ADD _,1IMH'j'1AY P1-FRPOSI",'S (CABRAL) 'sVIILIRJEAS, public interest and necessity require that the real property hereinafter described be acquired by the City of Alameda for public street and highway purposes; and WEiEAS, Clarence W. Cabral and Edwina L. Cabral, his wife, are the owners of the real property hereinafter described and are willing to sell the same to the City of Alameda for the sum of $410.00; hOh' THEREFORE) M IT RESOLVED BY '!--,-!E COUTCIL OF THE CITY OF ALAMEDA as follows: Section 1. That the City of Alameda nurchase from Clarence W. Cabral and Edwina 1. Cabral, his wife, for the sum of 14.10.00 that certain real property situated in the City of Alameda, County of Alameda, State of California, particularly described as follows: PORTIO! of the parcel of land described in the deed by William A. 3reakfield, and Dorothy Brookfield to Clarence W. Cabral and Edwina L. Cabral dated October 15, 1945, recorded October 24, 1945, in book 4794 of Official Records of Alameda County, at page 229, described as follows: BEGINNING AT A POINT on the eastern line of said parcel of land, distant thereon North 10 35' 45" East 134.06 feet from the northern Zine of Lincoln Avenue; and running thence North 640 58' 39" West 43.59 feet to a point on the western line of said parcel of land, distant thereon North 10 35' 45" East 151.39 feet from said line of Lincoln Avenue; thence along the western line of said parcel of land North 10 351 45" East 14.98 feet to the northern line thereof; thence along a curve to the right of radius of 2271.88 feet southeasterly 42.81 feet more or less to the eastern line thereof of said parcel of land; and thence along the last named line South 10 35' 45" West 16.44 feet to the point of beginning, open the following terms and conditions, to -wit: (a) That good, merchantable title in fee simple in said real property be convcyed to the City of Alameda, free and clear of all objections, liens, en- cumbrances, clouds and claims of title, but subject to second installment of taxes and assessments for the fiscal year 1948-1949; K That the title to said real property be evidenced by policy of title insurance issued by the Alameda County -East may, Title Insurance Company, insuring title in the City of Alameda, as provided in the preceding subdivision (a); (c) That upon deposit with said title insurance company for delivery to the City of Alameda of a good and sufficient deed of grant conveying said real property to the City, of Alameda, and conditioned upon the issuance of a title insurance policy, as aforesaid, to be approved by the City Attorney, a warrant of the City of Alameda be drawn for $425.00, payable to the order of said Alameda County -East Bay Title Insurance Company, and delivered to said title insurance company as escrow holder for the purpose of effecting the constLtnation of said purchase and to pay cost of title insurance policy. Section 2. The sum of $425.00 is hereby appropriated from Gas Tax #2 Fund of the City of Alameda to pay the purchase price of said real property and cost of title insurance policy.
