Resolution 03903RE SOLUTION NO. 3903 AUTHORIZING THE ACQUISITION 03' CERTAIN REAL I PROPERTY FOR PUBLIC STREET AND HIGMI'MY PURPOSES WHEREAS, public interest and necessity require that the real property hereinafter described be acquired by the City of Alameda for public street and highway purposes; and WHEREAS, F. B. McAtee and Ruth '14cAtee, his wife, are the owners of the real property hereinafter described and are willing to sell the same to the City of Alameda for the surm of $250.00; NOW THEREFORE, BE IT RESOLVED BY THE COMTCIL OF THE CITY OF ALAItY!EDA as follows: Section 1. That the City of Alameda purchase from F. B. McAtee and Ruth McAtee, his wife, for the sum of $250.00, that certain real property situated J in the City of Alameda, County of Alameda, State of California, more particularly described as follows: BEGIKNING at the intersection of the southern line of Lincoln Avenue with the western line of Fifth Street; and running thence along said line of Lincoln Avenue north 880 241 15" west 13 feet; thence southeasterly on a curve to the right with a radius of 13 feet to a point o� the western line of Fifth Street, distant thereon south 1 37' 0211 west 13 feet from the point of beginning; and thence north 10 37' 0211 east 13 feet to the point of beginning, upon the following teras and conditions, to -wit: (a) That good, merchantable title in fee simple in said real property be conveyed to the City of Alameda, free and clear of all objections, liens, encumbrances, clouds and claims of title; taxes to be prorated as of date of recording of deed. (b) That the title to said real property be evidenced by policy of title insurance issued by the Alameda County -East Bay Title Insurance Company, insuring title in the City of Alameda, as provided in the preceding subdivision (a); (c) That upon deposit with said title insurance company, for delivery to the City of Alameda, of a good and sufficient deed of grant conveying said real property to the City of Alameda, and conditioned upon the issuance of a title insurance policy, as aforesaid, to be approved by the City -Attorney, a warrant of the City of Alameda be drawn for $250.00, payable to the order of said Alameda County -East Bay Title Insurance Company, a corporation, and delivered to said title insurance company as escrow holder for the purpose of effecting the consum- mation of said purchase. Section 2. The sum of $270.00 is hereby appropriated from the Capital Outlays Fund of the City of Alameda to pay the purchase price of said real property and cost of title insurance policy. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 7th day of December, 1948, by the following vote, to wit: AYES: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5).
