MINUTES: 1.TheminutesoftheregularmeetingheldFebruary3,1970,wereapprovedastranscribed. 2Atthistime,"ScoutGovernmentDay"wasrecognizedbytheCityCounci1.AProclamationhadbeen issuedbyMayorLaCroixsettingforththeweekofFebruary8to14,1970,as"BOYSCOUTWEEK"and February8,1970,astheSixtiethAnniversaryofthefoundingoftheorganization. PresidentLaCroixcalleduponMr.JohnD.Goss,AssistantCityManager,whoreportedontheactivities whichhadtakenplaceduringtheafternoonfortheenlightenmentofthevariousScoutDay"Officials". ManyoftheScoutshadvisitedwiththeircounterpartCityDepartmentHeads.Theconclusionofthe programwastheirvisittothemeetingoftheCityCouncilthisevening.Mr.Gosscommentedthatthe boysparticipatingwereanexceptionallyfinegroup. CertificateswerethenpresentedtoalloftheparticipatingBoyScouts.Therewasalargeaudience comprisedofmanyScoutsandtheirparents.ThePresidentcongratulatedtheboysfortheireffortsin scoutingandtheirinterestinthecommunity,andtheparentspresentfortheircontributiontotheprogram. Mr.MorrieViola,DistrictScoutExecutive,andMr.KennethHargreaves,anactiveparticipantinthe Scoutingmovementformanyyears,werealsorecognized. WRITTENCOMMUNICATIONS: 3.FromMr.andMrs.WilliamM.Heans,624WillowStreet,expressingtheopinionthatdestructionof theSouthGolfCoursewouldbeagainstpublicinterest,andrequestingthatbothCoursesberetained. PresidentLaCroixremarkedthatthisquestionhadbeenraisedatarecentCouncilmeetingandtheCity ManagerhadbeenrequestedtosubmitareportonstudiestobemadeastothepossibilitiesavailablefortheSouthGolfCourse. Theletterwastobeacknowledgedwithinformationthatnoactionwouldbetakenuntilsuchtimeasan appropriatestudyhadbeenmadeandcompletefactshadbeensubmittedforconsiderationbytheCouncil. 4.FromtheAlamedaJapaneseAmericanCommunity,requestingthattheCityCouncilsupportrepealoftheEmergencyDetentionAct. PresidentLaCroixstatedthattheAlamedaCountyMayors'Conferencehadrecentlyactedinsupportofthe requesttorepealthisAct.HecommentedonthehistoryoftheJapanesepeopleintheCityandthe sympathyfeltforthemintheirproblemsduringtheunfortunatesituationswhicharoseintheearly1940's. CouncilmanMcCallmovedtheproposedresolutionbeacceptedanditbeforwardedtotheproperparties,as indicatedtherein.CouncilmanForesecondedthemotionwhichcarriedonthefollowingrollcallvote.Ayes:Five.Noes:None.Absent:None. HEARINGS: 5.ContinuedfromthemeetingofFebruary3,1970,wasthematterofanAppealfromthedecisionof thePlanningBoardtodenyaUsePermittoallowanoutdoorcommercialuse,afleamarket,inan DistrictintheareabetweentheTubes.TheAppealhadbeenfiledbyMr.J.PaulGutleben. II Mr.DonaldJohnson,PlanningDirector,reviewedtheactionofthePlanningBoard,ascoveredinhis memorandumdatedFebruary16.ThiswasthesecondAppealbyMr.GutlebenfromactionbytheBoardto denyhisUsePermitapplicationtooperateafleamarketintheareaoftheTubes.Thepreviousaction hadinvolvedpropertyformerlyoccupiedbytheAlamedaDrive-InTheatre,onwhichMr.Gutlebenandhis partner,Mr.JoeAmaya,hadtriedunsuccessfullytoobtainaleasefromthePeraltaJuniorCollege District.Forthisreason,thepreviousAppealhadbeenwithdrawn. Mr.Johnsonstatedtheapplicantnowproposedtoleasean8.2-acreparcel,indicatedasParcel"8"onthe exhibitmap,fromtheStateDivisionofHighways,andalsoaparcelof2.7acres,Parcel"C"justnortherly ofParcelliB:,foroff-streetparking.Theproposalwastolocate423stallsforfleamarketuse,parking for300cars,installationofpermanentsanitaryfacilitiesintherequiredamounts,permanentfood vendingandhandlingfacilitiesplusfencingandgatesasneededtohandletrafficandparking.The