WRITTENCOMMUNICATIONS: 2FromAlamedaPoliceAssociation,signedbyOfficerPatrickM.McDermott,President,enlistinqthe supportoftheCityCouncilinbehalfoftwelveAlamedaCountySheriffOfficerswhohadbeenindictedby theFederalGrandJuryinconnectionwiththeriotsintheCityofBerkeleysomemonthsago. CouncilmanLongakerstatedhefelthedidnotknowenoughabouttheissuetovoteintelligentlyonit exceptthefactthattheGrandJury,assetupbytheGovernment,apparentlyhadgoneintothematter fully.Thosewhohadbeenindicted,hefelt,wouldbeabletoprovethemselvesinnocentofanycharqes. PresidentLaCroixexpressedtheopinionthateveryonesupportslawofficers,thereasonfortheir existenceandtheactionstheyareaskedtotakeonbehalfofallcitizens.Hestatedthereareproper formsoflawintheUnitedStatestowhichallshouldadhere.HeagreedwiththestatementofCouncilman Longakerthat,undertherightsoftheGrandJurytoindict,thishadbeendoneandcertainlytheofficers involvedinthisinstancehadtherightofrecoursewhichproperlyshouldbethroughthecourts. Therebeingnofurtheractiontobetakeninthematter,thecommunicationwasorderedaccepted. 3.FromMr.W.Walker,925CentralAvenue,protestingagainsttheUtilityUsersTaxandinquiringastothecollectionofataxbytheBureauofElectriCity. CouncilmanLevypointedoutthattheBureauofElectriCityhadjustannounceditwouldlevythefivepercentuserstaxwithinthenextmonthortwo.Mr.Walkerwastobesoinformed 4.FromBayFarmIslandReclamationDistrictNo.2105,signedbyMr.BruceT.Mitchell,Secretary, requestingapprovalofWarrantNo.168intheamountof$50,000toreplenishtherevolvingfund. Thismatterwasreferredto"Resolutions", 5.FromMr.RobertE.Hannon,requestinganextensionoftimeoftwoyearsinwhichtocompletethe improvementsinconnectionwithParcelMapNo.318,inVOlvingpropertyontheeastsideofWebsterStreetattheEstuary. CityEngineerHanna,onrequest,statedhehadnoobjectiontotheextension,nocontrolwouldbelostand therewasnoneedfortheimprovementsuntilsomethingwastobedonewiththeproperty. PresidentLaCroixpointedouthewouldnotwantitconstruedbyanyoneintheaudiencethattherewasquilt onthepartofanyofthemeninvolvedinthiscasebecauseofwhatmighthavebeenprintedinthenews 7.IntheMatterofanAppealfromthedecisionofthePlanningBoardtodenyaUsePermittoalIowan outdoorcommercialuse(fleamarket)onthegroundsoftheIslandDrive-InTheatre.TheAppealhad filedbyMr.AlbertH.KessleronbehalfofConcordTheatreCo.andGenevaTheatre,Inc. AcommunicationhadalsobeenreceivedfromKessler,Kessler &Buchman,AttorneyssignedbyMr.AlbertH. Kessler,requestingthattheHearingontheAppealbecontinuedtotheCouncilmeetingofMarch17. Therebeingnoobjections,itwasstatedtheHearingonthisAppealwouldbecontinuedtothenextregularmeetingoftheCityCouncil,onTuesdayevening,March17,1970. 8.IntheMatteroftheProposedRezoningofcertainpropertiesinthe2400and2500blocksofWebb andLincolnAvenuesandthe1500blocksofEverettStreetandBroadwayfromtheIIC-211,CentralBusiness District,tothe"R-411,NeighborhoodApartment,andthe"R-511,GeneralApartmentDistricts.Apetition hadbeenfiledbyMr.JosephLucaseyandthePlanningBoardhad,onitsownmotion,extendedtheareaforconsideration. TheClerkstatedtherewasonhandtheAffidavitofPublicationofNoticethatthiswouldbethetime