RESOLUTION NC. 3444
AUTHORIZING THE CITY ATTORNEY OF THE CITY OF ALAMEDA
TO FILE STIPULATION FOR FINAL JUDGMENT IN RE UNITED
STATES CF AMERICA VS. CERTAIN AREAS OF LAND IN THE
CITY OF ALAMEDA, ET AL.
WHEREAS, the City of Alameda has been served as a defendant in an action
to condemn certain lands in said City, which action is now pending in the District
Court of the United States, in and for the Northern District of California, Sou-
thern Division, entitled "United States of America, Plaintiff, vs. Certain Areas
of Land situate in the City of Alameda, County of Alameda, State of California,
The Regents of the University of California, et al., Defendants, No. 24109-R; and
WHEREAS, the Declaration of Taking in the said matter was filed on the
3d day of April, 1945, and decreed that the plaintiff have the right to the pos-
session of said land described in said Declaration of Taking;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF' THE CITY OF ALAMEDA
that Stanley D. Whitney, as City Attorney of the City of Alameda, be, and he is
hereby, authorized and directed to execute for and on behalf of the City of Ala-
meda, and with the plaintiff in said action, and to file in the above entitled
action, a stipulation or stipulations authorizing and petitioning the said court
to enter a final judgment in said action condemning said land described in the
complaint on file in said action, subject to the easements reserved to the City
of Alameda.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 17th day of December, 1946, by the following
vote, to wit:
