Marie McCloud, for the sur l of $530.00, that certain real property situated in the City of Alameda, County of Alameda, State of California, particularly described as follows: PORTION of the parcel of land described in the Decree of Distribution. in the estate of Louis Torre, deceased, to larie McCloud, dated May 6, 1946, recorded August 12, 1946, in book 4933 of Official Records of Alameda County at page 316, described as follows: BEGIERV5 at a point on the western line of said parcel of land, distant thereon south 10 25' west 121.36 foot from the southern line of Pacific Avenue; and running thence along said western line of said parcel of land south 10 25' west 24.64 feet to a point on a curve to the right of radius 2311.88 feet; thence along the last mentioned curve southeasterly 7.29 feet to the southern line of the named parcel; thence along the named line south 880 24' 15" east 31.50 feet to the eastern line Of said Purcel of land; thence along the last named line north 10 251 east 10.58 feet to a point distant thereon south 10 25, C west 138.11 feet from said line of Pacific Avenue; and thence north 64 58' 39" west in a direct line 41.83 feet to the point of beginning, upon the following terms and conditions, to -wit: (a) That good, merchantable title in fee simple in said real property be coLveyed to the CLty of Alameda, free and clear of all objections, liens, en- cumbrances, clouds and claims of title, cut subject to secjnd installment of taxes and assessments for the fiscal year 194.-1949; (b) That the title to said real property be evidenced by policy of titie insu2ance issaed by the Alameda County -East 3ay Title Insurance Cumpany, insuring title in the City of Alameda, as provided in the precedinS subdivision (a); (c) That upon deposit with said title insurance company for delivery to the City of Alameda of a good and sufficient deed of grant conveyinZ said real property to the City of Alameda, and a conditioned upon the issunce of a title insurance policy, as aforesaid, tock approved by the City Attorney, a warrant of the City of Alameda be drawn for 1551.00, payable to the order of said Alameda County -East Bay Title Insurance Company, and delivered to said title insurance company as escrow holder for the purpose of effecting the con- summation of said purchase and to pay cost of title insurance policy. Section 2.
