Resolution 15323CITY OF ALAMEDA RESOLUTION NO. 15323 AUTHORIZING PRELIMINARY AND CONDITIONAL COMMITMENT OF $500,000 PUBLIC, EDUCATION, AND GOVERNMENTAL (PEG) FEE FUNDS FOR ONE-TO-ONE MATCH WITH ALAMEDA UNIFIED SCHOOL DISTRICT CAREER TECHNICAL EDUCATION (CTE) FACILITIES PROGRAM GRANT APPLICATION TO ESTABLISH COMMUNITY MEDIA CENTER (CMC) WHEREAS, on June 6, 2017, the City Council did adopt Operating and Capital Budget representing the financial plan for conducting the affairs of the City of Alameda for the Fiscal Year beginning July 1, 2017 and ending June 30, 2018; and WHEREAS, the City receives Public Education Government (PEG) Funds, which are accounted for in the Cable Franchise Equipment Replacement Fund; and WHEREAS, the Alameda Unified School District (AUSD) intends to apply for the State Community Technical Education facilities grant (CTE facilities grant), which requires certification by AUSD of a commitment of matching funds pursuant to 2 C.C.R. § 1859.194; and WHEREAS, the AUSD and the City have partnered to establish a Community Media Center (CMC) at Alameda High School's Industrial Arts Building for joint use by AUSD students or faculty and Alameda residents; and WHEREAS, accordingly, the City of Alameda intends to preliminarily and conditionally commit $500,000 of PEG fee funds for the purpose of assisting the AUSD in satisfying the matching requirement for the State Community Technical Education Facilities grant application for the Fourth CTE funding cycle, which requires a grant application be submitted by November 29, 2017. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ALAMEDA RESOLVES AS FOLLOWS: Section 1. The City shall preliminarily commit to using $500,000 in PEG fund fees to establish a CMC, subject to the following conditions: a. AUSD shall timely apply for and be awarded a CTE facilities grant for the Fourth CTE funding cycle; b. Within a reasonable time after AUSD is awarded a CTE grant facilities for the Fourth CTE funding cycle, they shall return before the City Council seeking approval for: An agreement with the City, after negotiating in good faith with the City Manager, containing various terms, including without limitation, oversight to ensure the City's PEG fund fees are spent in accordance with applicable law, joint use of the facility by AUSD students or faculty and members of the public, a provision for the reversion of unspent PEG fund fees to the City, enforcement provisions, and other provisions required by the City Manager; and A formal resolution to appropriate $500,000 of the City's PEG fund fees subject to the terms of the foregoing agreement. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular meeting assembled on the 21 st day of November 2017, by the following vote to wit: AYES: Councilmembers Ezzy Ashcraft, Matarrese, Oddie, Vella and Mayor Spencer — 5.
