Resolution 0350938 RESOLUTION NO. 3509 DECLARING RESULT OF GENERAL MUNICIPAL ELECTION HELD IN THE CITY OF ALAMEDA ON LARCH 11 1947. WHEREAS, a general municipal election was held in the City of Alameda on Tuesday, March 11, 1947, under and pursuant to the provisions of Article XIX of the charter of said city, for the purpose of electing officers to fill the office of Councilman, for terms as follows: Two (2) Councilmen on the Council of said city for two (2) full terms, each commencing at 8 o'clock, p.m- on the third Tuesday in April, 1947, and continuing for four (4) years thereafter and until a successor is elected and qualified; and WHEREAS, NOMINATING PETITIONS ARE DULY AND REGULARLY PRESENTED TO, and filed in the office of, the City Clerk of the City of Alameda in the time, form and manner prescribed. by the charter of said city, nominating for said offices the following persons, to-wit: FOR THE OFFICE OF COUNCILAN Sherwood Jones S. Chesley Anderson; and WHEREAS, said nominations were entered in a list, with the offices to be filled, which list was certified to and filed in the time form and manner re- quired by said charter, whereupon an election, proclamation signed by the Mayor of the City of Alameda and attested by the City Clerk and containing a statement of the time of the election, the offices to be filled, the names of the candidates and the propositions to be voted on, as the same were by the Council of the City of Alameda ordered to be printed and appear on the ballot, was duly and regularly issued more than ten (10) days before said election and was published twice in the official newspaper of said city, the last publication thereof being more than five days before the date of said election; and WHEREAS, the Council of the City of Alameda, being the legislative body thereof, pursuant to the provisions of Article XI, Sec. 8, of the Constitution of the State of California, on its own motion and by Resolution No. 3468, duly adopted on January 21, 1947, ordered submitted, and there were submitted to the electors of said city at said general municipal election two A2) separate proposals for amending the charter of said City of Alameda, which proposals were set forth in said resolution and separately and consecutively numbered as Proposal No 1 and Proposal No. 2, and which proposals are fully set forth in said resolution. No. 34o8 and are hereby referred to and by this reference made a part hereof to all intents and purposes as though fully set forth herein; and WHEREAZ, each title and statement for the adoption of each of said pro- posed. charter amendments was printed on the ballot used at said general municipal election in form and contents as required by law; and WHEREAS, the City Council caused each and all of said proposed charter amen ents to be published and advertised in accordance with the provisions of Sec. 8 cf the Article XI of the Constitution of the State of California, on the 23rd day of January, 1947, in the Alameda Times-Star, a daily newspaper of general circulation, printed and published in the City of Alameda and the official news- paper of said city, and in each edition thereof during the day of said publica- tion; and WHEREAS, copies of said proposed. charter amendments were printed in con- venient pamphlet form and in type of not less than ten-point, and an advertisement that copies thereof could be had by application therefor at the office of the City Clerk of he City of Alameda. was published in said. Alameda Times-Star, a daily newspaper of general circulation, printed and published in said city, on the 23rd, day of January, 1947, and in each issue thereafter until and including the day fixed for said general.. municipal election, all as required by Sec. 8, Article XT, of the Constitution of the State of California, and copies of said pamphlet could be had at the office of said City Clerk during all of said times; and WHEREAS, a copy of said proposed charter amendments, printed in conveni- ent pamphlet form and in type of not less than ten-point, was mailed to each quali- fied elector of the City. of Alameda with the sample ballot; and WHEREAS, the Council of the City of Alameda, being, the legislative body of said city, on its own motion and without a petition therefor, by its Resolution No® 346, duly passed on January 7, 1947, ordered submitted, and there was submit- ted, to the electors cf said city at said general municipal election a proposition for the adoption. of an ordinance entitled: ORDINANCE NO New Series. AN ORDINANCE AMENDING. ORDINANCE NO 276, NEW SERIES, ENTITLED "AU ORDINANCE PROVIDING FOR Al RELIEF, HEALTH, LIFE INSURANCE AND PENSION FUND FOR MEMBERS OF THE FIRE AND POLICE DEPARTMENTS OF THE CITY OF ALAMEDA; ALSO FOR THE ADMINISTRATION OF SAID FUND", which ordinance is fully set forth in said Resolution No 3465 and hereby referred to and made a