Resolution 15471CITY OF ALAMEDA RESOLUTION NO. 15471 AMENDING FISCAL YEAR 2018-19 RENT STABILIZATION FUND BUDGET IN THE AMOUNT OF $166,000 FROM AVAILABLE FUND BALANCE (FISCAL YEAR 2017-2018) FOR ACQUISITION AND IMPLEMENTATION OF DATABASE SOFTWARE TO IMPLEMENT POLICIES, PROVIDE ACCURATE DATA, AND INCREASE ADMINISTRATIVE EFFICIENCY FOR THE CITY’S RENT REVIEW, RENT STABILIZATION AND LIMITATIONS ON EVICTIONS (ORDINANCE NO. 3148) AND AUTHORIZING THE INTERIM CITY MANAGER TO EXECUTE CERTAIN AMENDMENTS TO THE STAFFING SERVICES AGREEMENT WITH THE HOUSING AUTHORITY TO REFLECT THE SOFTWARE ACQUISITION AND FUNDING APPROPRIATION WHEREAS, on March 1, 2016, the Alameda City Council adopted a Rent Review, Rent Stabilization and Limitations on Evictions Ordinance (Ordinance No. 3148) to protect local tenants from the rapidly increasing cost of rental housing that is the result of rising rents and a tight rental market; and WHEREAS, Ordinance No. 3148 went into effect March 31, 2016; and WHEREAS, the City of Alameda and the Housing Authority for the City of Alameda (“Housing Authority”) have had a long-standing and mutually beneficial relationship, including providing community development and housing services in Alameda as well as the role of the Housing Authority in the broader Alameda community of promoting housing affordability and stability, and accordingly, have entered into a series of services agreements since 1984; and WHEREAS, in June 2017, the City Council awarded an agreement to the Housing Authority to administer the City’s Rent Program and implement Ordinance No. 3148, which included a provision to establish a searchable, online database to be used for various purposes; and WHEREAS, to provide Fiscal Year 2017-18 funding to implement Ordinance No. 3148 and its resulting policies, on June 6, 2017, the City Council adopted a resolution establishing the Rent Program Fee of $120 for each rental unit, based on a fee study; and WHEREAS, as part of a periodic evaluation of the amount of the Rent Program Fee, staff, through a consultant, conducted a fee study to determine for Fiscal Year (FY) 2018-19: (a) the reasonable cost of the services necessitated by the Ordinance/Policies, and (b) the requisite amount of the fee to be imposed on rental property owners to defray the costs of such services; and WHEREAS, the City Council, on June 6, 2018, resolved to impose a Rent Program Fee of $106 based on the Fee Study recommendation that half of the FY 2017-18 projected Rent Program fund balance of $332,000, or $166,000, shall be applied to the total cost of Rent Program administration for FY 2018-19, as a credit and the remaining 50% of the FY 2017-18 Rent Program fund balance shall be applied to cover any unanticipated expenses in FY 2018-19; and WHEREAS, staff is proposing that the $166,000 of available fund balance be appropriated for the Rent Program database software acquisition and related expenses; and WHEREAS, the Council has considered the report and recommendations of the Interim City Manager on the budget amendment and has determined that the budget amendment is both fair and appropriate; and WHEREAS, this budget ensures that the City of Alameda has exercised prudent judgement in its fiduciary responsibility as guardian of the public tax dollars. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the budget amendment to appropriate the 2017-18 Rent Program available fund balance in the amount of $166,000, is approved. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Alameda that the Interim City Manager is authorized to execute an amendment to the staffing services agreement with the Housing Authority to reflect the purchase of database software, cover related expenses, and the funding appropriation. ****** I, the undersigned, herby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular meeting assembled on the 2nd day of January, 2019, by the following vote to wit: AYES: Councilmembers Daysog, Knox White, Oddie, Vella and Mayor Ezzy Ashcraft -5.
