HEARINGS: 3.IntheMatterofaPetitiontorezonefromthe"R-2",Two-FamilyResidenceDistrict,tothe"R-411, NeighborhoodApartmentDistrict,certainpropertiesinthe1600blocksofChapinandSt.CharlesStreets andthe1000blockofPacificAvenue.ThePetitionwasfiledbyMr.MarioMiranda,owneroftheproperty at1030PacificAvenue.ThePlanningBoardhadrecommendeddenialoftheapplication. TheCityClerkstatedtheAffidavitofPublicationoftheNoticesettingthistimeandplaceforthe HearinginthismatterwasonfileandtheminutesofthePlanningBoardmeetingatwhichtheapplication wasconsideredhadbeensenttotheCouncilmen. Mr.DonaldJohnson,PlanningDirector,explainedtheactionoftheBoardontheproposal,assetforthin itsletterdatedDecember11,1969.Withtheletterwassubmittedamapandstatisticswithregardtothe propertiesinquestion,alsoapetition,signedbytenresidents,expressingoppositiontotheproposal, whichhadbeenpresentedattheBoardHearing. Mr.Johnsonstatedtheapplicanthadindicatedheintendedtoconstructaduplextotherearofthelot, leavingtheexistingsingle-familyresidencetothefrontoftheproperty.However,attheBoardHearing, hehadindicatedhemightpossiblymovetheexistingstructuretotherearofthelotandconvertittoa triplexwithsomeadditionstothefrontandalsoallowoff-streetparkingonthefrontportionofthe parcel.TherehadbeennodevelopmentplansfiledwiththeapplicationandneithertheStaffnorthe Boardcouldoffer any commentontheproposeddevelopment.Twopersonshadappearedinprotest. TheBoard1sdenialwasbasedonthefindingthattheresidentsintheareadidnotdesireanincreasein thedensity.theapplicantdidnothaveafirmdevelopmentproposalandthelotswithintheareawereof suchasizethatgoodapartmentdevelopmentwouldbedifficult. CityAttorneyCunninghamthenstatedtheissuebeforetheCouncilwaswhetherornotthefindingsand recommendationofthePlanningBoardanditsadvisoryreport,basedonSection11-175oftheMunicipalCode. shouldbesustained,modifiedoroverruled. Onthecallforproponents,itwasnotedthatMr.Mirandawasnotpresent. TheClerksaidMr.GutlebenhadbeennotifiedthatthiswouldbethetimeandplaceforHearinginthe matter. PresidentLaCroixstatedMr.GutlebenhadappearedbeforetheregularmeetingoftheCouncilthiseven; andrequestedthathisAppealbewithdrawn.Therefore,noactionwouldbetakenbytheCouncilinthe matter. 5.ContinuedfromthemeetingheldDecember2,1969-intheMatterofanAppealfromthecisionof thePlanningBoardto deny avariancetowaivetheparkingrequirementforonedwellingunitonas1le- familydwellingconvertedtoatwo-familyresidenceat1431ShermanStreet.TheAppealhadbeen1 byMr.AlvinW.Frink. Thematterinquestionhadbeencontinuedinorderthatfurtherstaffadvicemightbeprovidedconcerni possiblesolutionstotheparkingproblemandinspectionofthebuildingforconformitywiththeconstruc- tionCodes. Onrequest,CityEngineerHannabrieflyreviewedhiswrittenreportonthesubject.Hestatedthe variousinspectorshadexaminedthepremises,asrequested,andfoundaveryconsiderableamountofwork whichwouldhavetoberedone.Thiswouldincludeconstruction,plumbingandelectricalwork,thesize ofwindows,andquiteavarietyofchanges.Hesaidithadbeenfoundalsothatapproximatelyoneyear priortotheincidentunderdiscussion,Mr.FrinkhadapproachedtheBuildingDepartmentandreviewed theCity'srequirementsforconstructinganotherapartment.Hehadbeeninformedthatanoff-street