applicanthadindicatedthatanylease,licenseorarrangementwiththeStateDivisionofHighwayswasdependentuponthegrantingofaUsePermitbytheCity. Mr.TheodoreCraig,Attorney,hadappearedinoppositionasrepresentativeofseveralinterestedparties,allofwhomownedpropertiesinthevicinity. Thestaffhadnottakenastrongpositioninoppositiontotheproposal,butremindedtheBoardthatif theUsePermitweregranted,atleasttwooff-streetparkingspacespertenantstallshouldprovidedas wellasrequirementsandconditionswhichotheragenciessuchastheCountyHealthDepartment,theCity EngineerandtheBuildingInspector,mightimpose.Itwasstatedtherewerealsocertainobjections fromthePoliceDepartmenttothistypeofoperationandthattheCitywasnotreallygearedtolevyameaningfulbusinesslicensetaxonoperationsofthistype. TheactionoftheBoardtodenytheUsePermitwasonthefindingthattheapplicantdidnothaveafirm planfordevelopment,nocommitmentfromthepropertyownerwasineffect,theuseproposedpresented certainpoliceproblems,adequatearrangementsforcopingwithtrafficandvehicularparkingwerenot knownandtheapplicantdidnotdemonstrateanycompellingcommunityneedfororbenefitfromtheintendeduse. InresponsetoaquestionbyCouncilmanFore,Mr.Johnsonsaidhecouldnotverifythesaledatebuthe hadbeenadvisedbytheRightofWayDepartmentoftheStateDivisionofHighwaysthatthelandinquestion wouldsoonbedeclaredsurplusandbeputoutforpublicbidorauction.Hesaidhedidnotknow,ifthe landshouldbesold,whethertherewouldbeanyrestrictionsastoitsuse. CityAttorneyCunninghamstatedtheissuebeforetheCouncilwaswhetherthefindingsandactionsofthe PlanningBoard,underSection11-162(e)oftheMunicipalCode,shouldbeaffirmed,modifiedorreversed. Onthecallforproponents,Mr.J.PaulGutleben,2844SanJoseAvenue,cameforward.Hepointedoutthe useproposedinhisapplicationwasnotincludedintheMunicipalCode.HesaidattheHearingbeforethe Boardonhispreviousapplication,whenitwasrevealedthathehadbeenunabletoobtainuseofthe Collegepropertybecauseofcertaincomplications,ithadbeensuggestedthathelookforanotherpieceof propertyandthesubjectareahadbeenmentioned.Hesaidithadbeenstatedthatthepropertywasve~y closetotheCollegeandhepointedoutitwasactuallymanyhundredsoffeetaway.Mr.Gutlebenadded thatthestudentswouldbeatschoolduringtheweekdaysandpeopleworkingintheareawouldbethere duringtheweek.Ontheweekendsthelocationwouldbedormantandthiswouldbethetimethefleamarketwouldbeoperated. Mr.Gutlebensaiditwastruehedidnothavealeaseontheproperty.Hesaidtherehadbeenanoticeinthenewspaperthatthepropertywouldbegoingupforabidrental. backingtosubmitabidtopurchasetheparcel.However,hewanted Citytousetheproperty.Hepointedouttheareawasindicatedin mentsinthefutureand,intheinterim,hewouldliketouseitasbringconsiderablemoneyintotheCity Hesaidhealsohadthefinancial firsttosecurepermissionfromthe theGeneralPlanforhigh-riseapart- proposed.Hefelttheenterprisewould Mr.Gutlebensaidheandhisprospectivepartner,Mr.JoeAmaya,werevoters,werepurchasingtheirhomes intheCity,andtheirchildrenattendedlocalschools.HeintroducedMr.Amaya,whohadformerlybeen theGeneralManagerofthePennyMarket,whichhadoperatedattheIslandAutoMovieItwaspointedoutthatMr.Amayawasnolongerassociatedwiththatbusiness. Mr.Amaya,1225UnionStreet,thenaddressedtheCouncil.Heindicatedontheexhibitmaptheareaforthe proposedoperation,andexplainedtheoperationofafleamarket.Hesaidorganizationsaswellasindivi- dualsparticipatedinthebusiness.Heindicatedthetrafficflowontheproperty,whichhesaidwouldnotinterferewiththeTubeentranceandexit. CouncilmanMcCallinquiredifMessrs.GutlebenandAmayahadanythinginwritingfromtheStateDivision ofHighwaystotheeffectthattheycouldgetaleaseonthesubjectpropertyiftheCityCouncilshould granttheAppeal.Mr.Gutlebenpointedouthehadmentionedthenoticecallingforbidsontheproperty. Hesaidoriginallytheyhadhaditprettywelltiedupandsomeoneelsehadalsobecomeinterestedinthe