AUTHORIZING PARTIAL PAYMENT TO ROBERTS ENTEETRTSES,
A CORTORATION, IN CONNECTION' WITH IMTROVEMENT OF
GARPTLD AATESKE ETC.
VPROTjEAS, on the 1360.. day of September, 1946, an a7reement was entered.
Into between. Roberts Enterprises, a corporation, the referred to as "Subdivider"
and City of Alameda, a municipal corporation, therein. referred. to as "CfLty", for
the performance of certain. work in connection with Liberty and Garfield. Avenues; and
WHEREAS, said. Subdivider has satisfactorily performed. all of the work:
provided. for 0 said. contract; and
WHEREAS, said contract provides that upon. the completion. of said work
referred to in paragraph. 2 thereof and acceptaece tin by,the City. Engineer of
said. City, the City a77,rees to pay the SNbdivider the is of ;14,000.00; payment of
said sum net to be due until thIrty -five (35 days after recordation o6 the nnt.Ice
of completion of said. work; and
WHEREAS, pursuant to Resolution No. 3490, passed February 4, 1947, a
progress paYment of '2,000.00 was made to said. Subdivider, leavin a balanpe of
.2,000.00 unpaid; and
WEIN.EAS, said. Subdivider has now applied. to the City to mo dify said con-
tract and to say the said balance of said contract price at this time; and
WHEREAS, the City Ens,ineer of the City has partially an said ap-
nlication an. d has recommended. payment of a further sum of .11,600.00 at this time;
and
WHEREAS, good cause for the modification of said. a7reement and the malsolr
of said further payment exists;
NOW, THEREFORE, BE TT RESOLVED BY THE CSUNCTL OF THE CITY OF ALAMEDA that
said contract shall be no and a further paymont shall be made to said Subdi-
. yider in the sum of ca,600.00 as recommended by said City Engineer; the balance due
under said.. contract to be paid. as provided in paragraph. 3 of said contract.
