Resolution 15153CITY OF ALAMEDA RESOLUTION NO. 15153 TERMINATING A PORTION OF AN EXISTING PUBLIC UTILITY EASEMENT WITHIN PARCEL MAP 10086 AND RECORDATION OF QUITCLAIM DEED WHEREAS, Catellus Alameda Retail, LLC granted a permanent non-exclusive easement to the City of Alameda for the purpose of installing and maintaining electrical infrastructure that was filed in the Office of County of Alameda Recorder on November 4, 2014; and WHEREAS, recent commercial development has resulted in the need to remove a portion of the public utility easement, where portions of that easement do not have or will not require electrical infrastructure and is considered excess easement; and WHEREAS, the aforesaid portion of the utility easement is no longer necessary for public access or infrastructure and can be vacated. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda does hereby approve and order that a portion of the Public Utility Easement within Parcel Map 10086 be terminated pursuant to the provision of Division 9, Part 3, Chapter 4, Article 1, Section 8333 (c) of the Streets and Highways Code and request recordation of the Quitclaim Deed. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular meeting assembled on the 7th day of June, 2016, by the following vote to wit: AYES: Councilmembers Daysog, Ezzy Ashcraft, Matarrese, Oddie and Mayor Spencer — 5.
