WRITTENCOMMUNICATIONS: 2.FromAlamedaUnifiedSchoolDistrict,signedbyMr.CalderHayes,Supervisor,ChildWelfareand Attendance,complainingofastructureonthewestsideofChestnutStreetnorthofLincolnAvenue,and requestingthattheCityCounciltakestepstoalleviatethesituation. CityEngineerHannahadindicatedinhismemorandumdatedMay27,1970,thatthebuilding,aconcreteblock structure,hadbeensealedatthedirectionoftheCountyHealthDepartmentandwasunderconstantsurveil-1ance. ItwasrequestedthatMr.Hannacontacttheownerofthebuildingwithregardtothepossibilityofhaving itdemolished,asitseemedtoservenoconstructivepurposeatthepresenttime. 3.FromMr.VernonW.Dennen,1918EverettStreet,complainingthattheSouthShoreBeachwashidden becauseofmountingsanddunes,alsosuggestingthatcoconuttreesbeplantedalongitsexpanse. ThecommunicationwasreferredtotheEastBayRegionalParkDistrictforattention. 4.FromMrs.AliceQ.Howard,1556EverettStreet,submittingsuggestionsforsolidwastedisposal. ItwasdirectedthatthecommunicationbereferredtotheCityManagertobepassedontotheCityEngineer forstudybythecommitteewhichhadbeenconsideringthisgeneralsubject. HEARlGS: 9.IntheMatterofCooperationAgreementbetweentheHousingAuthorityandCityofAlamedainconnec- tionwithdevelopmentofapproximately168dwellingunitsintheWesternHousingProject. Onrequest,CityAttorneyCunninghamexplainedtheissuebeforetheCouncil.Herecalledpreviousaction bytheCouncilatitsregularmeetingheldMay5,1970,inadoptingResolutionNo.7613authorizingpubli- cationofnoticesofthisPublicHearing,onwhichtheAffidavitofPublicationwasonfileintheofficeoftheCityClerk. .CunninghamstatedthepurposeoftheHearingwastoaffordinterestedpersonsanopportunitytobe heardastowhetherornottheCooperationAgreement,submittedtotheCouncilonMay5andreferredto insaidResolution,shouldbeenteredintobetweentheAuthorityandtheCity.TheproposedAgreement wasanecessarypreliminarytotheHousingAuthoritylscontemplatedreplacementofthe168existingunits inthe7~-acreparcellocatedatThirdandBrushStreets,whichhadbeenfoundtobeseriouslydeteriorated anddilapidated,asexplainedbyMr.RichardMarquardt,ExecutiveDirector,inhisletterofApril21. TheissuetobedecidedbytheCouncil,afterhearingfromanyinterestedpersons,waswhethertheCity shouldenterintosuchAgreementwiththeAuthority.Shouldthedecisionbeintheaffirmative,areso- lutionhadbeenpreparedforactionbytheCouncil. Onthecallforproponentsoftheaction,Mr.HowardK.Palmer,Jr.,ChairmanoftheHousingAuthority, addressedtheCouncil.HepointedoutthattheAuthoritywasadministeringsomeunitswhichhadbeen builtastemporarywarhousingduringtheWorldWarIIperiod.Eventhoughtherehadbeenexcellent maintenanceonthebuildings,themaintenancecostswerenowbecomingexcessiveandinsomecasesthe unitswerebecomingunsuitableforoccupancyaslivingquarters.HesaidthiswasthecaseintheWesternHousingProjectareainvolvedinthisHearing. Mr.PalmerstatedwhenthepresentCommissionershadtakenofficetheyhadbeenrequested,afterdisposing ofsomemoreurgentmatters,tolookintothereplacementoftheseunits.Hesaidastudycommitteehad beeninitiatedtolookintothebestmeansofreplacementandoffinancingtheproject,withtheresult thataturnkeymethodofreplacingthebuildingswasadopted.ThepresentstatuswasthattheAuthority hadsolicitedandreceivedpermission,oratleastafavorabledecision,fromtheofficeoftheAttorney GeneraloftheStateofCaliforniatopermitthemtoproceed.TheExecutiveDirectorhadbeenauthorized tomakeproperapplicationtotheHousingandUrbanDevelopmentpeopleforreplacementoftheunitsin questionand,aspartofthenecessarydocumentation,itwasrequiredthattheCityenterintotheCoopera- tionAgreementwiththeAuthority.TheAgreement,Mr.Palmersaid,wouldnotchangetherelationship betweentheCityandtheAuthority-itwouldmerelypointouttheestablishmentofaneedforreplacing theunits.Hesaidthecommissionersfeltthiswasaculminationoftheireffortstoprovidethepeople ofAlamedawithsafe,sanitaryanddecenthousing.HerequestedthattheCounciltakethenecessary