Resolution 15216CITY OF ALAMEDA RESOLUTION NO. 15216 AMENDING THE GENERAL FUND AND THE CAPITAL IMPROVEMENT PROGRAM FUND BY $75,000 FOR LEGAL, PROFESSIONAL AND CONSULTANT SERVICES RELATED TO THE OAKLAND INNER HARBOR TIDAL CANAL PROJECT WHEREAS, the Oakland Inner Harbor Tidal Canal (`Tidal Canal ") is a 1.8 mile long, 400 feet wide portion of the waterway between Oakland and Alameda that was dredged in 1882; and WHEREAS, the Army Corp of Engineers ( "Army Corp ") desires to transfer ownership of the Tidal Canal to one or more public entities at no cost and has legislative authority to do so; and WHEREAS, the Army Corp has offered to convey half of the Tidal Canal to the City of Alameda; and WHEREAS, on June 2, 2015, the City Council did adopt a biennial budget representing the financial plan for conducting the affairs of the City of Alameda for the Fiscal Years beginning July 1, 2015 and ending June 30, 2017; and WHEREAS, the City Council, at the October 20, 2015 City Council meeting approved appropriating $350,000 from the General Fund excess reserves to move the Tidal Canal Project forward; and WHEREAS, the City Attorney's Office needs additional funds for legal, professional and consultant services related to the Tidal Canal Project; and WHEREAS, the Council has considered the report and recommendations of the City Manager on the budget amendments and has determined that the budget amendments are both fair and appropriate; and WHEREAS, the budget ensures that the City of Alameda has exercised prudent judgment in its fiduciary responsibility as guardian of the public tax dollars. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the amendments to the City's Fiscal Year 2016 -17 Budget are approved, by increasing the General Fund transfers out by $75,000 and increasing the Capital Improvement Fund transfers in and expenditures by $75,000 each to pay for the Tidal Canal Project. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular meeting assembled on 20th day of December, 2016 by the following vote to wit: AYES: Councilmembers Daysog, Ezzy Ashcraft, Matarrese, Oddie and Mayor Spencer — 5.
