Resolution 15016CITY OF ALAMEDA RESOLUTION NO. 15016 OF INTENTION TO ANNEX TERRITORY TO THE CITY OF ALAMEDA COMMUNITY FACILITIES DISTRICT NO. 13 -1 (ALAMEDA LANDING PUBLIC IMPROVEMENTS) AND TO AUTHORIZE THE LEVY OF SPECIAL TAXES THEREIN WHEREAS, this City Council of the City of Alameda (the "City Council ") has conducted proceedings to establish the City of Alameda Community Facilities District No. 13 -1 (Alameda Landing Public Improvements) (the "District ") pursuant to the City of Alameda Special Tax Financing Improvement Code, constituting Section 3 -70.1 et seq. of the Alameda Municipal Code (the "Law"); and WHEREAS, under the Law, this City Council, as the legislative body for the District, is empowered with the authority to annex territory to the District, and now desires to undertake proceedings to annex territory to the District. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that: 1. This City Council hereby finds and determines that public convenience and necessity require that territory be annexed to the District. 2. The name of the existing District is "City of Alameda Community Facilities District No. 13 -1 (Alameda Landing Public Improvements)." 3. The territory included in the existing District is as shown on the map thereof recorded in Book 18 of Maps of Assessment and Community Facilities Districts at Page 45, in the office of the County Recorder of the County of Alameda, to which map reference is hereby made. The territory now proposed to be annexed to the District is as shown on the Annexation Map No. 1 of the District on file with the City Clerk, the boundaries of which territory are hereby preliminarily approved and to which map reference is hereby made for further particulars. The City Clerk is hereby directed cause to be recorded said Annexation Map No. 1 of the District, showing the territory to be annexed, in the office of the County Recorder of the County of Alameda as soon as practicable following the date of adoption of this Resolution. 4. The types of public facilities to be financed by the District and pursuant to the Law consist of those public facilities (the "Improvements ") described in Exhibit A to Resolution No. 14872 adopted by the City Council on December 3, 2013 (the "Resolution of Intention ") and, subject to completion of the proceedings with respect thereto, those additional public facilities (the "Additional Improvements ") described in Exhibit A to the Resolution entitled "City of Alameda Resolution of Consideration to Alter the Facilities to be Financed by, and to Increase the Bonded Indebtedness Limit of, Community Facilities District No. 13 -1 (Alameda Landing Public Improvements) (the "Resolution of Consideration "), which Resolution of Intention and Resolution of Consideration are, by this reference, incorporated herein. It is planned that the District and the territory now proposed to be annexed to the District will share equally the Improvements and the Additional Improvements. 5. Special taxes shall be levied in the territory proposed to be annexed to the District to pay for the Improvements and the Additional Improvements, the debt service on bonds issued for the District and for the other authorized purposes of the District pursuant to the Rate and Method of Apportionment of Special Tax as set forth in Exhibit B to the Resolution of Intention (the "Rate and Method of Apportionment"); provided, however, that in light of the increase in construction costs in the period following the formation of the District, the Assigned Special Tax Rates applicable to the territory proposed to be annexed to the District shall be as described in Exhibit A hereto which Exhibit A is, by this reference, incorporated herein. This Resolution makes no alteration to the Rate and Method of Apportionment, or of the maximum special taxes provided for therein, as the Rate and Method of Apportionment and such maximum special rates apply to the territory originally included in the District. 6. Tuesday, April 21, 2015, at 7:00 o'clock p.m., in the regular meeting place of this City Council, City Council Chambers, City Hall, 2263 Santa Clara Avenue, Alameda, California, are hereby appointed and fixed as the time and place when and where this City Council, as legislative body for the District, will conduct a public hearing on the proposed annexation of territory to the District and consider and finally determine whether the public interest, convenience and necessity require said annexation of territory to the District and the levy of said special tax therein. 7. The City Clerk is hereby directed to cause notice of said public hearing to be given by publication one time in a newspaper of general circulation in the area of the District and the area proposed to be annexed to the District. The publication of the notice shall be completed at least seven days before the date herein set for said hearing. The notice shall be substantially in the form attached hereto as Exhibit B. 8. This Resolution shall take effect upon its adoption. CITY OF ALAMEDA COMMUNITY FACILITIES DISTRICT NO. 13 -1 (ALAMEDA LANDING PUBLIC IMPROVEMENTS) ANNEXATION NO. 1 NOTICE OF PUBLIC HEARING Notice is hereby given by the City of Alameda (the "City ") with respect to its Community Facilities District No. 13 -1 (Alameda Landing Public Improvements) (the "District "), that on April 7, 2015, the City Council of the City, as the legislative body for the District, adopted a resolution entitled "City of Alameda Resolution of Intention to Annex Territory to the City of Alameda Community Facilities District No. 13 -1 (Alameda Landing Public Improvements) and to Authorize the Levy of Special Taxes Therein" (the "Resolution of Intention "). Reference is hereby made to the Resolution of Intention, which is on file with the City Clerk of the City for further particulars. The following is a summary of the provisions of the Resolution of Intention. Pursuant to the Resolution of Intention, the City Council determined that the public convenience and necessity require that certain territory, as more particularly described in the Resolution of Intention, be annexed to the existing District, as authorized by the City of Alameda Special Tax Financing Improvement Code, constituting Section 3 -70.1 of the Alameda Municipal Code (the "Law "). The Resolution of Intention provides that the special taxes heretofore authorized to be levied in the District shall be levied in the territory proposed to be annexed to the District, but the maximum special taxes authorized to be levied on the territory to be annexed be increased as described in Exhibit A to the Resolution of Intention, in any event subject to public hearing and landowner election proceedings as specified in the Law. Notice is further given that Tuesday, April 21, 2015, at the hour of 7:00 o'clock p.m., in the regular meeting place of the City Council, City Council Chambers, City Hall, 2263 Santa Clara Avenue, Alameda, California, are the time and place when and where the City Council of the City, as the legislative body for the District, will conduct a public hearing on the annexation of the territory described in the Resolution of Intention to the District and finally consider and determine whether the public convenience and necessity require the annexation of said territory to the District and the levy of special taxes on property therein. Notice is further given that at the hearing the testimony of all interested persons for and against the annexation of said territory to the District or the levying of special taxes within the territory proposed to be annexed will be heard.