parkingrequirementwouldbenecessary.Lackingspace,hewouldhavetoobtainawaiverfromthePlan- ningBoard. Mr.HannastatednomorewasheardofMr.Frinkuntilrecentlywhenithadcometotheattentionofhis DepartmentthatMr.Frinkwasworkingonthepropertyandhadnearlycompletedtheapartment.Atthat time,Mr.Frinkwasinformedthathewouldhavetoseekavarianceoreliminatesomeoftheequipment inthewould-bekitchen.Mr.FrinkhadthenappliedforavariancebeforethePlanningBoard,whichwas denied,andhehadappealedthemattertotheCityCouncil. Mr.Hannastatedithadbeenfoundthattherewasalmostnopracticalspaceintheyardforanyadditional parkingarea.Eventhegarageinthebuildingwasnotbeingusedasagarage,inviolationofother sectionsoftheZoningOrdinance.Thestreetitselfhadanumberofbuildingsonitinwhichtherewas nooff-streetparkingsothatthestreetwasheavilyparkeddayandnightandtheStreetDepartmenthad hadproblemsintryingtokeepthestreetclean.Hethereforefeltitwouldbeinadvisabletopermit anotherdwellingunitwhichwouldbringperhapsoneortwomorecarstothearea,withoutatleast havinganotheroff-streetparkingspace,andhadrecommendedagainstthevariance. CouncilmanLevymovedtheAppealbedeniedandthedecisionofthePlanningBoarddenyingthevarianceto waivetheparkingrequirementbeupheld.CouncilmanLongakersecondedthemotionwhichcarriedonthe followingrollcallvote.Ayes:Five.Noes:None.Absent:None. PresidentLaCroixstatedtheCouncilhadrequestedthattheCityManagerprepareareplytothisrequest. Mr.Weller,oninvitationtocomment,statedhefelttherewasasubstantialareaofinterpretationand judgmentonthepartoftheCouncilastothedutiesassignedtothePlanningBoard.Thebasiclaws involvedincludedtheCityCharter,theMunicipalCodeandtheStateConservationandPlanningAct.He suggestedthecommunicationbereferredtohisofficeforconsultationwiththeCityAttorney,thePlanning Directorandotherstodeterminewhatthefactualattitudesghtbeintermsofthestatutes.Itwould thenbeuptotheCounciltodetermine,withinthoselimits,whatitconsideredtheproperroleofthe Boardtobe. CouncilmanMcCallstatedhewouldliketobeinattendancewhenthesubjectwaspresentedtotheBoard andsuggestedthattheCouncilandtheBoardhaveajointmeetingforthispurposesothatcompleteunder- standingcouldbereachedbetweenthetwobodies. Inreplytoaquestion,Mr.Cunninghamstatedhehadnotbeenconsultedforalegalopinionwithregard totheletterfromtheBoard. TheproposalwasagreeableandtheCityManagerwasrequestedtoworkwiththeCityAttorneyonthismatter. WhenallinformationonthesubjecthadbeenproperlydocumentedandforwardedtotheCouncil,ajoint meetingoftheCityCouncilandthePlanningBoardwouldbesetassoonaspossible. 11.FromthePlanningBoard,signedbytheSecretary,recommendingapprovaloftheTentativeofthe condominiumsubdivisionknownasTractNo.3174,subjecttotermsandconditionsoftheCityEngineer's ReportdatedDecember24,1969.TheMaphadbeenfiledbyJones-Tillson &AssociatesforLinds Gallagher &Willettonpropertyat1500CentralAvenueand1501AlamedaAvenue. CouncilmanMcCallmovedtherecommendationbeadoptedandthesumof$1,800beapprovedforthedesignated purposeaskingatthesametimewhatpositiontheCitywouldbeinifitshoulddesiretowithdrawfrom theMayors'Conference,ifitwouldbeboundbythisactiontoremainintheConference.Itwasstatedthe CitywasfreetowithdrawfromtheConferenceatanytime. CouncilmanForesecondedthemotionwhichcarriedonthefollowi None.Absent:None.rollcallvote.Ayes:Five.Noes: UNFINISHEDBUSINESS. 