andplaceforHearinginthematterandtheminutesofthePlanningBoardmeetingsatwhichthesubjectwasconsideredhadbeensenttotheCouncilmen. TherehadalsobeenreceivedfromMr.FolkeTyreen,ownerofpropertyat2425-27\~rebbAvenue,aletterindicatinghewasinfavoroftheproposedreclassification. Mr.DonaldJohnson~PlanningDirector,describedtheextensiveareacoveredbythezonechangeproposal bymeansofamapprojectedonthescreen.Hesaidtheproposalconcernedtwodistinctareas,one boundedbyLincolnAvenue,EverettStreet,WebbAvenueandbisectingtheblockrunninggenerallybetween ParkandEverettStreets,calledArea"AIIontheexhibitmap,andthepropertiesbounded by Everett Street,LincolnAvenue,Broadwayandgenerallybyapropertylinerunningbetween\~ebbandSantaClara Avenues,calledArea11811,HecommentedthatArea"AIIwastheprivatelyheldpropertywhichhadforsome timebeenconsideredbytheUnitedStatesPostOfficeDepartmentforabuildingsite.Followingits decisiontolocateelsewhere,Mr.Lucasey,ownerofpropertyknownas2426LincolnAvenue,hadfiledan applicationtorezonethepropertiesindicatedasArea"A"fromthe"C-2"totheIR-5"District.The applicationhadstatedtheareawaspredominantlyinresidentialuseand"C-2"zoningactuallypenalized thepropertyownersas,undertheordinance,thiscategorywouldnotallowreconstructionofresidentialusesinanycaseexceptsubjecttocertainlimits. FollowingtheHearingontheLucaseyapplication,duringwhichitwasindicatedthatresidents in the areafavoredtheproposedchange,theBoardhadelectedtoexpandthechangetoincludeArea liS IIThe initialproposalhadbeentorezonebothareasto"R-5".However,f'olIowinqconsiderabledis and asecondpublichearing,theBoardhaddecidedtorecommendthatArea"A"berezonedtotheIIDistrict andArea"B",asmodified,tothe"R-4"District.Thiswasgenerallyacceptabletoproperty ownerswho appeared,withonlyoneprotestandfifteenpersonsinfavoroftheproposal.TheChamberofCommercehadfavoredthechange,subjecttocertainmodifications. CouncilmanLevyexpressedtheopinionthattheproposalwaslogicalandacceptableandshouldbevery beneficialtothepropertyownersinvolved,providinganopportunityforthemtoenhancetheirincome. HefeltalsothatdevelopmentofthepropertywouldbebeneficialtotheParkStreetmerchants. CityAttorneyCunninghamstatedtheissuebeforetheCouncilwaswhetherthefindinqsandrecommendation ofthePlanningBoardanditsadvisoryreport,baseduponSections11-172(c)and11=175oftheMunicipalCode,shouldbeapproved,modifiedordisapproved. Onthecallforproponents,Mr.JosephLucasey,2950NorthwoodDrive,addressedtheCouncil.Hestated ithadbeenalongtimesinceanythinghadbeendonewiththeareainquestionandhefeltnocommercial developmentwouldbeattemptedthereformanyyearstocome.HefeltthechangetoresidentialzoningwouldbringfamiliesandadditionaltaxestotheCity. Mr.JackCox,2517WebbAvenue,saidthepropertyownersintheareaunderdiscussionhadbeenpenalized duetotheinabilitytogetfinancingforimprovementsunderthe"C-2"zoning.Hefelttheyhadsufferedlongenoughandshouldreceivesomeconsideration. Mrs.SylvanaKerr,1527EverettStreet,saidshedesiredtobuildaresidenceand"vasinfavoroftherezoning. Mr.HaroldFlynn,2528WebbAvenue,statedthepropertyownerstriedtokeeptheirhomesupandhebelievediftheareawererezonedanevengreaterimprovementwouldbeseen. Mrs.RuthWhittington,2530WebbAvenue,statedthehomebelongedtoherauntandsheunderstoodifthe