A communication was received from Lieut.Col.John Biddle acknowledging the receipt of a copy of a resolution thanking him for courtesies extended to the City. Ordered filed. An invitation was received from the League of American Municipalities to send delegat- es to the 12th Annual Convention of the League at Omaha on September 30th. Ordered filed. A communication was received from Pacific Coast Association of Fire Chiefs request- ing the presence of the Chief of the Fire Department at a convention of the Association to be held in Victoria,B.C.on Sept.28,29,30 and October let 1908. Mr.Probst moved that the matter be referred to the Police and Fire Commission,seconded by Mr.Loop and carried. Police & A communication addressed to L.T.Ward of the Fire Commission,from W.A.Miller & Co. of San Francisco,offering to sell hay to the Fire Department in 60 ton lots in carload lots F.O.B.cars in Alameda at $17.75 per ton net payable on delivery of the car. A com- munication addressed to W.F.Chipman of the same commission,from Somers & Co.,of San Fran- cisco,offering to sell hay in from 60 to 80 ton lots in carload lots F.O.B.in Alameda at $18.00 per ton. Mr.Bullock moved that the bid of Miller & Co.,be accepted,seconded by Mr.Noy and carried by the following vote, Ayes:Councilmen Brown,Christensen,Magagnos, Bullock,Noy,Probst,Fisher and Loop.(8). The Police and Fire Commission presented plans and specifications for a fire house to be constructed on the lot owned by the City on Webb Avenue and requested the Council to adopt the same. Mr.Probst moved that the Council adopt the same and that the Clerk be directed to advertise for bids for the construction of the building,seconded by Mr. Magagnos and carried by the following vote. Ayes:Councilmen Brown,Christensen,Magagnos, Bullock,Noy,Probst,Fisher and Loop.(8). Noes:None. Absent:Councilman Gee.(1). Mr.Probst moved that the Commission be empowered to enter into a contract with the architect for the work of drawing up of the plans and specifications and for the general supervision of the work of the construction of the fire house on Webb Avenue,seconded by Mr.Loop and carried by the Following vote. Mr.Loop moved that the Police and Fire Commission be authorized to expend 400.00 for rent for six months and the fixing up of quarters for the use of the Fire Department during the construction of the new fire house,seconded by Mr.Probst and carried by the fol- lowing vote. The Clerk presented an affidavit of publication of the Alameda Daily Argus showing due publication of Notice of Application and Sale of Railroad Franchise and advertisement ific Company. The same was ordered opened and was for the sum of 0.00.00 a certified check being presented to cover the amount. Mr.Loop moved that the bid be accepted and the fran- chise awarded to the said Southern Pacific Company,seconded by Mr.Fisher and carried by the following vote. Mr.Loop introduced A Bill entitled "A Bill for Ordinance No. Granting to the Southern Pacific Company,A Railroad Corporation,and to its Successors and Assigns,the Right, Privilege and Franchise,for the period ending on the 26th day of July,1949,to Construct,Main- tain and Operate a Double -track Railroad,of Standard Gauge,together with all necessary X➢q Switches,Crossings, Sidings, Sidetracks ,Connections,Poles,wires and Other Necessary Appliances, Appendages and Adjuncts,said Railroad to be operated by Electricity or such other improved method of operation as may be authorized by law,except Steam Locomotives,over,across,along and upon certain Streets,Avenues and Private Ways in the City of Alameda,County of Alameda, State of California." The same was laid over under the provisions of the Charter. The Clerk presented an affidavit showing due publication of Notice asking for propo- sals for completion of the Men's Reading Room in the Free Library,and reported that three bids had been presented. The same were ordered received and opened and were read as fol- lows: From C.H.Foster & Son the sum of $1293.00 From Peacock & Bennett the sum of 41295.00 From Delanoy & Randlett the sum of 41376.00 Mr.Noy moved that the bid of C.H.Foster & Son,being the lowest bidders be accepted and the contract for the proposed work be awarded to them, seconded by Mr.Bullock and carried by the following vote. The matter of the request of the Board of Trustees of the Free Library to re-advertise for bids for the steel shelving for the Library was then taken up and the Council was ad- dressed by Library Trustees PJIastick,Barton and Maslin and representatives of the Library Bureau,Inc.,and the Art Metal Construction Company. Mr.Noy moved to reject all bids,se- conded by Mr.Bullock. Mr.Loop moved to amend by accepting the bid of the Art Metal Con- struction Co.,seconded. by Mr.Magagnos. The amendment being lost by the following vote. Ayes:Councilmen Magagnos,Probst and Loop.(3). Noes:Councilmen Brown,Christensen,Bullock, Noy,and Fisher.(5). Absent :Councilman Gee.