Mr.SlackwaspresentandwasinvitedtoaddresstheCouncilwithregardtohisproposal.Hestated thesaleoffishandchipsbymobiletruckwascommonpracticeinEngland,hishomecountry,andhe couldseenoreasonwhyitcouldnotbebroughttotheUnitedStates.Heexplainedhisapplication wasbroughtaboutbyaconstantflowofrequestsfromcustomersforhomedelivery. Mr.Slacksaiddeliveryofhisproductwasnotpracticalasthefishandchipsmustbecookedand servedwithinamatterofsevenoreightminutes.Heproposedthattheproperandmosthygienicway todothiswouldbetopreparethefoodoutsidecustomers'homesonorderandheplannedtoimportaspecial rangefromEnglandforthepurpose.Ifsuccessful,hehopedtohaveafleetoffortytrucks. HEARINGS: 4.ContinuedfromthemeetingofMarch3,1970.inthematterofanAppealfrom PlanningBoardtodenyaUsePermittoallowanoutdoorcommercialuse,afleamarket, oftheIslandDrive-InTheatre.TheAppealhadbeenfiledbyMr.AlbertH.Kessleron TheatreCo.andGenevaTheatre,Inc. decisionofthe ongrounds behalfofConcord TheAppellantshadbeeninformedthatthiswouldbethetimeandplaceforthecontinuedHearinginthe matterandtheminutesofthePlanningBoardmeetingatwhichtheapplicationwasconsideredhadbeen senttotheCouncilmen. InadditiontothecommunicationsnotedatthelastmeetingoftheCouncilinfavorofthisproposal, lettershadbeenreceivedfromthefollowingwiththepleathatthefleamarketbereopened:Mrs.C.J. AletterhadbeendeliveredatthemeetingfromMr.andMrs.D.Gruber,1717HighStreet,andninety-four additionalsignatureshadbeenfiledtobeaddedtothepetitionpreviouslysubmitted,infavorofthe fleamarket. CommunicationshadalsobeenreceivedfromMr.J.PaulGutleben,2844SanJoseAvenue,andMrs.Lillian Strom,ManageroftheKimberlyArmsApartments,1850ThauWay,accompaniedbyapetitionsigned twenty-fivetenantsoftheApartments,inprotestagainsttheproposal. PresidentLaCroixstatedheandtheotherCouncilmenhadreceivedmanyletterson additiontothoselisted. ismatterin Mr.DonaldJohnson,PlanningDirector,onrequest,reviewedtheHearingonisAppealbeforetheBoard anditsactionthereon,ascoveredhismemorandumdatedFebruary26,1970.statedMr.Kessler, hisbrotherLes1ie.andMessrs,RobertLippertandRaymondSyufy,ownersofthecompanynowoperating theIslandDrive-InTheatre,proposedtooperateafleamarketonthepremises.Asimilarbusinesshad beenoperatingatthislocationsinceabout1960,hebelieved.NoUsePermithadeverbeenobtained forthepreviousoperationanditwasdeemedneitheralegalnoraconforminguse.Itdidnotenjoy non-conformingstatusinthatithadbegunafterthedateofadoptionofpresentZoningOrdinance. IthadbeenrequiredthataUsePermitbeprocuredforthenewenterprise. Theproposalofthenewoperatorswasthatthefleamarketwouldoperatedbasicallyasformerly,with somerefinement,assetforthintheirfour-pageoutlinesubmittedwiththeapplication,copiesof1ch hadbeensenttotheCouncilmenfortheirinformation.Sevenpersonshadappearedinsupportofandone inprotestagainsttheproposal.TheHousingAuthorityoftheCityofAlamedahadalsofiledaletter inprotest. 41 TheapplicationhadbeendeniedbytheBoardonthefindingthattheoperationwouldDeincompatible withtheanticipatedplansforthearea,thattheapplicantcouldnotassurerequiredoff-streetparking, andthatnodetailedplanshadbeensubmittedforBoardreview.Atthetimeoftheapplication,itwas notknownwhethertherewouldbealeaseoranoccupancyagreementfortheareanorthoftheDrive-In Theatrepropertywhichtheapplicantsproposedtouseforoff-streetparking.Hesaidheunderstood therewasaleaseorrentalagreementnowinexistenceforpropertygenerallyownedbyDelNonteand,in thiscase,underdirectownershipofAlaskaPackersAssociation,Inc.