Resolution 0352517 RESOLUTION- NO 3525 AUTHORIZING INSTALLATION BY ALAMEDA BELT LINE OF TWO (2) RAILROAD SPUR TRACKS FEW THE CENTER LINE OF CLEMENT AVENUE TO THE NORTH LINE THEREOF, IMMEDIATELY' WEST OF WILLOW STREET. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMDA as follows; SECTION 1. That a remit be, and is hereby, granted to the Alameda Belt Line, a corporation, to construct, reconstruct, maintain and operate two (2) rail- road spur tracks from the center line of Clement Avenue to the north line thereof immediately west of Willow Street, in the City of Alameda, County of Alameda, State of California, the location of said spur tracks being particularly described as follows: TRACK "A" Commencing at the southern corner of Clement Avenue and Stanford Street; thence 30.0 feet northeasterly along the southeastern line of Stanford Street produced across Clement Avenue, to a point on the cen- ter line of existing Alameda Belt Line main track No. 1, said track being on the center line of Clement Avenue; thence 103.30 feet south- easterly along said track No. 1 to the actual point of beginning; thence along a curve to the left, having a radius of 235.65 feet, an arc distance of 119.29 feet, to a point on the northeastern line of Clement Avenue, said point being 298.36 feet southeasterly from the southeastern line of Stanford Street produced across Clement Avenue. kC '.1K "13" Commencing at the southern corner of Clement Avenue and Stanford Street; thence 30.0 feet northeasterly along the southeastern line of Stanford Street produced across Clement Avenue, to a point on the cen- ter line or existing Alameda Melt Lino main track No. 1, said track being on the center line of Clement Avenue; thence 315.80 feet south- easterly along said track No 1 to the actual point or beginning; thence along a curve to the left, having a radius or 235.65 feet, an arc distance of 119.29 feet, to a point on the n ortheactern line of Clement Avenue, said point being 430.86 feet; southeasterly from the southeastern line of Stanford Street produced across Clernent Avenue; the locations of said tracks being also shown in red on print of Alameda Melt Line Two ProPosed Spur Tracks for the Learner Co. at Alameda, California, dated April 3, 1947, N. R. Hart, Ens,ineer, No T-8-100, attached to and forming a part of said Alameda Belt Line's application dated April 25, 1947, on file in the office of the City Clerk of the City of Alameda and marked "Received Apr 30 1947, which said map is hereby referred to and made a part hereof. SECTION 2 and conditions: This permit is granted on and subject to the foliowtng terms (a) That said spur tracks shall be used for the transportation of freight only and shall not be used as a main line or part thereof. (b) That said spur tracks shall be constructed and maintained level with the street or streets along or across which said spur tracks are laid. (c) That all switchinc, movements over such spur tracks shall be so con- ducted as not to block longer than is necessary for ordinary switching operations the streets which are crossed by such spur tracks or to otherwise interfere with the use of the streets by the public. (d) That this permit shall he indeterminate and shall be revocable with- out compensation at any time at the option of the Council o13 the City of Alameda. (e) That said spur tracks shalt be operated under such regulations and conditions as may be proscribed from time to time by the City Council or NEc City of Alameda. (f) That notwithstandiac, anything in this permit to the contrary, per- mitee shall at all times maiatain said spur tracks and pavement immediately adja- cent thereto in good repair, at its own cost and expense. (g) That all construction, operation aryl maintenance work of said spur tracks shall be performed without cost or expense to the City of Alameda and that said permittee shall repave, repair and otherwise restore the portions of any street damaged or disturbed by the installation of such spur tracks, using the sane kind of material and construction as now exists in the portions of any such street adjacent to the portions of said street wherein said spur tracks shall be installed. 18 (h) That an revocation of this permit the permittee shall, at its own cost and expense, forthwith remove said spur trucks and repave, macadamize or otherwise restore the portions of the street damaged or disturbed by such removal, using the same kind of material and construction as shall be used by the City of Alameda upon the portion or the street adjacent to said spur tracks. (i) In the event that the perrnittee shall neglect or refuse to repave, repair or otherwise restore the portions of any street damaged or disturbed by the installation of said spur tracks as provided in paragraph (g) above, or in the event that permittee shall neglect or refuse to rerove such spur tracks or to repave and restore said street after the removal or said tracks as hcreinbefore provided in paragraph (h), then the City of Alameda may cause such repaving, re- pair or restoration to be made or such tracks to be re:loved or the work of repair- ing, macadamizing and otherwise restoring said street to be done, and permittee shall thereupon be obligated to pay to the City the amount of the reasonable ex- penses incurred by the City for any such purposes. (j) The construction by the permittee herein named of said spur tracks shall be deemed an acceptance by the permittee of all the terms and obligations set forth in this permit. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted, by the Council of the City. of Alameda in regular meeting assembled. on the 6th day of May, 1947, by the following vote, to wit: AYES: Councilmen Anderson, Osborn, Sweeney and.