part hereof; and WHEREAS, the City Clerk. of the City of Alameda caused the afore- said proposed ordinance to be printed and a cony thereof, enclosed in an envelope with said sample ballot, to be mailed to each voter at least ten (10) days prior to said election; and WHEREAS, there were 126 election precincts within the City of Ala- meda fixed and established by resolution of the Council of said city and designated and numbered consecutively from 1 to 126, inclusive, as the elec- tion precincts for holding the aforesaid general municipal election, said, precincts being the same as were last designated, fixed and established by the Board of Supervisors of the County of Alameda, State of California, as the election precincts for holding general state and county elections within said City of Alameda; and WHEREAS, all of the ballots used for said election were prepared, as to form and contents, as prescribed by law, and a sample ballot was mailed to each voter o f t he City of Alameda within the time and in the manner provided by law and such mailing was completed at least ten (10) whole days preceding the date of said election; and WHEREAS, the officers of election for said election were duly ap- pointed and qualified, and all election supplies furnished and election booths provided for each precinct as provided by law; and. WHEREAS, the Council of the City of Alameda at this, its next regu- lar meeting following said election, has met and fully canvassed the returns of the votes cast at said general municipal election as required by law, and bell' fully advised in the premises, and having the returns of said canvass before it NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL 02 THE CITY OF ALAMEDA, AND said Council finds, as follows: (1) That said general municipal election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascer- tained, determined and declared, in all respects and particulars in the time, form and manner provided by law. (a) That the total number of votes cast in the City of Alarneda in favor of the adoption of said Proposal No. 1 was 2,789® (b) That the total number of votes cast in the City of Alameda against the adoption of said Proposal No. 1 was 1,731, (6) That the total number of votes cast in the City of Alameda at said election for and against said. Proposal No. 2 was 4,356. (a) That the total number of votes cast in the City of Alameda in favor of the adoption of said Proposal No. 2 was 2,106. (b) That the total number of votes cast in the City of Alameda against the adoption of said Proposal No. 2 was 2,250. (7) That the total number of votes cast in the City of Alameda at said election for and against said Proposal No. 3 was 4,508. (a) That the total number of votes cast in the City of Alameda in favor of the adoption of said Proposal No. 3 was 3,944. (b) That the total number of votes cast in the City of Alameda against the adoption of said. Proposal No. 3 was 564. 502 NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND DECLARED that the afore- said Sherwood Jones and S. Chesley Anderson having received, respectively, the highest and next to the highest number of votes cast for the office of Councilman, were, and are hereby declared to be, duly and regularly elected to the office of Councilman and as members of the Council of the City of Alameda, each for a term beginning at 8 o'clock p.m. on the third Tuesday in April, 1)47, and continuing for four (4) years and until a successor is elected and qualified. BE IT FURTHER RESOLVED, DETERMINED AND DECLARED that a majority of the qualified electors voting on said Proposal No. 1 voted in favor thereof and that said proposed amendment No 1 be, and the same is hereby, declared ratified and approved as and for an amendment to and as part of the Charter of said City of Alameda. BE IT FURTHER RESOLVED, DETERMINED AND DECLARED that a majority of the qualified electors voting on said. Proposal No. 2 voted against said proposed amendment and that said proposed amendment lq). 2 be, and the same is hereby, declared rejected. BE IT FURTHER RESOLVED, DETERMINED AND DECLARED that Proposal No. 3 for the adoption of the aforesaid Ordinance No. New Series, amending Ordinance No, 276 New Series, received a majority of the votes cast thereon at such election; that a majority of the qualified electors voting on said proposed ordinance voted in favor thereof and that said ordinance was, and is hereby declared, duly enacted and adopted and numbered Ordinance No. 912, New Series, and shall go into effect ten (10) days from this date. • * * * * • >1= * I, the undersigned, hereby certify that the foregoing Resolution was duly and resularly introduced and adopted by the Council of tho City of Alameda in regular meeting assembled on the 18th day of March 1947, by the following vote, to wit: AYES: Councilmen Howe, Jones, Osborn, Sweeney and.