•foroff-streetparkinguse. l~r.Johnsonsaidthestaffpositionwassimplythat,asasubjectivematter,itwouldrecommendagainst itandasanobjectivematter,itwashardputtodoso.Itwasfoundthattheusewasnotparticularly beneficialnordetrimentaltotheCity.ItwasalsofoundthatotherCitydepartmentswereopposedto theproposalforcertainreasons,suchasthePoliceDepartment,onthefindingthatitwasapossible locationforundesirableactivities;theHealthDepartment,whichstipulatedthatcertainconditionsmust bemet;andtheBusinessLicenseoffice,whichstateditwasnotreallygearedtohandleanoperationof thistype. Mr.JohnsonstatediftheCouncilshouldbedisposedtooverruletheBoardandgrantaUsePermittoallow thefleamarket.hewouldsuggestfiveconditionsasaminimum,whiheenumerated. PresidentLaCroixinquiredof[VIr.JohnsoniftherehadeverbeenanattemptbytheCitytoclosedownthe previousfleamarketduringtheperiodofitsoperation.Mr.Johnsonstated,tohisknowledge,isflad neverbeendone. CityAttorneyCunninghamstatedtheissuebeforetheCouncilwaswhetherornottheactionandfindingsof thePlanningBoard,takenunderSectionll-162(e)oftheAlamedaMunicipalCode,shouldbeaffirmed, modifiedorreversed. Onthecallforproponents,Mr.AlbertH.Kessler,520-16thStreet,Oakland,addressedtheCouncil.He requestedtheopportunitytopostontheboardanaerialview.Copiesofanarchttect l srenderingofthe proposedoperationweredistributedtotheCouncilmenfortheirexamination. Mr.KesslerstatedtheTheatreCompanieshadpurchasedtheIslandDrive-InTheatrepropertyaboutfive yearsago,subjecttoanexistinglease,anditwasnecessarytowaitfortheleasetorunouttotake possession,whichhadbeendoneonJanuary28,1970.SincethatdatetheyhadbeenoperatingtheTheatre andplannedtocontinuetodoso.Obviously,thepreviousoperatorhadallowedthepremisestorundown andtheywereinneedofagreatdealofrepair.Hesaidprovisionswerebeingmadetodocertainthings, someofwhichdependedonwhatDelMonteCorporationwasplanning.Whenthelatterlsintentionsweremore concrete,definiteplanscouldbemadeastohowfartheywouldgoinremodeling. jVlr.KesslersaidtheyhadleasedfromEncinalTerminalsthepropertybetweentheendoftheDrive-In TheatreandtheroadleadingoutfromtheoldBethleheminstallationtoWebsterStreet,comprisingsomewhat oversixacres,andtheirarchitecthadestimatedtherewouldbeparkingforapproximatelyeighthundred carsinthearea.Heavyequipmentwouldhavetobeusedtocleartheareaandfenceswouldhaveto repaired.HeexplainedtrafficwouldentertheTheatregroundsthefrontentrancethroughthreeDooths, throughtheTheatreandbackintotheparkingarea,sotherewouldbenocongestioninthestreet.Exit wouldbebyagateatthefrontoftheparkingareaontoWebsterStreet.[vir.Kesslersaiditwasintended tolandscapethefencesalongWebsterStreetandatfrontofthegrounds. Mr.KesslerofferedtoanswerthequestionssetforthbyMr.Johnsoninthisconnection.Hesaidinpro- vidingaratiooftwospacespertenants1,theyhadbeeninformedbyi~r.Braun,themanagerofthe Pennyrvlarketfortenyearsunderthepreviousowners,theaverageattendancelastyearwas293vehicles perweek.Hesaidtheyestimatedtherewouldbe250or300parkingplacesinsidetheTheatreandapproxi- mately800spacesinthearearentedfromEncinalTerminals. rvlr.KesslercontinuedthatIvtr.Johnsonhadsuggestedeightuniformedparkingattendantsbeprovided,and hepointedoutthattheirletterhadstatedtheywouldprovideeighttotensuchattendantseverySunday, uniformedandfurnishedwithawalkie-talkieoutfitforcontactbetweenthemselvesandwiththeoffice. HesaidtheyalsoplannedtohaveanattendantstationedoutsideandinfrontoftheHousingAuthority propertytokeeppeoplefromparkingthere.Therewouldbeauniformedsecuritypatrolmanonthepremises atalltimes.Hesaidtheywouldpreferhavinganoff-dutyAlamedapoliceofficer,ifthiswaspermitted; ifnot,theywoulduseauniformedsecurityofficer. Mr.KesslerstatedhewasinterestedintheletterandpetitionfromthemanageroftheKimberlyArmsApart- ments.Hesaidhehadreceivedaletterfromtheownersofthebuilding,Russello &Rosenberg,stating theyhadneverbeendisturbedinanymannerbythePennyMarketandwereinfavorofanybusinesswhich wouldcreateemploymentandbringpeopletoAlameda. Mr.Kesslerstatedthepetitionsubmittedinfavoroftheproposalhadbeenentirelyunsolicitedbythe applicants.HesaidtheyhadreceivedaletterfromMr.DonOranskyofLeonardisEomen'sApparel,Past PresidentoftheWebsterStreetMerchantsAssociation,infavoroftheproposal.statinghehadpolledthe areamerchantsandtheyhadindicatedseventeenwereinfavorandfourwereagainstthefleamarket. r~r.KessleralsoreadaportionofaletterfromGrandAutoSupplythatthePennyMarkethadbroughtpeople intothegeneralareaandgreatlybenefitedtheWebsterStreetbusinesses;duetoitsclosing,therehad beenadropinSundaybusiness. t<lr.Kesslersaidwithrespecttokeepingthepropertyclean,theywouldexpecttopatrolandpolicethe area.Asamatteroffact,hesaidtheyhadbeenattemptingtofindasweepertrucktopurchaseandif theycoulddoso,theywouldseethatnotonlytheTheatrepropertybutthesurroundingareawasswept. HereiteratedthatanythingrepresentedbytheCompaniesintheirlettertothePlanningBoard,theywould makegood.Hesaidhehadreceivedmanycallsfrompeopleaskingwhentheywouldopenthebusinessandhe hopedtheCouncilwouldseefittogranttheUsePermi t, Mr.RobertL.Lippert~Danville,thenaddressedtheCouncil.HesaidMr.Kesslerhadcove proposalthoroughly.Hesaid.inclarification,theyknewoftheGeneralPlanforthearea.their Theyoperated theShowcaseC'inernasontheSouthShoresotheywereprettysubstantiallysituatedintheCityandwhat wasgoodfortheCitywasgoodforthem.HesaidhewouldliketoseetheWestEnddevelopedandthat Del[vJontepeoplehadbeeninformedtheycouldexpectfullcooperationfromtheownersoftheproposed businesswhenthetimecameforDelMontetomakeamove.Hesaidhewouldliketoseeimprovementin theDrive-Inwithoutgoingintotoomuchexpense,inordertobeinpositiontogetoutwhenDel~lonteso decided,withouttoomuchofafinancialproblem.Hesaidtheywouldabidebytherulesandregulations andhewassurethefleamarketwouldbeanassettotheCitywithproperpolicing,etcetera. Mr.KesslerthenfiledwiththeCityClerkaphotostaticcopyoftheLeasebetweenConcordTheaters CompanyandEncinalTerminals. TherewasabriefquestionandanswerperiodbetweentheCouncilandMr.Kesslerwithregardtothe areacoveredbytheLeaseandtheexperiencewithpoliceproblemsinconnectionwiththeoperation. Mr.Kesslersaidnomoretroubleofthiskindwasanticipatedthanwouldbeexpectedwianyother businessinvolvinglargenumbersofpeople.Theformeroperatorhadinformedhimthatintenyears therehadbeenonlytwoorthreeincidentsofthiskind. Mr.DonaldOransky,operatoroftwoapparelstoresonWebsterStreet.supportedtheAppeal.Hesaid theMarkethadnotadverselyaffectedbusinessonWebsterStreet-infact$hefeltithadhelped businessonweekends.HesaidhefelttherewouldbenomoretroublethanontheStateBeachorat theCityParks. Mr.SlackofRobinHoodsaidhe,asanownerofabusinessonWebsterStreet,feltthefleamarketwould beanassettotheWebsterStreetmerchants. Mrs.InaRatto,1053IslandDrive,madeastrongpleafortheproposedbusiness.Shesaidithadbeen thesourceofagreatdealofpleasureforherfamilyandfriendstogettogetherandspendanafternoon there.ShedidnotfeeltheproposedoperationwouldtakebusinessawayfromstoresintheCityasthings purchasedwerenotusuallynewitems,butinmanycasesthingswhichwerenolongerproduced.Shefelt theseweresomeofthereasonstheproposalwassowidelysupportedbycitizensofthecommunity. Mrs.Rattosaidshehadneverseenasingleincidentatafleamarketwheretherewasviolenceofany sort,andthatthePennyMarkethadalwaysbeenwellpolicedandacredittoitsoperators. Onthecallforopponents,Mr.WilliamLeitao,1051East33rdStreet,Oakland,representativeofMr. Wi11iamGannon,PresidentofSwarthmore &LansdowneCorporations,formeroperatorsoftheIs1andAuto Movieandrelatedbusinessonthepremisesat791ThauWay,appeared.HesaidtheCorporationshadbeen inbusinessintheCityfortwentyyearsandforthelasttenyearsthetotalpayrollhadamountedto three-quartersofamilliondollarssotheamountforthefulltwentyyearscouldwellbeimagined.He saidthissizeablesumofmoneyhadcontributedmuchtothegainfulemploymentofmanyAlamedaresidents, especiallystudentsfromtheHighSchools.HesaidtheCorporationswerethepioneersininitiatingthe PennyMarketbusinessintheCityin1963.Ithadnotbeentoosuccessfulforthefirsttwoyears becauseitwasnotknownhowtoattractpeople.However,afterlearnimoreaboutthebusinessithad beenexceedinglylucrative.!VIr.Leitaosaidforthelasttwenty-onemonthsthesalesofpersonal propertyonwhichthesalestaxhadbeencollectedwasinexcessofaquarterofamilliondollars. Mr.LeitaosaidtheCorporationshadbeenmostunfortunateinnotbeingabletoconsummatethepurchase oftheDrive-Inpremisesfromthepreviousownerandtheirleasehadexpiredandthepropertyhadbeen turnedovertothepresentowners.HesaidtheCorporationswereinquiringintotheavailabilityoflarge acreagesintheCityofAlameda,eitherforleaseorforsale.InviewofwhattheCorporationshad contributedtotheCityandalsoastheirpresentpennymarketbusinesspermitwouldnotexpireuntil June30,1970,Mr.LeitaosaidtheyfelttheCityshouldgivethemthefirstoptiontotrytore-establish thisbusinessinAlamedabeforethedeadlinedateofJune30.Hebegged,therefore,thattheCityCouncil delayanyapprovalofthePermitunderdiscussionuntilthatdeadlinedate.saidtheywerealso afraidthatiftheCouncilshouldapprovetheapplicationunderconsiderationandtheyshouldbeableto securenewpremisesforoperationofapennymarketbeforeJune30,theCouncilwouldbeloathetogrant permissionforoperationoftwosuchlargeenterprisesintheCityatthesametime. CouncilmanMcCallinquiredof.LeitaowhytheCorporations.knowingtheirleasewasabouttoexpire, hadnottriedtomakesomearrangementspriortotheexpirationdateforpurchaseoflandoralease agreementandstartoperationimmediatelyinordertokeepthebusinessgoing.Mr.Leitaosaidthe CorporationshadapproachedNr,JohnHuston,formerowneroftheproperty,withregardtopurchaseof theland.Itwasnotpossible,however,toagreeonthepriceandthereforethesalewasnotconsummated. Mr.J.PaulGutleben,2844SanJoseAvenue,thenaddressedtheCouncil.Heexpressedhisoppositionto theproposalunderdiscussionandhisopinionthattheproposedbusinesswouldnotbecompatiblewiththe GeneralPlan.criticizedtheconditionoftheAutoMoviepropertyandsaidhewasnegotiatingfor landonwhichheplannedtobuildanindoorfleamarket.HealsopointedoutthatPattonWaywouldtie inadjacenttotheAutoMovieproperty,andhefeltthiswouldcreateaserioustraffichazard. TheHearingwasdeclared C osed.CouncilmanMcCallrequestedthattheCityManagerchecktheLease AgreementandinformtheCouncilwhetherhewassatisfiedwithitassignedbyEncinalTerminals.said hewouldliketoknowwhetherthemonth-to-rnonthleasingprovisionsmentionedinletterofFebruary5, 1970,fromAlaskaPackersAssociation.Inc.,totheCityPlanningDepartmentweresetforthasacondition oftheAgreement,andanyotherconditionswhichshouldbestipulatedinamotion,shouldtheCouncildecidetosoact. Aten-minuterecesswascalledinorderthattheCityManagerandtheCityAttorneymightperusethe LeasebetweenEncinalTerminalsandConcordTheatersCompanycoveringtheparkingarea. Uponreconvening,Cunninghamstated,assetforthby.Kessler,theLeasestipulatedamonth-to- monthtenancywithmonetarypayment,theareacoveredwas240,000squarefeetandtheLeasehadbecome effectiveonMarch1,1970.saidvariousclauseswerecontainedintheLeasesomestandardandsome relatingspecificallytotheoperationofthepremisesforthepurposeleased,a'parkinglot.Thelessees