Resolution 12300CITY OF ALAMEDA RESOLUTION NO. 22300 ADOPTING A DRUG FREE WORKPLACE POLICY WHEREAS, it is essential that City employees be mentally and physically able to perform their duties safely and efficiently, in the interest of their fellow workers and the public; and WHEREAS, the presense of drugs and alcohol on the job, and the influence of these substances on employees during working hours, are inconsistent with this objective; and WHEREAS, it is the City's policy that City employees not be under the influence of alcohol or a controlled substance at City work location. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Alameda hereby adopt the City of Alameda Drug Free Work Place Policy, attached hereto as Exhibit A. BE IT FURTHER RESOLVED that as a condition of employment, City employees are expected to abide by the terms of this policy and to notify the City of any criminal drug statute conviction. BE IT FURTHER RESOLVED that violation of this policy is cause for disciplinary action, up to and including discharge. Felsch, City Clerk City of Alameda : UG FREE WO • PLACE POLIC This policy is intended to eliminate substance abuse and its effects in the work place. Our concern is that employees be mentally and physically able to perform their duties safely and efficiently, in the interest of their fellow workers and the public, as well as themselves. The presence of drugs and alcohol on the job, and the influence of these substances on employees during working hours, are inconsistent with this objective. Involvement with drugs and alcohol off the job can take its toll on job performance and employee safety. It is the City's policy to prohibit the unlawful manufacture, dispensing, possession or use of alcohol or a controlled substance at all work locations. It is also the City's policy that City employees not be under the influence of alcohol or a controlled substance at City work locations. Use of medically prescribed medications and drugs in accordance with physician's instructions is not per se a violation of this policy, as long as the medications or drugs do not interfere with the safe and effective performance of duties. Employees reasonably believed to be under the influence of alcohol or drugs shall be prevented from engaging in further work and may be detained for reasonable time until he or she can be safely transported from the work site. Refusal to submit immediately to the City of Alameda drug/alcohol testing procedure when requested by the City of Alameda's management or law enforcement personnel may constitute insubordination and may be grounds for discipline up to and including termination. The City of Alameda has established a voluntary Employee Assistance Program (EAP) to assist those employees who voluntarily seek help for alcohol or drug problems. Employees who think they may have an alcohol or drug usage problem are urged to voluntarily seek confidential assistance from the Employee Assistance Program Counselor. Employees should contact their supervisors or the EAP Counselor for additional information. As a condition of employment, City employees are expected to abide by the terms of this policy and to notify the City of any criminal drug statute conviction. Violation of this policy is cause for disciplinary action, up to and including discharge. "EXHIBIT A"
