered filed.
Mr. Roth introduced the following Resolution and moved its adoption:-
RESOLUTION NO. 1.
Transferring 01,000 from the General Fund to the
Police Pension Fund to re-imburse said Fund.
Mr. Walker seconded the motion to adopt the Resolution and on roll cali it
was adopted and passed unanimously.
Claims against the General Fund amounting to 0611.91; against the
Police Fund amounting to '250.00; against the Street Fund amounting to
0.698.34; against the Electric Light Fund amounting to 04119.03; against
the Library Fund amounting to 0404.39; against the Recreation Fund amounting
to 0100.41; against the Relief Fund amounting to 031.00 and against
pal Improvement Fund amounting to 06225.60 havin
been approved and

Mr. Walker moved that the claims as read be paid, seconded by Mr. Hammond and
on roll call carried unanimously.
The following were received:-
Reports of the Municipal Electric Light Plant for the months of July,
August, September, October and November, 1916. Ordered filed.
The Pound report for the month of December, 1916. Ordered filed.
The Affidavit of Publication of Notice of Sale of a Fire Horse.
Ordered filed.
4. The Affidavit of publication of the Notice of Sale of the houses
owned by the City along the Encin 1 Avenue widening. Ordered filed.
The Affidavit of publication and the Affidavit of posting of
Resolution of Intention No. 35, N. S. Ordered filed.
Safety Orders covering window cleaning, trench construction, oil
pressure tanks an9 electrical utilization, together with Resolutions from the
Industrial Accident Commission covering the same. Ordered filed.
6. v Deeds from Percy Riddle and Adolph Hecker and wife, covering property
purchased for the Longfellow School. Ordered filed.
The following communications wero received:-
. From the Union Iron Works Company makin application for permission
to lay cables across the city's tide lands. Referred to the City Attorney.
From Mayor F. H. Bartlett stating that he had suspended Street
Superintendent V. M. Frodden for dereliction, neglect and nonperformance of
duty. Mr. Stewart moved that the action of the Mayor be confirmed, seconded
by Mr. Morris. Mr. James E.Sutton addressed the Council and spoke on behalf

the charges brought could be determined. Councilmen Hammond and. Probst also
spoke on behalf of Mr. Frodden. Councilman Stewart spoke against Mr.
.Frodden's retention. Mr. Roth also spoke stating that he would do whatever
he felt was best for the interests of the City of Alameda. Mr. Probst moved
to amend Mr. Stewart's motion that the charges brought by the Mayor be
dismissed, seconded by Mr. Hammond. Mr. Wright, counsel for Mr. Frodden,
urged that the motion be withdrawn and at his request Mr. Probst consented
to the withdrawal of the motion. Mayor Bartlett gave his consent to the
hearing of the charges Wednesday evening, January 10th, 1917, at 8 o'clock.
Further communications:
From Senator Geo. J. Hans °flexing his services to the City of
Alameda to have the improvements to be made by the Union Iron Works Company
on the city's land on the Estuary fixed as the consideration required by
the Tideland's Act, in lieu of the 0200,000 therein required. Mr. Hmunond
stated'that as the sum of about 0150,000 was to be spent there it would be
deemed advisable to have the Act amended to conform. He moved that Mr.
Hans be requested to bring the matter before the State Senate and that
Assemblyman Arnerich be requested to lend his energies in the lower house
and that the Clerk notify him, seconded by Mr. Probst and carried.
10. / From Elliot T. Plummer requesting insurance on the City Hall and
automobiles and making application for surety bonds covering city officials.
Referred to the Public Buildings and Grounds Committee.
11. / From Dr. Hieronymus, Health Officer, stating that Miss Inez Smith had
been appointed. City Bacteriologist and chemist at a slary of 0_00.00 per
month, vice Walter Liegh resigned. Mr. Hammond moved that the appointment
be confirmed, seconded by Mr. Probst and carried.
12. / From the Board of Education requesting that the Council build the
curb along Alameda Avenue in front of the Porter School property, notice
for which improvement had been received from the Street Department. Re-
ferred to the Street Committee.
13. / From the City Clerk stating that to attach wires to electro15.ers
was contrary to the rule of the Liability Trsurance Board and the Board
of Underwriters, and recommending that the action of the Council heretofore
taken orderiag the same be rescinded. Mr. Hammond moved that the Clerk be
instructed to proceed with the previous recommendation of the Council,
seconded by Mr. Stewart and carried.
14. From Pollard and Son asking for insurance on the City Hall. Re-
ferred to the Public Buildings and Grounds Committee.
15. / From the Police and Fire Commission recommending that the Council
request the Peoples Water Cimpany to place an additional fire hydrant on
Webster Street, ten feet south of the Hunter Lumber Company's driveway. Mr.
Hammond moved that the matter be referred to the Police, Fire and Water
Committee with power to act, seconded by Mr. Walker and carried.
16. From the North Side Improvement Club stating that they had appoint-
ed. a Committee on the proposed industrial and residential zone matter.

the Oakland Tribune to give proper notice of publicity due the City of
Alameda in regard to the industries established here and that they had
appointed a Committee on the industrial and residential zone matter.
Ordered filed.
18. 1 The Clerk stated that the Printing Schedule for the ensuing year
had been prepared. Mr. Hammond moved that the matter be referred to
the Mayor, seconded b Er. Stewart and carried.
19. / Mr. Probst introduced the following Resolution and moved its
adoption:-
RESOLUTION NO. 2.
Fixing the Salary of J. J. Mulvaxiy Deputy
Auditor at 125.00 per month.
Mr. Hammond seconded the motion to adopt the Resolution. Er. Stewart
spoke against the Resolution and stated that he had evidence showing
the unfitness of Mr. Mulvany for the position. Mr. Mulvany addressed
the Council in his own defence denying the assertions made by Mr.
Stewart. Messrs John Maoauley, W. H. L. Hynes and A. J. Merle spoke
on behalf of Mr. Mulvany and upholding the character of Mr. Mulvany.
Mr. Stewart offered as a substitute motion, that the matter lie over
until he could procure affidavits supporting his contentions, seconded
by Mr. Morris and lost by the following vote:- es:Councilmen Morris,
Roth and Stewart, (3). Noes:Councilmen Allan, Hammond, Probst, Smith
and Walker, (5). Absent:Councilman Fouler, (1). he original motion
adopting the Resolution was then put and carried by the following vote:-
Ayes:Councilmen Allan mmond,,Probst, Smith and Walke (5). Noes:
Councilmen Morris Roth and Stewart, (3). Absent:Councilman Fowler,(1).
20. A communication was the received from James Fowler offering his
resignation as a member of the Council. Mr. Probst moved that it be
accepted, seconded by Er. Hammond and carried.
21. / The office of President of the Council being vacant due to the
resignation of Councilman E. B. Bullock, Mr. Morris placed the name of
Mr. Stewart in nomination as President seconded by Mr. Hammond. Mr.
Stewart declined the same and placed in nomination the name of Council-
man Roth. Mr. Hammond seconded the nomination and it was carried.
22. / Mr. Morris moved that D. A, Eberly be appointed a member of the
Board of Health, vice Walter S. McLean, resigned, seconded by Mr.
Hammond and carried.
Mr. Hammond moved that when the Council adjourn it adjourn to
meet.in adjourned regular session Wednesday evening, January 10th, 1917
at 8 o'clock, seconded by Mr. Probst and carried.
There being no further business to transact the Council adjourned to
meet in adjourned regular session Wednesday evening, Jarniary 10th, 1917
at 8 olclock.