property.TheStatehadthendecidedtoadvertisethebidforlease.CouncilmanMcCallpOintedoutthe noticewascontradictorytohisunderstandingthatthepropertywastobedeclaredsurplusandputupforsalesometimeinAprilorMay. CouncilmanMcCallstatedhewouldwanttoseesomethinginwritingthattheStateintendedtosellthe propertyinvolvedinthiscase.HecomplainedthattheCityhadnotbeeninformedofanyintentionsthe Statemighthavefortheland.Hepointedoutthattremendousdevelopmentwaspossibleinthegeneralarea andsaidhewouldhatetoseeanythinginterferewithdevelopmentofthelandentoto.Mr.Gutleben repeatedhewashopingtobegrantedatemporaryuse.Herealizedthelandwouldincreaseinvalue.He arguedthatthelotwasvacantatthepresenttimeandwasbringingnoreturntotheCityortheStateand hewouldliketouseit.HerepeatedhefelttherewasnouseofnegotiatingwiththeStateontheleaseifhecouldnotgetthenecessarypermitfromtheCityofAlameda. CouncilmanForequestionedMr.Amayaastotheplansformeetingthehealthproblemswhichwouldbeinvolved. Mr.AmayastatedrequirementsoftheAlamedaCountyHealthDepartmentwouldbecompliedwithinrespectto sanitaryandeatingfacilities.Hesaid,inreplytoanotherquestion,thattherehadbeensomeproblems withtrafficattheIslandAutoMovieoperationbuttheywerenotserious.Hestatedsalestaxeswere figuredbytheindividualonhissales,insertedinanenvelopeanddroppedintoaboxprovidedforthepurpose,uponleavingthepremises. CouncilmanLongakerinquirediftherehadbeenpoliceproblemswiththePennyMarketoperationinvolving stolenarticlesbeingsoldandfrequentpolicecalls.Mr.Wellerstatedheunderstoodtherehadbeensome concernonthepartofthePoliceDepartmentinthisconnection.Heexpressedtheopinionthatthiswasaninherentproblemwithenterprisesofthisnature. Onthecallforopponents,Mr.RobertBuchman,Attorney,520SixteenthStreet,Oakland,addressedthe Council,onbehalfofMr.A.V.Barnhill,whomheintroduced,Mr.RobertHannonandMr.TevisJacobs,San FranciscoAttorneyrepresentingReese's,anationalconcernwhichhadjustpurchasedSolomonGrundyand theMannings'propertyinthisareainconnectionwithproposedconstructionofarestaurant. Mr.BuchmanstatedatthePlanningBoardHearinginthismatterhehadunderstoodtheapplicantstosay therewouldbeanycustomerparkinginthe8.2-acreparcel,thatitwouldbeonlyforthesellersand forthefoodconcessions.HesaidfromwhathecouldseeinareportfromtheStateofferingtheproperty forlease,withbidscomingupFebruary27,Parcel"C:wasnotupforbid,onlythe8.acreparcel. Mr.BuchmanindicatedontheexhibitmapthepropertyownedandleasedbyMessrs.BarnhillandHannon, andpointedoutthatanyparkinginconnectionwiththeproposedmarketwouldhavetobewiththeconsent ofsomeoneandshouldbeinanareawhichhadbeenpavedandproperlysetup.Hesaidhehadinspected thepropertyandmostofthelandwassomewhatunderwater,veryguttedandrough,notmarkedasto entrancesandexitsandwithnostalls.Hebelieveditwouldpresentatremendousparkingproblem, irrespectiveoftheinconveniencetothepropertyowners.Mr.BuchmanstatedMr.Hannonalreadyhad plansdrawnforhisdevelopment.Theywerequiteconcerned,hesaid,withthetrafficflowonthe weekendswiththenumerouscustomersoftheyachtharbor,manyofthemcarryingboats. Mr.BuchmanstateditwashisunderstandingofthebidrequestedbytheStatethatthiswouldbefora month-to-monthoccupancy.Also,hesaid,theStatemadeitclearthatthebidderwouldhavetobe responsibleforallpermanentimprovementsalthoughnonecouldbeundertakenwithoutitsconsent.He claimedtherehadbeennoevidenceatthisHearingthattherewassuchconsentorplanapprovedbytheState. Mr.Barnhill,2394WebsterStreet,thenaddressedtheCouncil.Hepointedoutthattheingresstothe property