Resolution 04731111,'r'30I,UTION NO. 4731 ORDERING TEE VACATIOU OF A PORTION OF CLAY STREET IN TFE CITY OF ALKEDk WEE REAS, the Council of the City of Alameda did, on the 20th day of January, 1953, pass its Resolution of Intention No. 4710, declaring its intention to order the vacation, closing and abandonment of that certain portion of Clay Street, in the City of Alameda, County of Alameda, State of California, more particularly described in said Resolution of Intention as follows: FROM the northeastern corner of Clay Street and Post Street, as shown on the Yap of Town of Alameda and Adjacent Lands (H. A. Higley Survey), which shall be Imoiin as the POINT OF BEGINNING; THENCE along the northern line of Clay Street 215.42 feet to a point in the State Bay Farm Island Bridge right-of-way line; THENCE along said right-of-way line N 87* 261 35o w 88.14 feet to the south line of Clay Street; ITEANCE along the south line of Clay Street westerly 150.85 feet to the east line of Post Street; THENCE along said east line of Post Street northerly 60 feet to the POINT OF BEGINNING: M LUEREAS, the portion of said street to be vacated and abandoned and the details of said vacation are more particularly shown upon that certain map known as Drawing 3898, Case 51, bearing the legend: "Ownerships Vicinity of Clay and Post Streets", which map was by said Resolution of Intention approved for the purpose of this proceeding and was ordered filed in the office of the City Clerk of the City of Alameda and marked "Filed January 20, 1953", and which map was in said resolution referred to for further parti- culars as to the proposed vacation; and WREREAS, the City Clerk of the City of Alameda caused said Resolution of Intention to be published in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times -Star, a daily newspaper of general circulation published and circulated in said city and the official newspaper thereof; and 71111-71','REAS, proof of said publication is evidenced by an affidavit of publica- tion now on file in the office of the City Clerk of said city; and 'ZIEREAS, proof of said posting Of such notices is evidenced by the affidavit of the person posting said notices, which affidavit sets forth the facts regarding such posting and is now on file in the office of the City Clerk of said City; and TUEREAS2 the matter of said proposed vacation came on regularly for hearing before the Council of the City of Alameda at this, its regular meeting, on the 17th day of February, 1953, and at the time and place fixed in said Resolution of Intention, and at such hearing the said Council heard the evidence offered by all persons interested in said street vacation, and a full hearing thereon having been had and the matter submitted for determination; NOW FERE ORS I BE IT RESOLVED BY COITNICIL, OF U. -TE CITY OF AIAWA that said, Council hereby finds and determines, from all the evidence submitted, that the street and part thereof in said Resolution of Intention and Kereinbefore more particu- larly described, is unnecessary for present and prospective public street purposes and that public interest requires the vacation of said portion of said street.
