CKRTSTv, his wife, are the owners of the real property, hereinafter described and are willing to sell the same to the City of Alameda for the sum of $739-99; TMERIF,F09E) BE IT RESOLVED 3Y THE COUNCIL OV THE, C=7 OF as follows: Section 1. That the City of Alameda purchase from David B. Christy and Gene S. Christy, his wife, for the sum of $739.00, that certain real property situated in the City, of Alameda, Councy of Alameda, State of California, particu- larly described as follows: PORTION of the parcel of land deocribcd in the Ked by Joe Garese and Frank Garese to David 3. Christy and Gene S. Christy dated January 14, 1948, recorded January 22, i948, in Vol. 5210 of Official Records of Alameda County, at page 151, described as follows: BEGIINING at a point on the eastern line of said parcel of land, distant thereon South 10 251 West 121.36 feet from the southern live of Pacific Avenue; and running thence along said eastern line South 10 25' West 24.64 feet to the northeastern line of the parcel of land. secondly described in the deed by Southern Pacific Company to Central Pacific Company, dated December 28, 1926, recorded February 25, 1927, in book 1566 of Official Records of Alameda County, at page 29; tnence along the last narned line northwesterly on a curve to the left with to radius of 2311.88 feet, a distance of 53.70 feet, more or less, to the western line of said first above mentioned parcel of land; thence along the last named line horth 10 25' East 26.49 feet to a point distant thereon South 10 251 West 99.51 feet from said line of ?acific Avenue; and thence in a direct line South 640 581 39" East 54.57 feet to the point of beginning, upon the following terms and conditions, to wit: (a) That good, merchantable title in fee simple in said real property be conveyed to the City of Alameda, free and clear of all objections, liens, en- cumbrances, clouds and claims of title, out subject to second installment of taxes and assessments for the fiscal year 1948-1949; (b) That the title to said real property be evidenced by policy of title insurance issued by the Alameda County -East Bay Title insurance Company, insuring title in the City of Alameda, as provided in the preceding subdivision (a); (c) That upon deposit with said title insurance campany for delivery to the City of Alameda of a good and sufficient deed of grant conveying said real property to the City, of Alameda, and conditioned upon the issuance of a title insurance policy, as aforesaid, to be approved by the City Attorney, a warrant of the City of Alameda be drawn for $760.00, payable to the order of said Alameda County -East Bay Title insurance Company, and delivered to said title insurance company as escrow holder for the purpose of effecting the cunsumniation of said purchase and to pay cost of title insurance policy. Section 2. The sum of $760.00 is hereby appropriated from Gas Tax #2 Fund of the City of Alameda to pay the purchase price of said real property and cost of title insurance policy. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 18th day of January, 1949, by the following vote, to wit: AYES: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5).