houseweretobedestroyedbyfireherauntwouldloseeverythingbecauseshecouldnotrebuild.She saidshecouldnotseewhereaone-waydead-endstreetcouldbeofanycommercialvalueandwasinfavoroftheproposal. Onthecallforopponents,Mr.DarolTownsend,1521Broadway,spoke.Hesaidhisbusinesswaslocated at1523Broadway,wherehealsorentedspacetoaceramicsupplybusiness.Hesaidtheproposedzone changewouldhavetheoppositeeffectonhimasonthepeoplewhohadspokenpreviOUSly.Ifhis propertywererezonedtoaresidentialcategoryandhisbuildingshouldbedestroyed,hewouldnot abletorebuildcommercially.Hesaidhehadpurchasedthepropertiesbecausetheywerezonedcommer- cially;hisfutureplansweretoteardownallthebuildingsat1521and1523Broadwayandpossibly buildofficebuildings,butundertheproposalhewouldnotbeabletodoso.HesaidatthePlannina BoardmeetinganargumenthadbeenpresentedtoexcludetwobusinesslocationsonSantaClaraAvenue. Herequestedthathebeallowedthesameexclusiononhisproperties.HesaidtheBoardhadnotopened thematterupfordiscussionafterchangingitsthinkingwithregardtorecommendinqthatArea"B"be rezonedtoIR-4"ratherthanto"R-5".HesaidhefeltthepropertyalongBroadwaywouldinthefuture beusedcommerciallybecauseoftheheavytrafficandthedifficultyofparkingonthestreet.is, hefelt,wouldnothappenifthezonewerechangedtoresidentialuseatthistime.Ifitwastoberezoned,however,hefavored"R-5"over"R-4"zoning. Uponrequest,Mr.JohnsonexplainedtheBoard,initsconsiderationofMr.Townsends situation,had feltifthelotsweretoremaininthe"C-2"District,thefivedwellingunitsonthepropertywould remainnon-conforming.Inthisparticularlocationthesewouldbeamuchmorepredominantuseand actuallyindicatethelanduseratherthanhiselectricalcontractingbusinessandothersmallbusinesses whichmightbelocatedontheproperty.Further,ithadnotbeentheintentthattherewouldbelarge apartmentdevelopmentsinthearea.Mr.Johnsonpointedoutthatunder"R-4"zoningmostoftheproperties alongBroadwayreferredtobyMr.Townsendwouldonlycarrythreeunits,thatmostoftheusewassi ncle- family,duplexandinsomecases,twotofourfamilies.Inotherwords,theuse"vasalreadyestablished andittendedtofollowtherecommendedzoning.Thestructureswereoldandgenerallyingoodcondition. Mr.RobertAdams,GeneralManageroftheAlamedaChamberofCommerce,addressedCoun1.Hesaid Chamberdidnotopposetherezoningbutsuggestedamodificationtousethecenterlineof~IebbAvenue asthedividinglinebetweenthe"C-2"and"R-4"Districtsinthiscase.Thereasonforthiswasthatthe feasibilityofdevelopingcommercialpropertyfacingonSantaClaraAvenuewithoutthebackhalfofthe lotswasquiteunlikely.HesuggesteditwouldbemorelogicaltozoneeverythinguptoSantaClaraAvenue inthe"R-4"Districtthanitwouldbetodividethelots.Hethereforesuggestedconsiderationbeaiven tothe"jog"recommendedbytheBoardaroundexistingcommercialpropertyneedingtheaccesstoHebbAvenue. Mr.Johnsonexplainedthereasonforthe"joq"wastoincorporateortoavoidthosepropertiesincontiguous ownershiporusedcommercially-theElPaseoBuildingandparkinglotandtheCalvaryBaptistChurch~both withparkinglotsextendingthroughtoWebbAvenue.HewentontoexplaintheBoard'sthinkinowithreoardtootherpropertiesintheimmediatevicinity. Itwaspointedoutthatifthereshouldbeanindicationofcommercialuseinthefuture,thematterofreclassifyingthepropertiescouldagainbebroughttotheBoardforconsideration. Mr.EdwardBrennan,1510EverettStreet,statedhehadrecentlyinvestedapproximately$3,000toimprove