1919-03-04 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA;
TUESDAY EVENING, ':1-ARCH 4TH, 1919.
The meeting convened at 8.09 p. m. with Council—president Majors presiding.
The roll was called and Councilmen Latham, Otis, Probst and President
Majors were noted present. Absent: Councilman Noy.
The minutes of the regular meeting of February 18th, 1919, were approved
as read.
Mr. Otis addressed the chair and asked for the provilege of speaking.
He called attention to an attack that had been made on him in the local newspaper
and submitted a statement of his position, which was read. He also submitted a
communication from W. E. Creed, President of the East Bay Water Company, which
accepted his resignation as a Director of the East Bay Water Company and acknow
lodged the surrender of the stock owned by Mr. Otis. Mayor Majors stated that
he felt some action should be taken against Mr. Otis and called upon E. K. Taylor,
who was presented, and who declined to express an opinion. City Attorney Locke
stated in response to the Mayor's inquiry, that the matter was a q uestion of
law and had not been looked into by him thoroughly. President Majors urged that
the Council take some action, but as no formal charges had been filed no action
was taken by the Council. Mr. Latham moved, seconded by Mr. Otis and carried
that the communications be filed. Subsequently, later in the session, A. Feldhammer
addressed the Council and urged that action against Mr. Otis be taken. City
Attorney Locke, in response to a q uestion stated that it was his opinion that
there was no violation of the charter on the part of Mr. Otis. L. W. Rood also
spoke to the q uestion. No action of any kind was taken.
2. Mr. Probst introduced the following Resolution and moved its adoption:
"RESOLUTION NO. 201.
Transferring 0093.75 From the Electric Light Fund to
the Interest and Redemption Fund."
MR. Latham seconded the motion to adopt the Resolution and on roll call it was
adopted and passed unanimously,
The following were received:
The Affidavit of Publication of the list of election officers to serve
in the General Municipal Election, March 11th, 1919, Ordered filed.
The report of the Municipal Electric Light Plant for the month of
December, 1918. Ordered filed.
The following communicationswere received:
4. From L. M. King calling attention to the three bills that
had been introduced in the Legislature at the req uest of the Emergency Fleet
Corporation, for the purpose of validating certain leases to Government Island.
Messrs, Austin T. 'aright, Attorney for the Fleet Corporation, L. M. King and
E. K. Taylor spoke on the subject. After some discussion Mr. Otis introduced
the following Resolution and moved its adoption:
"Resolution No. 202.
Requesting Representatives in the Legislature to
Oppose Bills Validating Leases of Government Island,
Unless Amended."
Mr. Probst seconded the motion to adopt the Resolution and on roll call it was adopted
March 4th, 1919
Further communications:
From Congressman J. A. Elston, stating that there is little likelihood
of the passage of any public buildings bill, which would make possible the con-
struction of a branch post office in the West end of Alameda. @rdered filed.
i/ From Barrett Camp No. 29, Spanish War Veterans protesting against having
been omitted in the selection of a Committee which is to prepare a reception for
returned soldiers. The matter was referred to the Mayor with power to increase
the Committee and to include representatives from Camp Barrett.
7. From Osgood B. Howard, requesting a gratuitous license to peddle flavoring
extracts. Az the same bore the endorsement of the Chief of Police and the City
Manager, Mr. Lathan moved that the request be granted , seconded by Mr. Probst and
carried,
V Mr. Probst introduced the following Resolution and moved its adoption:
"Resolution No. 203.
Closing of Atlantic Avenue from Mulberry Street to
Walnut Street."
Mr. Latham seconded the motion to adopt the Resolution and on roll call it was
adopted and passed unanimously.

"Resolution No. 204.

Setting Aside Wednesday, March 12th, 1919, as "French
Soldiers' Relief Day" in Alameda and Authorizing the
Mayor to issue a Proclamation and to Appoint a Commit ee."
Mr. Probst seconded the motion to adopt the Resolution and on roll call it was
adopted and passed unanimously.
10. A Bill entitled
"A Bill
For Ordinance No. ____ Series."
Amending Section 528 of Article II of Chapter 8
of the Municipal Code."
was introduced and laid over under a provision of the Charter.
11. A Bill entitled
"A Bill
For Ordinance No. New Series.
An Otdinance Req uiring Physicians and all other
Persons Attending Cases of Contagious, Infectious
and Other Communicable Diseases to Report the Same
to the Health Office."
came up for passage and was read. Mr. Latham moved that the Ordinance be adopted,
seconded by Mr. Probst and on roll call carried unanimously.
Claims against the General Fund amounting to $1375.00; against the Police Fund
amounting to 1/-0.98; against the Fire Fund amounting to $54.34; against the Street
Fund amounting to $918.15; against the Health Fund amounting to 038.84; against the
Recreation Department amounting to $102.14; against the Store Fund amounting to
254.26; against the Relief Fund amounting to $66.94; against the Park Purchase
Fund amounting to $108.80; against the Electric Light Fund amounting to $4886.51;
and against the School Fund amounting to 06.25 having been approved and audited
by the proper officials were listed by the Clerk as follows:

Mr. Latham moved that the claims as listed be paid, seconded by Mr. Probst and
on roll call carried unanimously.
12. / City Manager Hewes brought up the matter of the moving of the high tension wires
from Lincoln Avenue and submitted a communication received by him from A. H. Babcock,
of the Southern Pacific Company, in which it was stated that efforts were being
made to attend to the matter.
13. v/ City Manager Hewes reported relative to the skip-stop and stated that the matter
is being considered by the San Francisco, Oakland Terminal Railways, and also that a new
survey regarding the same was being made.
14. // City Manager Hewes reported that the Southern, Pacific Company was willing to paint
sixty-six poles at the crossings so that they could be discernible at night.
15. V City Manager Hewes reported that the Southern Pacific Company would place the signs in
the stations at the west end notifyihg patrons of the hours when the trains would stop.
16. v/ City Manager Hewes reported that two bids had been received for the sale of the

March 4th, 1919.
17. Manager Hewes brought up the matter of the assessment and the taxes
levied on the property formerly owned by the Oakland Waterfront Company and now
under the control of the Fleet Corporation. He stated that taxes amounting to
some eight or ten thousand dollars had neat been paid and that the property on
March 1st, 1918 stood in the name of the Oakland Waterfront Company. MI'. Latham
moved, seconded by Mr. Otis and carried, that the City Attorney prepare necessary
resolutions to present to the proper authorities to make demand for the unpaid
amount of taxes.
There being no further business to transact the Council adjourned to meet
in regular session Tuesday evening, March 18th, 1919 at 8 o'clock.
