CANCELLING. COSTS, INTEHM=1„ PENALTIES AND PERSONAL

Ht1HES, certain real property situate in the City of Alameda, County of
Alameda, State of California, and more particularly described as follows
PARCEL ONE:
West 30 feet of Lot 11, Block A.
Damon s West End Tract;
PLH,GEL TWE:
East 20 feet of Lot 11, Block. A;
West 45 feet of Lot 10, Block A,
Dambns West End. Tract;
PARCEL THREE:
Tract of Tide Land bound. North by Highland of
Alameda, East by. Purcell, South. by. Mac:Nichol,
et al, and West by. American Trust Company,
has been assessed heretofore by the City of Alameda for the fiscal years 1944-45,
1945-45, and 1946-47, and the general municipal and special assessment taxes
levied thereon are uncollected and unaid; and
VVHEREAS, on August 31, 1944, pursuant to Vesting Order No. 3942, the
Alien Property. Custodian of the United. States of America took possession. of each
parcel Of said. real property- and possession. of each parcel of said. property did
vest in the United States of America by reason of the said Vesting Order; and
WHEREAS, since the assessment of said parcels of real property and the
non-payment of the taxes thereon, certain penalties and interest were added. to
the amount of taxes assessed against each parcel of the above described real
property; and

to said real property.; and
WHEREAS„ said personal property was erroneously added to the taxes
assessed against said Parcel One; and
WHEREAS, by reason of said. possession.. in tbe United States Government,
by
said property Is not subject to sale for delinquent taxes; and
WHEREAS, pursuant to Pu7o11 c Law 1371, 79th Congress, approved August 8,
-1945 tbo Allen Property Onstedlan .'7; Permitted to pav the 3ct iount of the
taxes only that accrued. after the date of vesting, and payment of renalties and
interest that accrued thereafter is barred by said Act;
NOW, THEREFCRE, BE IT RESOLVED AND ORDERED BY THE COUNCIL OF THE CITY OF
ALAMEDA, with the written approval of the City Attorney of said City, that oll 0
the interest, penalties and costs which have been added to the face amemnt of the
taxes assessed against each. of said parcels of said real property for the fiscal
years 1.944-45, 1945-45 arid 1946-47, and now a lien upon each of the above described
parcels of real property„ be , and the same are hereby. cancelled, and the Auditor
and Tax Collector of the City of Alameda are hereby ordered and. directed. to cancel
said interest, penalties and costs on their respective books, in connection with
each of the above described parcels of real property.
BE IT FURTHER RESOLVED tat the adding of an as in, the sum of
1,00. for personal prop(Trty against Parcel One was erroneously made and said per-
sonal property assessment against said Parcel One be, and, the same is hereby, can-
celled, and the Auditor and Tax Collector of the City of Alameda are hereby ordered
and directed to cancel said personal property tax against said. Parcel Inc on. their
respective books.
30 IT FURTHER RESOLVED, anything in this resolution. to the contrary not7
withstanding, the basic taxes upon the real estate and improvements of each of
said parcels of said ...real property. shall not be cancelled, but that said basix
taxes shall remain a charge against each of said parcels of real property.

withstanding, that this resolution and ordelEshall not be construed as cancelling .
or authorizing the cancellation of, any taxeS or assessments or penalties or costs
thereon charged or levied can any possessory interest In or to said real property,

The City Attorney of the City. of Alameda, State of California, hereby
consents to the cancellation of all uncollected City of Alameda interest, penal-
ties or costs and personal property taxes thereon charged and levied and now a
lien upon that certain. real property hercihabove described.