hisproperty,whichwasresidentiallyzonedinthe"C-2"District.Heexpressedtheopinionthatthere weresufficientvacantshopsintheCityandthattheareaunderdiscussionshouldbechangedtoresidentialzoning. TheHearingwasdeclaredclosed.PresidentLaCroixinvitedquestionsandcommentsbytheCouncil.Hesaid hebelievedtherezoningproposalunderdiscussionwasproperandonefromwhichthecommercialdistrictsoftheCityshouldbenefit,aswellastheresidentsoftheparticulararea. RESOLUTIONS: 14Atthistime,inordertoopenthesubjectfordiscussion,titlesofalternateresolutionswere read.ThefirstproposedanamendmenttotheCityCharterestablishingtheofficeofMayorasan electiveofficewithnoadditionalcompensation;thealternateproposedtheofficeofMayorbeelectiveatamonthlycompensationtobedeterminedbytheCouncil. TheproposalwastorequestoftheBoardofSupervisorsoftheCountyofAlamedathattheissuebe consolidatedwiththePrimaryElectionoftheStateofCaliforniatobeheldonJune2,1970,inorderthattheelectorsoftheCitymighthavetheopportunitytovoteonthequestion. PresidentLaCroixsaidhefeltthecitizenshadtheright,ifsodesired,toelecttheMayor.Hesaid healsobelieved,ifthisdecisionweretobemade,itshouldberecognizedthatanelectedMayorshould receivesomereasonablecompensationforthetimecontributedtocarryouttheoffice.Hequotedamounts paidtheMayorbysurroundingcities:Berkeley,$150permonth;Oakland,$7,500ryear;SanLeandro hadvoteddowntheCharteramendmenttopayitsMayorandtheCouncilofthatCityhadadoptedan ordinancecallingforaMayor'ssalaryof$800permonth;Hayward,$600permonth. CouncilmanLevysaidhefelttheelectorsshouldbegivenachoice.Hesuggestedaresolutionbe adoptedcallingforanelectedMayorwithoutcompensationandanotherresolution,alsotoappearonthe ballot,askingiftheMayorwassoelected,ifthecitizensofAlamedawouldconsiderafaircompensation forthatoffice.Hesuggestedtheamountofcompensationbesomethingwithinreasonandproposedan amountof$200permonth.Hebelievedthereweretwoseparateissuesinvolvedandelectorscouldindicate iftheywantedanelectedMayorand,iftheywantedthisprovision,theycoulddecidewhetherornottheywishedhimtohavecompensation. CouncilmanLongakersaidhefeltiftheMayorwastobeelected,partofthepackageshouldbeareason- ableamountofcompensationandthatitshouldbeincludedintheresolutiontobepresentedtothepeople foradoptionorrejection,asseenfit.Hesaidhealsofeltareasonableamountwouldbeapproximatelv$200permonth,andattheappropriatetimehewouldproposeamotiontothiseffect. CouncilmanForesaidhehadsuggestedtheCityhaveanelectedMayorandthiswasthereasonforthe resolutionontheagenda.Herecalledtheresultofthepreviouselectiononthematter,whenasalary hadbeenattachedtotheproposalandtheissuehadbeendefeated.Hefeltifasala~yweretobeattached tothepresentproposal,therewasnopointinputtingthematterontheballot. CouncilmanForesuggestedthematterofanelectiveMayorwithoutcompensationbesubmittedtotheelectorsoftheCityandmovedthefollowingresolutionbeadopted: "ResolutionNo. ProposinganAmendmenttotheCharteroftheCityofAlamedaonMotion oftheCityCouncil;CallingaSpecialMunicipalCharterElectionin theCityofAlamedaforthePurposeofSubmittingtotheElectorsThereof