(1). The motion of Mr.Noy that all bids be rejected was then voted on and carried by the following vote. Ayes:Councilmen Brown, Christensen ,Magagnos,Bullock,Noy,Probst and Loop.(7). Mr.Loop moved that the matter be referred back to the Board of Library Trustees to act with the Mayor in preparing new plans and specifications to be submitted to the Council seconded by Iulr.Bullock and carried. An application was presented for a gratuitous license to sell toilet articles etc.,by Miss Ethel Nourse of 1538 Paru Street. Mr.Probst moved that the application be granted, seconded by Mr.Magagnos and carried. An application for a gratuitous license to solicit orders for pianos was presented by McNeil & Co.,of Oakland. Mr.Noy moved that the application be denied,seconded by Mr.Bul- lock and carried. Four applications for the installation of arc lights at different points in the City were presented and referred to the Public Utilities Committee, A communication was presented from Augustus Taylor in referrence to pro rating the taxes on the Taylor Estate Property purchased by the City as a playground site. Mr.Loop moved that the City pro rate the taxes on the property from March 1st 1908,seconded b- Mr. Noy and carried by the following vote. Ayes :Councilmen Brown,Christensen,Magagnos,Bul- lock,ioy,Probst and Loop.(7). Noes:Councilman Fisher.(1). Absent:Councilman Gee.(1). A communication was received from Sheldon Borden acknowleggeing the receipt of a certified copy of the resolution of the Council to purchase the Thompson Property as a playground site. Ordered filed. A petition signed by the school children of the City requesting that the Council take immediate steps to put the playground sites in condition for use and to purchase if possi- ble the lot of land on the S.W.corner of Walnut and Central Avenue as a playground site for the use of the High School. Accompanying the petition was a communication from the Board of Education recommending the favorable consideration of the petition. same were ordered filed. The City Attorney reported that the Oltmann property adjoining the Wilson School had been purchased by the City and was now in possession of the School Department and that the purchase money of the Municipal Improvement Fund No.7 had been used up. E.A.Kober presented an application and bond for a liquor license at 1721 Lincoln Ave. same was approved as to form by the City Attorney. Accompanying the same xof 014M41 was an application to transfer his liquor license from 1538-1542 Park Street to 1721 Lin- coln Avenue. Mr.Probst moved that the request be granted seconded by Mr.Bullock and carried by the following vote. Ayes:Councilman Brown,Christensen,Magagnos,Bullock,Noy, Probst,Fisher and Loop.(8). Noes:None. A resolution was introduced by Mr.Bullock to have a railing fence or chain placed across the south end of streets at the bay shore as a protection against vehicles going over the embankment. Mr.Christensen moved that the same be referred to the Committee of the Whole,seconded by Mr.-"oy and carried. A communication was received from the Geo.E.Dow Pumping Engine Co.,notifying the Council to remove the water tank at the north end of Oak Street claiming that the same was located on their property. Mr.Loop moved that the Clerk be directed to address a com- munication to the said company denying that the tank was on their property,seconded by Mr. Probst and carried. A communication was received, from Hutchinson Company claiming that an error had been made in the publication of the Notice of Award in the matter of the grading,nacadamizing etc.of the north half of Buena Vista Avenue between Grand and Paru Streets and requesting the Council to rescind the resolution calling for bids in the matter and all subsequent proceedings and re-advertise the same. Mr.Christensen offered the following resolution and moved its adoption: Whereas,It appears to the satisfaction of this Council,that Resolution of Intention No.721 for the work of grading,curbing,macadamizing and otherwise improving the north side of Buena Vista Avenue from the western line of L4rand Street to the center line of Paru Street in the City of Alareda,adopted by this Council June 17th 1908,has been posted and published according to law,and that no legal objection to the doing of said work has been filed with the City Clerk of said City. RESOLUD,That the public interest and convenience require and the Council of the City of Alameda hereby orders the following described street work to be done in said City, according to the plans and specifications adopted therefor,namely: That Buena Vista Avenue from the western line of Grand Street to the center line of Paru street be improved as follows: That the northern half of said avenue between said limits,including the northern naj: u LEO crossing oi sale avenue witn hlooarci street ancl the northeastern quarter of the ma crossing g of said avenue with Paru street,be graded to the official grade;that concrete curb- ing,8 inches by 14 inches in cross section