14PresidentLaCroixrecalledthediscussionbeforetheCouncilwithregardtoacquiringandpreserving someoftheolderpropertiesintheCity.Oneofthosementionedhadbeenthehomelocatedat1630Central Avenue,whichwasthepropertyoftheAnthonyEstate.HesaidhehadtalkedwiththeExecutrixofthe Estateandfoundthefamilywasmostinterestedinthepossibilityoftheproperty,abeautifulVictorian home,beingpreservedwithintheconfinesoftheCity.TheExecutrixhadstateditwasnotdesiredtosell thepropertynortohaveittorndownfordevelopment.Thefamilywouldbemostinterestedinseeingif therewassomewayinwhichitcouldbepreservedfortheCityofAlameda. PresidentLaCroixstatedhewouldlike,iftheothermembersoftheCouncilconcurred,toestablisha citizens'committeetoworkinconjunctionwithareporttheCouncilhadrequestedfromtheChamberof Commerceonthesubject,tofindoutiftherewassomewaythepropertycouldbeacquiredforsafekeeping fortheCity.ThiswouldnotbeapurchasebytheCityitselfbutperhapscouldbeacquired,ifatall possible,byanon-profitorganizationandpreservedfortheinterestsoftheCity. TheCityManagerwasaskedtocomment.Mr.WellerstatedhebelievedtheinfluenceandsupportoftheCity wouldbehelpfulinsettingupsuchanorganization.Thiswasnotafunctionofthegovernmentbutrather asocialobligationbelongingtothecommunity.Hefeltanon-profitorganizationorsomethingofthat sortwouldbethelogicalbodytoaccomplishtheproject.Ifittookacitizensl committeetogetthat kindoforganizationgoing,heagreedthiswastheproperwaytoproceed. PresidentLaCroixsaidhewouldgoaheadwiththeappointmentofsuchacommittee. 15CouncilmanLevysuggestedtheMirandarezoningmatter,laidoverearlierinthemeeti,nowbetaken up.TheHearingwasre-opened. ItwasnotedthatMr.Mirandahadnotappeared.Onthecallforotherproponents,therewasnoresponse, norwasthereananswertothecallforopponents. CouncilmanMcCallmovedtherecommendationofthePlanningBoardbeacceptedandtheapplicationtorezone certainpropertiesinthe1600blocksofChapinandSt.CharlesStreetsandthe1000blockofPacific Avenuebedenied.CouncilmanLongakersecondedthemotionwhichcarriedonthefollowingrollcallvote. Ayes:Five.Noes:None.Absent:None. 16.CouncilmanMcCallstatedhewouldliketoknowthestatusoftheTerranovasituation,whenMr.Frank Terranova,1622ClintonAvenue,hadobjectedtotheCityordinancewhichprohibitedhimfrommakirepairs onhispropertyat2318EagleAvenue. CouncilmanMcCallstatedhehadreadinthenewspaperthattheSanFranciscoCityAttorney'sofficehad questionedthesamethingandthematterwasgoingtoCourtsotherewouldbeatestcase.Apparently,the SanFranciscoCityAttorneyhadruledsomeonehadbeenmiSinterpretingtheUniformBuildiCode. Mr.Cunninghamstatedhewasawareoftheruling.Hesaidthesituationwassomewhatdifferentfromthe oneinAlamedaandexplainedthedifference.Hesaidhefeltepolicepowerinrespecttothepublic health,welfareandsafetywasmuchmoreatissueandmuchmorefavorabletoAlameda'sordinancethanit wastoSanFrancisco's.HesaidhewouldwatchwithgreatinteresttheoutcomeoftheSanFranciscocase. CouncilmanMcCallstatedhewouldliketoseeinwritingthedifferenceinthetwoquestions. hamwasrequestedtofurnishthis i nformation..Cunni CouncilmanMcCallaskedifanythingfurtherhadbeendoneonthematterofaresolution,presentedatthe