Resolution 04751EWOLUTION XO. 4751 DECLARING RESTIT OF CGIZENEPdiL 10ITNICIPAL ELI-,_',CTIG!\T WEREAS, a General Municipal Election was held in the City of Alameda on Tuesday, Yarch 10, 1953, under and pursuant to the prow ikons of Article XIX of the Charter of said City, for the purpose of electing officers to fill the Wfice of Councilman, Auditor and Treasurer - and for the further purpose of submitting to the qualified electors of said City the questions of amending the Charter of the City of Alameda and also amending Ordinance No, 1079, New Series, known as the Police and Fire Pension Ordinance, as set forth hereinafter: Three (3) Councilmen on the Council of said City for three (3) full terms, each term commencing at 8:00 o1clock P. M. on the third Tuesday in April, 1953, and continuing for four (4) years thereafter, and until a successor is elected and qualified. One (1) Auditor of said City for a four (4) year term commencing at 8:00 otclock P. M. on the third Tuesday in April, 1953, and contin- uing for four (4) years thereafter, and until a successor is elected and qualified. One (1) Treasurer of said City for a four (4) year term cammens - ing at 8:00 o'clock P. M. on the 0drd Tuesday in April, 1953, and continuing for four (4) years thereafter, and until a successor is elected and qualified. Proposition No. 1 Shall subdivision (a) of Section 12-2 of the Charter of the City of Alameda be amended to provide that the Public Utilities Board shall. have the power to contract for the purchase, for not to exceed ten, years, of gas, electrical energy or such other public utility service or commodity necessary for its operations, rather than for tLe five- year period now permitted? Proposition No. 2 Shall Ordinance No. 1079 New Series, known as the Police and Fire Pension Ordinance, be amended to provide that warrants drawn against the Pension Fund shall not require the signatures of two members of the Pension Board, by amending subdivision 9 of Section 4 of said, Ordinance Ito. 1079 New Series? Proposition No. 3 Shall Ordinance No, 1079 New Series, known as the Folice and Fire Pension Ordinance, be amended to provide that each unmarried, motherless child of a deceased pensioner shall receive twenty per cent (200 of the salary of the rank held by the pensioner at the time of his retirement, until they shall attain the age of eighteen (1 8) years, provided the aggregate amount paid such child or children shall in no event exceed the amount of the pension; that if there be no such child or children, then one-third (1/3) of the salary of the rank held by the deceased pensioner at the time of his retirement shall be paid to his dependent father and/or mother during the lifetime of such depend- ent person or persons, by amending Sections 11 and 13 of said Ordinance No. 1079 New Series? WHEREAS, nominating petitions were duly and regularly presented to, and filed in the office of, the City Clerk of the City cat' ,kiameda, in the time, form and manner prescribed by the Charter of said City, not for said offices the following persons, to -wit: FOR TEE OFFICE OF COU'NCILT,,,,UyN: Frank P. Dallas WEREAS, said nominations were entered in a list, with the offices to be filled, which list was certified to and filed in the time, form and manner required by said Charter, whereupon an election proclamation signed by the Mayor of the City of Alameda and attested by the City Clerk and containing a statement of the time of the election, the offices to be filled, the names of the candidates and the measures to be voted on, as the same were, by the Council of the City of Alameda, ordered to be printed and appear on the ballot, was duly and regularly issued more than ten (10) days before said election and w4s published twice in the official newspaper of said City, the last publication thereof being more than five (5) days before the date of said election; and. WBEREAS, there were 128 election precincts within the City of Alameaa fixed and established by resolution of the Council of said City and designated and numbered consecutively fron-To. 1 to No. 128, inclusive - as the election pre- cincts for holding the aforesaid. Genu-7al_Municipal Election of the City of Alameda; and AVEREAS, all of the ballots used for said election were prepared, as to form and contents, as prescribed by law, and a sample ballot was mailed to each. voter of the City of Alameda within the time and in the manner provided by law and such mailing was completed at least 10 whole days preceding the date of said elec- tion; and WEEREAS, the officers of election for said election were duly appointed and qualified, and all election supplies furnished and election booths provided for each precinct as provided by law; and WEEREAS, the Council of the City of Alameda at this, its next regular meeting following said election, has met and fully canvassed the returns of the votes cast at said Genepal Municipal Election as required by law, and being fully advised in the premises, and having the returns of said canvass before it; NOW, THEWFORE, BE IT HEREBY RESOLVED, DETERMINED ANDDECLARED BY THni COUNCIL OF' THE CITY' OF ALAREDA and said Council finds, as follows: (1) That said General Municipal Election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascertained, determined and declared, in all respects and particulars in the time, form and manner provided by law. Tost and Homer R.