involved,comingfromAlameda,wasaverydangerouscornerwheretherehadbeenseveralacci- dents.HesaidthereweremanytruckscomingfromtheNavalSupplyDepotusingthestreetand150to 200carsparkedthereonSaturdaysandSundays.Hesaidstevedoresworkingintheareausedthelot indicatedasParcel"CII forparkingtheircars.Hesaidtherewasaterrifictrafficproblematthe presenttimeandanyadditionalcarswouldjustaddtothehazard.Mr.Barnhillsaidtherewasalsoa greatdealoftrashblownintotheareaandhefeltthiswouldbeaggravatedbytheproposedbusiness. Healsocomplainedthattherewereproblemswithpeoplesight-seeing,whichhefeltwouldbeincreased. CouncilmanMcCallexpressedtheopinionthatinviewofthefactspresentedtheproposedbusinesswould notbesuitablefortheareaandmovedtheAppealbedeniedandtheactionofthePlanningBoardbe upheld.CouncilmanForesecondedthemotionwhichcarriedonthefollowingrollcallvote.Ayes:Five.Noes:None.Absent:None. Itwasrecommendedthatleasearrangementswithprivateadjoiningownersbeworkedout,thatfuture recreationaluseofthepropertybeconsideredatsuchtimeasthePortofOaklandorothersdeveloped SanLeandroBayforrecreationaluses,thatthethreeten-footwalkwaysextendingfromFernsideBoulevard tothefederally-ownedpropertyintheEstuaryalsobeofferedforleasetotheadjoiningprivateowners, andifleasescouldnotbenegotiatedtheCityshouldmakearrangementstomaintainandcontroltheproperty. CouncilmanMcCallexpressedtheopinionthatallmembersoftheCouncilwereincompleteagreementwith therecommendationsoftheBoardinthismatter.Hesuggested,ifleaseagreementscouldbenegotiated withpropertyownersnowusinglandwhichrightfullybelongedtotheCityfromanadministrativeandalegalstandpoint,thatthisbedone. CouncilmanLongakersuggestediftheprivateownersadjacenttothethreepublicwalkwayswerenot interestedintheseways,theCitytakethenecessarystepstokeepthemclean. CouncilmanMcCallmovedthereportoftheBoardbeaccepted.CouncilmanLongakersecondedthemotion. Mr.WellersuggestedtheCityAttorney,theCityEngineer,thePlanningDirector,otherstaffmembers andhesubmittotheCouncilaproposedstandardleaseindicatingthegeneralbasis,includingtermand formulaforcompensation,forthecomputationoftheleasearrangement.HefeltiftheCitywereina positionofattemptingtonegotiatealeasetheCouncilshouldhavetheopportunitytoreviewthe limitswithinwhichitwouldwanttoauthorizenegotiations.Ifthegeneralformofleasewasacceptable totheCouncil,arrangementscouldthenbemadeforindividualnegotiations. Mr.Cunninghampointedoutthat,inanyevent,theleaseswouldcomebeforetheCouncilforfinalaction. Thequestionwasthenputandthemotioncarriedonthefollowingrollcallvote.Ayes:Five.Noes:None.Absent:None. TheCityManagerandtheCityAttorneywererequestedtodraftproperleasesforapprovalbytheCouncil beforeanynegotiationswereenteredintowiththepropertyownersinvolved. PresidentLaCroixrequestedthatMr.JohnsonconveytothemembersofthePlanningBoardtheappreciation oftheCouncilfortheexpeditiousmannerinwhichthismatterhadbeenhandled. 11.FromtheCityManager,recommendingextensionoftimeoffiveworkingdaysbegrantedontheproject ofConstructingtheClintonAvenueStormSeweratOakStreet. CouncilmanMcCallmovedtherecommendationbeadopted,thattherequestedtimeextensionoffiveworkinq daysbegrantedforcompletionoftheworkonthedesignatedproject.CouncilmanLevysecondedthemotion whichcarriedonthefollowingrollcallvote.Ayes:Five.Noes:None.Absent:None. UNFINISHEDBUSINESS: 12.PresidentLaCroixraisedthequestionoftheformerWebbAvenueFireStationwhichhadbeenlyingidleforsometime,onwhichareporthadbeenrequestedfromtheCityManager. PresidentLaCroixcommentedthattherehadbeenrequestsfromvariousgroupsintheCityastothepossi- bilityofusingthebuilding.HesaiditwasrealizedthatthebuildingwasnotuptoCodeandaconsider- ableexpenditureoffundswouldberequiredtorenovateit.Hesubmittedforconsiderationthepossibility