actiontoauthorizeexecutionoftheAgreement. Therewasdiscussionwithregardtothemethodoffinancingtheproject,theprovisionofoff-street parkinginconnectionwiththebuildings,theprovisionofabufferareabetweentheAlamedaMutualHomesandthenewconstruction,andotherpoints. CouncilmanMcCallinquiredoftheCityAttorney,inviewofthefactthattheacresinvolvedwouldbe usedforconstructionoftheproposed168units,ifthisAgreementwouldterminatethereandtheHousing AuthoritywouldhavetosubmittotheCouncilforapprovalanyadditionalprojectsunderitsjurisdiction. Mr.CunninghamsaidhehadbeenassuredthattheAgreementunderdiscussionwouldpertainonlytothe replacementofthe168unitsmentioned. Mrs.MabelTatum,2010-AWebsterStreet,expressedherelationthatstepswerebeingtakentoprovide low-incomehousing,andherhopethattheCouncilwouldtakethenecessaryactionatthismeetingto proceedwiththeproject. Mr.IraPlummer,2631SanJoseAvenue.statedthepeopleintheneighborhoodpreferrednottoraisetheir childrenadjacenttoanapartmenthouse,andsuggestedagainthataduplexortwocottagesbeplacedon thesubjectproperty.Heexpressedtheopinionthatapartmenthouseconstructionwasbringingtoomany peopleintotheCityandprotestedtheactiontheCouncilhadtakenonthematter. Mr.Stanley D.Whitney,Attorneyforthepetitioners,saidhefelttherewasnothingtoaddinrebuttal, thatthematterhadbeendiscussedfully. PresidentLaCroixcommented,inreplytoastatementbyDr.Vedros,thattheCouncilwasfurnishedcopies ofminutesofallPlanningBoardmeetingssoitwasawareoftheBoard'sactions.Hereiteratedhis positioninoppositiontotheproposedchangeofzoneonthepropertyunderdiscussionashefeltitwas anunjustifiedinroadintoan"R-l"District.HesuggestediftheCouncilmenwhohadvotedinfavorof theissuewishedtoreconsiderthematter,theymaketheirwishesknownatthistime. CouncilmanLongakerpointedoutthedwellingonthepropertyinquestionwasinextremelypoorcondition andsaidhefelttheadditionofcondominiumunitscoulddonothingbutupgradetheentireneighborhood. Hemovedtheordinancebepassedassubmitted.ThemotionwassecondedbyCouncilmanFore. Speakingonthequestion,CouncilmanMcCallremarkedthathispositionofoppositionhadnotchanged. HesaidhestronglyapprovedthedevelopmentwhichhadbeengoinginonBroadway,whichwasproperlyzoned formultipledwellings.Hecommentedthatthehomenextdoortothepropertyunderdiscussionhadjust beenrepainted.Hepointedouthehadsuggestedthatthelotinquestionbesplitashadbeendoneon severalotherparcelsintheCity,withgreatsuccess. PresidentLaCroixagaincommentedonthesubject.thatmanyoftheolderhomeswerebeingreclaimedfor usebyyoungcouplesraisingfamilieswhoenjoythelargerhomes.Hesaidhewouldpersonallyliketo seeactionatthismeetingtodenytherequestedrezoningashefeltitcouldsetanundesirableprecedent. Councilman Levy saidhehadnotmadehisdecisiononthismatterhastily,buthadtakenintoconsidera- tionthebenefittothepeopleoftheareaandtotheCityasa who le,andalsothequestionofdensity. Hesaidhefeltinthiscase,withjustonesmallareatoberezonedandanadditionofonlyfourunits, andtheprospectiveimprovementandbeautificationbyconstructionofaratherattractiveestablishment, theareainquestionwouldnotbeadetrimenttotheneighborhood.Headdedhefeltinthreeorfour yearstheneighborswouldbethankfultheCouncilhadtakenthisstep. CouncilmanLongakersaidhedidnotquestionthatthiscouldbedoneandexpressedtheopinionthat, unlessapersonwasinthecontractingbusiness)itwouldbeveryexpensive. Mr.GutlebenrecalledthatsomemonthsagotheConcordDrive-InTheaterCo.andGenevaTheatre.Inc.,had beengrantedaUsePermitforoperationofafleamarketontheIslandAutoMoviegrounds,afteraHearing beforetheCityCouncilonanAppealinconnectiontherewith.Itwasstipulatedthatparkingwouldbe providedintheareaownedbyEncinalTerminals,andtheagreementinthatconnectionwasgoodforthirty days.Mr.GutlebensaidonMay31theleasehadbeencancelled;however,theTheatreCompanyhadnegotiated anewleasewiththeStateofCaliforniaonpropertyownedbytheG.S.A.forparkinginanotherlocation. HesuggestedtheCityCouncilhavethematterinvestigated. Mr.Cunninghampointedoutthat,accordingtotheZoningOrdinance,whenaUsePermitisgrantedandthere