lastmeetingoftheCouncil,withregardtotheApprenticeTrainingAgreementswiththeStateDivisionof ApprenticeshipStandards.Thematterhadbeentabledforfurtherstudy. Mr.Wellerstatedareporthadbeenreceivedbyhisofficeonthismatter.However,hesaidadditional inforulationhadbeenrequested.Inviewofthefactthattheproposalhadbeenunsuccessfullypresentedto theCouncilonce,possiblyonthebasisofinsufficientinformation,hewishedtobesurethatwhenitcame backtotheCouncilalltheavailableinformationwouldbeincluded.Heanticipateditwouldbereadyforthenextmeeting. NEWBUSINESS: 18.CouncilmanLevypointedoutoneoftheproblemsfacingtheCitywiththestartofthenewyearwas thatoftheGolfCourse.HenotedfromthefigureshehadobtainedthattheCityhad"qoneintotheredll about$95,000intheoperationofthetwoCourses.Hefelttheremightbealternativeswhichcouldbe acceptedandchangeswhichcouldbemadetoreducethecostofthisoperation,orpossiblyitshouldbe eliminatedaltogether.HefeltthismattershouldbepresentedtotheRecreationCommission,withthe requestthatitmakeathoroughstudyindepth,withrecommendationtotheCouncil. CouncilmanLevysuggestedthatpossiblytheSouthCoursecouldbeeliminatedoritscharactercouldbe changedsothatitmightbeaneighteen-hole,three-parcoursewiththeamountofareainvolvedgreatly reduced.Thelandmadeavailableinthiswaycouldbeputtootheruse. CouncilmanLongakerremarkeditlookedasifthelossofrevenuetotheCityfromthissourceforthe currentfiscalyearwouldbe$100,000,andpossibly$115,000.Hefelttherewasnologicalreasonto continuetosupporttheGolfCoursestothisextentwithtaxpayers'money.HeconcurredwithCouncilman Levy'ssuggestionthatthematterbereferredtotheRecreationCommissionandsuggesteditalsobe referredtothePlanningBoardforarecommendation. PresidentLaCroixconcurredwiththesestatements.UponagreementbyCouncilmenForeandMcCall,the CityManagerwasdirectedtorefertheproblemtotheRecreationCommissionandstaffandthePlanning BoardandstafffordeliberationandrecommendationbacktotheCityCouncil. Mr.Wellersaidhewouldassume,sincethismatterwasbeingreferredtotheCommissionandtheBoard, thatthedirectionoftheCouncilwouldincludefullcooperationfromhisoffice,withanyreportsand informationavailable.Itwassoordered. 19.PresidentLaCroixrecalledthematterwhichhadcometotheattentionoftheCouncilthrougha requestbythePlanningBoardandhadariseninthepastmanytimes.Hereadastatementwithregardto thepropertiesontheeastshoreoftheCity.Hesaidhewishedtomakeitasclearaspossiblewhat wouldbeexpectedofthePlanningBoardandstaff. PresidentLaCroix,inhisstatement,saidhebelievedthatlimitedusebyabuttingownersofpubliclands alongtheeastshoreshouldbeformalizedthroughasystemofleasesorpermitsunlessitcouldbeshown thatalegitimateandpracticaluseexistedasanalternative.Hesaidhethereforewouldmovethatthe questionofgeneralpublicusebereferredtothePlanningBoardforarecommendationtobeconsideredby theCityCouncil,withtheunderstandingthatallmattershavingtodowithotherthangeneralpublicuse, includingalegalvehicleandthebasisofremuneration,wouldbedeterminedbytheCouncil.President LaCroixsaidhewouldsuggestthematterbereferredtotheCityManagerandtheCityAttorneyforpossible leaseagreementstobepresentedtotheCouncilforaction.Hesaidhefeltthemattershouldbeactedupon