aProposaltoAmendSaidCharter,viz:ByAddingSection2-1.1and Section3-1.1Thereto,RelatingtoEstablishmentofOfficeofMayoras ElectiveatLargewiththeCityCouncilThereaftertoConsistofiMayor andFourCouncilmen;FixingDateofSaidElection,MannerofHolding Same,andProvidingforNoticeThereof;andConsolidatingSaidSpecial MunicipalCharterAmendmentElectionwiththePrimaryElectionofthe StateofCaliforniatobeHeldonJune 2,1970," CouncilmanLevy,inordertoplacethematteronthefloorfordiscussion,secondedthemotion CouncilmanLevyinquiredofCouncilmanForeifhewouldentertainaproposalforasecondresolution leavingthedecisiontothevoters,iftheelectorateshoulddecidetheofficeofMayorshouldbe elective,whethertheMayorshouldreceivecompensationintheamountof$200permonth.CouncilmanForewasagreeabletothisproposal. CityAttorneyCunningham,onrequest,explainedthatbothresolutionssubmittedforconsiderationcould beadopted,althoughhewouldnotrecommendthisprocedure.Hesaidinsuchacase,wheretherewould beconflictingresolutions,bothofwhichcouldnottakeeffect,ithadbecometheruleoflawthatthe onereceivingthegreaternumberofvoteswouldbeadopted.Hesuggested,ifitwasthedecisionofthe Counciltoputontheballotcontingencymeasures--forexample,oneaskingthequestion,"Shallthe Mayorbeelected?"withnomentionofsalary,andanotherquestioninthesamemeasure,"Intheevent MeasureA,forinstance,isadopted,shalltheMayorreceiveasalaryofXXXDollars?"-thesewouldbe contingentandhefelttheywouldbetterservethepurposeofCouncilmanLevy'sproposal.Hesuggested, ifthisideaweretobeacceptedbytheCouncil,thatResolutionNo.1beadoptedandhebedirected toprepareasuitablecontingencymeasuretoaccomplishwhatCouncilmanLevyhadproposed. Mr.Wellerurgedthatalternativeresolutionsnotbeadopted.Hesaidhefelttheelectorate,ifthis weredone,wouldapprovetheconceptoftheelectedMayorandrejecttheconceptofcompensationforhim. HefeltthepublicwasbeingmisledifitconsideredthatthejobofelectedMayor,asbeingrepresented tothem,couldbeconductedwithoutcompensation.Hesaidtothebestofhisknowledgetherewasno directlyelectedMayorintheStatewhodidnotreceivecompensationandifexperienceinothercommunities meantsomething,assuggestedbysome,itmightalsosuggestthatthedirectlyelectedMayorshouldbecompensated. Mr.Wellersaidhefeltifitwasrepresentedthattheindividualholdingtheofficewouldkeepreqular officehours,forexample,representtheCityinintergovernmentalrelationshipsandatmeetingsin otherpartsoftheStateandinotherpartsofthecountry,andthatallofthiswouldbedonewithout compensation,thiswouldnotberealistic.HepointedoutthatinSanLeandro,theelectoratehadon threeoccasionsturneddowntheissueofcompensationfortheMayorbecausetheCharterprovisionwhich wasinitiallyapproveddidnotincludecompensation.HecommentedonthedeviceemployedbytheSan LeandroCityCouncilofpassinganordinancetoestablishcompensationfortheMayor. Mr.Wellersaiditseemedtohimonlyfair.equitableandreasonabletoputbeforetheelectoratea propositionwhichhonestlywouldstatethecase,thattherewouldorwouldnotbeanelectiveMayorbut, ifthiswasdone,hewouldbecompensatedreasonablyfortheworkhewoulddo. ThequestionwasthenputonadoptionoftheresolutionproposinganelectedMayorwithnocompensation andthemotionwaslostonthefollowingrollcallvote.Ayes:CouncilmenForeandLevy,(2).