isaviolationofconditions,itisinthefirstinstancethejurisdictionanddutyofthePlanningBoard tonotifythepermitteeoftheallegedviolationandthatapublichearingbeheldonthematter.Hesaid, intheinterestoforderlyprocedure,subjecttothewishesoftheCouncil,itwouldseemappropriatefor theBoardtohandlethismatterandholdtherequiredHearingonwhatheunderstoodwouldbeanapplication tosubstitutethepresentleasefortheoneEncinalTerminals.Hesuggestedtheinquirybedirected tothePlanningBoard. CouncilmanMcCallalsoremarkedthathehadrecentlybeenintheareainvolvedinthiscomplaintandnoticed thatparkingwas very heavy.HerecalledthattheIslandDrive-Inpeoplehadstatedtheywouldnotcause anyproblemsofthiskindtotheneighbors.Itwasstatedthisaspectofthemattershouldcomeupinthe HearingbeforethePlanningBoard. 35.{Mrs.InaRatto,1053IslandDrive,askedifanymembersoftheCouncilhadattendedthefleamarket andvieweditsoperation.asshefelttheywouldseethereweretwosidestothestory. Mrs.Rattobroughtupthesubject,firstpresentedtotheCouncil15monthsago,withregardtotheprovi- sionofanadditionalpublicparkonBayFarmIsland.Shesaidthesubjecthadbeen"bird-dogged"by interestedcitizensforsevenmonths,sincetheCouncilhadstateditwouldbeginastudyofthematter. Sheremarkedapetitionsignedby200residentshadbeensubmittedinsupportoftherequest. Mrs.Rattoexpressedconcernthatintheareainwhichshewasinterested,locatedwithintheconeofthe flightpatternofftheoldAirportrunway,therewouldbenoschoolsandhencenoplayground.Also,Site No.4onthemapappendedtotheLetterofUnderstandingbetweentheAlamedaUnifiedSchoolDistrict,the CityandUtahConstruction &MiningCo.,thesouth.hadnotbeenapprovedbytheStateforschool purposesandthereforecouldnotbeexpectedtobeusedforaparksite. Mrs.Rattosaidshehadfollowedtheproposedlanddedicationordinanceverycloselyandfeltitwouldbe mostbeneficial;however,itwouldmeetonlyminimalstandardsanditdidnotapproachthenational standardsforgoodrecreationplanningforhousingdevelopment.ShesaidshehopedtheCouncilcould continuetostudythematterandthatpossiblyatradeoflandcouldbegivenconsideration. Mr.Weller,onrequest,explainedthepresentstatusofthesubjectandtherewassomediscussion.Itwas pointedoutthatthequestionofwhetherornotaschoolsitemightbeapprovedbytheStatewould have no effectontheprospectivelocationofaparkinthearea.TheLetterofUnderstanding,itwasstated, providesthattheCitymightplaceaparkintheareaunderdiscussionwithoutaschool,iftheCityshould seefittodoso.Itwasstatedalsothatconsiderablestudyhadbeengiventotheentireproblemandthat therewereseveralalternativestobeconsideredwithregardtoprovisionofrecreationallandsonBayFarm Island. .WelleralsoexpressedtheoplnlonthatifthedevelopmentinwhatiscalledSectionIVonthemap appendedtotheLetterofUnderstandingshouldtakeplaceatallthewayitwascontemplated,irrespective ofwhattheStateshoulddecidewithregardtolocationofaschoolinthearea,therewould have tobea parkinthatvicinity. 36Mr.JimThompson.1127PearlStreet,saidhefeltinconsiderationoftherezoningapplicationonthe propertyat2615SanJoseAvenuetherehadbeenabadimpressionleftbycertaincomments.Hesaidthe AttorneyforthepropertyownerhadsaidintheHearingbeforethePlanningBoardthattheownerswereon thehornsofdilemma,theycouldnotsellthepropertyandthebuilderwasgoingtoofferthemawayout oftheirtrouble.However,noneoftheresidentsintheneighborhoodhadeverseenasignonthehouse thatitwasforsale,noranattempttosellthedwellingtoprivateresidents.Thestatementshadbeen thattheCouncilmenfelttheproposalwouldbeabenefittotheneighborhoodandthepeoplefelttheywere notbeingrepresentedbytheCouncil.Hesaidhefeltthispointwasdisturbingtheprotestants. 37.Mr.JohnBarni,Sr.,1364EastShoreDrive,statedthepropertyat2615SanJoseAvenuehadbeen listedforsaleontheBrokerBoard,anditwasnotmandatorythatasignbeplacedonthepropertyindicating thatitwasforsale.EveryrealestatesalesmanintheCitycouldattempttosellthepropertyandit wouldnotbewithheldfromsaleasfarasanyonewasconcerned.