couldnotassignthepremises,nousewouldbepermittedexceptparkingfortheadjacentarea,whichhe tooktomeantheTheatreownedbytheapplicant,thelesseesweregiventherighttoimprovetheproperty andtheyweretopreventtothebestoftheirabilityunauthorizedentryfromtheleasedpropertyonto theadjacentpropertyofEncinalTerminals,althoughitwasnotspecifiedthattheymusterectfencing. TheLease,hesaid,containedconventionalinsuranceandholdharmlessclauses,personalpropertyand workmen1scompensation,tobeevidencedbycertificatesofinsurancetobesuppliedbythelesseetothe lessor. Mr.Cunninghamsuggested,ifthereweretobeconditionsstipulated,that,inadditiontothoseespoused bythePlanningDirector,aconditionbeaddedthattheUsePermit,assumingthiswastobegranted, wouldexpireautomaticallyandwithoutfurtheractionintheeventthemonth-to-monthtenancyasencompassed inthisLeaseshouldbeterminated. Mr.Wellerstated,inhisopinion,theareaindicatedintheLease,representedtobe 240,000 squarefeet, properlygradedandmarked,wouldbeenoughforapproximately800carsat,roughly,300 squarefeetper s ta 11• ItwasnotedthattherehadnotbeenaLeaseAgreementpresentedatthePlanningBoardHearingonthis matter. CouncilmanMcCallpointedoutthattheBoard1smotionfordenialhadbeenonthefindingthattheoperation wouldbeincompatiblewiththeanticipatedplansforthearea,thattheapplicantcouldnotassurerequired off-streetparking,andthatnodetailedplanshadbeensubmittedforBoardreview,accordingtoMr.John- son1smemorandumofFebruary 26.Hesaidhefelt,therefore,thattheCouncilwasmerelyclarifyingthe matterandmovedthattheAppealbegranted,subjecttothefiverequirementssuggestedbyMr.Johnson andansweredbyMr.Kessler,thattheapplicantwould (1)provideoff-streetparkingintheratiooftwo spacespertenantstall;(2)provideeight(8)uniformedparkingattendantstobeondutyatalltimes duringthemarketoperation,insuringthatallvehiclesparkintheareaunderleasetoorownedbyConcord TheatersCompany;(3)keepHousingAuthoritypropertyandKimberlyArmspropertyfreeandclearofMarket customervehicles;(4)keeppropertynotownedorcontrolledbyConcordTheatersCompanyfreeandclearof litterdiscardedbyMarketcustomers;(5)opserveorprovideotherrepresentationsmadeintheapplicant1s letterofFebruary3,1970,totheCityPlanningBoard.TheconditionwasalsotobeimposedthattheUse PermitwouldexpireautomaticallyintheeventofcancellationoftheLeaseAgreementwithEncinalTerminals. CouncilmanLevysecondedthemotion. Speakingonthequestion,CouncilmanLongakerstatedhefeltitincumbentontheissuanceofthePermit, shouldthisbetheaction,thatalldueconsiderationbegiventoseetoitthattherewouldbenointer- ruptionwiththeApartmentsadjacenttotheTheatreproperty.HesaidhehadtalkedtotheManagerof theApartmentsandheunderstoodtheproblemwasaveryrealoneonSaturdaysandSundays. PresidentLaCroixexpressedtheopinionthattheCouncilwasconcernedwiththemaintenanceofthearea underdiscussion,andthiswasaparamountissue.HepointedoutthefactthattheHousingAuthorityhad comebackwithaletterinsupportoftherequestaslongasconditionsweremadeandfollowed. Thequestionwasthenputandthemotioncarriedonthefollowingrollcallvote.Ayes:Five.Noes: None.Absent:None. PresidentLaCroixsuggestedamatterinthisconnection,raisedbyMr.Johnsonwiregardtorevenue derivedinothercommunitiesascomparedtorevenueobtainedintheCityofAlamedafromthistypeof operation,shouldbeinvestigated~stothemannerinwhichthemoniesderivedwereusedinataxsense. Mr.CunninghamexplainedtheCityleviesataxfortheprivilegeofdoingbusinessintheCityandthe licenseratesforthistypeofoperationwereextremelybehindthetimes.suggestedCiTreasurer couldaidindevisinganewfeeschedulefortheCityManagertorecommendtoeCouncil.Mr.Weller wasrequestedtolookintothismatterandreportbacktotheCouncil.
