PresidentLaCroixremarkedthattheCityEngineerhadlongbeenawareoftheprocessofrecyclingandhad beeninvestigatingtheavailabilityofgarbageareasinadditiontothepresentdisposalareaoftheCity. whichwouldsoonbefilledup. CouncilmanLongakeraddedthattheCityEngineerhadbeenincontactwithandhadobservedanewoperation inLosGatoswhichwouldconsumeupto500tonsofgarbageperdayandwouldeventakeparticlesofsteel, cement,etcetera,andthroughincinerationwouldcomeoutwithaglasslikecrystalsimilartoobsidian. HEARINGS: 10.IntheMatterofaProposalinitiatedbythePlanningBoardtoamendcertainsectionsofng OrdinanceNo.1277,NewSeries,relatingtooff-streetparkingrequirements. ClerkstatedtherewasonfiletheAffidavitofPublicationoftheNoticethatthiswouldbethetime andplaceforHearingonthissubject.TheminutesofthePlanningBoardmeetingatwhithematterwas consideredhadbeensenttotheCouncilmen. AletterhadbeenreceivedfromJoyB.andGeorgeR.Osborne,656WestlineDrive,insupportofthe proposedordinance. Twopetitionshadalsobeenreceivedonthisdate,onesignedtwentyresidentsinoppositiontothe proposedordinanceaswritten,andthesecond,signedforty-sixresidents,protestingtheincreasein parkingrequirementsformultipleunits. DonaldJohnson,PlanningDirector,explainedthattheproposedamendmenthadpreviouslybeenthe subjectofHearingbeforethePlanningBoard,andthenbeforetheCityCouncilatitsregularmeeting heldAugust5,1969.Atthattime,ithadbeenthedecisionoftheCouncilnottoadopttheproposed change.ThematterhadbeenreopenedincompliancewitharequestfromtheAlamedaChamberofCommerce, andhadbeenreconsideredbythePlanningBoardatitsmeetingofMarch9. Mr.Johnsonstatedtheproposedamendmentprovidedfortwooff-streetparkingspacesperdwellingunit insingle-familydistricts"thatis,"R-l"zones,andoneandone-halfspacesrdwellingunitinall districtsoftwo-familyresidencesorgreaterdensity.ThemembersoftheCouncilhadbeenfurnished copiesoftheproposedordinance. Mr.JohnsonreviewedtheactionsoftheBoard,assetforthinitsletterdatedMarch12,1970.added therewerecertainancillaryadvantagesintheordinanceinthewayofdecreasinglotorareadensity andalsothatthiswasanincentiveforbetterdeSign.Hesaidiswasalsothestaffviewandrecom- mendation. Mr.JohnsonpointedoutpersonsappearingbeforetheBoardinprotesthadclaimedtheordinancetended tofavorspecialinterestgroupsandlargescaledevelopers.Heexpressedopinionthatthepoint wascompletelyunsupported.Herequestedtheopportunityforrebuttalonanyargumentswhichmightbe presentedduringtheHearing. CityAttorneyCunninghamstatedtheissuebeforetheCityCouncilwaswhetherthefindingsandrecommenda- tionsofthePlanningBoardanditsadvisoryreport,baseduponSection1l-172(c)oftheamedaf~unicipal Code,shouldapproved,modifiedordisapproved. Onthecallforproponents,Mr.RussellSpillman,1715OtisDrive.appearedonbehalfoftheAlameda ChamberofCommerce.HesaidhewouldliketoaddoneortwopointstothestatementsofMr.Johnson, whohadalreadystressedthepositionoftheChamber. Mr.SpillmansaidhefelttheprofessionalethicsofthePlanningstaffwasdirectedatmerelyproviding betterplanningfortheCity.HepointedoutthattheGeneralPlanhadsetforththecomplaintofresi- dentsofbothsingleandmultipledwellingsthattherewas"insufficientparkinginapartmentareas". Thesamereporthadrecommendeduptotwoparkingspacesperdwell i ngunitoronespaceperbedroom.He