andputtorestassoonandasequitablyaspossible. CouncilmanMcCallaskedifthewholeoftheCity,includingBay land,wasunderdiscussioninthis connection,Hesaidhefeltiftheissuewastobeopenedup,allas I includingthepositionofthe FederalGovernment,shouldbeconsidered.HereviewedtheconditionsoftheUnitedStatesGovernment underwhichpropertyownersontheestuarywerepermittedtoputdocks,patiosandbuildingsontheproperty. Hesaidhebelievedthepeopleinvolvedwerepayingfortheusebyraisedassessments,whichhefeltwasa legitimatewayoftaxingthem.Hesuggestedthematteroftheassessmentsbecheckedtodeterminewhether therewereanyinequitiesandifthiswastruesomethingshouldbedonetocorrectthatsituation. CouncilmanMcCallalsoraisedthequestionoftheCitygettingintothepicture,iftheconditionwas allowedbytheUnitedStatesGovernment.Withregardtotheaccessways,hefelttheseshouldneverbe openedupasprivatewaysforpeopletouse.Heemphasizedthat,ifthesubjectwastobeconsidered,the entireCityshouldbeincludedandinvestigationshouldnotbeconfinedtooneresidentialarea. CouncilmenLongakerandForeagreedthatallareasoftheCityshouldbestudiedinthisconnection. ItwasstatedanaerialphotographhadbeenmadeoftheareaapproximatelyfromtheFruitvaleBridgeto theBayFarmIslandBridge.Itwasbeingmountedandwouldbeavailableforreviewtoshowthesituation asitcurrentlyexisted. PresidentLaCroixsuggestedthattheCouncilact,undertheconfinesofhisstatement,directingand requestingthePlanningBoardtomakeastudyandsubmitareviewofitsfindingstotheCouncil,andalso, underthequestionsraisedbyCouncilmanMcCall,requestingtheCityManagertoperuseanyandallleases whichmighthavetodowithCityandFederally-ownedland.MrWellerstatedtheeastendwasundoubtedly theonlyareaatissuebuthewouldbehappytoreviewtheentireperimeterasrequested. TherewassomediscussionastotheareatobeinvolvedinthestudybythePlanningBoard.President LaCroixstatedhehadreferredtothespecificareainvolvingpropertiesattheeastendoftheCity. Hesaidthiswasamatterofconcerntotheresidents,ithadbeenbeforepreviousCouncils,andhefelt asolutiontotheproblemwouldbenefittheresidentsoftheareaandtheentireCity.Hefeltifthe Boardcouldcomeupwitharecommendationforplanningforthearea,theyshoulddosoandforwardthisto theCouncilforconsiderationandaction. Mr.WellersaidCouncilmanMcCall'spointwaswelltakeninthatthebulkofthequestioninvolved Federally-ownedtidelands,overwhichusetheCitywouldhavenojurisdiction.Hefelt,forthesakeof beingcomplete,thereshouldbesomeindicationoftheextentofencroachmentonFederally-ownedtide- landsbut,bothfromthestandpointofthePlanningBoardandtheCouncil,considerationcouldnotbe giventowhatdispositionmightbemadeofthoselands. CityAttorneyCunninghamstatedthereappearedtobeforty-sevenparcelsinCityownershipalongFernside BoulevardandEastShoreDrivefromapproximatelyThompsonAvenuetocinalAvenue. CouncilmanMcCallcommentedonthebeachareafromBroadwaytoBayFarmIslandBridgeandsuggested leasearrangementsbenegotiatedtocovertheselandsalso,toprotecttheownersofabuttingproperties. CouncilmanLevymovedthismatterbereferredtothePlanningBoardwiththerequestthatitconsider thesubjectassetforthinPresidentLaCroix'sstatementopeningthediscussion,andthatanyinformation whichcouldbesuppliedonthequestionsraisedbyCouncilmanMcCallalsobefurnishedtotheCouncil.
