AUTHORIZING EXECUTION OF AGREEMENT WITH ALASKA PACKERS
ASSOCIATION, A CALIFORNIA CORPORATION, IN CONNECTION
WITH THE CONSTRUCTION OF SEWER MAINS, DRIVEWAY, CURB
AND GUTTER
WHEREAS, Alaska Packers Association, a California corporation, has
applied to the City of Alameda for permission to relocate and construct, or
cause to be relocated and constructed, certain sewer mains, a driveway, side-
walk, curb and gutter, pursuant to Specifications, Special Provisions and
Plans, dated November 15, 1946; and
WHEREAS, the City of Alameda is willing that said sewers be re-
located and constructed and said driveway, sidewalk, curb and gutter be
constructed; and
WHEREAS, said Alaska Packers Association has agreed to pay all of the
costs and expenses of said relocation and construction of said sewers, drive-
way, sidewalk, curb and gutter, and hold the City free and harmless from any
such costs and expenses; and
WHEREAS, the City of Alameda believes that it will be to the advantage
and benefit of the City to have said work performed; and.

REAS, a form of agreement containing the stipulations and
agreements to be stipulated and agreed upon by and between the City of Alameda
and said Alaska Packers Association, a California corporation, covering the
said work of relocating and constructing said sewers, driveway, sidewalk, curb
and gutter, has been prepared and submitted to this Council at its regular
meeting held December 3, 1946, and ordered filed with the City Clerk of the
said City;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA
as follows:
That the form of agreement referred to in the preamble hereof and
the terms, covenants, agreements and provisions thereof be, and the same are
hereby, approved.
That the said agreement be entered into, and that the Mayor of the
City of Alameda be, and he is hereby, authorized and directed to execute said
agreement on behalf of the City of Alameda, and the City Clerk is authorized
to attest the same.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the City of
Alameda in regular meeting assembled on the 3rd day of December, 1946, by the
following vote, to wit:
AYES: Councilmen Howe, Osborn, Sweeney and President
Bran cheid, (4)0
NOES: None.
ABSENT: Councilman Jones, (1).