dimension be constructed on the northern curb line of said avenue between said limits and on the two curved corners thereof on the north- ern side of the crossing of Hibbard street with said avenue and on the curved corner at the northeastern corner of the crossing of Paru street with said avenue;that cement grouted rock gutters three feet in width of theuflat pattern" be constructed along the northern side of said avenue between said limits contiguous to said curbing and curved corners;that the re- maining portion of the roadway of said northern half of Buena Vista avenue between said lim- its and including the northeren half of said crossin of Hibbard streetand northeastern quar- ter of said crossing of Paru street be macadamized with a layer of broken trap rock eight inches in thickness;that three cast iron culverts imbedded in cement be laid and constructed as follows: One across Buena Vista avenue in the eastern side of its crossing with Paru street one across said avenue in the western side of its crossing with Hibbard street,and one across said avenue in the eastern side of its crossing with Hibbard street;that two gutter bridges each five feet in width and of pine lumber be constructed in each of the above mentioned curved corners. The Clerk of this City is hereby directed to publish this Resolution for two days in the Alameda Daily Argus,a daily newspaper published and circulated in this City,and which is hereby designated for that purpose. He is also directed to post conspicuously for five days near the Chamber Door of the said Council,notice of said work with specifications inv- itind sealed proposals or bids for doing the work ordered,and to publish notice of said work inviting sealed proposals or bids for doing the work and referring to the specifications posted or on file,also for two days in the said Alameda Daily Argus,the newspaper hereby g designated for that purpose. Both of the said notices shall require a certified check or a bond,either as proscribed by law and for an amount not less than ten percent of the aggre- gate of the proposal,and shall name Monday,the 21st day of September,1908,as the day hereby designated on which up to the hour of 8 o'clock,p.m.,the said proposals shall be received. Street Superintendent Frodden reported that the work of grading,curbing,macadamizing and otherwise improveing Santa Clara Avenue between Court and Fountain Streets done by Hutchinson Company,contractors under private contract had been faithfully finished and com- pleted under his direction and to his satisfaction. Ordered filed. Street Superintendent Frodden reported that the work of grading,curbing,macadamizing and otherwise improving Eagle Avenue between Pearl and Broadway done by Hutchinson Company under private contract had been completed to his satisfaction and under his direction. Ordered filed. A communication was received from Delanoy & 'Randlett agents for the Sather Estate, requesting permission to construct under private contract a sewer in Santa Clara Avenue from the Cohen line east to Court Street. Mr.Christensen moved that permission be grant- ed,seconded by Mr. Magagnos and carried. A communication was received from Delanoy & Randlett agents for the Sather Estate requestin that the Resolution of Intention to construct a sewer in Santa Clara Avenue be- tween Fountain 6.7 High Streets be rescinded as there was no present need of a sewer in that block. Mr.Christensen moved that all action pertaining to this matter be rescinded,second- ed by Mr.Magagnos and carried by the following vote. Ayes :Councilmen Brown,Chri tensen, Magagnos,Bullock,Noy,Probst,F her and Loop.(8). Noes:None. Absent:Councilman Gee.(1). A communication was received from EA.Holman,accompanied by a deed to Mound Street, requesting that the same be not recorded until an Ordinance abandoning the so-called Shell Street had been passed by the Council. The deed was referred to the City Attorney and thereupon Mr.Christensen introduced A Bill entitled "A Bill for Ordinance No. _To Declare the Abandonment of the Way known as Shell Street," which was laid over under the provisions of the Charter. Mr.Christensen introduced A Bill entitled. "A Bill for Ordinance No. Establishing a Board of Park and Playground Commissioners and Prescribing the Duties and Powers of said Board." Same was laid over under the provisions of the Charter. A communication was received from the Mayor making various recommendations for the betterment of the streets &c of Alameda. Same ordered filed, and referred to the Committee of the Whole. Nr.Probst moved that the Clerk he directed to address a communication to Varney & Green,notifying them to remove their fences from the property purchased from the Taylor Estate,seconded by Ivir.Noy and carried. Mr. Noy moved that in the future the City Engineer be directed to furnish the Clerk with duplicate copies of plans,specifications and quantity estimates in all street proceed- ings,seconded by Mr. Bullock and carried.