ofputtingthepropertyupforsaleontheopenmarkettoacquirethebestpossibleuseforthesite, takingintoconsiderationtheadjacentbusinessesandtheclimateofbusinessinthearea. ItwasfeltitwasimportanttogiveconsiderationtothebestuseofthepropertyaccruingtotheCity andnotthehighestamountofmoneyavailable.TheothermembersoftheCouncilwereinagreementwiththeproposal. AtthesuggestionoftheCityManager,itwasdirectedthatanappropriateresolutionorsomeotherkindof recommendationbesubmittedforconsiderationbytheCouncilatitsnextmeeting,specifyingmorepreciselyconditionstobeincludedinthecallforbids. Mr.CunninghampointedouttheCouncilwasnotrequiredtoputthispropertyouttobidsothatitwould notbeboundasitwasinpublicworkscontractstoacceptanybid. 13.CouncilmanForerecalledthatinJune,1968,Charteramendmentshadbeenincludedontheballotfor thePrimaryElection,withregardtoanelectedMayor.HeproposedthattheCouncilattempttohave consolidatedwiththePrimaryElectiontobeheldJune2,1970,theissueofanelectedMayorwithno changeinsalaryfromthatpresentlyprovidedbytheCityCharterfortheMayorandtheCouncilmen,the CounciltoconsistofaMayorandfourCouncilmen. Therewasdiscussionontheproposalandthequestionofwhetherasalaryshouldbestipulatedforthe Mayorandtheamount.CouncilmanMcCallexpressedtheopinionthattheMayorshouldreceiveadditional compensationoverthatpaidtotheCouncilmen.andhesuggestedaminimumof$200permonth.Herecalled hispredictionduringdiscussionsonthepreviousactiontoputthismatterbeforetheelectorsoftheCity thattheattachmentofaMayor'ssalaryof$600permonthhad"killed"themeasure.Hesaidhefeltthere wouldhavetobesomekindofchoiceofferedtothevoters. Mr.CunninghamstatedtheCityClerkhadbeeninformedbyMr.ReneDavidsonoftheElectionsDivisionof theCountyClerk'sOfficethattheAlamedaCountyBoardofSupervisorshadbeenrequestednottoaccept anyrequestsforconsolidationpriortotheBoard'smeetingofApril7.Thismeantthatactionbythe CityCouncilwouldhavetobetakenbyitsmeetingofMarch17,withrespecttoadoptionoftheappropriate resolutions,unlessaspecialmeetingweretobecalledforthepurposeofactingonthematter. CouncilmanMcCallsuggestedthattheCouncilreceivetwoorthreeproposalsonthequestionwhichitmight considerinanattempttodecideonameasure,orpossiblyameasureandanalternate,whichwouldbeinthebestinterestsofthecommunity. PresidentLaCroixremarkedthatheappreciatedfully.fromhisownexperience,thetimepreviousMayors hadcontributedtotheposition.Hesaidhefeltiftherewerenotsomeadditionalcompensationgiven totheelectedMayor,shouldthisbethewishesofthevotersoftheCity,therewouldbetheriskof attractingonlycertainindividualswhocouldfindthetimeandwhoenjoyedtheeconomicstationbywhich theycouldaffordtogivethetimenecessaryforthejobofMayor.Hefeltonthisbasistherewouldbe manycompetentpeoplewithintheCitywhocouldnotconsiderrunningfortheoffice.Hedidnotfeelit wasnecessarytoincludethedutiesoftheofficebutifthepeoplewantedtheopportunitytochoose whetherornottheywantedtostaywiththepresentmeansofselectingtheMayorfromtheCouncil,all membersbeingelectedatlargefromtheCity,orwhethertheywishedtoelectaMayorandfourCouncilmen, thisshouldbetheirchoice.Hefelttheparamountquestionwouldhavetobethelevelofcompensation andthattheamountshouldbesuchthatitwouldnot"kill"thepossibilityofanelectedMayorbutshould makeitpossibleforindividuals,regardlessoftheireconomicstation,torunfortheoffice. CouncilmanLevyalsobroughtupthequestionofthelengthoftermanelectedMayorshouldserve,whether two,fourorsixyears.Thisissuewasdiscussedbriefly.CouncilmanMcCallstatedhewouldnotbeinfavorofalengthoftermlessthanfouryears.