saidtheChamberfeltthesewereverystrongrecommendationsforconsideringtheproposedamendmentin lightoftheactionofotherprogressivecommunitiesinadoptingsimilarordinances.Hecommentedthat thedevelopersoftheParkWebsterApartmentComplexhadindicatedtheyhadprovided1.2spacesper dwellingunitandpreferredtoprovidemore.Mr.Spillmansaidhefelttheproposedchangewouldupgrade Alamedaandimproveitsimage. PresidentLaCroixinquiredofMr.Spillman,asPresidentoftheAlamedaFirstNationalBankandasalender, ifhewouldfeelthatatougherandmoreup-datedparkingordinancewouldlenditselfmoretothequality ofconstructionandenablethelendertolookmorefavorablyuponastructureorsite.Mr.Spillmanreferred tohiscommentswithregardtothedevelopersoftheParkWebsterComplex.whosephilosophieswerethat betterenvironmentforthedwellerandforthecommunitywasabetterprofit-orientedprogramforthemand theyhadbeenverysuccessfulwithit.Hesaidhewouldconcur. Mrs.EvelynBeasley,1106VerdemarDrive,supportedtheremarksofMr.Spillmanonthebasisofherexperi- encesintherealestatebusiness. Onthecallforopponents,Mr.JohnE.Mitcheom,1319HighStreet,cameforward.Hesaidhewasappearing onbehalfoftheAlamedaBoardofRealtors.Hesaidsometimeago,inconnectionwithproposedconstruction, hehadbeentoldbyasavingsandloancompanythatitwasnotthemeforqualityconstructioninAlameda, thatpeoplewouldnotpaythepriceforit.HequotedfiguresreceivedfromthecitiesofSanFrancisco, Oakland,AlbanyandPiedmont,whichwerenotinagreementwiththeproposedordinance. OnbehalfofthepropertyownersintheCity,Mr.Mitcheompleadedthesepeoplewerehitfromeveryangle withhighertaxes,higherservicechargesandnowtheywouldbehitbytheproposedchangeinthezoning ordinance.Hesaidhewasinfavorofmorestringentparkingregulationsbutcouldnotseehowboth aspectscouldbeaccompliShedatonce.Hepointedoutthatmanyparkingspacesweretoonarrowtoaccom- modatetheautomobilesandpeopleusedtheirgaragesforboats,familyrooms,etcetera,whiletheircars wereparkedonthestreet. ~lrs.IreneNoe,2249CentralAvenue,stateditwasnotnewconstructionintheCitywhichwascausingthe parkingproblembutexistinghomeswhichusedthegaragesforotherpurposes,andtheconversionsinthe "R_411 District,inmanyofwhichtherewerenotevencarportsforparking.Shepleadedalsofortheelderly peoplepaying$700and$750intaxesperyear.Mrs.NoesuggestedthepresentCityordinancesrestricting on-streetparkingbeenforced. Mr.JohnBarni,Sr.,1364EastShoreDrive,statedhewasnotinfavoroftheproposedordinanceasits rigidtermswouldapplytoalltypesofconstructiontobebuiltintheCity.Forexample,hepointedout thatthebuilderofatwenty-unitstudioapartmentdwellingwouldberequiredtohavethirtyoff-street parkingspacesand,bythesametoken,abuilderplanningtoerecttwentythree-bedroomunitswouldbe requiredtohavethesamenumberofspaces.Hefelttheresidentsofthree-bedroomunitswouldundoubtedly havemorecarsthansomeonelivinginastudioapartment.Forthisreason,hefelttheordinancewould notbeforthebestinterestsoftheCity. rVir.BarnialsocommentedthattheFederalGovernmenthadmanyprogramsforassistingnon-profitorganizations toputuphousingforlowerincomefamilies.Heexpressedtheopinionthattheproposedchangewouldbe detrimentaltothistypeofprogram,homesforelderlypersonswhichmightbeconstructedintheCityin thefuture,andcondominiumapartmentprojects.HesuggestedthattheproposalbereturnedtothePlanning