ACCEPTING CONVEYANCE FROM ALASKA PACKERS ASSOCIATION
OF EASEMENT IN CERTAIN REAL PROPERTY AND CONSENTING
TO THE RECORDATION THEREOF
V REAS, a certain indenture dated December 3, 1946, made by and between
Alaska Packors Association, a California corporation, as party of the first part,
and City of Alameda, a municipal corporation, as party of the second part, was,
on or about said date, executed and delivered by said party of the first part to
the City of Alaaeda; and
'WHEREAS, by said indenture, the grantor therein named granted to the
City of Alameda a permanent easement and right of way to at any time, or from time
to time, to construct, maintain, operate, replace, remove and renew underground
sanitary sewers and storm drains in, through, under and along those certain pieces
or strips of land in the City of Alameda, County of Alameda, State of California,
particularly described as follows, to-wit;
PARCEL 1.
An easement ten (10 feet in width lying five (5) feet on
each side of the following described center line.
Commencing at a point in the Westerly line of Hibbard Street
(formerly Perch Street) distant thereon fifteen (15) feet Northerly
from the Northerly line of Buena Vista Avenue (formerly Falcon Street)
as said streets are shown on the map entitled "Map of Town of Encinal and
the lands adjacent surveyed by Horace A. Higley" and filed August 7,
1854, in the office of the Recorder of Alameda County, State of Calif-
ornia, in Map Hood 6 at Page 8, and running thence Westerly parallel to
said line of Buena Vista Avenue 519.54 feet to the true point of
beginning of the easement center line herein described; running thence
Northerly in a line at right angles to said line of Buena Vista Avenue
325.5 feet to the end of said easement center line.
PARCEL 2.
An easement ten (10) feet in width lying five (5) feet on each
side of the following described center line.
Beginning at the point of intersection of the Northerly line of
Eagle Avenue (formerly Eagle Street) and the center of Hibbard Street
(formerly Perch Street) extended as said streets are shown on the p
entitled "Map of Town of Encinal and the Lands Adjacent Surveyed by
Horace A. Higley" and filed August 7, 1854, in the office of the Recorder
of Alameda County, State of California, in Map Book 6 at Page 8, and
running thence along the center line of Hibbard Street extended
Northerly 31.00 feet; thence Westerly and parallel to the Northerly
line of Eagle Avenue 281.00 feet; thence at right angles Northerly
10.00 feet to the end of said easement center line; and
WHEREAS, the City of Alameda did, on December 3, 1946, accept said
conveyance, and acquired possession of the said easement in the real property
above described;
NOW, THEREFORE, BE IT RESOLVED BY TEE COUNCIL OF THE CITY OF ALAMEDA
that the aforementioned indenture be, and the same is hereby, accepted on behalf
of the City of Alameda, and said. City Council, acting for and in behalf of said
City, hereby consents to the recordation of said indenture and orders this
Resolution to be attached thereto, as required by Section 1158 of the Civil Code
of the State of California.
I, the andersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 3rd day of December, 1946, by the following
vote, to wit:
AYES: Councilmen Howe, Osborn, Sweeney and President Branscheid, (4).
NOES: None.
ABSENT: Councilman Jones, (1).
