GRANTING THREE WATER LINE EASEMENTS TO EAST BAY
MUNICIPAL UTILITY DISTRICT ACROSS CITY -OWNED REAL
PROPERTY WITHIN ALAMEDA POINT
WHEREAS, the City entered into a Disposition and Development Agreement
(DDA) with Alameda Point Partners, LLC on August 6, 2015 for the sale and lease of
approximately 68 acres of real property at the Site A development at Alameda Point; and
WHEREAS, the DDA includes obligations for Alameda Point Partners, LLC to
construct an Infrastructure Package which includes among other requirements a new
water main system servicing Site A and Alameda Point to be owned and operated by the
East Bay Municipal Utility District (EBMUD); and
WHEREAS, for the proper functioning of the water main system within Site A and
Alameda Point, the new water mains must connect with existing infrastructure located
outside of Phase 1 of Site A; and
WHEREAS, at three locations the water mains are located within City -owned real
property that is planned for, but has not yet been dedicated as public right-of-way; and
WHEREAS, EBMUD requires water line easements whenever a new water main
is constructed outside of a public right-of-way.
NOW, THEREFORE, BE IT RESOLVED that the City Council of City of Alameda
does hereby grant three water line easements to EBMUD for the installation of new water
main service across City -owned property within Alameda Point, authorize and direct the
Acting City Manager to execute and attest to, respectively, on behalf of the City of
Alameda, a grant of said easement and any and all ancillary documents, and direct the
recording of the grant of easements.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda in a regular meeting
assembled on the 24th day of July, 2018, by the following vote to wit:
AYES: Councilmembers Ezzy Ashcraft, Matarrese, Oddie, Vella and
Mayor Spencer — 5.
NOES: None.
ABSTENTIONS: None.