Boardforreappraisal,toattempttocomeupwithsomethingmoreequitableforoneandall. Mr.JohnBarni,Jr.,1825ClintonAvenue,presentedaletterfromMr.P.G.Sandifer,2043BuenaVista Avenue,whohadbeencalledoutoftownandcouldnotattendtheHearing.Mr.Barn;broughtoutthefollow- ingpointssubmittedbyMr.Sandifer:Wouldtenantsusetheextraspaceprovidedandcouldtheybeforced touseit?Thetenantswouldundoubtedlybechargedextrafortheextraparkingspace.Mr.Sandifer claimedhehadowneda5-plexintheCityforfourandone-halfyearsandhadneverhadatenantwithmore thanonecar.Hefelttherealproblemwassingle-familyhomeswithconversionsofgarages,storageof boats,etcetera.Mr.SandiferandhiswifehadpurchasedbuildinglotsintheCity~lookingtothefuture, and,iftheproposedamendmentwasadopted,theywouldbeforcedtoconstructamoreexpensivebuilding becauseoftheparkingrequirements,orincreasetherents.Hehadsuggestedthattimebeallowedfor peopletoadapttothechange.Mr.Sandiferhadalsorequestedthatastudybemadeonthesubject. Onhisownbehalf,Mr.Barniobjectedtothewaytheordinancewaswritten.Hesaidhedidnotagreewith theratioof"oneandone-halftoone"asablanketencumbranceovertheentireCity,andwonderedifthe provisionswouldnotbeout-datedeventually.HesaidhefeltAlamedaneededsomethingthatwouldworkfor itandhehatedtoseetheCityspendmoneytochangetheordinancewhenitwouldnotbenefittheCity. Hesuggestedthatafluctuatingscale,suchasusedindowntownSanFranciscoandinAlbany,wouldbethe bestsolution.HeurgedthattheCouncilgivethoughttothepointsinvolvedasthematterwasaserious one. iVJr.KarlBoller,1247Broadway,concurredwithMr.Barn;ISremarks. CouncilmanLongakerrequestedthatMr.Johnson,inhisrebuttal,enlargeonthethoughtenvelopedinthe areaofparkingunitsbaseduponthenumberofbedroomsinaunit. Mr.Johnson,inreplytoCouncilmanLongaker'sinquiry,statedthathehadfoundnocorrelation,thatit wasabsolutelyimpossibletodeterminethereqredamountofoff-streetparkingthenumberofbedrooms. Hesaidinmanycasesitwasfoundthatinathree-bedroomunittherewouldbeonlyonecar,inothers therewouldbetwooreventhreecars.Thesameheldtrueforstudioapartments.Manywereoccupiedby couples,wherebothoccupantshadacar.Inothercases,inevenone-bedroomunits,fouryoungpeople mightlivetogetherandallfourhaveacar. Nr,Johnsonthenofferedrebuttaltotheobjectionspresented.HesaidtheCitiesofSanLeandro,Berkeley. RichmondandHaywardhadbeenconsultedandtheirregulationshadbeenfoundtoagreewiththeproposed ordinance.ThesecitieswereconsideredcomparabletotheCityofAlameda.Heagreedthattherewasa problemwithexistingdwellingsbutitwasnotthetotalproblem,andcitedthecaseoftheSouthShore area,wherestructureswerealllessthantwelveyearsoldandtheoff-streetparkingprivilegewas grosslyabused. Mr.Johnsonagreedthattheproposedordinancewasnotthecompleteanswertotheproblemofoff-street parking.Hesaiditwasapartialanswerbutitwouldprobablygofurtherasasingleanswerthanany othersolutionwhichcouldbeproposedinalegislativewaytoamelioratethestreetparkingconditions. Heexpressedthethoughtthatanysuchordinancewouldhavetoberigidandtherewouldhavetobeexceptions toit.Thiswasthepurposeofthevarianceprocedure.Hesaidaslightlymoregraduatedscaleinthe wayofoff-streetparkinghadbeenconsideredbutithadbeenrealizedthattheCitywasnotstaffedto administeracomplexsetofoff-streetparkingordinances. Mr.Johnsonsaidhedidnotfindthattheoneandone-halftooneratiowasnecessarilyrestrictive, inequitableorunworkable.Hepointedoutthatchangeswouldhavetobemadeinanyordinanceasconditions soindicated.Hesaidhedidnotfeeltheproposedordinancewouldpenalizeanypropertyowner.ashe considereditaqualityprovisionintheordinanceandlocalownersandoutsideinvestorsweresimplybeing requestedtobuildbetterunits. Mr.Johnsonpointedout,withregardtotheproposedrebuildingprojectoftheHousingAuthority"thathe couldseenomajorproblemasafullFederalprojectwouldnotbeboundbytheCityZoningOrdinance. Federally-assistedprojects,whereanon-profitinstitutionwoulduseaFederalguarantee,mightbebound bythisprovisioniftheywereconstructingresidentialunits. CouncilmanMcCallasked~withtheHousingProjectunitsbeingdemolished~whetherprovisionsforoff-street parkingwereincludedintheplansasrequiredintheordinanceandwhetheritwasintendedtoobservethe ordinance.Mr.JohnsonstatedthiswastrueandtheplansexceededtherequirementsoftheCity.Hesaid theordinanceasproposeddidnotrequirecoveredparking. Counci1manLevycommentedonthestatementswithregardtocondominiumunits\l/hichmightbeconstructed fortheelderlywhowouldhavenouseforcarsandunderthe crdtnance,oneandone-halfparkingspaces wouldberequiredperunit.Heaskediftherewerelegalapproachestovariancestotakecareofsituations ofthisnature.Mr.Johnsonstatedthiswassoand~again~hesaidhecouldnotseethisasasubstantial problem.HesaidonlytenpercentoftheCity1spopulationwasagedsixty-fiveorolder.This.might beaprobleminaparticularcaseandhesuggesteditbehandledatsuchtimeasnecessarybyavariance procedure. TheHearingwasdeclaredclosed.PresidentLaCroixcommentedontheolderpropertiesintheCityand thepossibilitythattheproposedordinancewouldbeadetrimenttopropertyownersindevelopingtheir propertiesinmultipleunits.Hesaidhehadbeeninthesavingsandloanbusinessforfifteenyears, wasanappraiserandhadbeenaloanofficer.HesaidhehadfoundespeciallyinAlameda,andina numberofothercities,thatthemajorityofthepropertiesunderdiscussionwerenotdevelopedbythe ownersthemselvesbutweresoldtodevelopersforfuturedevelopment.Thelosstothemwouldbenothing, ashesawit.Hefeltsomeoftherealtorsweretryingtoprotectthemselvesandhecouldunderstand thistoanextent,asfewerrestrictionswouldmakeapieceofpropertymoresalable.Hesaidhecould not,however,seeanydetrimenttothepropertyownerortothesellerpriortodevelopment.Hefelta mistakemadeovertheyears thattoooftenopportunitiesofthistypehadarisenandtheCity hadremainedinactivewith realestateproblems.Hesaid,speakingofthelendinginsti- tutions,thatanytimeaCi tobetryingtoupgradeitself,especiallyinthefieldof multipleunits,propertywasimmediatelymoresalableandvendablethanwhentherehadbeennoeffortto upgradeconditionsnortolooktotheproblemsoffiveortenyearshence.saidhefelttheCity couldnolongerlivewiththemistakesofthepastandthattheordinanceunderdiscussionshouldDepassed. CouncilmanLongakersaidshortlyafterhehadbecomeaCouncilmanthequestionofchangingtheoff-street parkingrequirementsintheZoningOrdinancehadbeenpresentedtotheCounei 1;atthattimehehadvoted inoppositiontotheproposaloutofpureignorancebuthehadlearnedagreatdealinthepastyear. HecommentedontheconcernthepreviouseveningofMr.Barni,Jr.,withregardtothetremendousdensityofpopulationinAlameda;tonightthediscussionwasinadifferentvein.
